Reviewers and general readers found little with which to quibble in the book’s main contention that the traditional post-talmudic authorities developed the halakhah with diversity, flexibility, and creativity. What did cause offence, for both Orthodox and Reform critics, was the final chapter, ‘Towards a Non- Fundamentalist Halakhah’, which puts forward the view that it is both desirable and possible to preserve the halakhic system, albeit in a more dynamic form than in the past, even now that it has been demonstrated by the massive researches of the historical school that the halakhah did not simply drop down from Heaven but has had a history. I confess that I thought twice before adding this controversial and speculative chapter to the book, and was tempted to omit the chapter from this revised edition so as not to obscure the book’s basic thesis, which is that the traditional halakhists operated, consciously or subconsciously, in re- sponse to a felt need to make their halakhic decisions conform to their general stance on what Judaism demands of its adherents. Yet to have ignored the new historical challenge to the halakhic system would have been cowardly and dishonest. In this new introduction I try to defend the view presented in the final chapter against strictures from the right and left wings, as well as describing, at least in outline, further work that has been done by scholars in the area covered by the book as a whole. First, reference should be made to a book of the utmost relevance to the themes treated in A Tree of Life that has appeared in the Orthodox Forum series of the Rabbi Isaac Elhanan Theological Seminary, Rabbinic Authority and Personal Autonomy.1 The basic problem to which the Modern Orthodox essayists in the book address themselves is to what extent a contemporary Orthodox rabbi can be innovative and creative in his halakhic decisions. These writers agonize in one way or another over the dilemma of Modern Orthodox rabbis who seek to follow the halakhic process typical of rabbis of the old school while accepting, unlike the latter, many of the values of Western thought and culture. 1 Edited by Moshe Z. See also my review in the Jewish Journal of Sociology. xii introduction to the second edition The opening essay in this book exposes the flaws in the notion, preva- lent among the h.aredim or ultra-Orthodox today, that the gedolim (‘great ones’, chiefly the (unelected) members of the Council of Sages of Agudat Yisrael) have a kind of built-in guarantee that their opinions, even in political matters such as attitudes towards Zionism and the State of Israel, are as infallible as what the h.aredim call da’as torah, the view of the Torah, to reject which is to reject the very word of God.2 Far from such a view being traditional and Orthodox it is, in fact, modern, since it only emerged under the influence of hasidic veneration of the tsadik in the early twentieth century.

Neale com­ plained, when he undertook to survey the subject of church seating for the Cambridge Camden Society in 1842. 1 To a large extent, the same situation prevails today in connection with "pues" in the American syn­ agogue. Although it is common knowledge that American synagogue seating patterns have changed greatly over time - sometimes following acrimonious, even violent disputes - the subject as a whole remains unstudied, seemingly too arcane for historians to bother with. 2 Seating patterns, however, actually reflect down-to-earth social realities, and are richly deserving of study. Behind wearisome debates over how sanctuary seats should be arranged and allocated lie fundamental disagreements over the kinds of social and religious values that the synagogue should project and the relationship between the synagogue and the larger society that surrounds it. As we shall see, where people sit reveals much about what they believe. The necessarily limited study of seating patterns that follows focuses only on the most important and controversial seating innovation in the American synagogue: mixed (family) seating. Other innovations - seats that no longer face east, 3 pulpits moved from center to front, 4 free (un­ assigned) seating, closed-off pew ends, and the like - require separate treatment. As we shall see, mixed seating is a ramified and multifaceted issue that clearly reflects the impact of American values on synagogue life, for it pits family unity, sexual equality, and modernity against the accepted Jewish legal (halachic) practice of sexual separatiop in prayer.

    eSharp Issue 20: New Horizons A Fresh Perspective on the History of Hasidic Judaism Eva van Loenen (University of Southampton) Introduction In this article, I shall examine the history of Hasidic Judaism, a mystical,1 ultra-orthodox2 branch of Judaism, which values joyfully worshipping God’s presence in nature as highly as the strict observance of the laws of Torah3 and Talmud.4 In spite of being understudied, the history of Hasidic Judaism has divided historians until today. Indeed, Hasidic Jewish history is not one monolithic, clear-cut, straightforward chronicle. Rather, each scholar has created his own narrative and each one is as different as its author. While a brief introduction such as this cannot enter into all the myriad divergences and similarities between these stories, what I will attempt to do here is to incorporate and compare an array of different views in order to summarise the history of Hasidism and provide a more objective analysis, which has not yet been undertaken. Furthermore, my historical introduction in Hasidic Judaism will exemplify how mystical branches of mainstream religions might develop and shed light on an under-researched division of Judaism. The main focus of 1 Mystical movements strive for a personal experience of God or of his presence and values intuitive, spiritual insight or revelationary knowledge. The knowledge gained is generally ‘esoteric’ (‘within’ or hidden), leading to the term ‘esotericism’ as opposed to exoteric, based on the external reality which can be attested by anyone. 2 Ultra-orthodox Jews adhere most strictly to Jewish law as the holy word of God, delivered perfectly and completely to Moses on Mount Sinai.

    Dogma, Heresy, and Classical Debates: Creating Jewish Unity in an Age of Confusion Byline: Rabbi Hayyim Angel Judaism includes the basic tenets of belief in one God, divine revelation of the Torah including an Oral Law, divine providence, reward-punishment, and a messianic redemption. Although there have been debates over the precise definitions and boundaries of Jewish belief, these core beliefs have been universally accepted as part of our tradition.[1] The question for believing Jews today is, how should we relate to the overwhelming majority of contemporary Jews, who likely do not fully believe in classical Jewish beliefs? Two medieval models shed light on this question. Rambam: Dogmatic Approach Rambam insists that proper belief is essential. Whether one intentionally rejects Jewish beliefs, or is simply mistaken or uninformed, non-belief leads to one’s exclusion from the Jewish community and from the World to Come: When a person affirms all these Principles, and clarifies his faith in them, he becomes part of the Jewish People. It is a mitzvah to love him, have mercy on him, and show him all the love and brotherhood that God has instructed us to show our fellow Jews. Even if he has transgressed out of desire and the overpowering influence of his base nature, he will be punished accordingly but he will have a share in the World to Come. But one who denies any of these Principles has excluded himself from the Jewish People and denied the essence [of Judaism]. He is called a heretic, an epikoros, and “one who has cut off the seedlings.” It is a mitzvah to hate and destroy such a person, as it says (Psalms 139:21), “Those who hate You, God, I shall hate.” (Rambam, Introduction to Perek Helek) Scholars of Rambam generally explain that Rambam did not think of afterlife as a reward.

    An Autobiographical Sketch My own personal concern for the relationship between human rights and religion stems from my upbringing and background. I was brought up in the Jewish tradition in Germany and became a refugee child in England at the age of three. My status as a refugee taught me that you can adapt to wherever you live, and in so doing experi- ence a breadth of human society which enriches you. is was made possible for me through the concerns and caring attitude of others. We kept the major Jewish holidays and went to synagogue, and although we were more liberal than orthodox, my father kept traditional values. Our family on my fa- ther’s side were partly of Sephardi origin. Sefarad is the old rabbinic word for Spain and Portugal, thus ‘Sephardi’ denotes those Jews whose ancestors hailed from Spain or Portugal and who were expelled from the Iberian Peninsula in (Spain) and (Portugal) respectively. Many of the merchant families found refuge in North- Western European cities such as Amsterdam, Copenhagen, London and Hamburg. In Hamburg, the Sephardi Jewish community was the first Jewish group to be allowed to settle within that city, partly because they successfully pretended to be Portuguese Catholic merchants. Yet the community was quickly allowed to practise Judaism and, unusually, given permission to establish a synagogue, a privilege that local German Jews would not be accorded until the second half of the seventeenth century. e two communities were separate from very early on. Some of my family were thus part of a long Sephardi history in the midst of the northern ‘Freie und Hansestadt Hamburg’ which itself had a longstanding tradi- tion of trade and exchange all over the world, although my forefathers came from Copenhagen and Rendsburg, which was originally Danish before it became part of Prussia.

At around 14 years old, she met and eloped with a Polish Christian man, who, after converting, took the name Avraham Borokovsky. After living for a few months in Poland, the Borokovskys made Aliyah along with Chava’s parents sometime in the 1930’s. • Soon after they arrived in Israel, Chava and Avrohom’s marriage fell apart and they separated without obtaining a Get. This became problematic when Chava did not disclose this fact to the Beit Din that issued a license for her to marry her second husband, Otto Langer, in 1944. Two children, Chanoch and Miriam, were born to Otto and Chava Langer. • In 1951, Avraham Borokovsky and Chava Langer went to the Tel Aviv Beit Din in order to execute a Get before Borokovsky’s second wedding. The Beit Din, while investigating the facts of the case, discovered Chava’s second marriage, and subsequently banned Otto and Chava from living together. Otto passed away in 1952. • IN 1955 When Chava seeked to remarry, the status of her children became known, and they were declared Mamzerim by the Beit Din. • This status was upheld until 1966, when Chanoch Langer, then a soldier in the IDF, approached Beit Din to get married. When the Beit Din ruled he was a Mamzer, he brought the case to the Supreme Rabbinical Court of Appeals. He argued that Avraham Borokovsky did not undergo a valid conversion and that he was still a practicing Christian.

Blogging Rav Lichtenstein INTRODUCTION AND INVITATION This past Rosh Chodesh Iyyar, the world of Torah and avodat Hashem lost a giant, mori ve-rabi R. Aharon I in ,ואני בעניי ,Lichtenstein. Many people are taking on important acts and learning projects in his memory my limited capabilities, wanted to join in that. The idea that came to me was to review R. Lichtenstein z”l’s published volumes. While he wrote more than many realize (here’s the bibliography), there are, as far as I know, thirteen books he wrote or that were based on his talks. Eight of those are notes on shiurim he gave at Yeshivat Har Etzion, one is a collection, Minchat Aviv, of articles he published, and four volumes (By His Light, two volumes of Leaves of Faith, and Varieties of Religious Experience) collect English language talks he gave or articles he wrote. As I try to review for myself some of the fruit of R. Lichtenstein’s toiling and tilling in the garden of Torah, I hope to share one stimulating idea a week. I make no pretense that I will be comprehensive, will capture all or a representative sample of what is found in those works, only that I can, in a few hundred words, share a thought worth knowing.

  • Jewishness, Birth and Giyyur
    1 Zvi Zohar All Jews are Jews by Birth Biblical and Rabbinic Judaism agree, that anyone born to the appropriate Jewish parent – is Jewish. To most Jews, it sounds quite reasonable for Jewishness to derive from birth. However, such a determination is far from self-evident. Consider a counter-example: if a person was born on a kibbutz, and her two parents are members of the kibbutz, she is not automatically a member. Rather, upon reaching a certain age, she must decide if she wishes to apply for membership. If she applies, her application comes up for discussion by the kibbutz assembly, who then decide the matter by a vote. While it is reasonable to assume that a child born and grown on the kibbutz will be accepted for membership if she applies, it is not automatic. The important point (in the current context) is, that her membership is contingent upon at least two decisions: her decision to apply, and the assembly’s decision to accept her. In contrast, Jewishness is not contingent upon any person’s decision, but is regarded by tradition as a ‘fact of birth’. The sources of this self-understanding are very ancient: in the Bible, the Israelites are the “Children of Israel”, i.e., the lineal descendents of the Patriarch Jacob and his twelve sons. In the bible, then, the People of Israel are made up of persons born into a (very) extended family. Some notions accepted in Biblical times were abrogated or modified by the Oral Torah (Torah she- b’al peh); significantly, the concept of the familial nature of Jewishness was not only retained, but also even reinforced.

The Mishna Sanhedrin presents the rabbis as arbiters of the afterlife, who regulate its access by excluding a set of individuals whose beliefs or practices undermine the nature of rabbinic authority and their tradition. In doing so, the Mishna evinces the foundational tenets of rabbinic Judaism and delineates the boundaries of ‘Israel’ according to the rabbis. Consequently, as arbiters of the afterlife, the rabbis constitute Israel and establish normative thought and practice in this world by means of the world to come. ii There have been surprisingly few studies on the afterlife in rabbinic literature. Many of the scholars who have undertaken to explore the afterlife in Judaism have themselves remarked upon the dearth of attention this subject has received. For the most part, scholars have sought to identify what the rabbis believed with regard to the afterlife and how they envisioned its experience, rather than why they held such beliefs or how the afterlife functioned within the rabbinic tradition.
