1 GAPS IN ACCESS TO JUSTICE: THE OVERSEAS FILIPINO WORKERS’ EXPERIENCE, AN INITIAL ANALYSIS OF PHILIPPINE JURISPRUDENCE ON LABOR MIGRATION A study by the Commission on Human Rights of the Philippines1 and Atty. Henry S. Rojas2 Lawyers Beyond Borders Philippines, Inc. I. ABSTRACT OR EXECUTIVE SUMMARY In this research study, cases involving overseas Filipino workers (OFWs) that were decided by the Supreme Court in 2015 to 2019 were examined, in conjunction with other online secondary sources, for the purpose of identifying possible gaps/concerns in the migrant/human rights protection regime for OFWs, and to come up with policy recommendations to address such gaps or concerns. The following migrants’ rights concerns were identified in the study: 1. In the OFW cases decided by the Supreme Court in 2015-2019, it took 7.2 years on the average for an OFW money claims case to go through the entire judicial process from the date of filing of the complaint before the National Labor Relations Commission 1 The Commission on Human Rights of the Philippines (CHR) is the National Human Rights Institution (NHRI) of the Philippines. Established by the 1987 Philippine Constitution, the CHR has a general jurisdiction for the protection of human rights of all persons within the Philippines, as well as Filipinos residing abroad, and provide for preventive measures and legal aid services to the underprivileged whose human rights have been violated or need protection. An “A” NHRI, the CHR complies with the Paris Principles on the Status of National Human Rights Institutions adopted by the UN General Assembly in 1995. -

The claim is often made that the Republic of the Philippines, by reason of American tutelage, stands as the one nation in the Orient that has successfully established itself as an American-type democracy. The Philippines is confronted today by serious econcanic problems which may threaten the stability of the nation. From the point of view of purely economic considerations, Philippine national interests would seem to call for one line of policy to cope with these economic problems. Yet, time and again, the Philippine government has been forced by political considerations to foUcw some other line of policy which was patently undesirable from an economic point of view. The National Economic Council, a body of economic experts, has been organized for the purpose of form ulating economic p o licy and recommend ing what is economically most desirable for the nation. -

CongressWatch Report No. 176 Report No. 176 17 June 2013 The 16th Congress In the Senate The 16th Congress will open on 22 July, the same day that President Benigno Aquino III delivers his fourth State-of-the-Nation Address (SONA). The Senate will likely have a complete roster for the first time since the 12th Congress. It may be recalled that during the 2001 elections, 13 senators were elected, with the last placer serving the unfinished term of Sen. Teofisto Guingona who was then appointed as vice president. The chamber had a full roll of 24 senators for only a year, due to the appointment of Sen. Blas Ople as Foreign Affairs Secretary on 23 July 2002, and due to the passing of Sen. Renato Cayetano on 25 June 2003. The 11th, 13th, 14th, and 15th Congresses did not have full membership, primarily because a senator did not complete the six-year term due to being elected to another post.1 In the 2013 midterm elections last May, all of the six senators seeking re-election made it to the top 12, while two were members of the House of Representatives in the 15th Congress. The President. Compared to the second quarter 2012 survey, of May 24-27, the percentage satisfied with P-Noy’s performance rose to 77 from 63, and the percentage dissatisfied with him fell to 10 from 21. Consequently, his net satisfaction rating rose from +42 in May to +67 in August, topping his previous best of +64 in November 2010. Both his old and new personal bests are classified by SWS as Very Good (+50 to +69). P-Noy’s net rating rose most of all in the National Capital Region, from merely +18 (Moderate) in May to +59 in August. It also rose significantly in Balance of Luzon, from +41 (Good) to +70 (Excellent), and in the Visayas, from +41 (Good) to +76 (Excellent). In Mindanao, it was at a Very Good + 61 in both May and August. Everyone is entitled to do her/his own analysis of the survey findings. Personally, I do not emphasize too much the timing of the interviews -- that is to say, during the tragic week of mourning for the lost Secretary Jesse Robredo – because I prefer to look at the total picture encompassing the two successive quarters, in which the obvious big difference was the ouster of former Chief Justice Renato Corona. -

EXTERNAL (for general distribution) AI Index: 35/04/93 Distr: UA/SC UA 68/93 "Disappearance"/ Death Threats 12 March 1993 PHILIPPINES: Romeo Legaspi, 58, Journalist / Publisher Amnesty International is concerned for the safety of Romeo Legaspi, a journalist and publisher, who "disappeared" after being abducted by four armed men believed to be linked to the Philippines National Police (PNP) on 11 January 1993 in Olongapo City, Zambales. Prior to his abduction, Romeo Legaspi had been harrassed and threatened by police authorities about whom he had written a critical article in the Voice of Zambales newspaper. Police have denied having him in custody and, as of 12 March 1993, his whereabouts remained unknown. The Supreme Court has yet to reach a decision on a habeas corpus petition filed by family members in late February. Amnesty International fears that Romeo Legaspi may be in danger of ill-treatment or unlawful execution if he is not located immediately. The organization is also concerned for the safety of Romeo Legaspi's relatives who have received death threats since they filed a formal complaint about his "disappearance". In 1992, ten members of the PNP's Intelligence Special Operations Group (PNP-ISOG) in Olongapo, including the Station Commmander, filed libel charges against Romeo Legaspi for an article which alleged that their unit had been involved in illegal activities, and which called for its dissolution. The charges were dismissed, but he continued to receive threats and warnings from the police involved. In letters to family and friends, and in his personal diary, he expressed fear that the police authorities might take action against him. -

Dissertation for the MA in Governance and Development Institute of Development Studies University of Sussex By Silvia Sanz-Ramos Rojo September 2002 Policy Paper SUMMARY This paper will analyse the Barangay Justice System (BJS) in the Philippines, which is a community mediation programme, whose overarching objective is to deliver speedy, cost-efficient and quality justice through non-adversarial processes. The increasing recognition that this programme has recently acquired is mainly connected with the need to decongest the formal courts, although this paper will attempt to illustrate the positive impact it is having on improving access to justice for all community residents, including the most disadvantaged. Similarly, the paper will focus on link between the institutionalisation of Alternative Dispute Resolution (ADR) and the decentralisation framework in the country. It will discuss how the challenging devolution of powers and responsibilities from the central government to the barangays (village) has facilitated the formal recognition of the BJS as an alternative forum for the resolution of family and community disputes. Moreover, the paper will support the idea that dispute resolution is not autonomous from other social, political and economic components of social systems, and will therefore explore how the BJS actually works within the context of the Philippine society. Thus, the analysis will be based on the differences between how the BJS should work according to the law and how it really operates in practice. It will particularly exhibit the main strengths and limitations of the BJS, and will propose certain recommendations to overcome the operational problems in order to ensure its effectiveness as an alternative to improve access to justice for the poor. -

Sanders, Dean of Graduate Studies Date ABSTRACT Filipino culture was founded through the amalgamation of many ethnic and cultural influences, such as centuries of Spanish colonization and the immigration of surrounding Asiatic groups as well as the long nineteenth century’s Race of Nations. However, the events of 1898 to 1914 brought a sense of national unity throughout the seven thousand islands that made the Philippine archipelago. The Philippine-American War followed by United States occupation, with the massive domestic support on the ideals of Manifest Destiny, introduced the notion of distinct racial ethnicities and cemented the birth of one national Philippine identity. The exploration on the Philippine American War and United States occupation resulted in distinguishing the three different analyses of identity each influenced by events from 1898 to 1914: 1) The identity of Filipinos through the eyes of U.S., an orientalist study of the “us” versus “them” heavily influenced by U.S.
