First, one part of the female (or male) body is uncovered and found erotic; and then another part is dis- covered, creating what has been referred to as "shifting erogenous zones." 9 Living for the moment's prevailing passion' ° and for hedonistic plea- sure--considered the sole object of desire-" threatens to be overwhelming for many.' 2 Packaging sex, in all its various products, is big business. In New York City, for example, the marketing of sex as an industry is a signifi- cant part of the City's economy and a lucrative tourist attraction as well.' 3 Not only does it generate business dollars and tax revenues, it employs a 5 large number of people. " Sadly, one person's vulgarity is another's lyric. ' Western society has, over the years, sought to develop various standards to suppress the viewing and commercial dissemination of explicit materi- als.' 6 The dilemma, however, remains. As much as dilemmas cry for reso- lution, being what they are, they resist it. '" This is especially the case here as the quest for a "decent society" is forever balanced against the right of free expression with the first amendment,' 8 always being viewed as proscribing common sense' 9 by those who seek its protection. In 1986, Maine became the first state in the Nation to conduct a referen- dum on whether pornography should be restricted. More specifically, the question on the ballot asked: "Do you want to make it a crime to make, sell, 7. Will, Sex as Tabasco Sauce, in THE MORNING AFTER: AMERICAN SUCCESSES AND EXCESSES 1981-86, 20 (1986). 1988] A Streetcar Named Lust give for value or otherwise promote obscene material in Maine."2 The re- sults revealed, by a two to one majority, that the residents of Maine did not want any restrictions placed on their right to enjoy obscene material.21 This outcome should come as no surprise; for although a 1986 Harris poll found forty-one percent of Americans support "reasonable censorship" of obscene or pornographic materials, thirty-five percent opposed censorship and twenty-four percent expressed ambivalence, or a "we-don't-think-it-matters" attitude.22 If, as the Surgeon General of the United States concludes, pornography is "blatantly antihuman" and poses a clear and present danger to the health of America,2" what should be done to prevent human sexuality from descend- ing to the level of starkness or that "of animals other than man?",24 Modern society's ongoing debate about pornography and obscenity focuses upon two primary themes or questions: the nature of the relationship between that which is considered obscene and that taken as pornographic and the stan- dards used to delineate and judge these two; and the relationship between the words and images of pornography-in the broad context-with violence against women (or, stated otherwise, as pornography the theory and rape the practice), male attitudes toward women generally, child abuse, and specifi- cally consumer desensitization where the culture accepts violence against women as routine.25 These two dynamic themes present a background for analysis of the mod- em dilemma of society in dealing with obscenity and pornography, and spe- cifically the need to preserve a decent, moralistic society while guaranteeing a free right of expression, dissent and moral independence. Although labo- ratory studies reveal violent pornography may very well promote aggression toward women, the integrity of these conclusions in unstructured social situ- ations is yet to be established.26 While some caution must obviously be taken in imposing blanket restrictions on pornography, on the issue of child pornography there can be no hesitancy in eradicating its dissemination and 20. The benchmark for ultimate decision making in this area of concern must forever be the standard of reasonableness that, in turn, dictates a case- by-case balancing of individual freedom of expression against the societal right to decency and moral integrity. I. NUDITY: YESTERDAY, TODAY AND TOMORROW Insofar as recorded history is concerned, the concept of nudity belongs to the ancient Greeks and their participation in athletic competitions.27 Those who competed in stadia did so entirely in the nude and thereby freed them- selves of cumbersome garments during their competitions. Body freedom, then, was a tolerable activity for the sportsman. But this freedom almost totally vanished with the Dark Ages.2" For more than fifteen centuries-with one single and rather markable ex- ception-nudity was taboo.

    Per Se or Power? Age and Sexual Consent Joseph J. Fischel* ABSTRACT: Legal theorists, liberal philosophers, and feminist scholars have written extensively on questions surrounding consent and sexual consent, with particular attention paid to the sorts of conditions that validate or vitiate consent, and to whether or not consent is an adequate metric to determine ethical and legal conduct. So too, many have written on the historical construction of childhood, and how this concept has influenced contemporary legal culture and more broadly informed civil society and its social divisions. Far less has been written, however, on a potent point of contact between these two fields: age of consent laws governing sexual activity. Partially on account of this under-theorization, such statutes are often taken for granted as reflecting rather than creating distinctions between adults and youth, between consensual competency and incapacity, and between the time for innocence and the time for sex. In this Article, I argue for relatively modest reforms to contemporary age of consent statutes but propose a theoretic reconstruction of the principles that inform them. After briefly historicizing age of consent statutes in the United States (Part I), I assert that the concept of sexual autonomy ought to govern legal regulations concerning age, age difference, and sexual activity (Part II). A commitment to sexual autonomy portends a lowered age of sexual consent, decriminalization of sex between minors, heightened legal supervision focusing on age difference and relations of dependence, more robust standards of consent for sex between minors and between minors and adults, and greater attention to the ways concerns about age, age difference, and sex both reflect and displace more normatively apt questions around gender, gendered power and submission, and queer sexuality (Part III).

    NOTE CRIMINALIZATION IN CONTEXT: INVOLUNTARINESS, OBSCENITY, AND THE FIRST AMENDMENT Cynthia Barmore* “Revenge porn,” referring to the distribution of sexually explicit images without the consent of those featured, is a growing problem in the United States. New Jersey and California were the first states to criminalize the practice, but state legislatures around the country have been passing and considering similar laws in recent months. Proponents of legislation, however, are confronting critics who protest that the First Amendment precludes criminal liability for distributing lawfully acquired true material. This Note provides the first in-depth analysis of how obscenity law can and should be used to criminalize revenge porn within the boundaries of the First Amendment. While no state legislature has characterized revenge porn as ob- scenity, this Note argues they should because the obscenity context provides the greatest insulation from a First Amendment challenge. If drafted to prohibit ob- scenity, such laws would enable states to robustly and constitutionally criminalize revenge porn, even when the photographer is the person objecting to distribution or the distributor acts without intent to cause serious emotional distress. The hope is this Note will guide legislatures to draft constitutionally responsible legis- lation to combat revenge porn.     LGBT History Just like any other marginalized group that has had to fight for acceptance and equal rights, the LGBT community has a history of events that have impacted the community. This is a collection of some of the major happenings in the LGBT community during the 20th century through today. It is broken up into three sections: Pre-Stonewall, Stonewall, and Post-Stonewall. This is because the move toward equality shifted dramatically after the Stonewall Riots. Please note this is not a comprehensive list. Pre-Stonewall 1913 Alfred Redl, head of Austrian Intelligence, committed suicide after being identified as a Russian double agent and a homosexual. His widely-published arrest gave birth to the notion that homosexuals are security risks. 1919 Magnus Hirschfeld founded the Institute for Sexology in Berlin. One of the primary focuses of this institute was civil rights for women and gay people. 1933 On January 30, Adolf Hitler banned the gay press in Germany. In that same year, Magnus Herschfeld’s Institute for Sexology was raided and over 12,000 books, periodicals, works of art and other materials were burned. Many of these items were completely irreplaceable. 1934 Gay people were beginning to be rounded up from German-occupied countries and sent to concentration camps. Just as Jews were made to wear the Star of David on the prison uniforms, gay people were required to wear a pink triangle. WWII Becomes a time of “great awakening” for queer people in the United States. The homosocial environments created by the military and number of women working outside the home provide greater opportunity for people to explore their sexuality.

Whereas the nude male figure on Athenian vases is generally perceived by scholars as representative of heroic, ritualistic or civic nudity, the female form’s nude state remains ambiguous in comparison. In an attempt to uncover the cultural significance behind the appearance of the nude female figure on Athenian vases, multiple scholars have suggested that her utterly exposed state must surely have been indicative of a ‘disreputable’ status, especially that of the hetaira. However, this interpretation is problematic as it ultimately restricts the possible function(s) of the nude female figure to being primarily erotic in nature.

In most of these diversions there can be no question of adornment; in some cases garments interfere with the purpose of the activity; in some they may even be detrimental to health. Yet social pressure compels the wearing of some clothing in all these pursuits. This taboo of the body is fairly universal. It is found among savage and civilized races alike, and prevails in all climates. Most investigators in this field have been interested in the origin of clothing rather than in the rise of the taboo. The two problems are distinct, though closely related. The origin of the impulse to cover the body has been variously explained by different writers. It has been attributed to the need of protection from cold, insects, dampness, excessive heat, rough soil, thorns, evil spirits, etc.; or to the craving for adornment, especially in order to promote sexual attraction. A number of writers ascribe the origin of clothing to a primitive modesty instinct, which would make the body taboo a native or inherent trait of the human race. J. C. The present study continued prior work assessing positive body image and went further adding an instrument used to assess Eating Disorder treatment efficacy expecting to benchmark naturists with very low symptomatology scores. Self-report Interoceptive testing was also employed to consider neurological underpinnings and benefits of their exceptional resilience. 43 naturists (37 male), average age 57, and 36 controls (21 male), average age 38, British origin, participated online. Utilizing the Body Appreciation Scale 2 and The Eating Disorder Examination Questionnaire, naturists consistently, significantly achieved higher positive, and lower negative body image scores across all measures. Naturist results on the Multidimensional Assessment of Interoceptive Awareness 2 across all dimensions were also persistently higher than controls. Naturist results confirm their position as a unique population demonstrating exceptionally high negative body image resilience, this coupled with potential advantageous neurological benefits that with further investigation could lead to naturism becoming a proactive mind-body therapy to help prevent eating disorders. Comprehensive future philosophical, phenomenological and longitudinal research options were also put forward. 2 Introduction A Body Image Dissatisfaction Epidemic Body and appearance dissatisfaction in the Western world have reached epidemic proportions with general population estimates of between 23-56% for women, and 15-43% for men, leading to the term ‘normative discontent,’ meaning it has become normal for the general population to feel dissatisfied with their body (Fallon, Harris & Johnson, 2014).
