The ballot listed specific projects with VTA as the implementing authority. The VTA Board of Directors is responsible for the implementation of the Measure A Program and for all policy-related decisions including the composition, implementation schedule and funding level of projects. The ballot designated the Citizens Watchdog Committee (CWC) as the independent oversight body for Measure A tax dollar expenditures. Tax collection began in mid-2006, making Fiscal Year 2019 the 13th year of the 30-year program, and will continue through March 31, 2036. FY2019 CITIZENS WATCHDOG COMMITTEE FINDING In approving Measure A, Santa Clara County voters entrusted the CWC, comprised of fellow community members, with overseeing Measure A expenditures to ensure sales tax dollars are spent as intended by the ballot. VTA is committed to doing its part in helping support the economic growth of the region and the quality of life of the communities it serves. This commitment can be seen in VTA’s successful implementation of Measure A. While most of the projects defined in the ballot are very complex and require years of planning, design, and construction, significant progress can be observed in FY 2019. The accomplishments are summarized in the project section of the report. VTA's BART Silicon Valley Extension VTA’s BART Silicon Valley Extension Program (BSV), the largest transportation infrastructure investment in Santa Clara County history, will extend the existing San Francisco Bay Area Rapid Transit District (BART) system into the county. It will bring frequent and reliable regional rail service ringing the entire San Francisco Bay. The Program is being delivered in two phases. The first phase is the 10-mile Berryessa Extension (SVBX), a project that connects BART from South Fremont/Warm Springs Station to Milpitas and on to Berryessa in Northeast San José. During FY 2019, SVBX tracks were turned over to BART for pre-revenue operations and testing. Work progressed on the Operations and Maintenance Agreement, which is needed prior to opening the project for public use. VTA, BART and contractor teams were working hand-in-hand to conduct all the necessary safety and punch-list items to get the project to the finish line. The BART Silicon Valley Phase II Project (Phase II Project) is 6-miles, includes four-stations and extends through downtown San José to the City of Santa Clara. Significant progress occurred during FY 2019 including advancing engineering and analysis work to evaluate the tunnel configuration, assess risks and determine funding plan. iii FY 2019 KEY ACHIEVEMENTS Eastridge to BART Regional Connector- Capitol Expressway Light Rail Project The VTA Board of Directors certified the Final Second Supplemental Environmental Impact Report and approved the proposed changes to the Eastridge to BART Regional Connector project in June 2019. These changes include the continuous elevated guideway to minimize community impacts and maximize transit operations. Design, right-of-way activities and acquisitions are progressing. An overarching Community Outreach and Public Engagement Plan is currently being developed. VTA continues to meet with residents in the project area. iv Citizens Watchdog Committee Activities The CWC appreciates the importance of the role entrusted to us by Santa Clara County voters to provide oversight for the tax collected under 2000 Measure A and for keeping county residents informed. To that end, the CWC engaged in the following activities: Program Monitoring The CWC periodically reviewed updates to the 2000 Measure A Transit Improvement Program including project status and costs. Independent Compliance Audit The CWC commissioned Macias Gini & O’Connell LLP, an independent certified public accountant firm, to conduct an audit. The CWC reviewed the compliance audit plan and schedule prior to the audit of the Measure A Program financial records. Compliance Audit Review & Publication The CWC reviewed the compliance audit for FY 2019 and published the results of the independent audit of the FY2019 2000 Measure A financial schedules and records. Conducted Public Hearing On August 14, 2020 the CWC conducted a public hearing to receive input from the public on the Measure A Program, its expenditures, the results of the CWC’s annual independent compliance audit, and on Measure A Program reports for FY 2019. The financial activity of the 2000 Measure A Program is included in the accompanying Budgetary Comparison Schedule and related notes. Management is responsible for VTA’s compliance with those requirements. Our responsibility is to express an opinion on VTA’s compliance based on our examination. Our examination was conducted in accordance with attestation standards established by the American Institute of Certified Public Accountants. Those standards require that we plan and perform the examination to obtain reasonable assurance about whether VTA complied, in all material respects, with the requirements of the 2000 Measure A Program. An examination involves performing procedures to obtain evidence about VTA’s compliance with the requirements of the 2000 Measure A Program. The nature, timing, and extent of the procedures selected depend on our judgment, including an assessment of the risks of material noncompliance with the requirements of the 2000 Measure A Program, whether due to fraud or error. We believe that the evidence we obtained is sufficient and appropriate to provide a reasonable basis for our opinion. Our examination does not provide a legal determination of VTA’s compliance with specified requirements. In our opinion, VTA complied, in all material respects, with the aforementioned requirements of the 2000 Measure A Program for the fiscal year ended June 30, 2019. Per the Federal Transit Administration (FTA) Title VI Circular (Circular) 4702.1B, Title VI Requirements and Guidelines for Federal Transit Administration Recipients (October 1, 2012), the District is required to conduct a Title VI Service and Fare Equity Analysis (Title VI Equity Analysis) for the Project's proposed service and fare plan six months prior to revenue service. Accordingly, staff completed an updated Title VI Equity Analysis for the Project’s service and fare plan, which evaluates whether the Project’s proposed service and fare will have a disparate impact on minority populations or a disproportionate burden on low-income populations based on the District’s Disparate Impact and Disproportionate Burden Policy (DI/DB Policy) adopted by the Board on July 11, 2013 and FTA approved Title VI service and fare methodologies. In the opinion of Orrick, Herrington & Sutcliffe LLP, Bond Counsel to the District, based upon an analysis of existing laws, regulations, rulings and court decisions, and assuming, among other matters, the accuracy of certain representations and compliance with certain covenants, interest on the 2020C-1 Bonds is excluded from gross income for federal income tax purposes under Section 103 of the Internal Revenue Code of 1986. In the further opinion of Bond Counsel, interest on the 2020C-1 Bonds is not a specific preference item for purposes of the federal alternative minimum tax. Bond Counsel is also of the opinion that interest on the 2020 Bonds is exempt from State of California personal income taxes. Bond Counsel further observes that interest on the 2020C-2 Bonds is not excluded from gross income for federal income tax purposes under Section 103 of the Code.
