Dear Ivlr. President:

ct I ba ve been attempting to talk to you directly today, but I have lbeen unable to do so. In lieu of a personal message to you concerning the ,. tragic situation on the Pine Ridge Reservation, !-; lam writing this lette.r:: to make some recommendations which I think must be carried out in an effort to restore so~ kind of order to Pire Ridge. " On numerous occasions prior to yesterday's tragic urge-d events, I have upon the Bureau of Indian Affairs tl:a t a different policy be carried out · ... on the reservation designed to end the anarchy which has existed there dur- ing the past two -and one· -half years. I have received only a bureaucratic r e sponse, but no action. Therefore, the only avenue remaining is direct action on your part to order the necessary basic changes which made. need to be

Accordingly,. I offer the following recommendations with respect to the Pine Ridge Rese:::vation: ... l. that the 3c..reau of Indian Affairs law enforcement authority be transferred to proie.ssional law enforcement personnel either in the Bureau o£ Indian Affairs or in the Justice Department and remove-d control from political under wh...ich it now acts on the reservation.

5 memo to Phil Buchen on unan In response to your November I am prov iding a status swered Congressional correspondence, to the report on a letter from Congressman President.

Vern Loen' s letter to Congressman Attached at Tab A i s a copy of about a memo an inquiry by the Congressman A bdnor concerning the Robert Burnette, President of randum to the President from also attached.) The Counsel's SiotL'< Tribe. (Burnette memo the Burnette memo until Ve~n Office did not receive a copy of reply to the Congressman. Upon sent it to us with his O cto ber 4 to contact Bob Burnette, who receiving Vern's letter, I attempted in the Tribal Office on a was a friend of mine. No one answered other contacts I discovered that number o£ occasions, and through and bitter election campaign the reason related to a very active Tribal Presidency. The result that was being conducted for the lost the Presidency of the of that election was that Bob Burnette ~ then attempted to fire Rosebud Sioux Tribe by 40 votes. Burnette the election a nd swore in the victor the Tribal Judge who certified suit in F e deral district court to and, when that move failed, filed to order a new election. Burnette in validate the swearing-in and persuade him t o have the ·white also called Ted Marrs to try to dispute. Ted declined to do s o. House intervene in the election

I did not think it \vas appropriate Given the above circumstances, Burnette. Ted i'vla rrs had received to continue to try to contact Bob to the President and had sent it the original of the Burnette memo and response. He has not received to the FBI for further con1ment of the addressees Department7 one a response to date. The Justice looking into the alleged harassment of the Burnette tnemo, has been

as \vell as into a number o£ other alleged incidents on the n eigl-:bor ing Pine Ridge Reserv ation. T here is at present no substanti'.re reply to Burnette and, therefore, no copy to Congressman Abdnor. Until there is such a reply, I did not think it was necessary to cor respond with the Congressmen. However, I would be happy to verbally convey this inforrnc_tion to Congressrnc_n Abdnor and \Vill do so on 1vlonday unless I hear from you to the contrary.

Though the Abdnor letter is the only one from your list which I personally have as outstanding, let me also note that the Counsel's to a letter from f Office has not sent a further ·white House response I Congresswoman Holt to the President dated September 29. Vern i Loen answered the Congresswoman on October 6 {see Tab B f or Holt letter and Loen response) , and it was my opinion, shared by 1 Dick Parsons and David Lissy of the Domestic Council~ that Vern s l letter was both sufficient and as responsive as the ·white House could be. There was no further response we could give the Con I gresswoman to her attack on HE\V, the Federal courts and Justice that (1) would please her; and (2) would not run the danger of being misinterpreted by various groups.
