Introduction In the process of proposing and writing the Advance Notice of Public Rulemaking relating to mortgage acts and practices, the FTC has already recognized the myriad of unfair and deceptive practices facing homeowners in the origination, servicing and foreclosure process. The FTC has already identified many of the practices that need to be prohibited. The FTC now has the unquestionable authority to identify and ban these shameful and illegal practices on a market-wide basis.
