Notice of January 21, 2009 (1:08-mc-0442, dkt. no. 1535). Respondents submit corrected versions of Exhibits 1, 2, and 3 as substitutions for those included in the original filing.1 The substitutions properly note that ISN 168’s petition is before Judge Leon, that ISNs 694, 696, and 682 are subject to charges under the Military Commissions Act, that ISN 1015 has been 1 Respondents further plan to file under seal supplements to their January 21, 2009 filing in order to clarify the status of particular detainees. Since the military brought the first detainees to Guantánamo in January 2002, the Pentagon has consistently refused to comprehensively identify those it holds. While it has, at various times, released information about individuals who have been detained at Guantánamo, it has always maintained ambiguity about the population of the facility at any given moment, declining even to specify precisely the number of detainees held at the base. We have sought to identify the detainee population using a variety of records, mostly from habeas corpus litigation, and we have sorted the current population into subgroups using both the government’s allegations against detainees and detainee statements about their own affiliations and conduct.

Pond1 INTRODUCTION asser Talal al Zahrani was only sixteen years old when he was first captured and later transferred to the Guantanamo YBay detention camp, where he would spend the next four years until allegedly ending his own life on June 6, 2006. He was a citizen of Saudi Arabia, held in extrajudicial detention (or detention without trial) for an alleged connection with the Taliban. Just days before his death, he had written a letter to his father, Colonel Talal al-Zahrani, detailing two other prisoners who seemed to be on the verge of death. Ten days after receiving the letter, the Department of Defense announced the apparent suicide of Yasser Talal al Zahrani and two other prisoners: Salah Ali Abdullah Ahmed Al-Salami and Ali Abdullah Ahmed Naser al-Sullami. The bodies were returned to their families with trauma to the faces, necks, and chests of the bodies.

It must be closed. This document outlines a five-step plan for closing Guantánamo and restoring the rule of law. Secrecy and fear have distorted the facts about Guantánamo detainees. Our plan is informed by recognition of the following critical facts, largely unknown to the public: • The government has quietly repatriated two-thirds of the 750 detainees, tacitly admitting that many should never have been held at all. • Most of the remaining detainees will not be charged as terrorists, and can be released as soon as their home country or a haven country agrees to accept them. • Trying the remaining detainees in federal court – and thus excluding evidence obtained through torture or coercion – does not endanger the public. The rule of law and the presumption of innocence serve to protect the public. Furthermore, the government has repeatedly stated that there is substantial evidence against the detainees presumed most dangerous – the High Value Detainees – that was not obtained by torture or coercion. See appendix for full copies of the logs. 3 The US Department of Defence has released ‘in-process’ records of Guantanamo inmates, detailing when prisoners were first weighed and measured on entry to the prison. It is possible confirm the identities of prisoners transported to Guantanamo through Portuguese jurisdiction by matching the ‘in- process’ dates of particular prisoners held in Guantanamo with flights contained in the Portuguese flight logs.
