The Commission on Elections from Aquino to Arroyo
ACKNOWLEDGEMENTS It is with deep gratitude to IDE that I had a chance to visit and experience Japan. I enjoyed the many conversations with researchers in IDE, Japanese academics and scholars of Philippines studies from various universities. The timing of my visit, the year 2009, could not have been more perfect for someone interested in election studies. This paper presents some ideas, arguments, proposed framework, and historical tracing articulated in my Ph.D. dissertation submitted to the Department of Political Science at the University of Wisconsin-Madison. I would like to thank my generous and inspiring professors: Paul Hutchcroft, Alfred McCoy, Edward Friedman, Michael Schatzberg, Dennis Dresang and Michael Cullinane. This research continues to be a work in progress. And while it has benefited from comments and suggestions from various individuals, all errors are mine alone. I would like to thank the Institute of Developing Economies (IDE) for the interest and support in this research project. I am especially grateful to Dr. Takeshi Kawanaka who graciously acted as my counterpart. Dr. Kawanaka kindly introduced me to many Japanese scholars, academics, and researchers engaged in Philippine studies. He likewise generously shared his time to talk politics and raise interesting questions and suggestions for my research. My special thanks to Yurika Suzuki. Able to anticipate what one needs in order to adjust, she kindly extended help and shared many useful information, insights and tips to help me navigate daily life in Japan (including earthquake survival tips). Many thanks to the International Exchange and Training Department of IDE especially to Masak Osuna, Yasuyo Sakaguchi and Miyuki Ishikawa. -

It was a period of challenges for the BDO Group as the lingering effects of the 2008 global financial crisis told on the country’s economic performance and gnawed at business confidence. It was a difficult time for business and industry but the Group, exhibiting great resiliency and financial strength, ably cleared the hurdles by taking the right strategies that included the offering of more build-to-suit financial products and continued expansion of the branch network, thus, increasing further the client base. 2009 was also a rewarding year for Banco De Oro Unibank. Despite the hard times, the Group’s performance exceeded expectations with its better-than-industry results for growth and income generated. Its market share continued to expand and its hold on being the market leader in terms of total assets, customer loans, deposits and assets under management has solidified even more. CORPORATE PROFILE The product of a merger heralded as unprecedented in size and scale in the Philippine banking industry, Banco De Oro Unibank (BDO) today represents a firm consolidation of distinct strengths and advantages built over the years by the entities behind its history. -

No. 160261 EN BANC D E C I S I O N CARPIO MORALES, J.: There can be no constitutional crisis arising from a conflict, no matter how passionate and seemingly irreconcilable it may appear to be, over the determination by the independent branches of government of the nature, scope and extent of their respective constitutional powers where the Constitution itself provides for the means and bases for its resolution. Our nation's history is replete with vivid illustrations of the often frictional, at times turbulent, dynamics of the relationship among these co-equal branches. This Court is confronted with one such today involving the legislature and the judiciary which has drawn legal luminaries to chart antipodal courses and not a few of our countrymen to vent cacophonous sentiments thereon. There may indeed be some legitimacy to the characterization that the present controversy subject of the instant petitions - whether the filing of the second impeachment complaint against Chief Justice Hilario G. Davide, Jr. with the House of Representatives falls within the one year bar provided in the Constitution, and whether the resolution thereof is a political question - has resulted in a political crisis. -
Legal Maxims
Legal Maxims AB INITIO From the beginning (Heirs of Arches vs. Diaz, L-27136, 30 April 1973; 50 SCRA 445). ABERRATIO ICTUS Blow or stroke gone astray as when a person receives a blow or a bullet intended for another (People vs. Salarda, 05494-CR,11 June 1971). “The only rational explanation for that lamentable aberratio ictus or error en la persona is that, inasmuch as the stabbing was perpetrated at night, the inebriated assailants mistakenly assumed that Metucua, whom they had intended to kill, and who was not a pedicab driver, was the person inside the sidecar (for the passenger) and that Candel, a pedicab driver, was the person on the driver’s seat of the pedicab. As previously recounted, Candel, who must have been drunk, was the one inside the sidecar while Metucua was on the driver’s seat.” (THE PEOPLE OF THE PHILIPPINES vs. WARLITO PLATEROS Y CALATRAVA, alias BABIE, and MURILLO LAHOY Y BUENO, alias BOY, G.R. No. L-37162, May 30, 1978). “For the killing of Teotimo Fameronag, the same cannot be said to be accidental as it was the result of an aberratio ictus, or miscarriage of the blow.” (PEOPLE OF THE PHILIPPINES vs. LEONITO MACAGALING y ATILLANO, G.R. Nos. 109131-33, October 3, 1994). Also refer to ERROR IN PERSONA. ABNEGATION Denial, a renunciation, self-denial (People vs. Bacalso, 3159-R, 30 September 1950). ABREACTION Relieving of suppressed emotion as by talking about it (People vs. Valdemoro, 16159-CR, 30 July 1979). See also RES GESTAE — equivocal act, RES IPSA LOQUITUR — the act speaks for itself, and ABREACTION — relieving suppressed emotions. -
