LUSABE, Ottawa, Canada 2017 ABSTRACT This thesis analyses participative structures in selected particular Churches in the AMECEA1 region and proposes some concrete means through which active participation of the Christian faithful may be fostered in the participative structures of these Churches. Structures of participation are means whereby a communio ecclesiology finds expression. The 1983 Code provides for a greater number of participative structures in a particular Church in order to reflect communio. This study focuses on five of these participative structures: the diocesan synod, the diocesan finance council, the presbyteral council, the college of consultors, and the diocesan pastoral council, treating their nature, purpose, composition, functions, and cessation. Pope Francis emphasizes the principle of synodality, a constitutive element of the Church, as offering the most appropriate interpretative framework for understanding the Church. For synodality to be a reality, there is an urgent need for the renewal of participative structures.     CANON 294 ECCLESIASTICAL CIRCUMSCRIPTIONS AND THEIR RELATIONSHIP WITH THE DIOCESAN BISHOP What is the relationship of the faithful in personal ecclesiastical circumscriptions to the local diocesan bishop? OPINION The Apostolic See, in the Annual General Statistical Questionnaire, asks diocesan bishops the number of priests in the ecclesiastical circumscription of the diocese, their country of origin and whether they are diocesan or religious. The fact that the diocesan bishop is answering these questions indicates the close relationship between himself and any personal Ecclesiastical Circumscription. Canons 215 and 216 of the 1917 Code required that ecclesiastical circumscriptions be territorial within a diocese and an apostolic indult was needed, for example, to establish personal parishes for an ethnic group of the faithful. After World War II, Pope Pius XII provided for the pastoral care of refugees and migrants in his apostolic constitution Exsul Familia in 1952. Chaplains for migrants were granted special faculties to facilitate pastoral care without receiving the power of jurisdiction or governance. The Second Vatican Council admitted personal criteria in ecclesiastical organisation. The decree Christus Dominus 11 held that the essential element of a particular Church is personal, being a “portion of the people of God”. Personal factors are crucial to determine the communitarian aspect of the makeup of a community. After Vatican II, the Code of Canon Law needed revision. The Synod of Bishops in 1967 approved the principles to guide the revision of the code.     302 THEOLOGICAL TRENDS Canon Law and Ecclesiology II The Ecclesiological Implications of the 1983 Code of Canon Law Introduction N A PREVIOUS article, published in The Way, January 1982, I gave an I outline of the highly centralized and clerical view of the Church that was common in the nineteenth and early twentieth centuries. This was the view of the Church that was expounded in most seminary text-books on the subject. It was this notion of the Church, too, that was reflected in the 1917 Code of Canon Law, and I indicated a number of examples of this centralized approach from the 1917 Code: local customs as such were considered undesirable (C.5); bishops were forbidden to grant dispensations from the general law of the Church, unless the faculty to do so had been expressly granted them by the Pope, or the case was particularly urgent. I also indicated that this same theological outlook was evident in the whole structure and content of Book II of the 1917 Code. I went on then to show how the second Vatican Council put forward a doctrine of the Church which puts greater emphasis on the importance of the local Church. The universal Church is now seen not primarily as a society of individuals, but as abody with different organs, each having its own proper characteristics, a communion of churches, together making up the Catholic Church. In this second article, I shall consider how this conciliar teaching has influenced the structure and contents of the new Code of Canon Law, promulgated by Pope John Paul II on 25 January of this year, 1983.

Your Grace! First of all, I assure you of my devotion and humility. I declare that I consider and have always considered myself a member of the U[krainian] A[utocephalous] O[rthodox] C[hurch] in spite of the fact that I formally belonged to a different hierarchy, for it is well known that the Ukrainian Church, Orthodox as well as Catholic, is outlawed in Ukraine. Such are the barbaric ethics of the Bolsheviks. 1 The appeal was a remarkable testimony that almost fifty years after the destruction of the Ukrainian Orthodox Autocephalous Church formed in the 1920s and over thirty years after the eradication of the Church restored during the Second World War, loyalty to Ukrainian Orthodoxy still remains alive among Ukraine's believers. It also demonstrates how shared persecution has brought new ecumenical understanding between U,laainian Orthodox and Ukrainian Catholics. 'To discuss the position of Ukrainian Orthodoxy in the Soviet Union is a difficult task, for since the destruction of tens of its bishops, thousands of its priests, and tens of thousands of its lay activists in the early 1930s (and once again after the Second World War), and its forcible incorporation into the Russian Orthodox Church, it exists more as a loyalty and an Ull­ realised dream than as an active movement.

From January 8th through February 25th, 2014, the Extraordinary General Chapter of the Legion of Christ took place in Rome. His Eminence, Cardinal Velasio De Paolis, CS, and his two counselors, Fr. Gianfranco Ghirlanda, SJ, and Fr. Agostino Montan, CSI, presided. Sixty- one chapter fathers participated, 19 ex officio and 42 elected by the nine territories of the congregation and the centers of Rome. 2. This Extraordinary General Chapter marks the end of the journey of in-depth revision that the congregation has travelled since the apostolic visitation, which took place during 2009- 2010, and the naming of a Pontifical Delegate in the summer of 2010. Our principal tasks in the Chapter, as Pope Benedict XVI1 indicated and as Pope Francis confirmed2, were to revise the Constitutions and to elect a new central government for the congregation. 3. In the first days, in light of the reports that the Pontifical Delegate and the pro-General Director submitted, we focused on analyzing the life of the Congregation since the ordinary General Chapter that took place in 2005. One of the outcomes of the intense exchange of ideas that took place in those days was the communiqué that the Chapter approved on January 20th, 2014, about the journey of renewal of the Congregation. This Church, unlike the Roman Catholic Church in the period 1950 - 1968 did not even exist legally. It was due to power interference of the communist state power in 1950. The plan of Commu- nist Party assumed the "transformation" of Greek Catholic Church into the Orthodox one. Procedure of liquidation of the Greek Catholic Church later came to be known as Action "P". Its climax came in April 28th 1950, when “sobor of Presov”, being prepared for a longer time, took place. The gath- ering in “sobor” manipulated by the communists declared in “sobor” the abolition of the Union with the Vatican, as a result the Greek Catholic Church ceased exist in Czechoslovakia and the clergy and faithful were meant to became the members of the Orthodox Church.1 In fact only a small part of the Greek Catholic clergy succumbed to power pressure and accepted Orthodoxy. Church leaders, as well as many priests who refused to change to the Orthodox have been arrested and sentenced to many years of punishment. The other Greek-Catholic clergy and their families were deported to the Czech lands and were forbidden to perform a duty of priestly ministry and banned from staying in eastern Slovakia for several years.
