He earned a Bachelor's Degree from Phillips University, Enid, Oklahoma; a Master's Degree in Economics from Atlanta University, Atlanta, Georgia; and studied Law at Oklahoma University. While servmg m the United States of America Air Force, i1 1 i1 ' 1J ill il ' (YAHWEH BEN YAHWEH) earned the rank of captain and served as a tactical instructor. His tours of duty were done in California and Texas. He is an honorably discharged veteran. il 1il' 13 i1 1il' (YAHWEH BEN YAHWEH) came to Miami, Florida, alone in 1979 to become the Spiritual Leader and Founder of the Nation of illil' (YAHWEH). Although He took a vow of poverty that same year, within 12 years He guided the Nation and those who followed His teachings and principles to amass an economic empire in Miami and throughout the United States worth over $250 million. It began with an illegal raid against all Yahweh properties nationwide in which doors were forcefully broken down, innocent men, women, and children were handcuffed and paraded around like cattle, and members were arrested wholesale-- all without presenting a single search warrant or arrest warrant. The persecution continued in prison where il1il' [3 il1il' (YAHWEH BEN YAHWEH) and seventeen of his followers remain on trumped up charges. The abuses range from being placed in solitary confinement for several weeks to outright denial of emergency medical treatment. Their persecution has even found its way to the courtroom where bail has been categorically denied because of their common belief, and a fair trial will probably never take place. This publication is meant to illuminate the righteous people of the Earth to the daily atrocities that continue even as you read these pages. You must be properly informed about this struggle of good and evil. The future of the world depends upon it. • XI The Persecution of il 1 il., 1J il 1 il ., Volume One ~S.GOVERNAIENTPERSECUTES illil} lJ illil} IN JAIL - In an effort to persecute il 1il' [3 il 1il' (YAHWEH BEN YAHWEH) and 13 of his followers, the U.S. Government has placed them in inhumane living conditions. il 1il' [3 il 1il' (YAHWEH BEN YAHWEH's) religious rights and human rights have been violated and totally ignored. All of the members of the Nation of ll 1 il ., (YAHWEH) have been separated and placed in different cells. Several members, including il 1il' [3 il 1il' (YAHWEH BEN YAHWEH), have been placed in solitary confinement for no reason. No one has ever been placed in solitary confinement upon his arrival without provocation. il 1il' [3 il 1il' (YAHWEH BEN YAHWEH) and his followers have their meals shoved under a door. These meals, barely fit for animal consumption, let alone human consumption, are entirely different from the "vegetarian meals" stated by the Government officials in the media. No facilities or materials have been provided for il 1 il ., [3 il 1 il ., (YAHWEH BEN YAHWEH) to bathe daily or even for him to brush his teeth. The lack of basic 1 The Persecution of il 1 il., 13 il 1 il., Volume One living necessities is not due to the inability of the Government to provide these items. If that were the case, then why won't the Government allow ill il ' 13 ill il ' (YAHWEH BEN YAHWEH's) followers to supply him with these items? In addition, illil' 13 illil' (YAHWEH BEN YAHWEH) is only allowed to go outside in the fresh air for one hour a day, while other convicted prisoners roam outside on the prison grounds all day long. During transit from the jail to the courthouse and back, ill il ' 13 ill il ' (YAHWEH BEN YAHWEH) was treated roughly by the guards which bruised his wrists. Other members were treated in similar a manner. His cultural attire, dictated by the Holy Bible, has been taken from him and replaced with worn, ragged uniforms. Though ousted Panamanian President Manuel Noriega has been allowed to wear his military uniform, ill il' 13 ill il' (YAHWEH BEN YAHWEH) has not been granted a similar privilege. Even former member Robert Rozier has been allowed to wear his white cultural attire, both in prison and in court, even after he claimed he was no longer affiliated with the Nation of il 1il ., (YAHWEH). Yet, illil' 13 illil' (YAHWEH BEN YAHWEH) and his followers are being denied the right of freedom of religious expression. 2 The Persecution of i1 1 il" '7 3 i1 1 il" Volume One il1il' 13 il1il' (YAHWEH BEN YAHWEH) is being denied his freedom of the press. Freedom of the press, while giving the media the right to report the news in a responsible manner, also gives citizens the right to hear these reports. The U.S. government has, in effect, instituted a total censorship of all news going to il1 il ., ?3 il1 il ., (YAHWEH BEN YAHWEH) and his followers, including news pertaining to their trial. il1 il ., ?3 ill il ., (YAHWEH BEN YAHWEH) and his followers have not been allowed to read newspapers, hear the news on the radio, or see the news on TV, since being arrested November 7, 1990. Several of the members of the Nation of il 111 ., (YAHWEH) have already been denied bond, and the prosecution plans to ask for the same for all. The U.S. government is not considering the fact that all of the members of the Nation of il111 ., (YAHWEH) are responsible citizens with jobs and families. Though the Government claims that they are "threats to society," this is pure speculation pending the outcome of this trial. The indictments, which are all based on the testimony of a few questionable sources, should not serve as a reason for denial of bond. Why is it that William Lozano was able to be out on bond during his hearing even though it was an established fact that he killed two innocent people? Why is it that William Lozano is still out on bond as he appeals his conviction of second degree manslaughter? Just as he has a family and children, and has had a respectable job .. 3 .. The Persecution of n ln., [3 n ln., Volume One in the community for years, members of the Nation of il1 il" (YAHWEH) fall in these same categories. The very fact that the most recent allegation is over four years old, proves that these members do not pose any threat to the community. There is absolutely no reason for this inhumane treatment of one of the most re spected national leaders of our people. When the U. S. government terrorized il1il' 13 il1il' (YAHWEH BEN YAHWEH) and other members of the Nation of il1il" (YAHWEH) on November 7, 1990, with an extraordinary display of force and firepower, il1il' r:::1 illil" (YAHWEH BEN YAHWEH) and all his followers gave the authorities full cooperation. During the entire time that il1il" 13 il lil" (YAHWEH BEN YAHWEH) and his followers have been detained in jail, they have been role models in the display of their conduct. Not one incident of disorderly conduct in the slightest has emerged as a result of these unjust arrests. Yet, the Government has not given il1il" 13 il1il' (YAHWEH BEN YAHWEH) proper treatment afforded someone of his prominence. They have not even treated ill il., 13 il lil' (YAHWEH BEN YAHWEH) and his followers as they would treat ordinary citizens who have been arrested. Instead, they have elected to deal with il1il' 13 il1il" (YAHWEH BEN YAHWEH) and his followers in the worst way possible, even disregarding their own constitutional rights whenever inconvenienced. The Government has not been provoked to act in such a manner. The Government 4 The Persecution of illil' 73 illil' Volume One has not even offered any justification for such harsh treatment. The Government cannot even claim that they are treating il1il' 73 il1il' (YAHWEH BEN YAHWEH) in the regular manner. What the U.S. government is doing is tantamount to persecution of il1 il ' 73 il 1 il ' (YAHWEH BEN YAHWEH) and his followers because of their religious beliefs or their nationality or both. • .. 5 r The Persecution of il 1 iP 1:::1 il 1 il" Volume One FBI TERRORIZES INNOCENT FOLLOWERS OF il 1 il ; NATIONWIDE - On November 7, 1990, the FBI conducted a pre-dawn terroristic attack against innocent followers of lllll"' (YAHWEH) nationwide. FBI agents, SWAT team members, DEA agents, and local police joined forces in a heavily armed illegal invasion, seeking to provoke members of the Nation of ll lll ., (YAHWEH) and looking for an excuse to do them harm. The FBI was sorely disappointed as they found no weapons, and were met with full cooperation. In New Orleans, il 111" 1:::1 lllll' (YAHWEH BEN YAHWEH), the Spiritual Leader of the Nation of illll"' (YAHWEH), was forcefully apprehended by dozens of FBI agents. Contrary to their press release, FBI agents stormed into his quarters at 3:30 in the morning. Although no resistance was offered, and no weapons of any kind were found on the premises, pump shotguns, M-16s, and a variety of handguns were pointed at his head, neck, heart, and other vital organs. Because it was in the early 6 The Persecution of il 1 il., r3 il 1 il., Volume One morning, il1il' [3 il1il' (YAHWEH BEN YAHWEH) was not dressed. The FBI threatened to take him into custody without any clothes on before finally giving him just a bathrobe to put on. After taking il1il' [3 il1il' (YAHWEH BEN YAHWEH) into custody, the FBI proceeded to strip-search him. In Miami, over 300 FBI agents, SWAT team members, DEA agents, and local police participated in an illegal guerrilla invasion of the holy Temple and other properties. At the Temple, doors were battered down and windows were broken unnecessarily as FBI agents forced their way in, without a search warrant or arrest warrants. All the men on the premises were arrested without a warrant or probable cause. Defenseless women and children were taken into the streets with guns pointed to their heads, made to lie down in the street with their faces to the ground, and their hands cuffed behind their backs. The women and female children were searched thoroughly by agents out in the open. Their holy headdresses were then removed out in the public. All of the agents participating in this terrorist attack carried automatic weapons and hand grenades; yet not a single weapon was found in the sanctuary or on any Yahweh members. The FBI proceeded to break down office doors (many of them were unlocked) all over the building. Offices were ransacked and left in total disarray while the FBI carted off materials. At no time did the FBI ask that any of the offices be opened. 7 • The Persecution of il 1 il" 73 il 1 il" Volume One At no time did the FBI present a warrant for any materials, or even ask for these materials. What they did was commit strong arm robbery inside the temple, and felt justified because they wore a badge. As Yahweh buses were coming to daily morning prayer service, the drivers were asked to pull over, and all males aboard the bus were arrested and taken into custody, again without a warrant or probable cause. At Yahweh apartment buildings, which house both members and non-members, FBI agents encircled the buildings and busted into apartments. Again the agents were heavily armed, BUT FOUND NO WEAPONS OR RESISTANCE. The tenants were forced out of their apartments in the middle of the night in their underwear. Children were threatened at gunpoint, and were threatened with arrest. The FBI even threatened to shoot tear-gas into apartments with innocent infants and toddlers inside. Again, this took place without a search warrant or an arrest warrant. Outside of New Orleans, a bus load of members were traveling to a speaking engagement. The bus was pulled off to the side of the road, and FBI agents approached the windows with heavy artillery. All aboard were made to crawl along side the bus and along the highway as oncoming traffic passed by. All of the men were arrested without a warrant or probable cause. The women and children were made to lie face down on the highway with their hands cuffed behind their backs, and 8 The Persecution of i1 lil"> 13 i1 lil"> Volume One then their headdresses were removed in the open in a most humiliating fashion. Then women and female teenagers were thoroughly hand searched by male agents in the open. Again, NO WEAPONS OF ANY KIND WERE FOUND. The men who were arrested outside of New Orleans were strip searched and separated. After this nationwide terrorist attack on the Nation of ill il" (YAHWEH), the media, who in collusion with the FBI, proceeded to harass Yahweh members, tenants at their apartments, children in their school, patrons in their stores, and guests in their hotels. They were asked questions in such a way as to demoralized members. Though the media interviewed people in the community and found overwhelming support for the Nation of illil" (YAHWEH), their positive responses wound up on the floor of the editing room. This terroristic raid was the culmination of a federal investigation that spanned several months. During this investigation, ill il ., 13 ill il ., (YAHWEH BEN YAHWEH) and other members were asked to appear before the Grand Jury several times. Each time, the Nation of ill il" (YAHWEH) cooperated without hesitation. illil" 13 illil" (YAHWEH BEN YAHWEH) even notified officials that if they were to issue a warrant for his arrest or the arrest of other members, he and his followers would voluntarily and peacefully surrender. A spokesperson for the Nation of il 1 il ., (YAHWEH) stated, "The reason we have willfully cooperated in the past and agreed 9 , The Persecution of il 1 il" 13 il 1 il" Volume One to do so in the future is that we know we are innocent of all charges. il 1 il ' 13 il 1 il ' (YAHWEH BEN YAHWEH) is totally innocent of these allegations, which are nothing more than trumped up charges." il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) has taught people for over 10 years that they do not have to carry weapons to defend themselves. No weapons have ever been found on Temple grounds or on any of the Yahweh properties. In fact, they do not even allow visitors to "defile the Temple" by bringing in weapons. ill il' 13 ill il ' (YAHWEH BEN YAHWEH) teaches and demands the practice of moral behavior which means to be a law-abiding citizen by choice. The Nation of il 1 il ., (YAHWEH) has an unblemished record of cooperation with law enforcement officials whenever called upon. There is no justification for terrorizing women and children. There is no justification for raiding defenseless properties with enough firepower to devastate a small country. There is no justification for suspending constitutional rights with this forceful invasion without a warrant. There is no justification for vandalizing the Yahwehs' holy temple and stealing their items. The FBI, by conducting this nationwide terrorist attack, has revealed its diabolical plans. The purpose of this raid was not to arrest ill il ' 13 il 1 il ' (YAHWEH BEN 10 The Persecution of n ln., 13 n ln., Volume One YAHWEH) and other members of the Nation of il1il' (YAHWEH) and bring them to trial concerning various allegations, but, rather, the purpose was to try to destroy the Nation of il1 il ' (YAHWEH) because it stands as a role model of economic empowerment and independence for our people. The evil plans of the FBI are to try to destroy the good works that il1 i1 ' ?3 i11 i1 ' (YAHWEH BEN YAHWEH) has done for our people. The wicked plans of the FBI are to try to separate the Nation of il1 il ., (YAHWEH) from the rest of OUF people. ~ But try as they may, they cannot separate us, because we are family: though members of the Nation of il1 il., (YAHWEH) may have different beliefs from others in our community, we are still one family -- we are all brothers and sisters. The works of il1i1' ?3 i11i1' (YAHWEH BEN YAHWEH) prove this. All of their grocery stores offer "First Rate Goods" and "First Rate Services" at "First Rate Prices," to all members of the community regardless of belief or nationality. All of the Yahweh apartments offer a clean, safe, affordable, drug-free, crime-free, family environment to all, regardless of belief or nationality. All of their hotels and motels offer luxurious accommodations with the spirit of hospitality shown to all, regardless of belief or nationality. According to his disciples, "il1il' ?3 i11i1' (YAHWEH BEN YAHWEH) has instilled in us an undying love for our people, and this love is manifested in all of 11 • The Persecution of il 1 il ., 73 il 1 il"' Volume One our businesses-- this is what our enemies are trying to destroy. They do not want us to show love to our people because they know it might just catch on. Once this love catches on among our people, our enemies know that their days of manipulating and exploiting our community are over." The plans that the FBI are executing on il 1il ' 13 il1 il ' (YAHWEH BEN YAHWEH) and the Nation of illil' (YAHWEH) are signs of what they plan to do to every man in our community that stands for good. This is just step two and phase one of their wicked plans. The FBI plans to shut down all Black men that are doing good. What they are doing to il1 il ' 13 il1 il ' (YAHWEH BEN YAHWEH) is a perfect example of what they plan to do to all of our leaders. "Greater love hath no man than this, that a man lay down his life for his friends." il 1il' 13 il1il' (YAHWEH BEN YAHWEH) has laid down his life by dedicating his entire existence to our happiness. il1il' 13 il1il' (YAHWEH BEN YAHWEH) is the true public servant, because in all that he has done for our people, he has never ~' taken a salary. His reward is in making this world a better place for all the good people of the Earth. This is the price you sometimes have to pay for doing good. It is because of this undying love for our people that the Government has chosen to attack il1il' 13 il1il' (YAHWEH BEN YAHWEH). For more information concerning this book, see the order form inside this magazine. • _) 13 The Persecution of il 1il., 73 il 1il ., Volume One U.S. GOVERNMENT CONTINUES PRE-TRIAL PERSECUTION OF illilj jJ illilj - The U.S. Government continues to persecute il 1il' jJ il 1il' (YAHWEH BEN YAHWEH) and several of his followers by imposing starvation upon them. All this is being done while the U.S. Government continues to ignore its own laws. The First Amendment guarantees the right to freedom of religion. Thus, all American citizens are free to worship God as they please. This includes the right to a Kosher diet as prescribed by the God of the Bible in Leviticus, Chapter 11 and Deuteronomy, Chapter 14. According to the Second Edition of Florida Jurisprudence § 37, "The lack of reasonable opportunities to exercise religious freedof constitutes a violation of the First Amendment including the disallowance of any special diet for persons whose religion imposes dietary restrictions." This law references Miller v. Carson which stated that "Restrictions in religious freedom that existed in a county jail deprived pre-trial detainees of their rights under the First and Fourteenth Amendments to the U.S. Constitution, and an injunction would be issued where persons whose religion imposed dietary restrictions were not allowed any 14 The Persecution of i1 1 i1 ., 73 i1 1 il" Volume One special diet where pork was served as a main dish or used in seasoning other dishes in virtually all meals." On July 18, 1986, U.S. District Court Judge Sidney Aronovitz ordered the Florida Department of Corrections to allow members of the Nation of il 1 il ., (YAHWEH) to have a pork-free diet. Judge Aronovitz stated that members of the Nation of il1 il ., (YAHWEH) must "be afforded the same opportunities to worship as other prisoners." The U.S. Government has already established in the Code of Federal Regulations (CFR) rules and regulations which dictate how inmates, both convicts and pre-trial detainees, are to be treated during their stay at any Federal Prison. According to 28 CFR Ch. V (7-1-90 Edition)§ 548.13(a), "An inmate who wishes to observe religious dietary laws will be provided a diet which meets or exceeds recommended daily ) allowances ... and which complies with religious dietary laws ..." After a public request for Kosher meals was made, Charles Davis, Assistant Warden of the Metropolitan Correctional Center, gave an interview to WCIX, Channel 6 of Miami on Tuesday, November 20, 1990. Davis stated that the request for Kosher meals had been granted. However, sources reveal that il1il' 13 il1il' (YAHWEH BEN YAHWEH) and his followers are still not being served Kosher meals. In fact, out of the 63 meals that were supposed to have been given to il1il' 13 il1il' (YAHWEH " 15 The Persecution of il 1 il ., [ 3 il 1 il ., Volume One BEN YAHWEH) during his first three weeks in the prison, only 21 meals have been .. delivered, and most of these 21 meals were not Kosher . According to a statement by il1il' 13 il1il' (YAHWEH BEN YAHWEH), "Officials admit that they have Kosher meals for all white Jews; yet, I am absolutely denied the same privilege. I have gone through due process by completing the necessary ( CO POUT form. I was then promised Kosher meals and officials said My request had been approved. Yet, I was denied these kosher meals. Prison officials have attempted to deceive Me by putting 'K' on my take-out plate, but when compared to the 'unkosher' meals of the other inmates, My meals are identical to theirs. I have been given plates after pork has been taken off of them. If it were not for some inmates occasionally giving Me an apple, lettuce and tomato salad, and oranges, I would soon be hospitalized for malnutrition and starvation. Only My evening meals are classified as Kosher, and even those are served with meat. I am a Kosher Vegetarian!" Other examples of this cruel treatment include: • Since being detained, il1il' 13 il1il' (YAHWEH BEN YAHWEH) has been forced to drink water from the same line as the toilet. • On Sunday, November 18, 1990, il1il' 13 il1il' (YAHWEH BEN YAHWEH) was denied Kosher meals and forced to eat only two grapefruits. 16 The Persecution of il 1 il., 13 il 1 il., Volume One • On Sunday, November 24, 1990, il1il' 13 il1il' (YAHWEH BEN YAHWEH) was denied fresh air, recreation time, two Kosher meals, and showers, while other inmates were permitted to take showers. Thus, the U.S. Government is imposing starvation upon il1il' 13 il1il' (YAHWEH BEN YAHWEH). In addition to the illegal withholding of Kosher meals, the U.S. Government has also chosen to ignore and violate its own established rules and regulations: 28 CFR Ch. V § 540.42(a) states that - - "At a minimum, the Warden shall establish visiting hours at the institution on Saturdays, Sundays, and holidays." It further states in § 540.50( c) that "Staff may not suspend an inmate's visiting privileges because of violation of Bureau regulations other than for those specifically concerned with the visiting guidelines or having a reasonable relationship to the orderliness or security of the visiting room." Yet, in the case of il1il' 13 il1il' (YAHWEH BEN YAHWEH), a pre-trial detainee who has not violated any Bureau regulations whatsoever, he has been limited to two visits a month. This is clearly in violation of Federal regulations, and this violation has not been imposed on anyone else but illil' 13 illil' (YAHWEH BEN YAHWEH) and some of his followers. In 28 CFR Ch V § 540.51(g)(3), "The Warden may allow a visitor to leave money with a designated staff member for deposit in the inmate's commissary account." '-- 17 • The Persecution of il 1 il ., 73 il 1 n., Volume One However, when i11il' 1:::1 il1il' (YAHWEH BEN YAHWEH's) attorney attempted to leave money for him in his commissary account, his attorney was told that the money order had to be mailed in. Again, this is totally inconsistent with federal regulations. In 28 CPR 540.71(a), it states that "An inmate may receive other soft-cover material (for example, paperback books, newspaper clippings, or magazines) from any source." Yet, Bibles (King James Version) and other paperback books sent to il1il' 73 il1 il ., (YAHWEH BEN YAHWEH) and his followers were rejected and returned. Even Judge Aronovitz in his 1986 ruling stated that religious books published by the Temple of Love, Inc. were to be allowed into all state penal institutions, and to deny their admission was a violation of the First Amendment. Paragraph (b) further states that "The Warden may not reject a publication solely because its content is religious ..." So again, we have a clear violation of federal regulations. The only inmates who are being denied access to the Holy Bible are members of the Nation of il 1il j (YAHWEH). According to 28 CPR Ch. V § 541.11, "[The Bureau of Prison] Staff shall advise each inmate in writing promptly after arrival at an institution of the inmate's rights and responsibilities." To this date, this has not been done in the case of il1il' 73 18 The Persecution of il 1 il ., 1:::1 il 1 il ., Volume One il1il' (YAHWEH BEN YAHWEH) and his followers. Other rights which have been violated include: • The right to be treated respectfully, impartially, and fairly by all personnel. • The right to be informed of the rules, procedures, and schedules concerning the operation of the institution. • The right to freedom of religious affiliation, and voluntary religious worship. • The right to health care, which includes nutritional meals, proper bedding and clothing, ... an opportunity to shower regularly. • The right to participate in the use of the law library reference materials. Judge Aronovitz also ruled "to allow all requesting inmate members of the class the opportunity to wear religious headdresses during formal worship services." It also states in 28 CFR Ch. V § 548.12(f) that "An inmate ordinarily shall be allowed to wear or use personal religious items during devotional services. Upon request of the inmate, the Warden may allow an inmate to wear or use personal religious items within the institution." However, il lil' 13 il1il' (YAHWEH BEN YAHWEH) and his followers have not been afforded the opportunity to wear their religious attire. Regulation§ 551.118(c) goes on to state that an inmate may supply his own clothing during court appearances. Page 23 of the Metropolitan Correction Center Manual allows for the use of civilian clothes while involved in court proceedings for pre-trial 19 The Persecution of il 1 il" 73 il 1 il" Volume One detainees. Again, however, il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) and his followers have not been allowed to wear their cultural attire in the courtroom. As stated in 28 CFR Ch. V. § 540.2l(b ), "Writing paper and envelopes are provided at no cost to the inmate." Paragraph (i) further states, "Holdovers and pre-trial commitments will be provided a reasonable number of stamps for the mailing of letters at the Government's expense." However, il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) has been denied envelopes, writing paper, stamps, and pencils. il 1 il ., 13 il 1 il ., (YAHWEH BEN YAHWEH) has been denied toothpaste, toiletries, and deodorant. He has also been denied emery boards and nail clippers to repair two badly torn fingernails. Yet, 28 CFR Ch. V. § 551.103(a)(7)(i) requires, "Provision of personal hygiene to include -- issue of personal hygiene items." On Saturday, November 17, 1990, Officer Croon denied il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) phone accessibility to call his lawyer. In fact, calls to his lawyer are routinely denied. When il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) is allowed to talk to his legal counsel, the phone is constantly taken away in the midst of their conversation. Nevertheless, 28 CFR Ch. V. § 551.117(c) states, "[Prison Bureau] Staff shall allow the pre-trial inmate, upon his request, to telephone his attorney." 20 The Persecution of il 1 il ~ 13 il 1 il ~ Volume One And § 540.102 further states, "The Warden may not apply frequency limitations on inmate telephone calls to attorneys ..." il 1il ., 13 it 1 it ., (YAHWEH BEN YAHWEH) is handcuffed behind his back whenever he has to go 10 feet to the shower in a cage, 20 feet to a 12 x 12 cage to get air for one hour, or to the visitation room. When it 1 it' 13 it 1 it' (YAHWEH BEN YAHWEH) goes to the visitation room, he is strip-searched, which involves looking at every intimate inch of his body. This happens prior to every visit with his lawyer. "Convicted" felons do not have to go through this process and are allowed to move freely over the entire compound. However, in the case of United States v. Lilly, it was ruled that "Visual inspections of the anal and genital cavities were humiliating and of little utility, and are therefore unreasonable on this record under the Fourth Amendment. Detainees, as well as convicted inmates, retain the Fourth Amendment protection requiring that searches of person or property be reasonable under the circumstances of imprisonment." No form has been given to it1 il ., 13 it1 it ., (YAHWEH BEN YAHWEH) to desig nate his selected visitors. However, 28 CFR Ch. V. § 540.51(b )(1) states, "[Prison Bureau] Staff shall ask each inmate to submit during the admission orientation process a list of proposed visitors." 21 The Persecution of il 1 il ., 73 il 1 il ., Volume One il 1il' (3 il 1il' (YAHWEH BEN YAHWEH) has been kept in a LOCK-DOWN HOLE (the public has been told he was in Segregation) reserved for problem inmates. illil' 13 illil' (YAHWEH BEN YAHWEH) has not committed nor been convicted of a crime, neither is there a record of him causing any problems since being detained. Prison officials have stated that ill il ' 13 ill il ' (YAHWEH BEN YAHWEH) is being held in "Administrative Detention." Administrative Detention is defined in 28 CFR Ch. V. §541.22 as "the status of confinement of an inmate in a special housing unit either by self or with other inmates which serves to remove the inmate from the general population." Paragraph (b) further states that "The Warden shall prepare a memorandum detailing the reasons for placing an inmate in administrative detention, with a copy given to the inmate . . . Staff shall deliver this memorandum to the inmate within 24 hours of the inmate's placement in administrative detention." Paragraph (c) adds, "The Segregation Review Official (SRO) shall conduct a record review within three work days of the inmate's placement in administrative detention and shall hold a hearing and formal- ly review the status of each inmate who spends seven continuous days in administra-tive detention ... The inmate appears before the SRO at the hearing." On November 11, 1990, illil' 13 illil' (YAHWEH BEN YAHWEH) was transferred to the Metropolitan Correctional Center and immediately place in Administrative Detention. He was not notified by memorandum of this 22 The Persecution of il 1 il" 73 il 1 il ., Volume One status until November 26, 1990. As of this date, he has not received a hearing. Paragraph (d) goes on to state that," ... the Warden shall give an inmate housed in administrative detention the same general privileges given to inmates in the general population. This includes, but is not limited to, providing any inmate with the opportunity for participation in education programs, library services, social services, counseling, religious guidance, and recreation." Yet, ill il' ?::I ill il' (YAHWEH BEN YAHWEH) has not been afforded these opportunities. In fact, illil' 13 illil' (YAHWEH BEN YAHWEH) has been denied visits with the chaplain, rabbi, his assigned counselor, and unit management. ill il ' 13 ill il ' (YAHWEH BEN YAHWEH) has been denied the freedom of the press which includes the right to be informed of the news through newspapers. Based on 28 CFR Ch. V. § 540.70(a), "The Bureau of Prison permits an inmate to subscribe to or to receive publications without prior approval . . . The term publication in this rule means a book, or a single issue of a magazine or newspaper." And § 540.71(a) further states that this material may be received "from any source." Regulation§ 544.10l(b) adds, "The inmate library shall offer an inmate a variety of reading materials, including, but not limited to periodicals, newspapers ... and reference books." 23 The Persecution of il 1 il ., 7:::1 il 1il" Volume One The continued persecution of il1 il ., 13 il1 il ., (YAHWEH BEN YAHWEH) is not merely limited to the deprivation of his rights, but also extends to physical abuse as well. Since being detained, il1il' 13 il1il' (YAHWEH BEN YAHWEH) has con- tracted a serious cold because the facilities he is being housed in are set at freezing temperatures, and the blankets are too short. His condition has developed to the point where he is coughing blood. On Thursday, November 15, 1990, il1il' 13 il1il' (YAHWEH BEN YAHWEH) was required to go to the hospital without his request or permission. He was given two shots without his request or permission. He was later told that the two shots were a tetanus shot and a TB vaccine. Also, two vials of blood were taken, and he was also given chest X-rays without his permission. On Friday, November 16, 1990, il1il' 13 il1il' (YAHWEH BEN YAHWEH) was taken back to the hospital for a "SMAC TEST," again without his permission. During his detention, an officer bruised il 1il ., 13 il1 il ., (YAHWEH BEN YAHWEH's) wrists by placing his handcuffs on too tightly and handling him too roughly, causing a major vein to have a bubble swelling, which could cause a dangerous hemorrhage. There is no excuse or reason for this inhumane treatment! All of these actions lead to the inevitable conclusion that il 1 il ., 13 il1 il ., 24 The Persecution of il lil' 73 il lil' Volume One (YAHWEH BEN YAHWEH) is a political prisoner. (Even the Geneva Convention requires decent treatment.) Not only is il1il' 13 il1il' (YAHWEH BEN YAHWEH's) mistreatment political, it is racist to the core. If a white American were treated this way by another nation, the United States would immediately initiate war, as her past records prove. The actions of this prison facility display open, blatant discrimination by the U. S. Government and media. This is absolutely wrong and destructive. This is religious persecution at its highest. These events are reminiscent of the trials and tribulations faced by the Hebrews in ancient Rome, the Spanish Inquisition during the Renaissance, and the witch hunts during the era of the early pilgrims. This persecution cannot be allowed to continue. ill il' [3 ill il' (YAHWEH BEN YAHWEH) issued a final statement in regard to these events: "All of this persecution and more, I suffer for your salvation, redemption, resurrection, and true freedom." The U.S. Government continues to persecute ill il' 13 il 1 il' (YAHWEH BEN YAHWEH) and his followers while they await trial. The basis of this persecution is clearly religious discrimination and racial hatred. 25 The Persecution of il 1 il"' 13 il 1 il"' Volume One On Thursday, November 29, 1990, one of the counselors at the Metropolitan Correctional Center (MCC) informed il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) of the following: "We noticed about 20 or more of you walking together as a group to breakfast, and you were grouped together after breakfast around the lake. We are asking you not to group together, unless you want to go back to the 'HOLE' (dungeon, segregation). We must protect our Institution." First, there are only 12 of the Yahweh brothers at this institution. Second, several sets of 25-30 Christians group together every morning around the same lake, holding hands, singing, praying out loud, and inviting people to join them without opposition. Also on Thursday, November 29, 1990, Mr. Gilmartin of NBC News wanted to interview il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) at the MCC. But il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) was forced to decline the interview because officials of the MCC said il 1il' 13 il1il' (YAHWEH BEN YAHWEH) could not wear his holy culture before the world. Yet, Panamanian President, Manuel Noriega, is allowed to wear his military uniform. Though il 1 il ' 13 il 1 il ' (YAHWEH BEN YAHWEH) and the other members of the Nation of il 1 il ., (YAHWEH) are being held as pre-trial detainees, which mean that they retain all their rights of citizenship, they should not be treated as criminals or convicts. While Noriega is allowed to properly project and protect his image, as to not look like a criminal or convict in the 26 The Persecution of il 1il., 13 il 1il., Volume One minds of the public, il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) and members of the Nation of il 1il' (YAHWEH) are not granted this same right. Volume 28 of the Code of Federal Regulations (28 CFR), Ch. V. (7-1-1990 Edition) § 548.12(f) states that "An inmate ordinarily shall be allowed to wear or use personal religious items during devotional services. Upon request of the inmate, the Warden may allow an inmate to wear or use personal religious items within the institution." Therefore, this unjust decision by the counselors to deny il 1 il' 13 il 1 il ., (YAHWEH BEN YAHWEH) the right to appear before the world in his holy garment represents a clear case of religious persecution and racism. On Friday, November 30, 1990, il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) was called to the Chief Lieutenant's office and told, "I don't know anything about your religion, but we cannot allow your entourage or group to carry each other's trays in the dining area. You must be 'INDIVIDUALISTS' like everybody else." il lil' jJ i1 1il' (YAHWEH BEN YAHWEH) replied, "We will obey your rules, but for your information, we are courteous and caring toward each other. We naturally show love one to the other." The Lieutenant's final words were, "We have to protect 'THE INSTITUTION.' " Nothing in the rules demands that the inmates be INDIVI DUALISTS. This is merely a matter of religious harassment designed to destroy the unity between il 1 il ., 1J il 1 il ., (YAHWEH BEN YAHWEH) and his followers. 27 The Persecution of n 1n., 13 n 1n., Volume One Also on Thursday, November 29, 1990, one of the counselors at the MCC advised il1 il ' 13 il1 il ' (YAHWEH BEN YAHWEH) that he would not be receiving his mail that is addressed in the name of "il lil' 13 il1il' (YAHWEH BEN YAHWEH)." In addition to this being his world renown name, it is also his legal name. The legal papers validating this have already been submitted to the officials at the MCC by il1il' 13 il1il' (YAHWEH BEN YAHWEH's) attorney, Alcee Hastings. Thus, this threat is totally illegal and represents an infringement of ill il ' 13 il1 il ' (YAHWEH BEN YAHWEH's) First Amendment rights. On Saturday, December 1, 1990, Hebrew brothers were told that if they were caught inside any other dorm than their own, they would be put in the HOLE (dungeon, segregation). They had not been told this rule, neither is it being enforced upon anyone else. Also, on the same day, Hebrews were told that they were not allowed to carry a Holy Bible in their hands from one point to another. This rule does not apply to any of the other 1,200 inmates. All of the Hebrew brothers constitutional rights are being violated. They are citizens in Pre-Trial detention, and have not been "convicted" of anything. On Sunday, December 2, 1990, a female guard ran several Hebrew brothers out of the showers at 5:30 a.m. The posted signs clearly indicate that the cut-off time is 28 The Persecution of il 1 il"' 13 il 1 il"' Volume One 7:30 a.m. This action upset a large number of other inmates of all nationalities. They stated that this had never happened before. Also that day, no newspapers were allowed at the MCC. It was stated by many of the inmates that the reason was that a front page article in the Miami Herald blasted the Government's Star Witness against the Yahwehs (Rozier) as a possible nightmare for the Government and they didn't want the inmates of the MCC to see anything in favor of II 111 ., (YAHWEH). Many of the inmates wives called and read the article to them over the telephone and they were threatened with the HOLE (dungeon, segregation). This is a clear case of illegal censorship of the news based solely on religious persecution and racial hatred. The masses of Latin and Hispanic inmates at the MCC are 100 percent in support of lllil" (YAHWEH). On Monday, December 3, 1990, four Hebrew brothers were standing on the sidewalk in front of their dormitory when an officer said, "Get off the sidewalk. You can't stand out here." At the same time, there were several inmates all around. Of course, the Hebrews always obey orders, even when they are indisputable recipients of HATRED and DISCRIMINATION. "One Law for All" does not exist at the MCC. This persecution must come to an end. The U. S. Government cannot be allowed to continue to ignore its own laws because of religious intolerance. To abandon the constitutiona1 rights afforded every citizen would be to red1.1ce America to a 29 The Persecution of i1 1 il" 13 i1 1 il" Volume One totalitarian police state. We, the People, demand that the U.S. Constitution and the Bill of Rights be properly and fairly enforced! • 30 The Persecution of il 1 il ., 13 il 1 il ., Volume One U.S. GOVERNMENT CONSPIRES TO DENY ~1~" l:J ~1~} BOND - A careful analysis of the proceedings at each of the bond hearings reveals a carefully coordinated plot among the Government officials to illegally detain il 1 il., 13 il 1 il' (YAHWEH BEN YAHWEH) and other members of the Nation of il 1 il ., (YAHWEH). In each of these cases, the laws governing bonds are ignored as justice is totally denied. There is absolutely no doubt that had the defendants in these bond hearings been of another nationality or religion, the outcome would have been different. Consider the case of illil' 13 illil' (YAHWEH BEN YAHWEH). At his bond hearing, several prominent, respectable businessmen appeared as character wit- nesses for il 1 il ., 13 il 1 il' (YAHWEH BEN YAHWEH). Their testimony was totally ignored. Magistrate Lynn Johnson committed such a gross abuse of discretion that collusion with the prosecution becomes very obvious. Thus, she effectively convicted ill il ' 1::I ill il ' (YAHWEH BEN YAHWEH) without a trial. The prosecution read depositions from a convicted serial killer with a notorious background. Aside from this testimony, no evidence was presented that would indicate that illil' 1:::1 illil' (YAHWEH BEN YAHWEH) is a threat to the community. Although the laws of America clearly state that the burden is on the prosecution to present clear and convincing evidence, this was not the case. In fact, considering the good works that il 1il' 1:::1 il 1il' (YAHWEH BEN YAHWEH) has done in the community, his very absence is a threat to the community. illil' 1:::1 illil' (YAHWEH BEN YAHWEH) has been invited on several occasions to numerous social events and received various awards for his outstanding work in the community. In fact, il 1il ' 1:::1 ill il ' (YAHWEH BEN YAHWEH) is the current recipient of the Businessman of the Year Award by the National Business League. He was awarded this honor because he has established several economically viable businesses in economically impoverished areas, thus setting an example for the world. The fact that since the severing of ties between the Nation of il 1 il ., (YAHWEH) and former member Robert Rozier, no further accusations have been made; and the fact that the accolades have continued and even increased should prove to the world that 32 The Persecution of il lil., 13 il lil., Volume One il 1il' 1:::1 il 1il' (YAHWEH BEN YAHWEH) is not a threat to our community. The fact of the matter is that in light of il 1il' I :::I il 1il' (YAHWEH BEN YAHWEH's) numerous accomplishments in our community, particularly in the area of economic empowerment, it is clear that il 1il' 1:::1 il 1il' (YAHWEH BEN YAHWEH) is being held, not because he represents a physical threat to our community, but because he is an economic threat to other communities. As we consider the cases of il 1 il ' 1:::1 il 1 il ' (YAHWEH BEN YAHWEH'S) followers, the collusion between the prosecution and the magistrates becomes even more apparent. Consider the case of Judith Israel: Though she has not been charged with actually participating in any violent crime, she, too, is being held without bond until the trial. In fact, the worst charge on the indictment charges her with "buying and maintaining properties." The fact that the Miami Herald lists Judith Israel as the "Financial Wizard" of the Nation of illil., (YAHWEH) shows that the Government is trying to destroy the economic empire of the Nation of i1 1 i1 ., (YAHWEH) by continuing to hold her. Again, it is clear that it is not because she represents a physical threat to our community, but because she represents an economic threat to other communities. Consider the case of Hezion Israel: He was attacked and suffered severe wounds as he defended himself. When the event occurred, the State decided not to charge 33 The Persecution of i1 1 i1 ., 13 i1 1 i1 ., Volume One Hezion. Yet, the U.S. Government charges him four years later on the words of a confessed serial killer. First, there were no evidence to the charges. Second, the only testimony involved is hearsay. Third, Hezion has an impeccable background. Several people in the community attested to his good character. Magistrate Johnson, in another clear case of abuse of discretion, decided to hold Hezion without bond, though there was no "clear and convincing evidence" that he is a threat to the community. Consider the case of Aher Israel: The Government could not locate Aher to arrest him. Yet, upon learning that he was wanted, knowing his innocence, and believing in the fairness of the judicial system, he turned himself over to the authorities. However, Magistrate Ted Banstra ordered Aher to be held without bond because he believed Aher would not show up for the trial. This ruling is totally inconsistent with the facts presented and, thus, points to an obvious conspiracy within the Government. These are just a few examples of obvious miscarriages of justice. Altogether, 17 people are being held without bond. The latest charges are over four years old, and some of the earliest are almost ten years old. This proves that for the last four years, the community has been safe with these people walking around in society. None of these 17 people have any evidence linking them to the charges, nor any witnesses linking them to the charges. The fact that although the Government claims many witnesses, it also admitted that all except one of the 34 The Persecution of il 1 il" 13 il 1 il" Volume One witnesses refused to participate in the witness protection program. This action alone proves that there is no REAL fear of intimidation or safety of the witnesses. The one star witness of the Government is an admitted serial killer with a notorious background. It is a sad day in America when you can be accused without facts or evidence, and held without bond, regardless of your good background and accomplishments in the community. This indicates that the U.S. Constitution and the Bill of Rights are dead, of none effect, and can be ignored by the Government whenever it pleases. It also proves that in our Free Enterprise System, one is free to succeed as long as his success does not overshadow the success of the "powers that be." These injustices can only continue if we, the people, allow them. However, we must know the facts first. Therefore, The People For Truth is dedicated to informing the people as to what is really going on behind the scenes. • 35 The Persecution of il 1 il" [3 il 1il" Volume One PRE-TRIAL PERSECUTION OF YAHWEH BEN YAHWEH CONTINUES - The U.S. government continues to persecute il lil' 13 illil' (YAHWEH BEN YAHWEH) and his followers while they await trial. The basis of this persecution is clearly religious discrimination and racial hatred. On Thursday, November 29, 1990, one of the counselors at the Metropolitan Correctional Center (MCC) informed illil' 13 illil' (YAHWEH BEN YAHWEH) of the following: "We noticed about 20 or more of you walking together as a group to breakfast and you were grouped together after breakfast around the lake. We are asking you not to group together, unless you want to go back to the 'HOLE' (dungeon, segregation). We must protect our Institution." First, there are only 12 of the Yahweh brothers at this institution. Second, several sets of 25-30 Christians group together every morning around the same lake, holding hands, singing, praying out loud, and inviting people to join them without opposition. This is absolute religious discrimination and racial hatred. Also on Thursday, November 29, 1990, Mr. Gilmartin of NBC News wanted an in- 36 The Persecution of il 1 il., 13 il 1 il ., Volume One terview with il1il' 13 i11il' (YAHWEH BEN YAHWEH) at the MCC. But il1il' 13 il1il' (YAHWEH BEN YAHWEH) was forced to decline the interview because officials of the MCC said il1il' 13 il1il' (YAHWEH BEN YAHWEH) could not wear his holy culture before the world. Yet, Panamanian President Manuel Noriega is allowed to wear his military uniform. Though il1 il ' 13 il1 il ' (YAHWEH BEN YAHWEH) and the other members of the Nation of il1il" (YAHWEH) are being held as pre-trial detainees, which mean that they retain all their rights of citizenship, they are being treated as criminals or convicts. Yet, Noriega is allowed to properly project and protect his image as to not look like a criminal or convict in the minds of the public, while il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) and the other members of the Nation of il 1 il ., (YAHWEH) are not granted this same right. Volume 28 of the Code of Federal Regulations (28 CFR), Ch. V (7-1-1990 Edition) § 548.12(f) states that "An inmate ordinarily shall be allowed to wear or use personal religious items during devotional services. Upon request of the inmate, the Warden may allow an inmate to wear or use personal religious items within the institution." Therefore, this unjust decision by the counselors to deny il 1 il ' 13 il 1 il ' (YAHWEH BEN YAHWEH) the right to appear before the world in his holy garment represents a clear case of religious persecution and racism. On Friday, November 30, 1990, Yahweh Ben Yahweh was called to the Chief 37 l The Persecution of il 1 il" 13 il 1 il" Volume One Lieutenant's office and told, "I don't know anything about your religion but we cannot allow your entourage or group to carry each other's trays in the dining area. You must be 'INDIVIDUALISTS' like everybody else." illil' 13 illil' (YAHWEH BEN YAHWEH) replied, "We will obey your rules, but for your information, we are courteous and caring toward each other. We naturally show love one to the other." The Lieutenant's final words were, "We have to protect 'THE INSTITUTION.'" Nothing in the rules demands that the inmates be INDIVIDUALISTS. This is merely a matter of religious harassment designed to destroy the unity between ill il ., 13 illil' (YAHWEH BEN YAHWEH) and his followers. Also, on Thursday, November 29, 1990, one of the counselors at the MCC threatened ill il' 13 ill il ., (YAHWEH BEN YAHWEH) that he would not be receiving his mail that is addressed in the name of "Yahweh Ben Yahweh." In addition to this being his world renown name, it is also his legal name, and the legal papers validating this have already been submitted to the officials at the M CC by ill il ., 13 ill iP (YAHWEH BEN YAHWEH's) attorney, Alcee Hastings. Thus, this threat is totally illegal and represents an infringement of illil' 13 illil' (YAHWEH BEN YAHWEH) first amendment rights. On Saturday, December 1, 1990, Hebrew brothers are told that if they are caught inside any other dorm than their own, they would be put in the HOLE (dungeon, 38 The Persecution of illil"' [3 illil"' Volume One segregation). This rule has not been told to them, nor is it being enforced upon anyone else. Also, on the same day, Hebrews were told that they were not allowed to carry a Holy Bible in their hands from one point to another. This rule does not apply to any of the other 1,200 inmates. All of the Hebrew brothers constitutional rights are being violated. They are citizens in Pre-Trial detention, and have not been convicted of anything. On Sunday, December 2, 1990, a female guard ran several Hebrew brothers out of the showers at 5:30 a.m. The posted signs clearly indicate that the cut-off time is 7:30 a.m. This action upset a large number of other inmates of all nationalities. They said that this had never happened before. Also that day, no newspapers were allowed at the MCC. It was reported by many of the inmates that the reason was a front-page article in the Miami Herald blasted the Government's Star Witness (Rozier) against the Yahwehs as a possible nightmare for the Government, and they didn't want the inmates of the MCC to see anything in favor of il 1 il ., (YAHWEH). Many of the inmates wives called and read the article to them over the telephone, and they were threatened with the HOLE (dungeon, segregation). This is a clear case of illegal censorship of the news based solely on religious persecution and racial hatred. The masses of Latin and Hispanic inmates at the MCC are 100 percent in support of illil" (YAHWEH). 39 The Persecution of n 1 n., 1::1 n 1 n., Volume One On Monday, December 3, 1990, four Hebrew brothers were standing on the sidewalk in front of their dormitory when an officer said, "Get off the sidewalk. You can't stand out here." At the same time, there were several inmates all around. Of course, the Hebrews always obey orders, even when they are indisputable recipients of HATRED and DISCRIMINATION. "One Law for All" does not exist at the MCC. This persecution must come to an end. The U.S. government cannot be allowed to continue to ignore its own laws because of religious intolerance. To abandon the Constitutional Rights afforded every citizen would be to reduce America to a totalitarian police state. We, the People, demand that the U.S. Constitution and the Bill of Rights be properly and fairly enforced! • 40 The Persecution of il 1 il"' r 3 il 1 il"' Volume One STRANGE EXPLOSION KILLS YAHWEH CHILD - On November 7, 1990, the FBI terrorized tenants at apartment buildings owned by the Nation of il1il" (YAHWEH). At 5 a.m. tenants were rudely awakened with threats of tear gas, and semi-automatic weapons pointed in the faces of innocent men, women, and children. Men, women, children, and babies were thrown down to the ground and terrorized in a manner only likened to slavery during the early history of America. The FBI illegally stormed onto the properties without presenting any search warrants or arrest warrants. Now, nearly three months later, terrorism strikes again at the Nation of il1 il., (YAHWEH), and this time it claimed the life of an innocent 16-year old boy. A strange explosion occurred in the boiler room of a Yahweh building killing the Yahweh youth who was inside. We must ask some questions concerning this incident. Since we are "aware" that the U.S. Government and the FBI are working day and night to destroy the Nation of il1 il., (YAHWEH), was this an act of God? Was this an accident? Or, was this an ACT OF TERRORISM BY THE U.S. GOVERNMENT? Since we are also aware that the U.S. Government and the CIA work dirty tricks and murder people all over the 41 l The Persecution of il 1 il" 1:::1 il 1 il"' Volume One Earth, was this evil, murderous plot designed to frighten the citizens of the Nation of il1il' (YAHWEH) away from il1il' 13 il1il' (YAHWEH BEN YAHWEH)? Is this innocent 16-year old boy the first MARTYR of the Nation of' il1il' (YAHWEH) at the murderous hands of the U.S. Government? The Holy Bible says, "They shall deliver you up to be afflicted, and they shall kill you: and you shall be hated of all nations for my name's sake." -- Matthew 24:9. We have evidence that il1il' 13 il 1il' (YAHWEH BEN YAHWEH) is the True Shepherd and is totally unafraid to stand up and be persecuted for the sake of all good people. We, The People For Truth, demand some righteous answers from the U.S. Government. It is criminal the way the U.S. Government is condemning and trying to convict a whole nation of people, the so-called Black people of America, the Nation of il1il' (YAHWEH). America accuses other countries of being terroristic, but we must all admit that America is the most diabolical, terroristic country in the world. America can no longer hide her evil doings under the carpet. The world is now beginning to look at America for her worldwide evils and for her open religious persecution of il1il' 1::::1 ill il' (YAHWEH BEN YAHWEH). • 42 The Persecution of il 1 il ., 73 il 1 il ., Volume One illilj lJ illil) DENIED BOND - Over 15,000 families signed petitions of support for il1 il' 13 il1 il' (YAHWEH BEN YAHWEH's) release. All of the members of the Nation of il1il' (YAHWEH) who are being illegally held have family members in the Middle East War. il1il' 13 il1il' (YAHWEH BEN YAHWEH) has nephews, cousins, and a son-in-law in the Middle East, and is himself a veteran. We have open proof that the community (Jews, Hispanics, Whites, and Blacks) over whelmingly supports one of America's most respected religious leader's release. il1il' 13 il1il' (YAHWEH BEN YAHWEH's) book, "From Poverty to Riches," is in the hands of the world leadership, and shows his miraculous works. There is no excuse for denying il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) bond. Remember, il1il' [3 il 1il' (YAHWEH BEN YAHWEH) is only "accused" by a "Judas" serial killer who made up lies to escape the death penalty. We have many examples in the Miami community of open and "convicted" killers who are out on 43 1l The Persecution of il lil"' 73 il lil"' Volume One bond. il 1 il ' 13 il 1 il ' (YAHWEH BEN YAHWEH) is not accused of killing anyone. He has been indicted under the gray area of conspiracy, which is a criminal misuse of power by racists individuals within the U.S. Government. Miami has had more than its share of racial problems. The U. S. Government now has the golden opportunity to avoid a potentially explosive situation at home while fighting a war 10,000 miles away in a foreign land. How can a volunteer army composed of 65 percent Blacks be effective soldiers while their relatives are being persecuted and brutalized at home? We are making a plea for sanity within the U.S. Government for FAIRNESS and JUSTICE for il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) by giving him Liberty. Denying il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) bond in Pre-Trial Detention destroys a PRINCIPLE that the majority of Americans still believe, "A person is innocent until proven guilty." il 1 il ' 13 il 1 il ' (YAHWEH BEN YAHWEH) is being held as a convicted criminal and told, "He is guilty and must prove his innocence before he can go free." This is against what most Americans believe is RIGHT. Miami also has a Mr. Borsch who was convicted of being a terrorist by blowing up 44 The Persecution of il 1 il., 1::1 il 1 il ., Volume One an airplane with 73 people and other acts, and was to be deported. Yet, this man is under partial house arrest. illil' 13 illil' (YAHWEH BEN YAHWEH) has lived on this earth 55 years without a criminal record. illil' 13 illil' (YAHWEH BEN YAHWEH) has set a PERFECT MORAL EXAMPLE OF EXCELLENCE through his microcosmic Nation of illil' (YAHWEH), which can bring peace to the entire world. The masses of the Earth are tired of war and false promises of peace. The moral people of the world are saying, "RELEASE il 1 il ., 13 ill il ., (YAHWEH BEN YAHWEH) NOW!" This innocent man has now spent four months in prison. ill il' 13 ill il' (YAHWEH BEN YAHWEH) is the Self-Proclaimed Son of ill il ., (YAHWEH). Remember that 2,000 years ago, Christ was also arrested and accused falsely. Our question is this, "What if ill il ' 13 ill il ., (YAHWEH BEN YAHWEH) really is the Son of God illil' (YAHWEH)?" • 45 The Persecution of i1 liP 73 i1 liP Volume One THE WICKED WITHIN THE U.S. GOVERNMENT SABOTAGE THE YAHWEHS' OVERTOWN SUPERMARKET - On Saturday night, January 26, 1991, wicked agents within the U.S. Government sabotaged First Rate Foods, the only supermarket in the predominantly Black neighborhood of Overtown, which is owned and operated by members of the Nation of il 1 il ., (YAHWEH). Air conditioning pipes leading to all of the freezers in the store were systematically cut and removed. Several professional repairmen who arrived on the scene Sunday, January 27, 1991, concluded that the degree of sophistication displayed was the result of experts and not a mere case of vandalism. The damage resulted in repairs totaling thousands of dollars, and in a loss of all the perishable items in the supermarket, also costing tens of thousands of dollars. All of the meats, frozen foods, dairy products, and produce were spoiled beyond consumption. Considering the fact that First Rate Foods is the only supermarket in Overtown, this vicious act not only created a huge financial loss to the YAHWEHS, but was also the source of a major inconvenience to all of the Black community. 46 The Persecution of i1 1 il"' [3 i1 1 il"' Volume One In addition to this is the fact that First Rate Foods is located within 100 feet of a police substation. It is incomprehensible that this kind of action could take place in the face of the police substation located in the adjacent complex. Though Black businessmen pay taxes, and the Black community supports businesses from all other nationalities, which also pay taxes that support and sustain the police department, we still do not receive our fair share of protection from them; nor do we receive cooperation from them in the investigation of our problems. This is a very callous act, not only against the Nation of il1il' (YAHWEH), but also against the people of Overtown and all Black people in general. It is a fact that wicked forces within the U.S. Government have attacked illil' [3 illil' (YAHWEH BEN YAHWEH) and his followers, arrested them on trumped up charges, and have been holding them unconstitutionally for several months-- because the Nation of il 1il ., (YAHWEH) was making too much progress economically. The illegal detention and subsequent persecution of illil' [3 il lil' (YAHWEH BEN YAHWEH) are calculated efforts to try to destroy the economic gains made by the Nation of illil" (YAHWEH) and thus the role model of the Black community. Now these same evil forces have gone a step further to actually try to destroy his works through sabotage. The members of the Nation of illil' (YAHWEH) have proven that they are a peace- 47 The Persecution of il 1 il., 13 il 1 il ., Volume One ful people although they have had their holy temple raided and their women, child ren and babies terrorized by members of the Government and the FBI. Though the U.S. Government continuously comes against the Nation of il1il' (YAHWEH) through both covert and overt operations, the Nation of il 1 il ., (YAHWEH) remains an amicable people. il1 il ., 13 il1 il' (YAHWEH BEN YAHWEH) teaches and demonstrates peace and love, but to the contrary, members of the U.S. Government teach and promote violence by sabotaging the most successful Black-owned business in our community in an attempt to try to force the Yahwehs out of business. It is becoming clear that the U.S. Government wants our people to have no hope for the future. Whereas, il1il' 13 il1il' (YAHWEH BEN YAHWEH) has done nothing but build the Black community, evil men within the Government are determined to tear the Black community down. • 48 --~ The Persecution of il 1 il"> 13 il 1 il"> Volume One unprecedented and unfounded move, North Shore is demanding a cash deposit before they will admit Judith! Never before has North Shore implemented such an inhumane policy of denying medical attention to someone in an emergency situation such as this. This is open discrimination and religious persecution. However, because the primary concern was for the health of one of their members, regardless of the economics involved, the Nation of il 1 il j (YAHWEH) submitted to the extortion and blackmail policy imposed by North Shore by depositing over $9,000 cash in advance. At this point, Gertrude Novicki, the federal prosecutor handling the case, stepped in personally to insure that Judith was not allowed to be hospitalized. She was not even allowed to go to Jackson Memorial Hospital, which has a unit specifically designed to handle inmates. At this time, Judith is currently experiencing extreme pain on a continuous basis in certain parts of her body, while other parts exhibit no feelings whatsoever. This is cruel, inhumane treatment against a person who is legally presumed to be innocent until proven guilty, as the U.S. Constitution guarantees. These atrocities are in addition to the fact that Judith has been denied bail although she has not been accused of any violent crime, but has been accused only of being a "financial wizard" in a growing economic empire. Therefore, under the thinly veiled guise of "pro tecting the community," wicked members within the Government are carrying out cruel and unusual punishment against an innocent, defenseless woman. 50 The Persecution of il 1 il., 73 il 1 il"> Volume One Not only is Judith Israel, the victim of this savage treatment, a law-abiding citizen without a criminal record, she also has several relatives in the Middle East who are proving their loyalty to this country daily. It is sadly ironic that while her relatives are putting their lives on the line, all in the name of preserving human rights internationally, Judith's human rights are being maliciously withheld as she is denied medical treatment. This extreme case of abuse of authority presents clear and convincing evidence that Judith Israel is being persecuted because of her religious belief and faith in ill il., 1:::1 illil' (YAHWEH BEN YAHWEH) as the Messiah. Almost 2,000 years ago, the disciples of Christ were also persecuted for their faith. Christ prophesied in Matthew 25:44-46 that some would come to him saying: "Lord, when saw we thee an hungred, or athirst, or a stranger, or naked, or sick, or in prison, and did not minister unto thee? Then shall he answer them, saying, Verily I say unto you, Inasmuch as ye did it not to one of the least of these, ye did it not to me. And these shall go away into everlasting punishment: but the righteous into life eternal." The community petition consisted of Whites, Jews, Hispanics, and African-Americans. The petition stated that illil" (YAHWEH) is "A solid community leader and a great asset and ... not a threat to the community." il1il' 13 il1il' (YAHWEH BEN YAHWEH) is an international figure, known for his miraculous works in the spiritual, social, educational, political, and economical realms. The United States Government should be ashamed for allowing a few misguided individuals in its ranks to take the side of a few jealous, miscreant, profane, and "unenlightened" so-called ex-followers to destroy the spiritual works of this great man. The petition is a great sign that the Miami community is ready to come together and work for Miami to become the greatest city on Earth because il 1 il ., (YAHWEH) has chosen to place his name in Miami. 53 l -- .__ ...... We all must ask ourselves this question: "What if il1il' 13 il1il' (YAHWEH BEN YAHWEH) is really the Son of Man prophesied to come?'' • 54 The Persecution of il 1 il" 73 il 1 il" Volume One STOP THE DOUBLE STANDARDS IN THE YAHWEHS' TRIAL - President Bush condemned the beating of a motorist in Los Angeles, California, but praised the Los Angeles police chief. President Bush said, "Do not pre-judge Chief Gates. The man is entitled to a credible hearing." President Bush then met with Attorney General Dick Thornburg and FBI Chief William Sessions. Then Bush said in many ways that Chief Gates has been an exemplary police chief. He then called the Los Angeles chief one of the all-American heros for winning the war on drugs and gang violence. This is great until you study this comparative analysis: We, the people, want to know why President Bush does not praise il1il' 13 il1il' (YAHWEH BEN YAHWEH) for his good works. Why President Bush does not hold Chief Gates responsible for the brutal acts of his officers, but allows il1 il' 13 il 1 il ' (YAHWEH BEN YAHWEH) to be held responsible and to be indicted for "alleged" acts of his followers? Why ignore the fact that illil' 13 illil' (YAHWEH BEN YAHWEH) is noted for having zero drugs at il 1 il ' (YAHWEH) University: Not only do the students not take drugs or use drugs, but they don't even deal in drugs, nor do they smoke. They're not alcoholics. They're not juvenile delinquents. Why is it that this is ignored? Why does Bush say Chief Gates is entitled to a credible hearing while ignoring the fact that there is no hearing for illil' 13 illil' (YAHWEH BEN YAHWEH) for bond nor for indigent status. We, as voters, are not asking for favors, but equal justice. Why do Attorney General Dick Thornburg and FBI Chief William Sessions allow the religious persecution of the Yahwehs? Why are they allowing their freedom of religion to be crushed and their freedom of speech to be suppressed? Why are they allowing their due process under the laws of this land to be ignored? They have been incarcerated for approximately six months. Why are they allowing their constitutional rights to be violated? We must bring out the fact that this is pure racism. This is an anti-Black attitude. This is open religious persecution. This means that ill il ' 13 ill il ' (YAHWEH BEN YAHWEH) is a political hostage. The U.S. Government is demonstrating double standards. A police officer in Miami, Florida, as of March 1991, was arrested for killing his wife after officials found direct evidence that supported his guilt. He was brought to the Metropolitan Correctional Center where ill il ' 13 il1 il ., (YAHWEH BEN YAHWEH) is being held, and he is now out on bond for $250,000. ill il ., 13 ill il ., (YAHWEH BEN YAHWEH) has only been "accused" by detractors, but has been denied bond. Where is the justice? This is obviously an open case of racism before the whole world. This is an anti-Black attitude on the part of the U.S. Government. Again, this is religious persecution. The U.S. Government has arrested a whole religion. They have charged everybody that believes in il 1il ; (YAHWEH) with being criminals. They charged the Nation of il1il' (YAHWEH), the Yahwehs, the Children of God ill il ' (YAHWEH), and the Temple of Love. This is unprecedented in this civilization. This is yet another example of the double standards. But, again, under il1il' (YAHWEH), there is one law for all. On March 1991, a school teacher in Miami, Florida, shot into a car on I-95, a public highway, killing an occupant unknown to him. Yet, he is not considered a threat to society and is out on a $50,000 bond. il 1 il ., [3 ill il ., (YAHWEH BEN YAHWEH) 57 L __ 1 The Persecution of il 1 il" 73 il 1 il" Volume One has only been "accused" of conspiracy-- not personally accused of killing anyone but, yet, denied bond. March 26, 1991, on the front page of the Miami Herald, the suspended Mayor of Hialeah was convicted on six racketeering and extortion counts, which is RICO (Racketeering Influenced Corrupt Organizations). Yet, he remains free on $100,000 bond. i1 1 il' 13 il 1 il ' (YAHWEH BEN YAHWEH) has only been "accused" under this same RICO act, and has "not been convicted," but has been denied bond and a hearing by the 11th Circuit Court of Appeals. Not only did the 11th Circuit Court of Appeals refuse to look at the appeal, but they did not even open it or review it. In one sentence-- they simply denied it. Where is the justice in this? Why is it that President Bush, Attorney General Dick Thornburg, and FBI Chief William Sessions are all silent about the religious persecution of the Yahwehs? Why are they silent about il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) being in pre-trial detention for six months? Thus, due process under the law has been totally ignored at all appeal levels. Why is this being ignored by the U.S. Government and most especially the Executive Branch? Through the crucifixion of il 1 il ' 13 il 1 il ' (YAHWEH BEN YAHWEH), are 60 million Blacks in America to conclude that there is no hope for them in America? Are they to conclude that there is no hope for justice in America? This is a flagrant, 58 The Persecution of il 1 il"' 13 il 1 il"' Volume One open case of racism and an anti-Black attitude on the part of the United States Government toward 60 million Blacks who look to the United States Government for justice. i1 1 il' 13 i1 1i1 ' (YAHWEH BEN YAHWEH) is being held as a political hostage. This is an open case of religious persecution and another example of double standards in regard to the law. But, again, under the Government of i1 1 it' (YAHWEH), there is one law for all. America claims to be a country under the rule of law, but how can this country stand with double standards? According to headlines in the local section of the Miami Herald, March 27, 1991, "il 1il' 13 i1 1il' (YAHWEH BEN YAHWEH) asks for help to pay his lawyer." It states that the court rejects the poverty plea from i1 1i1 ' 13 i1 1 i1 ' (YAHWEH BEN YAHWEH). This rejection is all without reason. Absolutely no reason is given whatsoever. A month before the indictment, ill i1 ' 13 ill i1 ' (YAHWEH BEN YAHWEH) lectured at the Miami Arena and stated that he does not receive a salary, nor any money for his services as Founder of the Nation of il1 it" (YAHWEH), and that he owns no bank accounts any place on the entire planet Earth, and all the properties of the Nation of it 1 it ' (YAHWEH) are in the names of his followers and belong to them. On the other hand, America produces and promotes individualism. We are all the same blood, the same bone, the same family, and have the same God. il 1il' 13 il 1il., (YAHWEH BEN YAHWEH) is doing this as a sacrifice to show how it should be done. il 1il., 13 il 1il., (YAHWEH BEN YAHWEH) and Judith Israel have been denied a hearing to prove that they're indigent. il 1il ., 13 il 1il ., (YAHWEH BEN YAHWEH) and Judith have committed their lives to il1 il., (YAHWEH), the Supreme Being, and in so doing have given up all worldly goods. The Pope of Rome, the priests, and the nuns would never be denied indigent status. Everybody on the Earth knows that the Pope, the priests, and the nuns have all taken oaths of poverty. il 1il ., 13 il1 il ., (YAHWEH BEN YAHWEH), too, has taken an oath of poverty. Neither his children nor grand-children have any estate at law in the United States from il 1il" 13 il1il' (YAHWEH BEN YAHWEH). What in the world could possibly be the motive for denying him indigent status? The court's rejection of il 1il., 13 il 1il., (YAHWEH BEN YAHWEH's) poverty plea shows open racism, double standards and religious persecution, which make il1il" 60 The Persecution of il lil., 13 il lil., Volume One 13 il 1il' (YAHWEH BEN YAHWEH) a political hostage. This is showing open proof to the world that there is no hope for 60 million Blacks in the United States of America. Thus, 60 million Blacks have no choice but to run, hurry, and fly to il 1il ., (YAHWEH): il 1il ., (YAHWEH) equals one law for all people on the planet Earth. There is absolutely no hope for Blacks otherwise. What if il 1il' 73 il 1il' (YAHWEH BEN YAHWEH) really is the Self-Proclaimed Son of God il 1 il ., (YAHWEH) promised to return? • 61 The Persecution of il 1 il ., 73 il 1 il"' Volume One PREJUDICED JUDGE IN THE YAHWEHS' TRIAL ASKED TO STEP DOWN - Monday, April 8, 1991, was to be the final status conference before the actual trial of the Yahwehs. However, a last minute motion requesting that Judge Roettger "recuse" himself or step down from the trial interrupted all proceedings. The defense filed a motion asking for Roettger's dismissal based upon a statement made by the Judge at a February 6, 1991, status conference. At that hearing, Roettger clearly stated, "I am not terribly concerned about getting an impartial jury." However, two months later, Roettger reversed his position entirely. In doing so, Roettger clearly showed signs of displeasure at the defense for raising the motion. Roettger, who had decided on motions presented over the last two months, refused to release his decision. He cited he prefers to wait until determination of the motion for recuse. Although his preference was to hand the matter over to Magistrate Snow, he agreed, at the behest of lead defense counsel, Alcee Hastings, to refer the motion to Chief Judge King for resolution. Magistrate Snow has previously rendered decisions relative to this case which appear to be part of a collusion in the U.S. Justice Department to persecute the Yahwehs. Thus far, all of the Yahwehs have 62 The Persecution of il 1 il" 1:::1 il 1 il" Volume One been denied bond by several U.S. Magistrates although legal requirements for "clear and convincing evidence" have not been met by the prosecution. At the April status conference, Roettger issued additional remarks which indicated an unfavorable disposition toward the defendants. Roettger stated for the record that a number of persons in attendance were wearing white robes and turbans and felt that this might present a problem during the actual trial; he stated that this might intimidate jurors. Alcee Hastings issued a strong objection clarifying that the white attire is part of the religious cultural attire prescribed by the Nation of il1 il., (YAHWEH's) faith. He further added that it would not be an issue if they were Catholic. It is a well-known fact that the Yahwehs wear white robes. In several of their publications, this practice is supported by several scriptures in the King James Version of the Bible. However, Roettger showed total disregard for this practice by referring to the ceremonial attire as "uniforms." Roettger also denied a motion earlier this year requesting that the defendants be allowed to wear their religious attire during court proceedings. This is a clear case of religious discrimination and a total disregard for the U.S. Constitution which maintains freedom of religion in the First Amendment. In addition, four of the defense lawyers stated that the presently scheduled trial date of May 20, 1991, presents a conflict with another previously scheduled trial. However, the conflicting schedule was totally disregarded. All of these facts lead to the inescapable conclusion that the prosecution along with the Judicial Branch are involved in a conspiracy to railroad the Yahwehs to prison without allowing a fair trial to take place. Although Judge Roettger said that he was the only one concerned about holding a fair trial, several facts indicate otherwise. Among them: • No bond for any defendants, although no evidence and no witnesses have been presented by the prosecution. • The prosecution, which has the legal obligation to report all evidence and witnesses, has been given permission to withhold this vital information. • The Judge is limiting the defense to 30 days to prepare for trial, although the prosecution has prepared for four and a half years. • The Judge is not concerned about an impartial jury. • The Judge refuses to acknowledge the defendants by their religiously adopted names, although some have had their names legally changed as such. • The Judge refuses to allocate adequate funds for the investigation requirements of the defendants, although millions of dollars have been spent by the prosecution. • The Judge shows a disregard for the religious beliefs of the defendants. • The Judge schedules a trial at a time when four of the defense lawyers cannot fully participate. 64 The Persecution of i1 1 i1 ., 73 i1 1 i1 ., Volume One • The Judge allows the prosecution to have a free hand in all affairs. • The Judge schedules the trial to occur in the midst of one of the three most sacred holy festivals of the defendants. • The Judge urges the defendants to plead guilty at any time saying, "I prefer to get it out of the way in a hurry." He followed this statement by expounding on his sentencing guidelines -- never once giving consideration to the fact that the defendants may be innocent. This government is declared to be "by the people, of the people, and for the people." We, The People For Truth, demand that these words be honored. il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) and the other defendants are entitled to the same rights granted to all other persons in this country. il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) and his followers are entitled to the First Amendment right guarantees them freedom of religion, which includes their religious attire as prescribed by the Bible. il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) and his followers are entitled to the Eighth Amendment right which guarantees them a reasonable bail. ill il' 13 il 1il' (YAHWEH BEN YAHWEH) and his followers are entitled to the Sixth Amendment right which guarantees them due process of law, which includes a fair trail before an impartial judge and 12 impartial jurors. The fact that the prosecution has to go through such measures indicates that there is more than meets the eye. Obviously the prosecution has ulterior motives against il 1 il ' 13 il 1 il ' (YAHWEH BEN YAHWEH) and his followers. Otherwise, why this 65 , The Persecution of il 1 il"' 73 il 1il ., Volume One obvious disregard for all of the fundamental principles that this country was built upon? Could all of this prosecution/persecution be because il 1il ., 13 il 1il ., (YAHWEH BEN YAHWEH) is who he says he is? Two thousand years ago, the laws of a country were totally disregarded in order to crucify one man -- Christ. Is it possible that il 1 il ., 13 il 1 il ., (YAHWEH BEN YAHWEH) is the Christ that is promised to return? • 66 The Persecution of i1 1 il., 7::I i1 1 il., Volume One YAHWEHS HUMAN RIGHTS VIOLATED ACCORDING TO UNITED NATIONS - The United Nations adopted the Universal Declaration of Human Rights "as a common standard of achievement for all peoples and nations." Yet, in the continuing persecution of illil' [3 illil' (YAHWEH BEN YAHWEH) and his followers, their human rights, as defined by the Universal Declaration of Human Rights, have been severely and repeatedly violated. Article 5 of this Declaration states, "No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment." Yet the Yahwehs have been placed in a "hole" for days without meals, baths, or fresh air. Members have been denied emergency medical treatment. This is totally inhumane, cruel, and degrading. Article 7 states, "All are equal before the law and are entitled without any discrimination to equal protection of the law." Whereas other persons have been convicted of crimes that are worse than those that the Yahwehs are only accused of, these other persons have been granted bond while the Yahwehs have been categorically denied bond. 67 'i The Persecution of i1 lil" [3 i1 lil" Volume One Equality means that if a person is convicted of racketeering (such as Hialeah Mayor Martinez) can be granted bond, then certainly a person (such as il 1il' 13 il 1il' [YAHWEH BEN YAHWEH]) who is only accused can be given bond as well. Equal before the law means that if Manuel Noriega, who has tens of thousands of loyal followers in Panama and millions of dollars in bank accounts across the world can have his legal fees paid by the U.S. Government, then certainly il 1il' 13 il 1il' (YAHWEH BEN YAHWEH), who has no bank accounts anywhere, can be granted the same. Equal before the law means that if Manuel Noriega can wear the attire of his choice in court, namely his military uniform, then certainly il 1 il ' 13 il 1il ' (YAHWEH BEN YAHWEH) and his followers should be allowed to wear the attire of their choice, namely their religious cultural garments. This is total discrimination and a complete violation of this UN adoption. Article 9 states, "No one shall be subjected to arbitrary arrest, detention or exile." Yet, on November 7, 1990, all male members of the Nation of il1il' (YAHWEH) were arbitrarily arrested, most without warrants, simply because they were Yahwehs. Until this day, illil' 13 illil' (YAHWEH BEN YAHWEH) and 16 of his followers are in pre-trial detention, simply because they are Yahwehs. All guidelines for pre trial detention have been totally ignored in this case with the Yahwehs. Article 10 states, "Everyone is entitled to a fair and public hearing by an independent 68 The Persecution of i1 1 i1 ., 13 i1 1 il" Volume One and impartial tribunal." Yet, Federal Judge Norman C. Roettger stated for the record, "I am not terribly concerned about getting an impartial jury." In addition, Roettger showed clear contempt for the religion of the defendants, labeling their religious attire as "uniforms." Then Roettger attempted blackmail of one of the defendant's lawyer (a public defender) by reducing his pay because his client did not plea bargain. Article 11 states, "Everyone charged with a penal offence has the right to be presumed innocent until proven guilty according to law in a public trial at which he has had all the guarantees necessary to his defense." Yet, the Yahwehs are being detained as though they are guilty. Roettger continues to address the defendants as though they are guilty, urging them to plea bargain at any time or else face stiffer sentences. One of the legal guarantees for a fair trial is the release of the evidence and witnesses against the defendants. Yet, the prosecution refuses to comply with the United States laws in this matter. Never in the history of America has this information been withheld in a non-capital case. Since the Yahwehs are supposed to be presumed innocent, why have they been imprisoned for six months without a trial? Article 12 states, "No one shall be subjected . . . to attacks upon his honor and reputation." Yet, the prosecution in cooperation with the media has continually 69 '- The Persecution of i1 1 il., 73 i1 1 i1 ., Volume One attacked the character of il1il" 13 il1il" (YAHWEH BEN YAHWEH). In a recent article, U.S. Attorney Dexter Lehtinen admitted to this collusion saying that one reporter had all of the information contained in a sealed indictment the day before it was served. Article 17 states, "Everyone has the right to own property alone as well as m association with others." Yet, one of the charges in the indictment against the Yahwehs charges them with "buying and maintaining property." Since when is it against the law to own property? But the Yahwehs have been arrested and are currently imprisoned for "buying and maintaining property." In America, millions of people own property and buy property every day. Yet the Yahwehs are being singled out in depriving them of this fundamental human right. Article 18 states,"Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship, and observance." Yet, the Yahwehs are being harassed and persecuted because of the "practice, worship and observance" of il1il" (YAHWEH's) laws, statutes, judgments, and commandments as found in the Holy Bible. il1il" jJ il1il" (YAHWEH BEN YAHWEH) is being incarcerated and implicated 70 The Persecution of il lil"' 13 il lil"' Volume One because of his religious teachings, which come straight from the Holy Bible. One member, currently imprisoned in New York, was told by his parole board that until he stopped believing in il 1il' (YAHWEH) as God, he would not be granted parole. This is totally unethical, illegal, and immoral. Although il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) has the right to manifest his teachings in the Nation of ill il' (YAHWEH), wicked members of the U.S. Government are trying to deny him this right. They are trying to put an end to these teachings because il 1il ' 13 il 1il ' (YAHWEH BEN YAHWEH's) teachings are serving as a model of excellence for the Black community. Article 19 states, "Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive, and impart information and ideas through any media." Yet, the only evidence presented against il 1il ' 13 il 1il ' (YAHWEH BEN YAHWEH) was a printed pamphlet. This pamphlet was not written by il 1il' 13 il 1il' (YAHWEH BEN YAHWEH). This pamphlet was not printed by il 1il' 13 illil' (YAHWEH BEN YAHWEH). This pamphlet was written about il 1il ' 1J il 1il ' (YAHWEH BEN YAHWEH). Yet, because some of the views in that pamphlet do not agree with the views of some people in the Government, illil' 13 illil' (YAHWEH BEN YAHWEH) is labeled a "danger to the community" and is being held in prison without bail. 71 L___ , The Persecution of il 1 il"' 13 il 1 il"' Volume One Article 2 states, "Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, color, sex, language, religion or other opinion, national or social origin, property, birth or other status." Yet, the fact remains that the Yahwehs have had their human rights violated because they are Black. The Yahwehs are also being discriminated against because of their religion and have been denied their human rights because of their common belief in il 1 il ' (YAHWEH) as the Creator and Supreme Being. The Yahwehs are being denied their human rights because they, along with 60 million Blacks in America, are Hebrew Israelites by national origin and by birth. Therefore, 60 million Blacks in America must come to the painful reality that if the Government is allowed to take away the Yahwehs' rights, then they have no human rights in America. This Universal Declaration of Human Rights begins with the fact that, "recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice, and peace in the world." Therefore, until the human rights of the Yahwehs are restored to them, there cannot and will not be freedom, justice, and peace in the world. It further states that "disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind." This is happening today before your very eyes. Because wicked members of the U.S. Government have totally disregarded the human rights of the Yahwehs, thus committing barbarous acts against them, the 72 The Persecution of i1 lil" 73 i1 lil" Volume One conscience of the moral people of the Earth are becoming outraged as these facts are brought to light. What is the reason for this total denial of the Yahwehs' human rights? iJ 1il' 13 iJ 1il' (YAHWEH BEN YAHWEH) claims to be the Second Coming of Christ. Two thousand years ago, when Christ declared his divinity, his rights were denied and he was held in contempt by the rulers of that era. Now, we see the same thing happen ing today. Is this a mere coincidence or is iJ 1 iJ' 13 iJ 1 iJ' (YAHWEH BEN YAHWEH) the Son of God iJ 1 iJ ' (YAHWEH), the Christ who is promised to return in these last days? • 73 ' l The Persecution of i1 1 il., )3 i1 1 il., Volume One THE TRIAL OF~ 1il' IJ il1il ': GUARANTEED UNFAIR BEFORE IT STARTS - The Trial of il1 il ' 13 il1 il ' (YAHWEH BEN YAHWEH) has not begun. In fact, it has not been scheduled. Yet, several factors already lead to the inevitable conclusion that it will be anything but a fair trial. When former Federal Judge Alcee Hastings took over as the lead defense attorney in November 1990, he issued this short statement to the press, "My client is innocent. All that we're asking for is a fair trial before an impartial judge and 12 reasonable men and women." Though this is what we have come to expect in this country, it now appears that Mr. Hastings was asking for a bit too much. First, there is a matter of "discovery" in which the prosecution, traditionally as required by law, releases to the defense attorney the information, witnesses, and evidence it has accumulated against the defendant. This information allows a defendant to know what he is faced with and thus, prepare an adequate defense. Yet, Judge Roettger is allowing the prosecution to withhold this vital information 74 ! I I l The Persecution of i1 1 i1 ., 13 i1 1 i1 ., I Volume One I l l until 30 days before the trial begins. He has totally ignored the pleadings of 17 I defense lawyers who have stated several times they need this information to prepare I l an adequate defense. Whereas the prosecution has accumulated this information, I analyzed it and dissected it over a period of four to ten years, by some modern I I miracle, the defense is supposed to be equally prepared in only one month. l I I The prosecution claims that it is withholding this information to protect witnesses. Yet, this flimsy excuse falls apart when examined. First of all, il lil' 13 il lil' (YAHWEH BEN YAHWEH) and his followers are being held because they sup- posedly represent a threat to these witnesses, whose identities they do not know! Even more importantly, with the exception of an admitted serial killer who needs no protection, all of the witnesses for the prosecution have refused to enter the Federal Witness Protection program, although it has been repeatedly offered to them. That fact in itself proves that these witnesses obviously do not feel that ill il ., 13 ill il ., (YAHWEH BEN YAHWEH) is a threat to their safety. In addition, the Government claims to have hundreds of witnesses. Never in South Florida's history has a witness for a Federal case been harmed by the accused. According to illil' 13 illil' (YAHWEH BEN YAHWEH), he has been fully aware of this investigation for the last few years; fully aware of individuals testifying to the Federal Grand Jury in reference to him. Yet, he has not, in any way or fashion, to 75 L-~------The Persecution of il 1 il ., 13 il 1 il"' Volume One even the slightest degree, attempted to obstruct justice by intimidating any of these witnesses. The present safety and well-being of all the witnesses support this 100 percent. The very fact that all of the defendants remain imprison pose a serious obstacle to a fair hearing. Studies by Harvard Law School indicate that pretrial detention virtually eliminates any chance for a fair trail. Pretrial detention prevents the defendants from preparing an adequate defense, and this virtually assures success for the prosecution. It has been proven that the longer you can keep the defendant imprisoned before the trial begins, the greater your chances are for prosecution. This is the real reason for keeping il 1 il ' 13 il 1 il ' (YAHWEH BEN YAHWEH) and his followers incarcerated. They do not represent a threat to the community, they represent a threat to the success of the prosecution! Since being imprisoned, none of the Yahweh members have been able to support their families, and are being represented by public defenders. As a result, monies for their defense are allocated by the federal government. Although the prosecutors have already spent millions on this investigation for the last ten years, they refuse to allocate even a small fraction of that for the defense. On the side of the prosecution, there is a team of investigators from several local, state, and federal agencies who have worked for ten years to build a case. On the other hand, the Government has allocated only enough money for each defendant to have one investigator working 76 The Persecution of il 1 il., 73 ill il ., Volume One for only one week to build an adequate defense. The reason given for this miserly allocation of funds is out of concern for the taxpayers' money. Why isn't the taxpayers' money an issue when it comes to the prosecution's budget? Why isn't the taxpayers' money an issue when it comes to the pretrial detention of illil" ?J illil" (YAHWEH BEN YAHWEH)? The money spent to keep seventeen innocent people imprisoned before trial could be better spent elsewhere. On one side, the prosecution can run up a bill unto the millions of dollars, and on the other hand a few thousand dollars for the defense of innocent people is deemed to be too much. The Yahwehs have been law-abiding, tax-paying citizens for years. Whereas other religions enjoy a tax-free status, the Yahwehs have been required to pay taxes for years. Now all of a sudden, the same money that they put into the system cannot be used for their benefit. This is nothing but religious persecution! Next, we have Judge Norman C. Roettger, who has been assigned to this case, openly admitting, "I am not terribly concerned about getting an impartial jury." This judicial system in this country is built around being tried before an impartial jury of your peers. If the jury has already condemned the defendant before the trial begins, then what is the use of a trial? If the judge is not concerned about an impartial jury, then he is obviously not concerned with justice being served in this case. The main reason behind the problem of getting an impartial jury is the onslaught of 77 L~------The Persecution of il 1 il ., 73 il 1 il ., Volume One negative publicity from the Miami Herald. In the first 120 days since the indictment was issued, the Miami Herald has printed over 30 negative stories on the Yahwehs, most of them on the front page of the main or local section. The Herald has not limited its coverage to just the facts, but has focused primarily on unsubstantiated allegations and hearsay. This proves that this negative campaign is far from being fair journalism. il1 il ' 13 il1 il ' (YAHWEH BEN YAHWEH) has actually gotten more press coverage than deposed Panamanian General Manuel Noriega. The Miami Herald reaches approximately 275,000 readers daily in Dade County, which represent almost half of Dade's registered voters. In addition, the Herald has a daily circulation of 100,000 in Broward County, or about one-sixth of their registered voters. Thus, it is apparent that it will be extremely difficult, if at all possible, to have an impartial jury in the case of il1 il ' 13 il1 il ' (YAHWEH BEN YAHWEH). However, the judge is not concerned about "an impartial jury." So we have il1il' 13 il1il' (YAHWEH BEN YAHWEH) and his followers locked up to prevent him from getting a fair trial. Then we have the prosecution withholding information from the defense to further prevent a fair trial; then the defense is severely limited in investigating this information to even further prevent a fair trial. The judge does not care about a fair trial, and the Miami Herald is doing everything it can to prejudice the public against the Yahwehs before the trial begins. 78 The Persecution of il lil" 13 il lil" Volume One If the charges against il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) were actually true, then all of this foul play would not be necessary. So obviously the charges are untrue. Why would all of these people go through all of this trouble to bring up and try to sustain false charges to stop one man? They obviously do not want him to continue his good works. Immoral individuals throughout the Government and the media are trying desperately to stop il1il' 13 il 1il' (YAHWEH BEN YAHWEH) because of his good works. Immoral individuals can only succeed as long as the righteous people of the world remain blind as to what is really happening. Two thousand years ago, the Scribes (reporters) and the Pharisees (immoral rulers) persuaded the people to turn against Jesus and crucify him. Will we listen this time? • 79 IL_~-~-- --···-, The Persecution of il 1 il"' 73 il 1 il' Volume One SUPREME COURT JUSTICE MARSHALL CONDEMNS LAW HOLDING YAHWEH AS UNCONSTITUTIONAL - Currently, il 1il' 13 il 1il' (YAHWEH BEN YAHWEH) and sixteen members of the Nation of il 1il' (YAHWEH) are being held under a Pre-Trial Detention Clause of the 1984 Bail Reform Act. In a recent Supreme Court decision regarding the 1984 Bail Reform Act, Justice Thurgood Marshall, the only Black Supreme Court Justice ever, condemned this Act as unconstitutional. Justice Marshall stated in his official opmwn, "This case brings before the Court for the first time a statute in which Congress declares that a person innocent of any crime may be jailed indefinitely, pending the trial of allegations which are legally presumed to be untrue ... Such statues, consistent with the usages of tyranny and the excesses of what bitter experience teaches us to call the police state, have long been thought incompatible with the fundamental human rights protected by our Constitution. . .. The charges against him, which are assumed to be untrue until proven, are the very cause for his incarceration. Justice Marshall continues, "Our fundamental principles of justice declare that the defendant is as innocent on the day before his trial as he is on the morning after his acquittal. Under this statute an untried indictment somehow acts to permit a detention, based on other charges, which after an acquittal would be unconstitutional. The conclusion is inescapable that the indictment has been turned into evidence. 'If it suffices to accuse, what will become of the innocent?"' " . . Imprisonment to protect society from predicted but unconsummated offenses is ... unprecedented in this country and ... fraught with danger of excesses and injustice ..." 81 a.. Though the Eighth Amendment guarantees the right to Bail, il1 il' [3 il 1il' (YAHWEH BEN YAHWEH) and his sixteen followers have been categorically denied bail before trial because of their common religious belief. In a series of staged hearings before four different U.S. magistrates, all the Yahwehs were ordered to pre trial detention, although no witnesses and no evidence have been presented against any one of them. Justice Marshall concludes, "Throughout the world today there are men, women, and children interned indefinitely, awaiting trials which may never come or which may be a mockery of the word, because their governments believe them to be 'dangerous.' Our Constitution, whose construction began two centuries ago, can shelter us forever from the evils of such unchecked power. ... Today a majority of the Court [in enforcing the Bail Reform Act] applies itself to an ominous exercise in demolition.'' The first Second Circuit case to face the constitutional issue directly was United States v. Melendez-Arrrion. The Honorable Jon 0. Newman's opinion in the case details how detention for dangerousness breaks radically not merely with the history of bail in the United States, but more importantly, with the fundamental notions that define liberty in this freest of nation. . .. That a competent adult may be jailed, before conviction of any crime, because government officers consider him 'dangerous to the community' under the terms of what the Government styles a 'regulatory' provision is too close to 'a police state approach."' In Unites States v. Gallo, it states, "The inevitable consequences of pretrial incarcer ation, particularly when prolonged beyond a short period, are undeniably severe. They constitute a pattern of harms that we traditionally consider punitive." The Harvard Journal of Law and Public Policy support this by stating, "The quality of the detainee's legal defense is likely to diminish dramatically as long as he or she is incarcerated. The interlude between arraignment and trial is 'perhaps the most critical period of the proceedings.' ... A defendant free on bail or on his own recognizance can make good use of this liberty. He is available on a twenty-four hour basis to consult and participate fully with counsel in time-consuming preparations for trial. He alone may be able to locate and persuade key defense witnesses to testify. He can assist in tracking down evidential leads. Authorities recognized that prior detention hobbles adequate preparation for trial." United States v. Gallo further adds, "All of these factors insure that the quality of the defendant's legal defense will be diluted at best, and possibly be rendered inadequate by extended pretrial incarceration. All of these hardships, including deterioration of morals, demeanor, finances, re sources, reputation, and quality and thoroughness of legal defense, may combine to disadvantage the defendant at the judgment and sentencing states of the pro ceedings. As to judgment, studies have indicated that detention is likely to increase the chances of conviction at trial. . . . studies indicate that detention increases the chances of harsher and longer sentence. . . . Detained defendants are stigmatized, disheartened, and made to suffer great hardships that would normally be associated with punitive sanctions. Other democratic nations which permit pretrial detention enforce fairly strict time 84 The Persecution of ill il" 73 ill il" Volume One limits. For example, the sixty-day or two month rule governs most cases of pretrial detention in Japan and France." All of these facts prove beyond a reasonable doubt that the Government is using pretrial detention against il1il' 13 il1il' (YAHWEH BEN YAHWEH) to attempt to destroy his character, and any chance that he may have for a fair, just, impartial trial. Judge Roettger supports this claim by his statement at a status hearing held on February 4, 1991, when he stated, "I am not terribly concerned about getting an impartial jury.'' In addition, the fact that this method of incarcerating il1il' 13 il1il' (YAHWEH BEN YAHWEH) is undeniably unconstitutional in itself, the very means in which it is being employed in this particular case is unprecedented and defies standards set throughout the country. Numerous examples exist to prove that in the Trial of il1il' 13 il1il' (YAHWEH BEN YAHWEH), the Government is clearly over stepping its bounds with regard to the laws of this country. In United States v. Knight, it is clearly stated that "the fact that the defendant is charged with an offense ... is not, in itself, sufficient to support a detention order." In United States v. Judge Roettger, who approved a pre-trial detention order for il lil' 13 il lil' (YAHWEH BEN YAHWEH) on January 22, 1991, clearly stated at a status hearing held on February 4, 1991, that "All I have is an indictment, and that's about as much as I know about the case." Roettger's decision shows a blatant disregard for the law, and is a clear case of an abuse of his judiciary authority. In United States v. Fisher, a standard was set for offering bail because, "Government offered only hearsay testimony, and chose to rely on triple hearsay ... moreover, conduct for which defendant was indicted occurred two years before indictment, during which time Government allowed him to remain on the streets." Yet in the case of il lil' 13 il lil' (YAHWEH BEN YAHWEH), the only witnesses presented by the Government against il lil' 13 il lil' (YAHWEH BEN YAHWEH) were three detectives who could only tell the court what a convicted killer told them that he heard from somebody else. In conclusion, first we have the United States Constitution ignored as a statute is created to imprison il 1il' 13 il 1il' (YAHWEH BEN YAHWEH). Next, we have the guidelines and standards of that statute ignored in order to continue to persecute il 1il' [3 il 1il' (YAHWEH BEN YAHWEH). Only once before in history, were all the laws of a country totally set aside in order to persecute one man, and that man was Jesus Christ. Are we going to let history repeat itself? • 87 ~. 1 The Persecution of il 1 il"> j::l il 1 iJ"> Volume One PROSECUTION SEEKS TO RAILROAD THEYAHWEHS - For the past six months, the prosecuting attorneys have refused to release any information or witnesses against Yahwehs. Yet, 17 Yahweh defendants, including il1il' 13 il1il' (YAHWEH BEN YAHWEH), remain incarcerated on unsub- stantiated allegations. The prosecution has totally ignored federal laws, rules, regulations and guidelines in every aspect of this act. The most recent case has been its continuous refusal to provide discovery to the defense. Discovery is when the prosecution releases the names of witnesses and all the evidence it will submit during trial. This information is given to the defense attorneys so that they may prepare a case, and to insure that the defendants get a fair trial. Discovery is required by law. Yet the prosecution has refused to release this information. 88 The Persecution of il 1 il., r3 il 1 il., Volume One Since the indictments were handed down on November 6, 1990, the prosecution has withheld vital information: information needed to prepare a proper defense, and information needed to insure a fair trial. The prosecution stated that they would not release this information until 30 days prior to trial. The trial is scheduled for May 20, 1991. As of April 20, 1991, 30 days before the scheduled trial is to begin, the prosecution still has not provided this vital information. The prosecution has now decided that they will not provide this information until two days before trial! This is totally unethical, unjust, and illegal. Rule 16 of the Federal Rules of Criminal Procedure clearly states, "Upon request of the defendant the Government shall permit the defendant to inspect and copy or photograph books, papers, documents, photographs, tangible objects, buildings or places, or copies or portions thereof, which are within the possession, custody or control of the Government, and which are material to the preparation of the defendant's defense or are intended for use by the Government as evidence in chief at the trial." Federal Criminal Code and Rules 1990 edition expounds on the necessity of dis covery by stating, "Discovery contributes to the fair and efficient administration of criminal justice ... by minimizing the undesirable effects of surprise at the trial; and by otherwise contributing to an accurate determination of the issue of guilt or innocence." 89 L_ The Persecution of il liP [3 il lil"' Volume One It goes on to state, "The American Bar Association Standards mandate the prosecutor to make the required disclosure . . . Due process will require the pro secution, on its own, to disclose evidence 'helpful' to the defense." "In Brady [vs. Maryland, 373 U.S. 83] the court held that 'due process' requires that the prosecution disclose evidence favorable to the accused." "Subdivision(a)(l)(E) ... provides for discovery of the names of witnesses to be called by the Government and of the prior criminal record of these witnesses. Many states [including Florida] have statutes or rules which require that the accused be notified prior to trial of the witnesses to be called against him. . .. The American Bar Association's Standards Relating to Discovery and Procedure Before Trial § 2.1(a)(i) require disclosure of the prior criminal record of witnesses places the defense in the same position as the Government, which normally has knowledge of the defendant's record and the record of anticipated defense witnesses. In addition, the defendant often lacks means of procuring this information on his own." These laws are clear. They were established to ensure that every citizen, regardless of race, religion, or ethnic origin, would get a fair trial. However, the prosecution has broken each of these laws, only in this case with the Yahwehs. I • The judge is "not concerned about getting an impartial jury," although I this is one of the fundamental requirements on which this country was I built. I I I If the prosecution, which represents the Government, is allowed to blatantly violate I the very laws that they established, then no citizen is safe in this country. The I I prosecution is setting a very dangerous precedent where a person can be I apprehended and imprisoned for months without bond, without a single piece of I evidence, or a single witness against him. Now, anyone who is considered a "threat to society" by this government becomes a potential political prisoner. This is exactly what is happening in the case of il 1il' 13 il 1il' (YAHWEH BEN YAHWEH). No longer do the words "innocent until proven guilty" carry any meaning within the U.S. justice system. No longer do the words "all men are created equal" continue to be relevant. Why is the prosecution violating the laws of the land in this case with the Yahwehs? If the Yahwehs are actually guilty, as the media would have us believe, then all of these devious, underhanded schemes by the prosecution would be unnecessary. Therefore, the question anses, "Why is the Government trying to railroad the Yahwehs?" The stories were systematically designed by wicked persons within the I media and the U.S. Government to cast il1il' (YAHWEH's) name out as evil. Although the media has been able to get secret information from the Government such as information contained in a sealed indictment, defense lawyers have been denied access to records they are entitled to-- information they vitally need to prepare for the upcoming trial. Worldwide media reports attempted to blot out the name il 1il' (YAHWEH) in stating that the Pulitzer Prize was awarded to coverage of a "local cult." Yet, headlines in the Miami Herald read, "Herald Wins Pulitzer for Articles Probing Yahweh Religious Sect." In fact, all of the stories emphasized the name il1il' (YAHWEH) in the headlines. This is because the media is trying to capitalize off of the fact that the Earth is becoming full of the knowledge of il 1 il ' (YAHWEH). The media is capitalizing off of the fact that people are interested in the name il 1 il ' (YAHWEH), and the people who are called by that name. The media is using the name il 1 il ' (YAHWEH) both to sell newspapers and to secure fame for themselves. This becomes apparent in light of the fact that almost 50 stories, most of them front page, have been written in the Miami Herald in the last six months. Although more stories have been written about il1 il ' (YAHWEH) than any topic, other than the Gulf war, the Herald admits that it has only done "spot" reporting, rather than complete coverage. In "spot" reporting, the Herald is quick to pick up on any negative gossip, rumor, or hearsay concerning the YAHWEHs, sensationalize 94 The Persecution of il 1 il"' 73 il 1 il"' Volume One it, and mix and match it together for several articles. Yet, verifiable facts are intentionally overlooked. In its "spot" coverage, the Herald has failed to report the . following facts: • No evidence has been presented against the YAHWEHs. • No witnesses have come forth to testify against the YAHWEHs. • No bond has been granted to the YAHWEHs, although the law calls for "clear and convincing evidence." • The YAHWEHs have suffered sabotage at their businesses during this ordeal. • The YAHWEHs have suffered persecution in prison. • Several members, including il 1il ., 1J il 1 il ., (YAHWEH BEN YAHWEH), himself, have been placed in solitary confinement without provocation. • One member, Judith Israel, was denied emergency medical treatment and almost suffered a stroke. • Before even looking at the appeal, the United States 11th Circuit Court of Appeals refused to grant il 1il ., 1J il 1 il ., (YAHWEH BEN YAHWEH) bond. • Judge Roettger is not "concerned about an impartial jury." • Judge Roettger will not allow the defendants to wear their religious garments, and has indicated that he may not allow spectators to wear theirs. • Convicted killers are granted bond while awaiting their appeal, while the "accused" YAHWEHs have been denied bond. Why are these modern day "scribes" only reporting half of the story? Two thousand years ago, Christ warned the "scribes" saying, "Woe unto you, scribes and Pharisees, hypocrites! for ye shut up the kingdom of heaven against men: for ye neither go in yourselves, neither suffer ye them that are entering to go in" (Matthew 23:13). Just as the scribes in the past were upset with Christ for preaching the Kingdom of Heaven, these modern day scribes are upset with il1 il' 13 il1 il ' (YAHWEH BEN YAHWEH) for teaching the Kingdom of Heaven today. Just as the scribes in the past plotted against Christ, so are the modern day scribes plotting against il1 il ' 13 il1il' (YAHWEH BEN YAHWEH) today. Just as the scribes in the past deceived the people and turned them against Christ, so these modern day scribes are attempting to deceive you and turn you against il1il' 13 il1il' (YAHWEH BEN YAHWEH). Is il1il' 13 il1il' (YAHWEH BEN YAHWEH) the Son of God il1il" (YAHWEH) who was promised to return? This is the one question that these modern day scribes do not want you to consider. • 96 The Persecution of i1 1 il., 13 i1 1 il., Volume One illil j 1::1 illil j DENIED BOND BECAUSE HE QUOTED THE BIBLE - In a unprecedented motion which is totally contradictory to the First Amendment guarantee to freedom of free expression, Judge Roettger denied ill il" 13 ill il" (YAHWEH BEN YAHWEH) bond based upon two taped classes given by ill il ., 13 illil" (YAHWEH BEN YAHWEH). On the first tape, Judge Roettger condemns illil" 13 illil" (YAHWEH BEN YAHWEH) for quoting Luke 19:27. Anyone with a red-lettered edition of the Bible can clearly see that these were the same words spoken by Jesus almost 2,000 years ago. In order for Judge Roettger to rule that ill il ., 13 ill il ., (YAHWEH BEN YAHWEH) is a threat to the community because he quoted Jesus means that Roettger, had he been around 2,000 years ago, would have likewise ruled that Jesus was a threat to the community. Thus, Roettger's decision means that hundreds of thousands of Christian ministers who teach from the Holy Bible, as well as hundreds of millions of Christians worldwide, are a threat to the community. 97 The Persecution of il 1 il" 13 il 1 il ., Volume One On the second tape, we hear il lil' 13 il lil' (YAHWEH BEN YAHWEH) quoting Leviticus 24:16. Leviticus 24:13lets us know that these are the words which the Lord il 1il' (YAHWEH) spoke unto Moses. Would Roettger have us believe that Moses, or even the Lord il 1il ' (YAHWEH) himself, is a threat to the community? Not only does this affect all Christians, but since Leviticus is one of the first five books of the Bible, also known as the Torah, then all Jews worldwide are likewise condemned by Roettger's decision. Other than these two taped sermons, no other evidence was brought forth against il 1il' 13 il lil' (YAHWEH BEN YAHWEH). Thus, it becomes apparent that the charges against illil' 13 il lil' (YAHWEH BEN YAHWEH) are not the real issue. THE REAL ISSUE IS HIS TEACHINGS. This is the type of decision we could expect if this were a communist state, or a totalitarian dictatorship, especially one where the worship of God is illegal. But this is America. The founding fathers of this country set up constitutional guarantees to insure that not only could you worship God as you please, but you could also express that belief. If nowhere else on Earth, you would expect that in America you could quote the Bible without being thrown in prison. This is the same Bible that has been the world's best-seller for centuries. This is the same Bible that is in virtually every home in America. This is the same Bible that is in almost every hotel and motel room in America. This is the same Bible that every Christian, Jew, and Muslim around the world believe in, either some part of it, or all of it. The Assistant United States Attorney, Richard Scruggs and his assistant, have stooped to the lowest of morality by attempting blackmail of a co-defendant by threatening him that if he did not falsely plea bargain and lie for them, they would falsely charge him with drugs. President Bush, we know you have the power to cure double standards at law, since your son was let off easy in the S & L problems. • 103 ~ ------The Persecution of il 1il ., 13 il 1 il" Volume One PERSECUTION BY U.S. GOVERNMENT DRIVES YAHWEH MEMBER INSANE - For the past eight months, Ahinadab Israel, along with il 1il' [3 il1il' (YAHWEH BEN YAHWEH) and 16 other members of the Nation of il1il., (YAHWEH), has been incarcerated under pre-trial detention. No evidence has been presented and not witnesses have testified against them, yet they still have been detained well beyond the three months prescribed by the Speedy Trial Act. In addition, corrupt government officials have abused their authority to persecute these presumably innocent defendants during these last several months. While people who have been convicted are being treated like decent human beings, these members of the Nation of il1il., (YAHWEH), who have only been accused and have not yet had a trial, are suffering from inhumane living conditions. Most recently, the Government has imposed starvation upon them. All of the defendants are strict kosher vegetarians whose diet is prescribed by the Bible. In every single case, the Government has granted these petitions with decent meals. Yet, in dealing with the Yahwehs, the corrupt government officials have twisted the meaning of kosher meals. One day it may mean two pieces of rotten fruit. On another day, it may mean brown lettuce and spoiled tomato salad. On another day, it may mean a few strips of carrots and a handful of broccoli. Whereas orthodox Jews can get kosher meals three times a day, and devout Muslims can get pork-free meals three times a day, members of the Nation of il1il"' (YAHWEH) have been reduced down to one paltry serving that is barely edible (and sometimes isn't edible at all). Months of this imposed starvation have taken its toll on the Yahwehs. The Yahwehs have experienced their first casualty as a result of this persecution by corrupt government officials. Ahinadab Israel, who refused to deviate from his Bible prescribed diet, has been starved to the point of insanity. He recently ran from the shower naked and went and put his head in a toilet. He has become totally paranoid. Ahinadab is suffering from anemia, malnutrition, starvation, disorientation, and massive hallucinations. If a team of doctors were brought in to examine him, they would probably all agree that he should be hospitalized. Yet he has been denied medical treatment. To make matters worse, instead of placing him in the hospital where he belongs, prison officials threw him in the "Hole" (solitary confinement). The Ahinadab that was arrested on November 7, 1990, has been killed off. Aside from i11i1' 13 i11i1' (YAHWEH BEN YAHWEH), Ahinadab no longer recognizes any of his brothers. Thanks to continued persecution by corrupt officials, he is no longer the same man that walked into the jail. For years, i11i1' 13 i11i1' (YAHWEH BEN YAHWEH) has prescribed a diet for his followers that consisted of beans, rice, vegetables, and a Hebrew salad which contained a wide variety of vegetables. Corrupt government officials have criticized i11i1' 13 i11i1' (YAHWEH BEN YAHWEH) for this diet. Assistant U.S. Attorney Scruggs has even accused i11 i1 ' 13 i11 i1 ' (YAHWEH BEN YAHWEH) of abusing his followers and starving them. Yet there has not been one proven case of this happening. While adhering to this diet for years, none of i11 i1 ' 13 i11 il ' (YAHWEH BEN YAHWEH'S) followers, including Ahinadab, have ever suffered abuse or malnutrition. In fact, some of his followers who came to him with terminal cancer have been fully rehabilitated solely because of this diet. This type of torture and abuse that Ahinadab is suffering is the type we would expect to see in places like the Soviet Union, Vietnam, Korea, Uganda, Haiti, Cuba, or any other underdeveloped or communist country -- but certainly not in America. We wonder which one of the Yahweh defendants (who have also been malnourished for over eight months) is next. You must ask yourself if you will be the next target of corrupt government officials. · Are you an enemy of the state? If the Republicans are in authority, then being a Democrat might make you an enemy. If Christians are in authority, then being a Jew or a Muslim might make you an enemy. If a Methodist is in control, then being a Baptist, Catholic, or Episcopalian might make you an enemy. Maybe this sounds far fetched, but it probably sounded far-fetched to so-called witches in this country in the late 1600s. How many months of starvation and malnutrition could you take before you go off the edge? Today it's Ahinadab because he's a Yahweh. Tomorrow it could be you. • • 107 The Persecution of il 1 il" 13 il 1il" Volume One FEDERAL JUDGE ROETTGER ATTEMPTS .. BLACKMAIL OF YAHWEH LAWYER - One of the public defenders assigned to the Yahwehs' case was forced to drop out after almost six months of preparation and with a month left before the scheduled trial date begins. Our informed sources close to the case reveal that Judge Roettger stated he was not going to sign for the lawyer to get paid because the lawyer did not get the defendant to plea bargain. This is outright religious persecution and racial discrimination. This is an open violation of human rights. The Sixth Amendment to the United States Constitution grants every individual in this great country the right to due process of law. This due process means that whenever any individual is arrested, he is told he has the right to be represented by an attorney and one will be provided to him if he is unable to afford one. On top of that, the U.S. Constitution dictates that a person is innocent until proven guilty. Yet, here is the case of a federal judge, a public servant paid to enforce the law, showing total disregard for the most fundamental laws on which this country is established. 108 The Persecution of il 1 il ., 1:::1 il 1 il" Volume One This lawyer was also one of the lawyers who adopted a motion to recuse Judge Roettger from the case because Roettger has clearly demonstrated that he does not intend to hold a fair trial. At a status hearing held February 6, 1991, Roettger urged all defendants to plea bargain, and then followed up by going over his sentencing · guidelines. Now we have this same federal judge attempting to coerce pleas by applying pressure to the legal counsel of the defendants. When explaining the situation to the defendant, the lawyer explained that he has a wife and children to support. These actions by the Judge made it impossible for him to fulfill his obligations to his family. So in order to continue to support his family, he has no other alternative than to drop the case. This is outright extortion by a federal judge. This is Blackmail! For a judge to force a lawyer to get his client to plead guilty or face monetary loss is illegal. Will this judge attempt this same extortion on the other defense lawyers? What about the jurors? Will the judge misuse his power to suppress evidence that would exonerate the defendants? Will this judge allow hearsay testimony (which is illegal) against the defendants, which has been the case in all of the bond hearings? How can the Yahweh defendants receive a fair trial from a judge who attempts blackmail against their lawyers? How can the Yahweh defendants receive a fair trial from a judge who "is not concerned about getting an impartial jury?" How can the Yahweh defendants receive a fair trial from a judge who allows the prosecution to ignore laws regarding discovery of evidence? How can the Yahweh defendants receive a fair trial from a judge who urges them to plead guilty at every available opportunity? If the Yahwehs, who are a model of excellence for the Black community, are allowed to be railroaded, then what hope do 60 million Blacks of America have for justice? Add to this the fact that when a white man was wrongly jailed for three years, he received over $250,000 compensation; but when two black men were wrongly jailed for 12 years, they have been repeatedly denied any compensation. Add to this the fact that police officers can outright kill innocent blacks and either be declared innocent (as in the case of Neville Johnson and Arthur McDuffie) or allowed to roam the streets without serving a day in jail after being convicted (as in the case of William Lozano). Now the one group that was making real progress in the economic empowerment of the Black community, the Nation of il1il' (YAHWEH), is being denied justice at all turns. Are all men created equal as the Declaration of Independence states? Or should this read, "All white men are created equal"? Is everyone innocent until guilty? Is the U.S. Government sending a message to the Black community that "When you stop begging for government dollars, pool your resources, become self-sufficient and independent, and rebuild your communities, then we're going to persecute you into submission"? Why does the U.S. Government continue attacking and persecuting ill il' 13 ill il' (YAHWEH BEN YAHWEH)? Could it be that illil' 13 illil' (YAHWEH BEN YAHWEH) is taking a stand in behalf of Blacks of America? Could it be that illil' 13 illil' (YAHWEH BEN YAHWEH) is the Self-Proclaimed Son of God who is promised to return? All indications of world affairs strongly imply that these are the days when Christ would make his second coming. What if ill il' 13 il 1 il., (YAHWEH BEN YAHWEH) is the second coming of Christ? • 111 ~ The Persecution of i1 1 il"' 7J i11 iP Volume One ASSISTANT U.S. ATTORNEY SCRUGGS TRIES ''DIVIDE AND CONQUER'' TACTICS AGAINST THE YAHWEHS - On Friday, March 15, 1991, one of the Yahweh defendants was rudely awaken at 4 a.m., and brought to a surprise hearing before U.S. District Judge Norman C. Roettger. Immediately, the Yahweh defendant was confronted by Assistant U.S. Attorney Richard Scruggs. He told the defendant that another defendant had told on him and that it would be best for him to plea bargain. The Yahweh defendant adamantly denied the charges against him, as he has done for the last four months while imprisoned before trial. Scruggs then began to badger the Yahweh defendant and to demand a confession and plea bargain. When Scruggs saw his bluff had been called, he pleaded with Judge Roettger. Roettger responded angrily declaring that he was informed he was called for a plea bargain, which was not taking place. Scruggs begged, saying he needed more time. Roettger reprimanded him saying that something stunk about the whole thing. After four months of holding all the Yahweh defendants without bail, the prosecution has produced absolutely nothing. No witnesses. No evidence. No confessions. 112 The Persecution of il 1 il"' 7:::1 il 1 il"' Volume One Nothing! Roettger has stated at an earlier status hearing held on February 6, that it is "unusual to have a case with 17 defendants and no pleas [plea bargaining] by this stage [after three months]." Now, a month after that status hearing, Scruggs has tried to force the issue by pressuring the defendants into plea bargaining, but to no avail. Then another bizarre twist is added to the dirty, underhanded schemes of the prosecution. Absolutely no record exists of the surprise hearing on March 15. According to U.S. District Court officials, records are made of each hearing, and are available to the public. Many hearings are transcribed and those transcripts are available for public inspection. Those that are not transcribed may be ordered to be transcribed for a fee. However, when inquiry was made into this strange hearing of March 15, request for public records were flatly denied. No explanation was given. All indications lead to the inescapable conclusion that Assistant U.S. Attorney Scruggs is trying to conceal the facts and mislead the public by hiding information that would be damaging to his case. This is nothing less than a coverup of major proportions! Inside sources reveal that Scruggs plans to try the same "divide and conquer" tactics with each of the Yahweh defendants by isolating them and outright lying to them, saying, "So-and-so told on you so you might as well confess. If you do, we'll make 113 • l The Persecution of i1 1 i1 ., 73 i1 1 il' Volume One sure you get a lighter sentence. Otherwise you'll be facing so many more years if you refuse to cooperate." Earlier this year, another defendant in the case, Sister Judith Israel, was denied emergency medical treatment. She later found out that if she would speak out against il1il' 13 il1il' (YAHWEH BEN YAHWEH), that she would become one of the "favored" inmates and would have full access to all the medical treatment she needs. On the one hand, you may say that these "divide and conquer" tactics are necessary to expose the truth. However, if you presume these people to be innocent, as the U.S. Constitution dictates, then it becomes easy to see how their refusal to confess to crimes they did not commit could be misconstrued as "not cooperating." The question becomes, "How long do you continue these devices before finally giving the defendants the benefit of the doubt?" The very fact that Scruggs has to resort to such wicked devices reveals that he does not have enough information to prove that person's guilt. So if you do not know of a surety that a person is guilty, how can such tactics be justified? The end does not justify the means. Two thousand years ago, the "divide and conquer" tactic was used successfully against Jesus Christ in order to separate him from his followers and the people, and thus, crucify him. When these two traitors agreed to lie for the Government, they were suddenly given bond and freed on their "own signature" bond of $500,000. They did not have to put up anything. The trick and game is: When you agree to lie for Assistant U.S. Attorney Scruggs, representing the Government, you are not a flight risk or a danger to the community. This is an insult to all intelligent people. What a shame on Assistant U.S. Attorney Scruggs. This continued type of low-minded, immoral behavior is bringing disgrace upon all good, law-abiding citizens of America. This is open proof of religious persecution: denial of due process of law under the U.S. Constitution. President Bush should be ashamed to "allow" Assistant U.S. Attorney Scruggs to indict a "whole religion" and call the "true" practice of religion a "racket." In 1990, followers of i11il" 13 i11il" (YAHWEH BEN YAHWEH), conforming to his teachings of self-help programs, utilized their resources to establish First Rate Foods. These hard-working, tax-paying citizens pooled their hard-earned savings to purchase equipment, to repair the run-down equipment provided by the city, and to stock the shelves. Then they volunteered their leisure time to clean up the building and prepare the store for grand opening. By unifying their efforts and working together as family, members of the Nation of ill il j (YAHWEH) were able to achieve the impossible and open First Rate Foods with less than two months preparation when it usually takes six months to a year to open a supermarket. Residents of Overtown, the predominantly black neighborhood that became infamous nationwide following several riots in the past few years, at long last had a supermarket in its midst that was truly "First Rate." However, evil individuals within the U.S. Government, led by Assistant U.S. Attorney Scruggs, have continually misused and abused their power to harass and hound First Rate Foods until it finally closed it doors. First they cast a shadow over First Rate Foods by publicly claiming that the owners and management were under federal investigation and, thus, in violation of the contract with the City of Miami. In fact, none of the owners, managers, or staff of First Rate Foods are under investigation. Yet, simply because other members of the Nation of il 1 il ., (YAHWEH) have been arrested (although not convicted), Scruggs is persecuting the entire Nation of illil' (YAHWEH) under the pretense of "guilt by association." This is totally in violation of the U.S. Constitution's First Amendment guarantee of Freedom of Religion. This is totally against the basic fundamental right that a person is innocent until proven guilty. 121 .-.. However, never in the history of this country has the mere arrest (not the conviction) of a person been just cause for other persons with a common belief to be subjected to harassment and persecution. Never has a group of people been denied the right to participate in the free enterprise system because of their religious belief. Yet this is exactly what is happening to members of the Nation of i11 il j (YAHWEH). If this dangerous precedent is allowed to stand, then the consequences for this country will be disastrous. Hitler, in persecuting the Jews because of their beliefs and economic successes, transformed Germany into a fascist police state. By eliminating the rights of the Jews, he successfully eliminated the rights of all citizens, particularly anyone in opposition to his plans. On November 7, 1990, over 300 Government agents raided all Yahweh properties nationwide, breaking down doors, handcuffing men, women, and children; seizing documents and arresting members wholesale -- all without a search warrant or an arrest warrant. Yet, HRS descended on il1il" (YAHWEH) University campus recently, saying they had received a report that there were unnamed students who were being abused and who were starving. These allegations are totally illegal, discriminatory, and amount to religious persecution. The first act of persecution is the fact that there are no boarding students. All of the students live off-campus. The act of harassing the Yahwehs' private school and not the public schools and other private schools is RELIGIOUS PERSECUTION and TOTALLY UNCONSTITUTIONAL. Jesus Christ, among men, is a vivid example of persecution and crucifixion in the absence of prosecution or trial. Some say the same may be true of the "Miami Messiah, " Yahweh Ben Yahweh. In our town--"love it or leave it"-- the Black person on the street is once again faced with the dilemma that both confounds and confuses him or her. The concern involves the religious group known as Yahwehs or Black Jews. The two questions most frequently heard are: What is the true interest of the federal government in the prosecution of the [group]? And, why is there so much reluctance 143 ----~ The Persecution of il 1 il" 13 il 1il" Volume One on the part of the Black community to get involved in the plight of their fellow citizens of color? With regard to question one, there appears to be two schools of thought. One is economic, involving the old Egyptian adage of the Phoenix rising from the ashes to again rule the world. This idea relates to Yahweh Ben Yahweh's formula for the redemption of Black people, which appears to be working, as shown in the regal bearing of his followers, and the community wealth they've been able to amass in a little more than a decade. The other is religious and political, involving biblical differences on the origin of the "one God" concept and fear of a "Black takeover" if they ever found out their true beginnings. The reluctance on the part of fellow Blacks to get involved in "Yahweh's business" is thought to stem from ignorance, media hype, and government propaganda. Ask any Black on the street about his attitude on the arrest and indictment of Yahweh Ben Yahweh and the leaders of the [group], and you will hear everything from a simple "I really don't know" to a barrage of stories they've heard or gotten strictly from "the horse's mouth" of a friend who is a member or former member. The question under these circumstances now becomes: To what extent are we, as responsible citizens of color, obligated to find out the truth about the problems of a group that are racially related (Black)? 144 The Persecution of il 1 il., 7::I il 1 il., Volume One Two aspects of this scenario bother these writers. One is: Why is Yahweh Ben Yahweh incarcerated and denied bail before his trial? And the other is: Why is the traditional "separation of church and state doctrine" conspicuously absent from these proceedings? It is also our understanding that this [group] (a bonafide religious entity) has been denied tax exempt status. Why? According to newspaper reports, the indictments stem from tapes of speeches made by Yahweh Ben Yahweh and circumstantial or hearsay information extracted from former members, or a convicted murderer of two Opa-locka residents, who is now m pnson. A very significant factor that appears to have been overlooked by prosecutors is the attitude of practicing Yahweh members, who categorically reject the Government's contention that their leader is an evil, merciless dictator, prone towards violence, sexual abuse, or even murder. From outward appearance, the members all seem well-adjusted, happy, and satisfied with their lives. The Yahwehs' simple response to what they believe is an "act to destroy their faith" has been through the distribution of leaflets and pamphlets extolling what they believe is the truth about what and who thy are: a newspaper ad (showing pictures of properties they own) containing the words: "For which of these works do they 145 The Persecution of i1 1 i1 ., 7J. i1 1i1 ., Volume One seek to persecute Yahweh Ben Yahweh?" and a 229-page book which explains in detail the philosophy, objectives, and practices of the [group]. In the book, "From Poverty To Riches-- The Works' of Yahweh Ben Yahweh, "published and edited by The Temple of Love, the following explanations of their beliefs are explored: • Who is Yahweh? "Yahweh, in the original Hebrew, is the covenant God of Israel." "According to Jewish custom, because of reverence, the divine name was not to be spoken, so the words 'Lord' and 'God' were substituted. Because the divine name discloses God's nature, it is laden with authority, power and holiness of God himself." • Where is the name Yahweh found? Untold thousands of more dollars have been spent per week, per person, to keep illil" [J illil" (YAHWEH BEN YAHWEH), the other 15 followers, and Sister Judith housed in prison, without a trial, for the past 58 weeks. Amended in 1978 and 1984, the statute was so broadly worded that it could be made to apply to any group or organization who is far outside of what would be normally considered racketeering enterprises. Even though this broad language in the statute could apply to religious organizations such as the Nation of il 1il., (YAHWEH), Kevin O'Neil, the Legal Director for the Ohio ACLU, reviewed the charges against illil' jJ illil' (YAHWEH BEN YAHWEH) and the Nation of il1il' (YAHWEH), and stated, "It is still unconstitutional for a church to be prosecuted under a racketeering law simply as a matter of First Amendment freedom of religious issues."
