The requirement for this report is set out in comments received from the Department of Environmental Affairs (DEA), in a letter dated 29th March 2019, on the Revised Draft Amendment Report, March 2019. A complete copy of the letter is included in Chapter 5 of this report, as well as in Appendix O in the final Amendment Report.

The requirement for a separate Comment and Response Report is detailed in section iii of DEA’s comments, the text of which is reproduced below. The format in which comments and responses must be presented (in Annexure 1 of DEA’s comments) is also reproduced.

Iii A Comments and Response trail report (C&R) must be submitted with the final report. The C&R report must be in the table format as indicated in Annexure 1 to this letter. Please refrain from summarising comments made by I&APs. All comments from I&APs must be copied verbatim and responded to clearly. Please note that a response as “noted” is not regarded as an adequate response to I&AP’s comments.

Section ii of the DEA’s comments is also reproduced below. It requires evidence to be produced of efforts to elicit comments from interested and affected parties (I&APs), government departments and agencies, and other key stakeholders, in the event that few or no comments were received. This is the case here. ii Please ensure that all issues raised and comments received from Registered I&APs and organs of state which have jurisdiction (including this Department’s Biodiversity Section) in respect of the proposed activity are adequately addressed in the final report. Proof of correspondence with the various stakeholders must be included in the final report. Should you be unable to obtain comments, proof should be submitted to the Department of the attempts that were made to obtain comments. The Public Participation Process must be conducted in terms of Regulations 39, 40, 41, 42, 43 and 44 of the EIA Regulations, 2014 as amended.

This report documents all correspondence sent to and received from I&APs, government departments and agencies and other key stakeholders, for all stages of the amendment application process.

Some of these stages were found to be procedurally invalid because of a procedural omission, and this is described in Chapter 1 of this report. Inclusion of all correspondence throughout the entire public participation process is considered to be necessary because very few comments were received, particularly from relevant government departments, despite four invitations to become involved in the process. In the light of section ii of DEA’s comments on the Revised Draft Amendment Report (above) it is therefore important to comprehensively document all efforts made to elicit comments from all stakeholders.

Copies of all notifications and invitations to comment are included as Appendices A, C, D and E,

1.1 History of the Amendment Application (i) Notification of the intention to submit an application to amend the environmental authorisation was sent to I&APs, representatives of government departments and agencies, and other key stakeholders and organisations in September 2018. (ii) A formal Amendment Application was submitted to the Department of Environmental Affairs (DEA) in Pretoria on 5th December 2018, and acknowledgement of receipt was received in a letter dated 14th December 2018. (iii) A Draft Amendment Report was made available to all stakeholders for review and comment on 4th January 2019 for a period of 30 days. (iv) Changes were made to the Draft Amendment Report as a result of comments received, and a Final Amendment Report was made available to all stakeholders for review and comment on 21st February 2019 a period of 30 days. Subsequent correspondence from DEA indicated that steps (iii) and (iv) above were invalid in terms of the NEMA EIA Regulations, because the department had not been given an opportunity to review the Draft Amendment Report and comment on it.

Accordingly, on advice from the department: (v) The Draft Amendment Report and the Final Amendment Report were withdrawn. (vi) The Amendment Application submitted in December 2018 was withdrawn. (vii) A second Amendment Application was submitted to DEA on 7th March 2019, and acknowledgement of receipt was received in a letter dated 20th March 2018. (viii) A Revised Draft Amendment Report was made available to all stakeholders, including DEA, for review and comment on 7th March 2019 for a period of 30 days.

1.2 Overview of Comments Received Although the first Draft Amendment Report (December 2018–Withdrawn) and the subsequent Final Amendment Report (January 20191–Withdrawn) were invalid in terms of the relevant regulatory procedures, a total of eight comments on the Draft report and two comments on the Final report were received from stakeholders. These comments, together with 12 comments received in response to the Notification of Intention, are recorded in Chapters 2, 3 and 4 of this report.

No comments on the Revised Draft Amendment Report (March 2019) were received from any of the stakeholders. Comments on the Revised Draft Amendment Report were received from DEA, and these related mainly to the department’s requirements for the format and content of the reports that will comprise the final submission of the Amendment Application.

The full text of the department’s Comments on the Revised Draft Amendment Report is reproduced in Chapter 5 of this report and in Appendix O of the Amendment Report. The requirements that are particular to this Comment and Response Report are set out in the Foreword.

2.2 Comments received The comments received from recipients of the notification are set out in Table 2.1. It is possible that some of the comments received were in response to the site notices erected at three locations around the site (section 7.2.1 of the Amendment report) and/or the newspaper advertisement placed in Grocotts Mail (section 7.2.2 of the Amendment Report), but none of the responders indicated that this was the case.

The appellants also averred that overseas trophy hunters will not come to the area to hunt if the facility is built, and this will not only prejudice the livelihoods of everyone who is involved in the business, but will also reduce the tax revenue from the business. The appeal decisions, which summarise the main thrusts of the grounds of appeal, will be made available to I&APs for the mandatory 30-day public review period. The Draft Amendment Report, February 2019, was subsequently withdrawn because of a procedural error in the public participation process. The comments are nevertheless considered to be relevant to the process, not least because they illustrate that communications were sent and received, even though most of the stakeholders did not respond to the several invitations to engage with the amendment process.

The “Final” Amendment Report, February 2019, was subsequently withdrawn because of a procedural error in the public participation process. The comments are nevertheless considered to be relevant to the process, not least because they illustrate that communications were sent and received, even though most of the stakeholders did not respond to the several invitations to engage with the amendment process.
