It must remain there until the intervention deadline for this proceeding. 3 1. Across Canada Application 2012-0170-7 Application by MOTV Média Inc. for a broadcasting licence to operate a national French-language specialty Category B service to be known as MOTV. The service’s programming would be devoted to personal development in the sense of leadership, motivation and self-transcendence. The service would focus on the interests and needs of a wide audience composed of men and women of all ages. The applicant proposes to offer programming from the following program categories set out in item 6 of Schedule I to the Specialty Services Regulations, 1990, as amended from time to time: 2(a), 2(b), 4, 5(a), 5(b), 7(a),7(b), 7(c), 7(d), 7(e), 7(f), 7(g), 9, 10, 11(a), 11(b), 12, 13 and 14. The applicant also confirmed that it would adhere to the standard conditions of licence and expectations set out in Standard conditions of licence, expectations and encouragements for Category B pay and specialty services – Corrected Appendices 1 and 2, Broadcasting Regulatory Policy CRTC 2010-786-1, 18 July 2011. The applicant stated that it would also accept the following conditions of licence: The licensee shall devote no more than 10% of all programming broadcast during the broadcast month to programs drawn from category 2(b). The licensee shall devote no more than 10% of all programming broadcast during the broadcast month to programs drawn from category 4. The licensee shall devote no more than 20% of all programming broadcast during the broadcast month to programs drawn from categories 7(d) and 7(e). The applicant stated that the exception to the standard limit of 10% of the broadcast month for categories 7(d) and 7(e) would allow for greater flexibility to broadcast motivating and inspiring feature films devoted to biographies and life experiences. The service’s programming would be devoted to entertainment news and the entertainment industry. The applicant proposes to offer programming from the following program categories set out in item 6 of Schedule I to the Specialty Services Regulations, 1990, as amended from time to time: 1, 2(a), 2(b), 3, 4, 5(a), 5(b), 6(a), 6(b), 7(a), 7(b), 7(c), 7(d), 7(e), 7(f), 7(g), 8(a), 8(b), 8(c), 9, 10, 11(a), 11(b), 12, 13 and 14. In addition, the applicant proposes the following conditions of licence: No more than 10% of all programming broadcast during the broadcast month shall be drawn from each of program categories 2(b), 6(a), 7, 7(d) and 7(e). No more than 10% of all programming broadcast during the broadcast month shall be drawn from program categories 8(b) and 8(c) combined. (3924181) for authority to acquire from 8135274 Canada Inc., as part of a corporate reorganization, the assets of the national, English-language specialty Category B undertaking known as ABC Spark (formerly known as Harmony). 3924181 is also requesting a new broadcasting licence to continue the operation of the undertaking under the same terms and conditions as those in effect under the current licence. 3924181 is owned by Corus Entertainment Inc. (51%) and Shaw Media Inc. (49%) and controlled by Corus Entertainment Inc. Following completion of the transaction, 3924181 will become the licensee of ABC Spark. 6 The transaction will not affect the effective control of the undertaking, which will continue to be exercised by Corus Entertainment Inc. The station would operate on frequency 103.9 MHz (channel 280LP) with an average effective radiated power of 5 watts (maximum effective radiated power of 5 watts with an effective height of antenna above average terrain of -5 metres).
