It should become a very short manifest only, and it is good to write it once the policy has been confirmed many times. Please see the text following this Editorial. The highlights of this EUFAJ number are quite simple: First the new EU Global Strategy for its foreign and security policy, then the Joint Declaration EU/NATO from 8th April 2016. This is a kind of documentary part. Then the Eastern Partnership countries: Georgia's South Ossetia - a portrait with an accent on security policy, by Grazvydas Jasutis, a Lithuanian expert for the region, Azerbaijan's civil society and the Ukrainian humanitarian crisis, for which we are most grateful to our colleagues of "Ukraine Analytica". Thirdly, the Eurasian integrtion and the EU, with a paper by the Europea Council of Foreign Relations, and a refreshing paper on the United States of Europe - by a student from the United States of America. Finally the Russian-Chinese-Indian triangle, mainly under economic auspices. The Paper covers European Foreign, Foreign Trade, Development, Security Policy, EU-Third Country Relations and Regional Integration as well as everything which is related to the EU internal policy and is of interest to third countries. The subject of EUFAJ is, therefore, rather large than narrow. 2. EUFAJ openly pleads for an integrationist view on the subjects mentioned, above in 1., i.e. also a critical approach towards all the aspects of European policies, noted in 1. 3. Among the various subjects, especially, the European values after Art. 2 of TEU and human rights are of a particular scrutiny. 4.     Borderization in Georgia: Sovereignty Materialized Edward Boyle∗ Abstract This paper shall examine the process of borderization that has been proclaimed as occurring along the Georgian-South Ossetian boundary. This boundary is one that remains largely unrecognized, as the claims of the Georgian state to sovereignty over South Ossetia are accepted by the majority of the international community. The crucial exception to this is Russia, under whose aegis this process of borderization is occurring. The result is the creation of a physical barrier around the territory of South Ossetia, one that seeks to materialize what was previously an administrative fiction on the ground, halting the movement of people and goods across this border and dividing people from their livelihoods. The paper shall consider what meaning this fencing has within the context of Georgia’s borders, and reflect upon the larger lessons that can be drawn for the concept of sovereignty and the status of borders in the contemporary world. Reporting the Border On April 15, 2014, three crew members of a Tbilisi-based television station were detained by Russian forces close to the village of Adzvi bordering South Ossetia. TV3 announced that its reporter Bela Zakaidze, cameraman Vakhtang Lekiashvili and broadcast technician Mikheil Mikhoev had been detained while working on a report about the shifting of the boundary between South Ossetia and Georgia deeper into Georgian-controlled territory. RES, South Ossetia’s official news agency, citing the South Ossetian Special Envoy for Post-Conflict Issues, Murat Jioev, reported that “three Georgian citizens were detained in the vicinity of South Ossetia … for violating the state border.” 1 Russia’s Ministry of Foreign Affairs issued a statement that Russian border guards, protecting the boundary between Georgia and South Ossetia as per the agreement between the governments of Russia and South Ossetia, had arrested three Georgian journalists and that, “According to the rules the detainees were transferred to the South Ossetian authorities.

Till Spanke writes that while two previous referendums have been held following the territory’s declaration of independence from Georgia in 1990, a further referendum is unlikely to be welcomed in either Tbilisi or Moscow. He argues that there are few immediate advantages for Russia of pursuing a unification in the current climate and it is likely South Ossetia will come under pressure to delay or cancel the referendum process. South Ossetia, a breakaway region on the territory of Georgia in the South Caucasus, has announced its plan to hold a referendum on unification with the Russian Federation. This development may not come as a surprise for observers of the region, yet the announcement puts Georgia and Russia in a difficult situation as it comes at an inconvenient point in time for both countries. The region’s de facto president Leonid Tibilov informed the media on 19 October about his decision to initiate a referendum on joining the Russian Federation after a meeting with Vladislav Surkov, the Russian president’s advisor for separatist matters, according to the South Ossetian news agency Res. This would be the third referendum of its kind since 1992. South Ossetia and Russia South Ossetia declared independence from Georgia in 1990, which ultimately resulted in the South Ossetian War of 1991 and 1992 that was fought between Georgian and South Ossetian forces.

    Has the Kosovo Case Diminished the Adherence of the International Community of States to the Inviolability of territorial Integrity of the UN State-members including Georgia? Prof. Levan Alexidze Tbilisi State University, Georgia Abstract International community of states continues facing bloody armed internal conflicts. One of the most dangerous challenges is an attempt of national minorities to secede from the states which gained independence after the dissolution of the Union of Social Socialist Republics (hereinafter - USSR) and the former Socialist Federal Republic of Yugoslavia (hereinafter – SFRY). Some of these minorities refer to their alleged right to self-determination, including the right of secession, and claim that they can realize this right unilaterally and if necessary also by using force. The question arises: does contemporary International Law indeed provide to national minorities the right of secession? The cases of Kosovo and so-called South Ossetia1 clearly show firm attitude of international community: no right of a national minority to secede from the democratic sovereign state - member of the United Nations and other international organizations - is recognized (South Ossetia), unless there has been gross and systematic violation of rights of national minorities in breach of international law (Kosovo). Introduction February 17, 2008 will remain in the history of International Law for a long time since, as it had been expected, the controversy over the legality of the events in Kosovo could produce a real danger to the stability of the contemporary international legal order. At the first glance, there was nothing new in an attempt of the Kosovo Albanians to formally secede from Serbia, issuing the Declaration of Independence of Kosovo.
