(ZEROS) Wednesday, September 23, 2009 HEROES The CCHR Welcomes The Acquittal Of Ho Vann Cambodian Center for Human Rights Press Release Phnom Penh: 23 September 2009 _________ THE CCHR WELCOMES THE ACQUITTAL OF HO VANN open in browser customize free license contest pdfcrowd.com The Cambodian Center for Human Rights (CCHR) welcomes the decision by Judge Sin Visal of the Phnom Penh Court of First Instance to dismiss the charge of defamation against Sam Rainsy Party lawmaker Ho Vann, arising from a complaint made by 22 officers of the Royal Cambodian Armed Forces. In his verdict on 22 September 2009 Judge Sin Visal stated that there was insufficient evidence to convict Ho Vann of the defamation charge. The CCHR commends this decision which can perhaps be viewed as the green shoots of judicial independence in Cambodia. Such progress is very welcome. The CCHR recalls that Cambodia Law provides that Ho Vann’s parliamentary immunity will be automatically restored. The CCHR is concerned with the fines imposed against Neou Vannarin and Kevin Doyle of the Cambodia Daily, and urges the Cambodian judiciary to respect freedom of expression. The CCHR calls on Judge Thor Saran to clarify his recent comments in relation to charges against Mr. Pen and to explain his role in the removal of the provincial coordinator from Ratanakiri. The CCHR is concerned that the case of Pen Bonnar represents evidence of a practice in Cambodia whereby the threat of legal charges is used to silence the voices of human rights activists and to curtail freedom of expression. The removal of Mr. Pen from Ratanakiri follows an extrajudicial and ultra vires request by Judge Thor to the administration of ADHOC that they remove Mr. Pen from the Province. In so doing, Judge Thor advised, ADHOC would remove Mr. Pen from the jurisdiction of the Provincial Municipal Court of Ratanakiri thereby ensuring that charges of incitement against him would be dropped; “it is easy to end the case and the court can compromise, drop his case and avoid [his] detention”.     Cambodia Page 1 of 20 Cambodia Country Reports on Human Rights Practices - 2006 Released by the Bureau of Democracy, Human Rights, and Labor March 6, 2007 Cambodia is a constitutional monarchy with an elected government and a population of approximately 13.8 million. Following elections in 2003, in 2004 the Cambodian People's Party (CPP), led by Prime Minister Hun Sen, and the National United Front for a Neutral, Peaceful, Cooperative, and Independent Cambodia (FUNCINPEC), led by Prince Norodom Ranariddh, formed a coalition government. However, the CPP dominated the three branches of government and other national institutions, with most power concentrated in the hands of the prime minister. Although the civilian authorities nominally controlled the security forces, in practice security forces answered to the CPP leadership. The government's human rights record remained poor. Government agents committed extrajudicial killings, and security forces acted with impunity. There was little political will to address the failure by government authorities to adhere to the rule of law. Detainees were abused, often to extract confessions, and prison conditions were harsh. Human rights monitors reported arbitrary arrests and prolonged pretrial detention, underscoring a weak judiciary and denial of the right to a fair trial. Land disputes and forced evictions, often accompanied by violence, were a growing problem. The government restricted freedom of speech and press through the use of defamation and disinformation suits, controlled or influenced the content of television and radio broadcasts, and sometimes interfered with freedom of assembly. Corruption was endemic and extended throughout all segments of society, including the executive, legislative, and judicial branches of government.

Pursuant to United Nations (UN) Human Rights Council resolution 5/1, which provides for the participation of civil society in the Universal Periodic Review (UPR) process, we - a coalition of non-governmental organizations (NGOs)1, coordinated by the Alliance for Freedom of Expression in Cambodia (AFEC) and assisted by the Asian Legal Resource Centre (ALRC) - make this joint submission on freedom of expression and assembly in Cambodia to the Office of the High Commissioner for Human Rights (OHCHR) in Geneva for inclusion in its summary of stakeholder information. 2. Cambodia has a variety of human rights obligations in respect of the rights to freedom of expression and assembly. The Royal Government of Cambodia (the “Government”) has engaged with some international human rights mechanisms but not with others, whist the current national human rights infrastructure is seriously flawed. The last four years have seen freedom of expression and assembly seriously undermined with opinion restricted, parliamentarians silenced, the media controlled, access to information blocked, and assembly and public demonstration prevented. The Government has breached its international and constitutional human rights obligations, and has relied on national legislation which itself breaches these obligations. Our recommendations for improving respect for freedom of expression and assembly include ratification of the First Protocol of the International Covenant on Civil and Political Rights; the establishment of an independent national human rights body; and a series of legislative reforms.

Since its establishment in 1992, LICADHO has been at the forefront of efforts to protect civil and political and economic and social rights in Cambodia and to promote respect for them by the Cambodian government and institutions. Building on its past achievements, LICADHO continues to be an advocate for the Cambodian people and a monitor of the government through wide ranging human rights programs from its main office in Phnom Penh and 12 provincial offices. LICADHO pursues its activities through two program departments: Department of Monitoring and Protection: Monitoring of State Violations and Women’s and Children’s Rights: monitors collect and investigate human rights violations perpetrated by the State and violations made against women and children. Victims are provided assistance through interventions with local authorities and court officials. Paralegal and Legal Representation: victims are provided legal advice by a paralegal team and in key cases legal representation by human rights lawyers. Prison Monitoring: researchers monitor 18 prisons to assess prison conditions and ensure that pre-trial detainees have access to legal representation. Medical Assistance: a medical team provides medical assistance to prisoners and prison officials in 12 prisons and victims of human rights violations. Department of Communication and Advocacy: Training and Education: advocates raise awareness to specific target groups, support protection networks at the grassroots level and advocate for social and legal changes with women and youths.
