Defamation, That Is, Comments Or Statements That Tarnish Or Destroy a Person’S Reputation in the Minds of Others
You Can’t Say That!! continued Hilary Findlay, a lawyer, and Rachel Corbett, a risk management consultant, are founders and directors of the Centre for Sport and Law. They are regular contributors to Coaches Report. In the last issue of Coaches Report, we wrote about defamation, that is, comments or statements that tarnish or destroy a person’s reputation in the minds of others. We identified the three elements that make a communication defamatory: A written or spoken communication must be made to a third person. The communication must convey a defamatory meaning or be capable of being interpreted in a defamatory manner. The defamatory meaning must be about the person bringing the allegation. We cited the case of Pliuskaitis v. Jotautas,1 in which a board member of a swim club was found by the court to have made a number of defamatory comments about the club’s coach. We explained that there is a very low threshold for a finding of defamation. In other words, it is not difficult to prove the three elements of defamation described above. Once defamation is established, the question becomes, Are the circumstances such that a defamatory communication may be legally justified or allowable? These are called “defences” to a claim of defamation and they are the focus of this article. We will also pick up the case of Pliuskaitis v. Jotautas and look at the defences put forward by the board member and see whether or not they were successful. There are four defences to a finding of defamation: consent, fair comment, justification, and qualified privilege. -

US Constitution First Amendment: an Overview
US Constitution first amendment: an overview The First Amendment of the United States Constitution protects the right to freedom of religion and freedom of expression from government interference. See U.S. Const. amend. I. Freedom of expression consists of the rights to freedom of speech, press, assembly and to petition the government for a redress of grievances, and the implied rights of association and belief. The Supreme Court interprets the extent of the protection afforded to these rights. The First Amendment has been interpreted by the Court as applying to the entire federal government even though it is only expressly applicable to Congress. Furthermore, the Court has interpreted, the due process clause of the Fourteenth Amendment as protecting the rights in the First Amendment from interference by state governments. See U.S. Const. amend. XIV. Two clauses in the First Amendment guarantee freedom of religion. The establishment clause prohibits the government from passing legislation to establish an official religion or preferring one religion over another. It enforces the "separation of church and state." Some governmental activity related to religion has been declared constitutional by the Supreme Court. For example, providing bus transportation for parochial school students and the enforcement of "blue laws" is not prohibited. The free exercise clause prohibits the government, in most instances, from interfering with a person's practice of their religion. The most basic component of freedom of expression is the right of freedom of speech. The right to freedom of speech allows individuals to express themselves without interference or constraint by the government. The Supreme Court requires the government to provide substantial justification for the interference with the right of free speech where it attempts to regulate the content of the speech. -

Competing Theories of Blackmail: An Empirical Research Critique of Criminal Law Theory Paul H. Robinson,* Michael T. Cahill** & Daniel M. Bartels*** The crime of blackmail has risen to national media attention because of the David Letterman case, but this wonderfully curious offense has long been the favorite of clever criminal law theorists. It criminalizes the threat to do something that would not be criminal if one did it. There exists a rich liter- ature on the issue, with many prominent legal scholars offering their accounts. Each theorist has his own explanation as to why the blackmail offense exists. Most theories seek to justify the position that blackmail is a moral wrong and claim to offer an account that reflects widely shared moral intuitions. But the theories make widely varying assertions about what those shared intuitions are, while also lacking any evidence to support the assertions. This Article summarizes the results of an empirical study designed to test the competing theories of blackmail to see which best accords with pre- vailing sentiment. Using a variety of scenarios designed to isolate and test the various criteria different theorists have put forth as “the” key to blackmail, this study reveals which (if any) of the various theories of blackmail proposed to date truly reflects laypeople’s moral judgment. Blackmail is not only a common subject of scholarly theorizing but also a common object of criminal prohibition. Every American jurisdiction criminalizes blackmail, although there is considerable variation in its formulation. The Article reviews the American statutes and describes the three general approaches these provisions reflect. -
Matal V. Tam & the Right to Own Disparaging Words
WHAT’S IN A NAME?: MATAL V. TAM & THE RIGHT TO OWN DISPARAGING WORDS I. INTRODUCTION In June 2017, the Supreme Court decided Matal v. Tam,1 a rare case in which intellectual property and First Amendment law collided.2 The principal question was whether the Lanham Act’s (“the Act”) Disparagement Clause was constitutional.3 While the Court had declined to answer this question with previous plaintiffs, such as the Washington Redskins (“the Redskins”), the Court granted certiorari to Simon Tam (“Tam”) and his Asian-American bandmates to decide whether the U.S. Patent and Trademark Office (“PTO”) had wrongly denied trademark registration for their band name: The Slants.4 Tam and his bandmates (collectively “The Slants”) are more sympathetic plaintiffs than the Washington Redskins: they are Asian-Americans reclaiming an outdated term derogatory to Asian-Americans.5 The Redskins, on the other hand, operate under a long-reviled racist term for Native Americans, and at best, a slim minority of their members is Native American.6 The Slants won their Supreme Court case, but the Court left unresolved the next question, which is what this decision means for less-than-sympathetic parties like the Redskins.7 This paper will explore what rights individuals and organizations have in owning derogatory terminology. Part II provides the background of trademark registration criteria and benefits, a summary of the process to appeal rejected trademarks, an introduction to the Act and Disparagement Clause, and a brief overview of First Amendment law. Freedom of Speech, Freedom of Self-Expression, and Kant's Public
Diametros 54 (2017): 118–137 doi: 10.13153/diam.54.2017.1136 FREEDOM OF SPEECH, FREEDOM OF SELF-EXPRESSION, AND KANT’S PUBLIC USE OF REASON – Geert Van Eekert – Abstract. This article turns to early modern and Enlightenment advocates of tolerance (Locke, Spi- noza, John Stuart Mill) to discover and lay bare the line of argument that has informed their com- mitment to free speech. This line of argument will subsequently be used to assess the shift from free speech to the contemporary ideal of free self-expression. In order to take this assessment one step further, this article will finally turn to Immanuel Kant’s famous defense of the public use of reason. In the wake of Katerina Deligiorgi’s readings of Kant, it will show that the idea of free speech requires a specific disposition on behalf of speakers and writers that is in danger of being neglected in the contemporary prevailing conception of free speech as freedom of self-expression. Contemporary debates about free speech or freedom of speech primarily deal with the question how free speech should be (in the sense of both “How free should speech be?” and “How should free speech be?”), and not (or at least not mainly) with the question why speech should be free.1 Admittedly, there seems to be no reason to urge the latter question: it is rather generally agreed upon today (at least in liberal democratic societies) that freedom of speech should be both es- teemed and categorically defended because it is both a fundamental human right and a key pillar of democracy and of the (scientific) quest for knowledge. -
Rehabilitating a Federal Supervisor's Reputation Through a Claim
Title VII and EEOC case law have created an almost blanket protection for defamatory statements made in the form of allegations of harassment or discrimination in the federal workplace. In this environment, federal supervisors would do well to exercise caution before resorting to the intui- tive remedy of a defamation claim. Although there are some situations where an employee may engage in action so egregious that a claim of defamation is a good option, one cannot escape the fact that supervisory employment in the federal workplace comes with an increased risk of defamatory accusations for which there is no legal remedy.
