REPLY BRIEF

In the Examining Attorney’s Appeal Brief of January 28, 2019, the Examining Attorney argued for the continued refusal of registration of the Applicant’s Mark.

The Applicant notes that the word “dynamine” has a common and ordinary English meaning and is not an arbitrary word. The word “dynamine” is the name for found in

South America. See exhibit 418.

In view of the fact that the word “dynamine” has a common and ordinary English meaning for a , it “is not impossible to predict the meaning that the public will attribute to the marks.” The average member of the public and the relevant consumer upon viewing the word “dynamine” will understand the word to be a name for butterflies and will not associate the mark with the cited mark “DYNO-MINS.”

The Applicant respectfully requests that the Board allow the mark to pass to publication.

The meaning attributed to the word “dynamine” by the relevant consumer is that of a butterfly and is not an arbitrary word with no precise meaning as suggested by the Examining Attorney. The meaning of a butterfly is not descriptive of the goods of the Applicant’s mark or the cited mark.
