Agency Worker Regulations (AWR) Non-compliance can result in a penalty to the value of up to 2 weeks pay per worker.

National Minimum Wage (NMW) Non-compliance can result in employers facing civil and criminal prosecution and fines to the value of up to £20,000 per worker.
Datum ensure that all hiring managers and agencies are aware of the current NMW and any legislative changes to secure the required rates for vacancies, placements and offers.
Off Payroll working rules (IR35) Non-compliance can result in a variety of penalty fines including backdated payment of Tax, National Insurance contributions and potentially interest on these values.
Datum to work with CBRE People team, Talen team and hiring manager to ensure full assessment & determination complete by April 2021 with subsequent process implementation to follow. Right to Work (RTW) The legal requirement to check each worker’s legal right to work. Non- compliance can result in up to 5 years imprisonment and civil fines of up to £20,000 for each illegal worker, with unlimited fine potential depending on the circumstances.
Datum ensure that all workers have a valid RTW prior to any offer being issued. Supplier Audits Agencies supplying workers through the Datum programme are audited on a regular basis ensuring legislative and operational compliance. Remedial actions imposed as and when required.
Contract Management Supplier agreements are held between Datum and the Agencies in the programme, managed to ensure Terms are standardised in line with CBRE requirements. Datum has principal contract status to further protect CBRE Cost Savings
Compliance Risk Mitigation
Temp-to-Perm worker transfer After 14 weeks of transacted timesheets a worker can be transferred from a temporary assignment to a permanent staff role with £0 fee. Speak to the Datum support team to find out if a worker qualifies or for any further details.
Pay Rate Management Pay Rates and specifically overpayment can be managed through consulting with the Datum team to understand average rates for commonly placed roles.
14 weeks+ worker migration to Datum payroll If you want to retain an agency worker on a temporary assignment after 14 weeks of transacted timesheets they can be transferred from an agency contract to the Datum payroll service £0 fee. Offering a reduction in final charge rate. Speak to the Datum support team to find out if a worker qualifies or for any further details. Ad-Hoc and additional saving opportunities If there's a need to capture additional costs savings Datum can support the analysis of the current temp work force and potentially identify initiatives that, with your support, they can implement to reduce existing charge rates.
Something to note Although costs are important, it’s worth knowing that some suppliers suggest that when clients continue to pay temporary workers National Minimum Wage (NMW) it results in a higher volume of attrition and potentially lower quality of work. Through the delivery of the programme and management of the approved PSL agencies Datum provides improved visibility of activity, cost savings, compliance and improved performance.
Datum and CBRE worked in partnership to rationalise the supply chain in order to drive a closer working relationship with the top performing agencies. This involved a tender, audit and comprehensive review of all agencies; resulting in a carefully selected list of partners based on performance, market presence, sector experience, geographic coverage and capability.
The rationalised supply chain came into effect in January 2020, YTD 98% of temporary vacancies have been fulfilled using the selected Tier 1 PSL agencies.
Using the Datum RPO Programme
An integral part of the Datum RPO programme is the Portal. This platform is used to raise vacancies, receive candidate submissions, select successful candidates and upload POs to support assignments. The portal is also where Datum will complete the offer, compliance and on-boarding process.
Once a candidate is on-boarded and joins you in the workplace the portal is also where timesheets are completed and authorised. The information input at the point of timesheet approval is what populates Datum’s invoices, therefore it’s important this is correct to ensure invoices are accepted and paid.
