You have applied under section 20.2 of Part II.1 of the Environmental Protection Act , R.S.O. 1990, c. E. 19 (Environmental Protection Act) for approval of: the establishment of stormwater management Works to serve the 10.91 ha portion of the Kleinburg North Extension Subdivision, in the City of Vaughan, for the collection, treatment and disposal of stormwater runoff from a total catchment area of 10.91 ha (4.96 ha portion of the 19T-08V04 Subdivision-owned by 11336 Highway 27 G.P. Inc., 5.87 ha portion of the 19T03V02 Subdivision- owned by 1321362 Ontario Inc. and 0.08 ha portion of a future residential subdivision (Vivot Property)), to provide Enhanced Level water quality protection and erosion control and to attenuate post-development peak flows to pre-development levels, discharging to the Humber River, for all storm events up to and including the 100-year return storm, consisting of the following:

a 150 mm deep permeable pavement sub-base located on all driveways within the subdivision to capture the 15 mm rainfall event;

increase of depth of topsoil by 56 mm on all right-of-way areas, buffer landscaped areas and all lot landscaped areas to capture the 15 mm rainfall event;

all roof leaders within the subdivision directing roof runoff to the front and rear yards;

OUTLET 3 five (5) enhanced grassed swales, located along the eastern side of Endless Circle, designed to accommodate up to and including the 100-year return storm runoff from a total catchment area of 1.36 ha and to provide pre-treatment upstream of each section of an infiltration trench, having a total active storage volume of 29.45 m 3 , a total length of 65.45 m, maximum ponding depth of 0.3 m, a 1% to 3% bottom grade, bottom width of 0.3 m, top width of 2.7 m and 4:1 side slopes, complete with a 1.15 m thick and 0.6 m wide sand fill layer, each enhanced grassed swale discharging via a Zurn Z- 100 area drain and a 200 mm diameter storm sewer to the infiltration trench system;

six (6) enhanced grassed swales, located along the western side of Endless Circle, designed to accommodate together with an infiltration trench up to and including the 100-year return storm runoff from a total catchment area of 0.48 ha and to provide pre-treatment upstream of each section of an infiltration trench, having a total active storage volume of 52.59 m 3 , a total length of 94.76 m, maximum ponding depth of 0.3 m, a 1% to 3% bottom grade, bottom width of 0.65 m, top width of 3.05 m and 4:1 side slopes, complete with a 0.5 m thick filter media layer located below the swale, consisting of 85% sand, 10% soil fines and 5% organic matter (leaf composite), discharging to the infiltration trench system;

a 1.3 m to 1.38 m wide, 2.88 m deep and 94.76 m long infiltration trench located along the western side of Endless Circle with some portions located under the enhanced grassed swales, complete with four (4) 200 mm diameter inlet pipes, 300 mm diameter and 375 mm diameter perforated pipe installed in a 2.88 m deep layer of 50 mm diameter clear stone wrapped on all sides with non-woven geotextile filter fabric and two (2) -2.8 mm and 2.88 mm diameter orifices allowing a maximum discharge of 54 L/s and 161 L/s (100-year return storm) respectively, the trench discharging via stormwater management Works located within the Kleinvit Estates Inc. Land - 19T-08V05 Subdivision (enhanced grassed swales, the infiltration trench, the 450 mm diameter outlet pipe complete with a 301 mm diameter orifice allowing a maximum discharge of 279 L/s (100-year return storm), the 450 mm diameter outlet pipe and the 0.15 m deep scour pool lined with rip rap (Outlet 3)) overland across the Region Conservation Authority Land to the Humber River;

OUTLET 2 three (3) enhanced grassed swales, located along the eastern side of Mary Natasha Court, designed to accommodate up to and including the 100-year return storm runoff from a total catchment area of 1.09 ha and to provide pre-treatment upstream of each section of an infiltration trench, having a total active storage volume of 20.53 m 3 , a total length of 45.63, maximum ponding depth of 0.3 m, a 0.5% and 1.7% bottom grade, bottom width of 0.3 m, top width of 2.7 m and 4:1 side slopes, complete with a 1.15 m thick and 0.6 m wide sand fill layer, each enhanced grassed swale discharging via a Zurn Z-100 area drain and a 200 mm diameter storm sewer to the infiltration trench system;

three (3) enhanced grassed swales, located along the western side of Mary Natasha Court, designed to accommodate together with an infiltration trench up to and including the 100-year return storm runoff from a total catchment area of 0.25 ha and to provide pre-treatment upstream of each section of infiltration trenches, having a total active storage volume of 29.25 m 3 , a total length of 52.71, maximum ponding depth of 0.3 m, a 0.5% and 1.7% bottom grade, bottom width of 0.65 m, top width of 3.05 m and 4:1 side slopes, complete with a 0.5 m thick filter media layer located below the swale, consisting of 85% sand, 10% soil fines and 5% organic matter (leaf composite), discharging to the infiltration trench system;

a 1.53 m wide, 3.03 m deep and 52.71 m long infiltration trench located along the western side of Mary Natasha Court with some portions located under the enhanced grassed swales, complete with three (3) 200 mm diameter inlet pipes and a 525 mm diameter perforated pipe installed in a 3.03 m deep layer of 50 mm diameter clear stone wrapped on all sides with non-woven geotextile filter fabric, discharging via a 525 mm diameter outlet pipe complete with a 188 mm diameter orifice allowing a maximum discharge of 119 L/s (100-year return storm), a 525 mm diameter outlet pipe and a 0.15 m deep scour pool lined with rip rap (Outlet 2) overland across the Toronto Region Conservation Authority Land to the Humber River;

OUTLET 1 four (4) enhanced grassed swales, located along the western and southern sides of Secret Garden Court, designed to accommodate up to and including the 100-year return storm runoff from a total catchment area of 0.83 ha and to provide pre-treatment upstream of each section of an infiltration trench, having a total active storage volume of 44.08 m 3 , a total length of 97.96, maximum ponding depth of 0.3 m, a 1.5% and 2.5% bottom grade, bottom width of 0.3 m, top width of 2.7 m and 4:1 side slopes, complete with a 1.15 m thick and 0.6 m wide sand fill layer, each enhanced grassed swale discharging via a Zurn Z-100 area drain and a 200 mm diameter storm sewer to the infiltration trench system;

four (6) enhanced grassed swales, located along the northern and eastern sides of Secret Garden Court, designed to accommodate together with an infiltration trench up to and including the 100-year return storm runoff from a total catchment area of 0.95 ha and to provide pre-treatment upstream of each section of infiltration trenches, having a total active storage volume of 33.8 m 3 , a the total length of 60.0, maximum ponding depth of 0.3 m, a 1.5% and 2.5% bottom grade, bottom width of 0.65 m, top width of 3.05 m and 4:1 side slopes, complete with a 0.5 m thick filter media layer located below the swale, consisting of 85% sand, 10% soil fines and 5% organic matter (leaf composite), discharging to the infiltration trench system;

a 1.45 m to 1.53 m wide, 2.95 m to 3.03 m deep and 60.9 m long infiltration trench located along the northern and eastern sides of Secret Garden Court with some portions located under the enhanced grassed swales, complete with four (4) 200 mm diameter inlet pipes, 540 mm diameter and 525 mm diameter perforated pipe installed in a 2.95 m to 3.03 m deep layer of 50 mm diameter clear stone wrapped on all sides with non-woven geotextile filter fabric and two (2) 312 mm and 416 mm diameter orifices allowing a maximum discharge of 304 L/s and 349 L/s (100-year return storm) respectively, the trench discharging via a 600 mm diameter outlet pipe complete with a 353 mm diameter orifice allowing a maximum discharge of 381 L/s (100-year return storm), a 600 mm diameter outlet pipe and a 0.15 m deep scour pool lined with rip rap (Outlet 1) overland across the Toronto Region Conservation Authority Land to the Humber River;

all in accordance with the application dated February 28, 2013 and received April 10, 2013, including the reports entitled "North Humber Extension Proposed Low Impact Subdivision Stormwater Management Design Report, City of Vaughan" dated August 2012 and "North Humber Extension Proposed Low Impact Subdivision Operations and Maintenance Report, City of Vaughan" dated May 2013, final plans and specifications prepared by The Municipal Infrastructure Group Ltd.

For the purpose of this environmental compliance approval, the following definitions apply:

1. "Approval" means this Environmental Compliance Approval and any Schedules to it, including the application and supporting documentation;

2. "Director" means any Ministry employee appointed by the Minister pursuant to section 5 of the Part II.1 of the Environmental Protection Act;

3. "District Manager" means the District Manager of the York-Durham District Office of the Ministry;

4. "Ministry" means the Ontario Ministry of the Environment;

5. "Owner" means 11336 Highway 27 G.P. Inc., and includes its successors and assignees;

6. "Water Supervisor" means the Water Supervisor of the York-Durham District Office of the Ministry; and

7. "Works" means the sewage works described in the Owner's application, this Approval and in the supporting documentation referred to herein, to the extent approved by this Approval.

You are hereby notified that this environmental compliance approval is issued to you subject to the terms and conditions outlined below:

TERMS AND CONDITIONS

1. GENERAL PROVISIONS

1.1 The Owner shall ensure that any person authorized to carry out work on or operate any aspect of the Works is notified of this Approval and the conditions herein and shall take all reasonable measures to ensure any such person complies with the same.

1.2 Except as otherwise provided by these Conditions, the Owner shall design, build, install, operate and maintain the Works in accordance with the description given in this Approval, the application for approval of the Works and the submitted supporting documents and plans and specifications as listed in this Approval.

1.3 Where there is a conflict between a provision of any submitted document referred to in this Approval and the Conditions of this Approval, the Conditions in this Approval shall take precedence, and where there is a conflict between the listed submitted documents, the document bearing the most recent date shall prevail.

1.4 Where there is a conflict between the listed submitted documents, and the application, the application shall take precedence unless it is clear that the purpose of the document was to amend the application.

1.5 The requirements of this Approval are severable. If any requirement of this Approval, or the application of any requirement of this Approval to any circumstance, is held invalid or unenforceable, the application of such requirement to other circumstances and the remainder of this Approval shall not be affected thereby.

2. EXPIRY OF APPROVAL

The approval issued by this Approval will cease to apply to those parts of the Works which have not been constructed within five (5) years of the date of this Approval.

3. CHANGE OF OWNER

3.1 The Owner shall notify the District Manager and the Director, in writing, of any of the following changes within thirty (30) days of the change occurring:

(a) change of Owner;

(b) change of address of the Owner;

(c) change of partners where the Owner is or at any time becomes a partnership, and a copy of the most recent declaration filed under the Business Names Act , R.S.O. 1990, c.B17 shall be included in the notification to the District Manager; and

(d) change of name of the corporation where the Owner is or at any time becomes a corporation, and a copy of the most current information filed under the Corporations Information Act , R.S.O. 1990, c. C39 shall be included in the notification to the District Manager.

3.2 In the event of any change in ownership of the Works, other than a change to a successor municipality, the Owner shall notify in writing the succeeding owner of the existence of this Approval, and a copy of such notice shall be forwarded to the District Manager and the Director.

3.3 Notwithstanding any other requirements in this Approval, upon transfer of the ownership or assumption of the Works to a municipality if applicable, any reference to the District Manager shall be replaced with the Water Supervisor.

4. OPERATION AND MAINTENANCE

4.1 The Owner shall make all necessary investigations, take all necessary steps and obtain all necessary approvals so as to ensure that the physical structure, siting and operations of the stormwater management Works do not constitute a safety or health hazard to the general public.

4.2 The Owner shall prepare an operations manual, complete with a water quality, water quantity, infiltration and groundwater and sediment accumulation monitoring program, prior to commencement of operation of the stormwater management Works, based on the recommendations of the report entitled "North Humber Extension Proposed Low Impact Subdivision Operations, Maintenance and Monitoring Report, City of Vaughan" revised July 2013 and prepared by The Municipal Infrastructure Group Ltd. and retain a copy at the Owner's office, and, upon request, make the operations manual available to Ministry staff. The operations manual shall include, but shall not be necessarily limited to, the following information:

(a) operating procedures for operation of the Works;

(b) inspection programs, including frequency of inspection, for the Works and the methods or tests employed to detect when maintenance is necessary;

(c) a water quality, water quantity, infiltration and groundwater and sediment accumulation monitoring program;

(d) repair and maintenance programs, including the frequency of repair and maintenance for the Works;

(f) procedures for the inspection and calibration of monitoring equipment; and

(f) procedures for receiving, responding and recording public complaints, including recording any follow-up actions taken.

4.3 The Owner shall maintain the operations manual current and retain a copy at the Owner's corporate office for the operational life of the Works. Upon request, the Owner shall make the manual available to Ministry staff.

4.4 The Owner shall undertake an inspection of the condition of the stormwater management Works, for the first two (2) years of operation at least after every major storm event (rainfall event of at least 25 millimetres) and following the first two (2) years of operation at least semi-annually after major storm event (rainfall event of at least 25 millimetres), in the Spring and in the Fall , and undertake any necessary cleaning and maintenance to ensure that sediment, debris and excessive decaying vegetation are removed from the above noted stormwater management Works to prevent the excessive build-up of sediment, debris and/or decaying vegetation to avoid reduction of capacity of the Works. The Owner shall also regularly inspect and clean out the inlet to and outlet from the Works to ensure that these are not obstructed. The Owner shall conduct the inspections based on the recommendations of the report entitled "North Humber Extension Proposed Low Impact Subdivision Operations, Maintenance and Monitoring Report, City of Vaughan" revised July 2013 and prepared by The Municipal Infrastructure Group Ltd.

4.5 After a four (4) year period from the start of operations, the District Manager of the MOE District Office may alter the frequency of inspection of the stormwater management Works, if he/she is requested to do so by the Owner and considers it acceptable upon review of information submitted in support of the request.

4.6 The Owner shall maintain a logbook to record the results of these inspections and any cleaning and maintenance operations undertaken, and shall keep the logbook at the Owner's corporate office for inspection by the Ministry. The logbook shall include the following:

(a) the name of the Works; and

(b) the date and results of each inspection, maintenance and cleaning, including an estimate of the quantity of any materials removed and method of clean-out of the stormwater management Works.

5. MONITORING AND REPORTING

5.1 The Owner shall carry out a water quality, water quantity, infiltration and groundwater and sediment accumulation monitoring program and evaluate the performance of the stormwater management Works commencing at the initial operation of the Works and continuing for a minimum of three (3) years after 90% of the homes in the Kleinburg North Extension Subdivision have been occupied.

5.2 The Owner shall carry out the water quality, water quantity, infiltration and groundwater and sediment accumulation monitoring at the site in accordance with the report entitled "North Humber Extension Proposed Low Impact Subdivision Operations, Maintenance and Monitoring Report, City of Vaughan" revised July 2013 and prepared by The Municipal Infrastructure Group Ltd. All samples and measurements taken for the purposes of this Approval are to be taken at a time and in a location characteristic of the quality and quantity of the stormwater discharge from the site over the time period being monitored.

5.3 The methods and protocols for sampling, analysis, and recording shall conform, in order of precedence, to the methods and protocols specified in the following:

(a) the Ministry 's publication "Protocol for the Sampling and Analysis of Industrial/Municipal Wastewater" (August 1994), ISBN 0-7778-1880-9, as amended from time to time by more recently published editions; and

(b) the publication "Standard Methods for the Examination of Water and Wastewater" (21st edition), as amended from time to time by more recently published editions.

5.4 The Owner shall submit to the District Manager, every year, a copy of the test results as per Condition 5.1 and Condition 5.2.

5.5 The Owner shall every five (5) years prepare and submit a performance report to the District Manager. The first such report shall cover the period following the commencement of operation of the Works and subsequent reports shall be submitted to cover successive periods following thereafter. The reports shall contain, but not be limited to, the following information:

(a) a summary and interpretation of all monitoring data collected in accordance with Condition 5;

(b) measurement of the mass of accumulated sediment removed when undertaking maintenance of the Works as per Condition 4.7

(c) an evaluation of the stormwater management Works performance, success and adequacy and its ability to meet the design performance criteria of 80% Total Suspended Solids removal on a long-term average basis based on the summary and interpretation of all monitoring data;

(d) a description of any operating problems encountered and corrective actions taken during the reporting period and the need for further investigations in the following reporting period for ways of improving the performance of the stormwater management Works to meet the performance target;

(e) any need for modifications of the monitoring program and/or the work plan;

(f) a summary of any complaints received during the reporting period and any steps taken to address the complaints;

(g) a summary of all spills or abnormal discharge events; and

(h) any other information that is deemed to have been obtained by the Owner pursuant to the requirements of this Approval that the District Manager requires for inclusion in the reports from time to time.

5.6 The measurement and reporting frequency specified in Condition 5, may, after three (3) years of monitoring in accordance with this Condition, be modified by the District Manager in writing from time to time. 6. RECORD KEEPING

The Owner shall retain for a minimum of five (5) years from the date of their creation, all records and information related to or resulting from the operation and maintenance activities required by this Approval.

The reasons for the imposition of these terms and conditions are as follows:

1. Condition 1 is imposed to ensure that the Works are built and operated in the manner in which they were described for review and upon which Approval was granted. This Condition is also included to emphasize the precedence of Conditions in the Approval and the practice that the Approval is based on the most current document, if several conflicting documents are submitted for review. The Condition also advises the Owners their responsibility to notify any person they authorized to carry out work pursuant to this Approval of the existence of this Approval.

2. Condition 2 is included to ensure that, when the Works are constructed, the Works will meet the standards that apply at the time of construction to ensure the ongoing protection of the environment.

3. Condition 3 is included to ensure that the Ministry records are kept accurate and current with respect to approved Works and to ensure that subsequent owners of the Works are made aware of the Approval and continue to operate the Works in compliance with it.

4. Condition 4 is included as regular inspection and necessary removal of sediment and excessive decaying vegetation from this approved stormwater management Works are required to mitigate the impact of sediment, debris and/or decaying vegetation on the treatment capacity of the Works. It is also required to ensure that adequate storage is maintained in the stormwater management facilities at all times as required by the design. Furthermore, Conditions 4 is included to ensure that the stormwater management Works are operated and maintained to function as designed.

5. Condition 5 is included to enable the Owner to evaluate and demonstrate the performance of the Works on a continual basis, so that the Works are properly operated and maintained at a level which is consistent with the design objectives specified in the Approval and that the Works do not cause any impairment to the receiving Humber River.

6. Condition 6 is included to require that all records are retained for a sufficient time period to adequately evaluate the long-term operation and maintenance of the Works.

In accordance with Section 139 of the Environmental Protection Act, you may by written Notice served upon me and the Environmental Review Tribunal within 15 days after receipt of this Notice, require a hearing by the Tribunal. Section 142 of the Environmental Protection Act provides that the Notice requiring the hearing shall state:

1. The portions of the environmental compliance approval or each term or condition in the environmental compliance approval in respect of which the hearing is required, and; 2. The grounds on which you intend to rely at the hearing in relation to each portion appealed.

The Notice should also include:

3. The name of the appellant; 4. The address of the appellant; 5. The environmental compliance approval number; 6. The date of the environmental compliance approval; 7. The name of the Director, and; 8. The municipality or municipalities within which the project is to be engaged in.

And the Notice should be signed and dated by the appellant.
