Thus, loss prevention as a discipline tends to be understa ed. But when you consider that a $20-billion-a-year retailer grapples with the average shrinkage rate of 6-7 percent — amounts to $140 million — a solution to the shrinkage problem could literally pay huge dividends. There are numerous sources of shrinkage (paper, external, spoilage, etc.) where analytics can play a loss prevention role. However, cashier fraud and “sweethearting” — collusion between cashier and customer — which is responsible for signifi cant shrinkage in retail is often overlooked. Identifying at-risk sta before it becomes a problem — for the retailer and the sta er — is a valuable proposition. But applying analytics to cashier transactions isn’t just about catching the bad guys. By detecting high-risk employees early, there’s an opportunity to intervene before they become a problem, for the store and for themselves. Analytics can fi nd training opportunities that have been overlooked. Analytics can refi ne and optimize sta ng processes. Introduction The Computer Fraud and Abuse Act (CFAA) is a powerful statute that can combat online theft and protect digital information.1 Congress originally discussed these objectives in the early 1980s and enacted the CFAA in 1986 in the midst of the Digital Revolution.2 As digital machinery began to quickly replace analog and mechanical devices, Congress needed a statute with the ability to grow alongside this new technology.3 The CFAA was meant to be malleable and adapt over time with ever-changing innovation.4 At inception in 1986, however, the idea of a global internet, not to mention numerous other online technologies that now exist, was not even conceivable. Congress designed the CFAA to be flexible because digital technology was new, but this flexibility has been misused.
