Main results of the Council

TheCouncil

– welcomedtheagreementreachedinfirstreadingwiththeEuropeanParliamentonaRegulation concerningtheVisaInformationSystem(VIS)andtheexchangeofdatabetweenMemberStates onshortstayvisas.ItalsoagreedonaDecisionconcerningaccessforconsultationoftheVISby designatedauthoritiesofMemberStatesandbyforthepurposesoftheprevention, detectionandinvestigationofterroristoffencesandofotherseriouscriminaloffences,

– adoptedaRegulationestablishingamechanismforthecreationofRapidBorderIntervention Teams,

– reachedapoliticalagreementonaDecisiononthesteppingupofcrossbordercooperation, particularlyincombatingterrorismandcrossbordercrime.ThisDecisioncontainsprovisions basedontheessentialpartsofthePrümTreatyandisdesignedtoimprovetheexchangeof informationbetweenauthoritiesresponsibleforthepreventionandinvestigationofcriminal offences,

– endorsedConclusionsonExtendingandEnhancingtheGlobalApproachtoMigration,which willnowbesubmittedtotheGeneralAffairsandExternalRelationsCouncil,foradoption,

– reachedageneralapproachonaproposalforaFrameworkDecisionontheorganisationand contentoftheexchangeofInformationextractedfromcriminalrecordsbetweenMemberStates, and

– regardingcounterterrorism,adoptedpolicyrecommendations,conclusionsona"Checkthe Web"projectandconclusionsonInformationexchangeonterroristkidnappings.

EUROPOL - Council conclusions

TheCouncilreachedanagreementonChapter1("Establishmentandtasks")ofaproposalfora CouncilDecisionestablishingEuropol.

ItalsoadoptedconclusionsonreplacingtheEuropolConventionbyaCouncilDecision,asfollows:

"THECOUNCIL

"1. recalls thaton4and5December2006,itwasagreedthat,onthebasisthatitconstitutesa clearimprovementoftheoperationalandadministrativefunctioningofEuropol,the EuropolConventionshouldbereplacedbyaCouncilDecisionsubjecttoafullassessment oftheimplicationsoffinancingEuropolfromthegeneralbudgetoftheEuropeanUnion andtheapplicationoftheECStaffRegulationsandtheProtocolonthePrivilegesand ImmunitiesoftheEuropeanCommunities(ECPPI)guidedbytheprincipleofbudget neutralityandtakingintoaccountthespecificrequirementsresultingfromEuropol's mandateandtasks.

2. notes thattheEuropolWorkingPartyandtheWorkingPartyontheStaffRegulations carriedoutacomprehensiveexaminationoftheeffectsoffinancingEuropolfromthe generalbudgetoftheEuropeanCommunitiesandtheapplicationoftheECStaff Regulations,inparticulartheimpactassessmentpresentedbytheGermanPresidencyas setoutindoc.10325/07EUROPOL73.

3. acknowledges thatsincetheCommissionandEuropoluseddifferentbasesofcalculation (actualstaffcostsvs.averagebasicsalary;shorttermvs.midtolongterm),theyarrived atdifferingresultsasregardsthefinancialimplicationsofapplyingtheECStaff Regulations.

4. notes thatasaconsequence,theWorkingPartyontheStaffRegulationshaspointedout thatintheabsenceofcomparablecalculations,itwasnotpossibletomakeanydefinitive statementsonbudgetneutrality.

5. underlinesthatthechangeoffinancingmechanismshouldnotaffectEuropol'soperational ability.

Therefore,andinlinewiththeCouncilConclusionsofDecember2006,theCouncilagreestothe following:

• TheEuropolConventionwillbereplacedwithaCouncilDecisionpursuanttoArticle34(2)(c)of theTEUandthenecessaryCouncilDecisionwillbefinalisedby30June2008,atthelatest.

• InaccordancewithArt.41(3)TEUandotherapplicableprovisions,Europolwillbefundedfrom theCommunitybudgetasfrom1January2010,providedthatsatisfactorysolutionsonthe followingaspectshavebeenfound:

• TheliftingofimmunityforEuropolofficialswhenparticipatinginoperationalactivities, especiallyJointInvestigationTeams

• TheprincipleofstaffrotationandthepossibilityforEuropolstaffparticipatinginJITtoreceive instructionsfromtheteamleader

• clarificationofthebudgetaryconsequences,guidedbybudgetneutrality.

• EuropolandtheCommissionwillensurethatallpreparatoryworkiscarriedoutinorderto enabletheintroductionofCommunityfinancingasfrom1January2010.Tothisend,Europol andtheCommissionwilldrawupanimplementationplan(roadmap)whichsetsoutthe milestoneswhichhavetobereachedbeforethatdate.TheCouncilwillendorsethe implementationplan(roadmap)assoonaspossibleand,atthelatest,inDecember2007."

Itshouldbenotedthaton4and5December2006,theJusticeandHomeAffairsCouncilagreed thattheEuropolConventionshouldbereplacedbyaCouncilDecision.Thiswillconstituteaclear improvementoftheoperationalandadministrativefunctioningofEuropol.Atthatmeeting,the CouncilalsodecidedthatafullassessmentoftheimplicationsoffinancingEuropolfromthe generalbudgetoftheEUandtheapplicationoftheProtocolonthePrivilegesandImmunitiesofthe EuropeanCommunitiesshouldbemade,guidedbytheprincipleofbudgetneutralityandtakinginto accountthespecificrequirementsresultingfromEuropol'smandateandtasks.

STEPPING UP COOPERATION FOR PURPOSES OF PREVENTION AND INVESTIGATION OF CRIMINAL OFFENCES

TheCouncilreachedapoliticalagreementonaDecisiononthesteppingupofcrossborder cooperation,particularlyincombatingterrorismandcrossbordercrime (10232/07) .

ThisDecisioncontainsprovisionsbasedontheessentialpartsofthePrümTreatyandisdesignedto improvetheexchangeofinformationbetweenauthoritiesresponsibleforthepreventionand investigationofcriminaloffences.

Tothisend,theDecisioncontainsrulesinthefollowingareas:

ontheconditionsandprocedurefortheautomatedtransferofDNAprofiles,dactyloscopic dataandcertainnationalvehicleregistrationdata,

ontheconditionsforthesupplyofdatainconnectionwithmajoreventswithacrossborder dimension,

ontheconditionsforthesupplyofinformationinordertopreventterroristoffences,and

ontheconditionsandprocedureforsteppingupcrossborderpolicecooperationthrough variousmeasures.

Thiscloserpoliceandjudicialcooperationincriminalmatterswillgohandinhandwithrespectfor fundamentalrights,inparticulartherighttorespectforprivacyandtoprotectionofpersonaldata, whichwillbeguaranteedbyspecialdataprotectionarrangementstailoredtothespecificnatureof differentformsofdataexchange.

TheDecisionistheresultofaninitiativesubmittedbyBelgium,Germany,Spain,France, Luxembourg,theNetherlandsandAustriawiththeaimofincorporatingthesubstanceofthe provisionsofthePrümTreatyintothelegalframeworkoftheEuropeanUnion.

ThePrümTreaty

Signedon27May2005atPrüm,Germany,theTreatyisdesignedtointensifycrossborderpolice cooperation,especiallyinthefightagainstterrorism,crossbordercrimeandillegalmigration 1.

TheTreatyhasmeanwhileenteredintoforceinAustria,SpainandGermanyandisexpectedtobe inforceintheotheroriginalsignatoryStatesinthefirsthalfof2007atthelatest.Theratification processesinthecountriesintendingtoaccedetotheTreatyarealsowelladvanced.

Alreadyatthisearlystage,theautomaticinformationexchangehasbroughtaboutnoticeable operationalsuccess:Forinstance,theGermanauthoritiesmatchedDNAprofilesofopencases againstdataheldbyAustrianauthoritiesandfoundhitsinmorethen1500cases(datareportedin February2007).Inthiscontext,over700opentracesfromGermanycouldbeattributedtopersons knowntotheAustriancriminalprosecutionauthorities.Brokendownbytypesofcrime,14hitsin homicideormurdercases,885hitsintheftcases,and85hitsinrobberyorextortioncaseshave beenfound(asat4January).Itistruethateveryhitneedstobeexaminedcarefully,anditwillnot bepossibletoclearupopencasesbyaDNAhitalone.Neverthelessitcanbeexpectedthathitherto unsolvedcasesinGermanyandAustriacanbeclosedandtheperpetratorsbroughttojustice.Inany case,prosecutionauthoritiesareconfidentthatthenumberofhitswillincreaseconstantlyasfurther Prümcountriestakepartinthisprocess,andthattheywillthusbeabletosolvenumerousother opencases.

ThespecialvalueoftheTreatyliesinthesubstantiallyimprovedandefficientlyorganised proceduresfortheexchangeofinformation.TheStatesinvolvedmaynowgiveoneanother automaticaccesstospecificnationaldatabases.Thisamountstoaquantumleapinthecrossborder sharingofinformation.

ThecontractingStateshavefullanddirectonlinereadaccesstovehicleregistrationdataheldby theirpartners.TheygiveoneanotheraccesstotheirDNAanalysisanddactyloscopic(fingerprint) databasesinwhatiscalledahit/nohitsystem.Policeservicesmaylaunchaqueryinthedata systemofacontractingpartnertofindoutwhetheritcontainsdataconcerningaspecificprofile, andareautomaticallyinformedoftheresultwithinamatterofminutes.Furtherinformation,such aspersonaldata,maybecommunicatedinthecourseofmutuallegalassistance.

Furthermore,theexchangeofdataconcerningpotentialterroristperpetratorsandhooligansis regulated.Policecooperationmayalsobesteppedupthroughoperationalmeasures,suchasjoint patrols,transferringsovereignpowerstopoliceforcesofothercontractingStates,orassistancein thecaseoflargescaleevents.

TheTreatycontainscooperationmechanismsthatneedtoberegulatedatEUlevelinthefirstpillar. Thisincludesprovisionsregardingdocumentadvisers,skymarshalsandreturnmeasures.

AnimportantaspectoftheTreatyisthecomprehensiverangeofmoderndataprotection regulations.

AsthedraftersofthePrümTreatysoughttofurtherdevelopEuropeancooperation,theTreatyhas beendesignedwithitsconversionintoEUlawinmind.

ThesignatoryStatesare:Germany,Belgium,Spain,France,Luxembourg,theNetherlands,and Austria.

ThoseStateshavingnotifiedtheirwishtoaccedetothePrümTreatyare:Slovenia,Italy,Finland, Portugal,Bulgaria,Romania,Greece,SwedenandEstonia.

PROTECTION OF PERSONAL DATA RELATING TO POLICE AND JUDICIAL COOPERATION IN CRIMINAL MATTERS

TheCounciladoptedthefollowingconclusions:

"TheCouncilrecognizestheimportanceoftheexistenceofacomprehensiveandcoherentsetof rulesattheleveloftheEuropeanUnionconcerningthehighlevelofprotectionofpersonaldata processedintheframeworkofpoliceandjudicialcooperationincriminalmatters,asapartofthe Union’severincreasingsetofregulatoryinstrumentsonsuchcooperation.Theseruleswillbuild upontheminimumdataprotectionprinciplessetbytheConventionof28January1981forthe protectionofindividualswithregardtoautomaticprocessingofpersonaldataanditsAdditional Protocolof8November2001,andtakeaccountofRecommendation(87)15regulatingtheuseof personaldatainthepolicesector,bothadoptedintheframeworkoftheCouncilofEurope.

TheCouncilnotesthattheEuropeanParliamenthasrapidlyforwardeditsopinionontherevised draftoftheCouncilFrameworkDecisionontheprotectionofpersonaldataprocessedinthe frameworkofpoliceandjudicialcooperationincriminalmattersandwillexamineallsolutions suggestedbytheEuropeanParliament,inthespiritofcooperationthatisreflectedintheopinion. TheCouncilthankstheParliamentforitscooperationonthisissue.

TheCouncilnotesthegeneralprinciplesintheannextotheopinionoftheEuropeanParliamentof 24May2007ontheprotectionofpersonaldataprocessedintheframeworkofpoliceandjudicial cooperationincriminalmatters.TheCouncilwilltaketheseprinciples,whereappropriate,into consideration,whendraftingtheCouncilFrameworkDecisionontheprotectionofpersonaldata processedintheframeworkofpoliceandjudicialcooperationincriminalmatters.

TheCouncilcontinuestogiveprioritytotheexaminationoftheproposalforaCouncilFramework Decisionontheprotectionofpersonaldataprocessedintheframeworkofpoliceandjudicial cooperationincriminalmatters,andintendstoreachapoliticalagreementontheproposalassoon aspossibleandatthelatestbytheendof2007."

VISA INFORMATION SYSTEM (VIS)

TheCouncilwelcomedtheagreementreachedinfirstreadingwiththeEuropeanParliamentona RegulationconcerningtheVISandtheexchangeofdatabetweenMemberStatesonshortstay visas.

ItalsoagreedonaDecisionconcerningaccessforconsultationoftheVISbydesignatedauthorities ofMemberStatesandbyEuropolforthepurposesoftheprevention,detectionandinvestigationof terroristoffencesandofotherseriouscriminaloffences.

TheVISisaparticularlyimportanttoolforstrengtheningtheareaofsecurity,freedomandjustice. TheECRegulationgoverningtheVisaInformationSystemallowsthecompetentauthorities(in particularvisa,borderandimmigrationagencies)tostoreinacentralEuropeandatabase alphanumericandbiometricdataonvisaapplicantsandvisaswhichhavebeenissued,deniedor revoked,andretrievethedataconcerned.Thisenablesthemtopreventwhatisreferredtoasvisa shopping,andtoidentifyapplicationsbythesamepersonunderdifferentnames.TheCouncil DecisiononaccesstotheVisaInformationSystem(VIS)allowssecurityauthoritiestoquerythe VISforthepurposeofpreventing,detectingandinvestigatingterroristoffences.Givingthesecurity authoritiesthisnewpossibilitytosearchtheVISwillallowamajoradvanceinprotectingagainst internationalterrorismandorganisedcrimeinparticular.

GLOBAL APPROACH TO MIGRATION - Council conclusions

TheCouncilendorsedConclusionsonExtendingandEnhancingtheGlobalApproachtoMigration. TheconclusionswillnowbesubmittedtotheGeneralAffairsandExternalRelationsCouncil,for adoption.

"1. TheCouncilunderlinestheimportanceoftheissueofmigrationfortheEUandits MemberStates.TheCouncilthereforewelcomestheimportantprogressbeingmadewith theadoptionandtheimplementationoftheGlobalApproachtoMigration,thestrategy establishedbytheEuropeanCouncilinDecember2005andcomplementedbyits ConclusionsonthedevelopmentofcomprehensiveEuropeanMigrationPolicyof December2006.

2. TheCouncilnotesthefirstsetofpriorityactionsforthepurposeoftheGlobalApproach focussedonAfricaandtheMediterranean.Strengthenedpoliticaldialogue, includingtherecentEUmissionstoAfrica,andconcretecooperationwithAfricanand EuroMedpartnersonmigrationandrelatedissues,includingdevelopmentaspectsof migration,areimportantrecentachievements.Thestrengthenedcapacitytomanagethe controlofexternalborders,inparticularthroughjointmaritimeoperations,isanother importantachievement.TheCouncilbelievesthatthesemeasuresshouldbefurther intensifiedinthelightofrecentevents.

3. TheCouncil,whileunderliningtheneedtocontinuetheseeffortsasamatterofurgency, alsoreaffirmstheneedtobothextendthegeographicalscopeandtoenhancethecontentof theGlobalApproachingeneral.

4. TheCouncilthereforewelcomestheCommissionCommunicationsof16May2007on applyingtheGlobalApproachtomigrationtotheEasternandSouthEasternregions neighbouringtheEuropeanUnionandoncircularmigrationandmobilitypartnerships betweentheEuropeanUnionandthirdcountries.TheCouncilcallsontheMemberStates andtheCommissiontoensurethatsufficienthumanandfinancialresourcesareallocated, withintheexistingfinancialframework,inordertoenablethetimelyimplementationof thecomprehensiveapproachtomigration.

A. Extending the Global Approach - Applying the Global Approach to Migration to the Eastern and South-Eastern Regions Neighbouring the European Union

5. TheCouncilunderlinesthenecessityfortheEUtoachieveamoreefficientmanagementof migrationgiventheconsiderablenumbersofmigrantscomingfromorthroughtheeastern andsoutheasternregions.Existingcooperationstructuresintheregionneedtobe enhancedandfullyintegratedinEUrelationswiththethirdcountriesconcerned,inorder tocreateamorecomprehensiveandcoherentapproach.Thisapplies,inparticular,to dialogueandeffectivecooperationinmatterssuchasenhancingbordercontrol,combating illegalimmigration,organisedcrimeandtraffickinginandsmugglingofhumanbeings. Thisalsoappliestoensuringwellmanagedmigrationforsocial,culturalandbusiness purposesandharnessingtheopportunitiestostrengthenthelinksandsynergiesbetween migrationanddevelopmentintheseregions.

6. TheCouncil,whilerecognisingthatthedialoguewitheasternandsoutheasterncountries iswelladvanced,stressestheneedtotakeadditionalcomprehensiveandconcreteactions basedonexistingpoliticalandinstitutionalframeworkstakingintoaccountthe competencesofMemberStates.Asamatterofpriority,particularattentionshouldbe giventostrengtheningthedialogueandcooperationwiththeregionsdirectlyneighbouring theEU,i.e.thecountriesoftheWesternBalkans,,theENPcountries–including issuesthatcouldaffectthem,suchastheconsequencesoftheIraqirefugeesituationand theRussianFederation.Furthermorethedialogueonmigrationissuesshouldbeintensified withCentralAsianandAsiancountriesoforiginandtransitidentifiedinaccordancewith themigratoryroutesconcept.

7. TheCouncilendorsesthepriorityactionsfocusingontheEasternandSouthEastern regionsneighbouringtheEUannexedtotheseConclusionsinthecontextoftheextension oftheGlobalApproachtoMigration.TheCouncilinvitestheCommissiontoreportback ontheimplementationoftheGlobalApproachthusextended."

B. Enhancing the Global Approach - Circular Migration and mobility partnerships between the European Union and third countries

8. TheCouncilreiteratesthatactiveconsiderationmustbegiventohowlegalmigration opportunitiescanbeincorporatedintotheUnion'sexternalpoliciesinordertodevelopa balancedpartnershipwithinterestedthirdcountries.Thesewouldneedtobeadaptedtothe specificEUMemberStates'labourmarketneedsaswellastothecooperationresults achievedfromthethirdcountriesconcerned.

9. TheCouncilwelcomestheCommissionCommunicationoncircularmigrationand mobilitypartnershipsasabasisforfurtherdiscussions.TheCouncilbelievesthatthesetwo conceptscouldmakeanimportantcontributiontoacomprehensiveapproach,which combinesmeasuresaimedatfacilitatinglegalmigrationopportunitieswiththosereducing illegalimmigration.Suchastrategycould,inparticular,bedirectedtopromotingsustained cooperationwiththirdcountriesalongthemigrationroutestowardstheEuropeanUnion.

10. TheCouncilunderlinesthatthesemobilitypartnershipswillbeconsideredinthosecases wheretheybringaddedvaluebothtotheEUandthethirdcountryonthemanagementof migrationflowsandontheunderstandingthatthewillingnesstocontributetothis partnershipandtocooperateactivelyisthebasisfortheopportunitiesofferedbythem. Suchpartnershipsshould,asfarasappropriate,includetheofferoflegalmigration opportunities,adaptedinparticulartothespecificMemberStates'labourmarketneeds, whilefullyrespectingthecompetencesoftheMemberStatesandtheprincipleof Communitypreferenceontheonehand,andagenuinecooperationonpreventingand combatingillegalimmigration,traffickinginandsmugglingofhumanbeingsaswellas effectivereadmissionandreturnpolicywhilerespectingtheprotectionofhumanrights,on theotherhand.

FurthermoretheCouncilagreesthat,buildingupontheeffortstoimplementmeasuresand actionsthatarealreadypartofthedialogueandcooperationwiththirdcountries,these partnershipscouldinclude:

• theenhancementofthelinksbetweenmigrationanddevelopment,i.a.tofacilitate productiveuseoftheresourcesofmigrantcommunitiesandtopromotecodevelopment projects;

• thepoolingofsupportmeasuresincapacitybuildinginordertobettermanageand controlmigration;

• thepromotionofthereintegrationofreturnees;

• visafacilitationinaccordancewiththecommonapproach,takingintoaccountthe experiencesintheimplementationofthecurrentagreements;

• theenhancementoftheprotectionofhumanrightsinthefightagainstillegal immigration,inreadmissionandreturnpoliciesandinthereceptionofmigrantsand asylumseekers;and

• theprotectionofrefugeesinaccordancewithinternationalstandards.

11. TheCouncilbelievesthattheconceptofmobilitypartnershipsbetweentheEuropean Union,MemberStatesandthirdcountriescouldbetestedbywayofalimitednumberof pilotpartnerships.TheCouncilthereforeinvitestheCommissiontoconsultMemberStates onthefurtherdevelopmentofthisconcept,including,inparticular,onthetermsof reference,andwithaviewtoexploratorytalkswithinterestedthirdcountriesonpilot partnershipsinclosecooperationwiththePresidencyandinterestedMemberStates.The CommissionisinvitedtoreportbacktotheCouncilontheoutcomeoftheseconsultations inordertoenabletheCounciltodecidebytheendof2007whethertoinvitethe Commissiontolaunchpilotpartnerships.

12. TheCouncilagreesthatlegalmigrationopportunities,includingwellmanagedcircular migrationcanpotentiallybenefitallpartnersinvolved.Allpossibilitiesforawellmanaged circularmigrationshouldthereforebeexploredinclosecooperationwithallrelevant stakeholderswithaviewtotheadoptionofCouncilConclusionsnotlaterthantheendof 2007."

CURRENT SITUATION OF THE EU’S SOUTHERN MARITIME BORDERS

TheCouncilheldadebateonthecurrentsituationontheEU'sSouthernmaritimeborders.

ThePresidencyconcludedasfollows:

"1. TheCounciltooknoteoftheattacheddeclarationbythePresidencyandCommission VicePresidentFrancoFrattini (see below) onrecentincidentsintheMediterranean.

2. WithregardtothespecificdifficultsituationofMalta,suggestionsonasystemofsharing ofresponsibilitieswillbediscussedinCorepernextweekwithaviewtoaproperfollow uponthisissue.

3. TheCouncilregrettedthatsomemediareportsonrecentincidentsintheCentral Mediterraneandidnottakeintoaccountallrelevantfacts.

4. SANCTIONS AGAINST EMPLOYERS OF ILLEGALLY STAYING THIRD COUNTRY NATIONALS

TheCouncilhadafirstexchangeofviewsonaCommissionproposalforaDirectiveprovidingfor sanctionsagainstemployersofillegallystayingthirdcountrynationals(9871/07) .

ThisproposalformspartoftheEU'seffortstodevelopacomprehensivemigrationpolicy.The CommissionproposalstatesthatoneofthefactorsencouragingillegalimmigrationintotheEUis thepossibilityoffindingwork.Thisproposalaimstoreducethatpullfactorbytargetingthe employmentofthirdcountrynationalswhoareillegallystayingintheEU.Buildingonexisting measuresintheMemberStates,theaimistoensurethatallMemberStatesintroducesimilar penaltiesforemployersofsuchthirdcountrynationalsandenforcethemeffectively.

Underthisproposal,itistheemployerwhowillbesanctioned,nottheillegallyemployedthird countrynationals.

AND ADOPT THE FOLLOWING CONCLUSIONS:

1. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesstressthe needtopromoteaglobalandcoherentapproachtointegrationpolicies,migrantflow management,developmentandcooperationwiththecountriesoforigin.Theyrecognise thecomplementarylinkagebetweenimmigrationandintegration.

2. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesrecognise thatintegrationisadynamictwowayprocessinvolvingbothimmigrantsandthehost society,withresponsibilitiesforbothsides,whichshouldbeunderpinnedbyanagreed valuesystem.Involvingthehostsocietyinthisprocessisoneofthemajorchallengesto theachievementofsuccessfulintegrationpoliciesandlongtermsocialcohesion.All individualsmustassumeresponsibilityinthisintegrationprocess–aswellasstate institutions,politicalparties,media,businessesandcivilsociety.Migrantswhoaimtostay permanentlyorforthelongtermshouldmakeadeliberateefforttointegrate,inparticular learningthelanguageoftheirhostsociety,andunderstandingthebasicvaluesofthe EuropeanUnion.

Theyfurtherrecognisetheroleoflocalstakeholders,includinginparticular,theroleof localgovernmentandcitiesindesigningandimplementingintegrationprogrammes,given thatintegrationtakesplaceprimarilyatalocallevel.

3. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStates emphasise theneedtocontinuetostrengthentheintegrationpoliciesofMemberStateswithaviewto managingdiversesocieties,counteractingallformsofdiscriminationandintolerance, maintainingsocialcohesionandensuringthatimmigrantsareabletoreachtheirfull potentialandareabletoparticipatetothefullestextentpossibleinthesocial,economic, culturalandciviclifeoftherelevantMemberState.

4. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStateswelcome theinitiativestaken,intheperiodsincetheadoptionoftheCommonBasicPrinciples (CBP),tofacilitatetheexchangeofexperienceaswellastheopportunityprovidedbythe InformalMeetingofEUIntegrationMinistersheldinPotsdamon1011May2007to reviewatapoliticallevelthescopeforfurtheractiondirectedtostrengtheningthe EuropeanframeworkforintegrationandtheintegrationpoliciesoftheMemberStates,by promotingunityindiversity.

5. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesalso welcomethepublicationbytheCommission,inallofficiallanguages,ofthesecond editionoftheHandbookonIntegrationforpolicymakersandpractitionersandrequestthe Commissiontoensurethattheeditionsbecontinuedanditbedisseminatedwidely throughouttheMemberStates.

6. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesemphasise thecontinuingimportanceoftheCBPasthebasisoftheEuropeanapproachtointegration andtheneedfortheCBPtocontinuetoguidetheactivitiesoftheNationalContactPoints (NCPI)onintegration.TheCouncilandtheRepresentativesoftheGovernmentsofthe MemberStatesrecognisetheneedtofurtherstrengthentheroleoftheNCPInetwork.

7. TheCouncilinvitesMemberStatestomakemaximumuseofthepossibilitiescreatedby theIntegrationFundtopromoteintegrationpoliciesandsharedexperience.

8. TheCouncilinvitestheCommissiontocontinuetosupporttheactivitiesoftheNCPI networkandtoconsiderwaystoredesigntheAnnualReportonImmigrationand Integrationinordertomakeitanuptodateinstrumentforthecomparativeanalysisof newdevelopmentsinintegrationpolicyintheMemberStatesandinduecoursetopresent anewconceptfortheAnnualReport.

9. TheCouncilinvitestheNCPI,supportedbytheCommission,toconsiderapproachesto integrationthatinvolvethesocietyasawhole,includinginparticularto:

– exploreandclarifythevariousconceptionsofandapproachestoideasofparticipation andthevariousconceptionsofcitizenshipunderdiscussion,takingintoaccountthe relevantECacquisthatrelatetotheintegrationofimmigrantsandMemberStates’ Constitutionalandlegalsystemsaswellasexchangeviewsandexperienceson naturalisationsystemsappliedbyMemberStates;

10. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesrecognise thatinterculturaldialoguehasbecomeanimportantinstrumentinfosteringthesuccessful integrationofcitizensofdifferentorigin,cultureandreligioninEuropeandin counteractingracismandextremism.TheCouncilandtheRepresentativesofthe GovernmentsoftheMemberStates,takingaccountofdevelopmentsinthecontextofthe forthcomingYearofInterculturalDialoguein2008,inviteMemberStatestobegina regularexchangeofexperiencegainedintheirrecenteffortstoestablishsuchdialogue.

TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesfurther welcometheinitiativeofGermanytoconvenethefirsttwoexpertmeetingsforthis purposeandwithaviewtothepreparation,inconsultationwiththeNCPI,ofareportfor theMinisterialConferencein2008,whichshouldincludeproposalsfortheestablishment ofaflexibleprocedurecapableofreactingtointerculturalproblemsorconflictswitha potentialcrossborderdimension.

11. TheCouncilinvitesincomingPresidenciesandtheCommissiontoproactivelydevelopthe CommonAgendaforIntegrationandtopromotetheprinciplessetoutinparagraph1.The CommissionisfurtherinvitedtoreportinparticulartotheaboveMinisterialConference onIntegrationontheresultsofthetasksassignedtotheNCPInetwork,asdescribedin point9oftheseConclusions.Thisreportshouldbethestartingpointfordiscussionon futurepriorities."

REFUGEE SITUATION IN IRAQ AND SURROUNDING REGIONS

TheCouncilheldanexchangeofviewsonthisissueandagreedthatitspreparatorybodiesandthe CommissionshouldcontinuetomonitortherefugeesituationinIraqanditsneighbouringregions, aswellastheinfluxofIraqirefugeestotheEU.

CommissionVicePresidentFrancoFrattinireportedinparticularontherecentstepsundertakenin ordertoacquireapreciseandcomprehensivepictureofnationalpracticesvisàvisIraqiasylum seekersintheEU.

TheCouncilhadanexchangeofviewsonthefollowingitems:

– aproposalforaCouncilDirectiveconcerningtheextensionofthescopeofCouncilDirective 2003/109/ECdeterminingthestatusofthirdcountrynationalswhoarelongtermresidentsto beneficiariesofinternationalprotection,

– areportontheevaluationofthe"Dublin"system,and

– aGreenPaperonthefutureCommonEuropeanAsylumSystem.

TheCouncilpreparatorybodieswillfurtherexaminetheproposalforaDirectiveandthereport.

ConcerningtheGreenPaper,theCommissionintendstolaunchanindepthreflectionanddebate. TheCommissionwillsynthesisetheresultsofthisreflection,togetherwiththeresultsofthe evaluationofthefirststageECasyluminstruments,andwillthensubmitaroadmapofthework thatwillhavetobecarriedoutinthefuture,inordertoestablishtheCommonEuropeanAsylum System.

CouncilDirective2003/109/ECdeterminesthestatusofthirdcountrynationalswhoarelongterm residents.AtthetimeoftheadoptionofthisDirective,theCouncilwelcomedtheCommission commitmenttotableaproposalfortheextensionoflongtermresidentstatustorefugeesand personsundersubsidiaryprotection,takingintoaccountthequestionoftransferofprotectionstatus. ThenewCommissionproposalrespondstothiscommitment.

Thesocalled"Dublinsystem"includesCouncilRegulation343/2003establishingthecriteriafor determiningtheMemberStateresponsibleforexamininganasylumapplication,andCouncil Regulation2725/2000concerningtheestablishmentof"Eurodac"forthecomparisonoffingerprints fortheeffectiveapplicationoftheDublinConvention(subsequently,Regulation343/2003).

ThesetwoRegulationsrequiredtheCommissiontoreportontheirapplicationafterthreeyearsof operationandtopropose,whereappropriate,thenecessaryamendments.TheCommissionhasnow submittedacombinedreportonbothinstruments,giventheircomplementarycharacter.The Commissionintendstoproposeinthefuture,withintheframeworkofthefutureCommon EuropeanAsylumSystem,thenecessarymeasurestoimprovethepracticalapplicationandthe effectivenessofthe"Dublinsystem".

VISA WAIVER RECIPROCITY

CommissionVicePresidentFrancoFrattinibriefedtheCouncilonthestateofplayregardingvisa reciprocitywithandtheUnitedStates.

Heannouncedthat,inthelightofrecentdevelopmentsinthesetwocountriesregardingthevisa waiverprogramme,thepresentationoftheCommission'sthirdvisareciprocityreportwouldbe delayeduntilSeptember2007.

ThesituationinCanadaisthatthereviewofvisawaivercriteriabeingundertakenbyCitizenship andImmigrationCanada(CIC)willprovideabasisfordiscussionwiththeCommissionandthe MemberStatesconcernedinthenearfuture.

TheUnitedStatessignalledanewinitiativeonthevisawaiverprogrammewhichwouldinvolvethe possibilityofnewlegislation.

TheCouncilagreedthatthePresidencyandtheCommissionwouldcontinuetohavecontactswith CanadaandtheUnitedStatesonvisareciprocity.

EXCHANGE OF INFORMATION EXTRACTED FROM CRIMINAL RECORDS BETWEEN MEMBER STATES

TheCouncilagreedonageneralapproachtoaproposalforaFrameworkDecisiononthe organisationandcontentoftheexchangeofinformationextractedfromcriminalrecordsbetween MemberStates.

ThisFrameworkDecisionisanimportantinstrumenttoimprovetheexchangeofinformationon criminalconvictionshandeddownagainstnationalsoftheEUMemberStates.

ItwilllaythegroundrulesforthetransmissionofinformationonconvictionstotheMemberState oftheperson'snationalityaswellasforthestorageofsuchinformationbythatMemberStateand forretransmission,uponrequest,tootherMemberStates.

TheFrameworkDecisionisintendedtoapplytorequestsinthecaseofbothcriminalproceedings andnoncriminalproceedings.TheFrameworkDecisionalsoaddressestheimportantissueof informationexchangearisingfromconvictionsforsexualoffencescommittedagainstchildren.

Atalaterstage,theEUwilldevelopamechanismforanelectronicinformationexchangebymeans ofaEuropeanstandardisedformat.

InformationonconvictionshandeddowninotherMemberStatesiscurrentlygovernedbyArticles 13and22oftheEuropeanConventiononMutualAssistanceinCriminalMattersof1959 1.The proceduresdescribedintheseprovisionsarenow,however,tooslowfortherequirementsof judicialcooperationinanareaoffreedom,securityandjusticesuchastheEuropeanUnion.

ThisFrameworkDecisionwillreplaceArticle22oftheConventionasregardstheobligationsofthe convictingMemberStatetotransmittotheMemberStateoftheperson'snationalityinformationon convictionshandeddownagainstitsnationals.ItwillalsorequiretheMemberStatesoftheperson's nationalitytostoresuchinformation,inordertoensureitisabletorespondfullytotheinformation requestsmadetoitbyotherMemberStates.

ThisFrameworkDecisionwillnotprejudgethepossibilityofthedirecttransmissionbyjudicial authorities'ofinformationfromcriminalrecordspursuanttoArticle6(1)oftheConventionon MutualAssistanceinCriminalMattersbetweentheMemberStatesoftheEuropeanUnion establishedbyCouncilDecisionof29May2000 2.

RECOGNITION OF SUSPENDED SENTENCES, ALTERNATIVE SANCTIONS AND CONDITIONAL SENTENCES

TheCouncilreachedacommonunderstandingoncertain"keyelements" (see below) ofadraft FrameworkDecisionontherecognitionandsupervisionofsuspendedsentences,alternative sanctionsandconditionalsentences:

– theaimoftheFrameworkDecision,

– thescopeofitsapplication,

– thetypesofsuspensorymeasuresandalternativesanctions,and

– thedivisionofcompetencesbetweentheissuingStateandexecutingState.

ThecommonunderstandingdoesnotcommitdelegationstospecificwordingoftheArticles,which stillneedtobefurtherdiscussed.Furthermore,thiscommonunderstandingmayneedtobe modifiedinthelightoftheworkthathasstilltobecarriedoutonotheraspectsofthedraft FrameworkDecision,whicharenotcoveredbythekeyelementsconcerned.

TheCouncilinstructeditspreparatorybodiestocontinuetheworkonthisdraftFramework Decisiononthebasisofthecommonunderstanding.

TheCouncilalsodiscussedtheissueofdoublecriminalityanddecidedtocomebacktothisissueat alatersession.

• asregardsthesentencedperson,theobjectiveisthatitallowsasentencedpersontoreturnto his/herplaceofhabitualresidenceduringtheperiodofprobation,whichfacilitatesthesocialre integrationofthepersonconcerned.Inthisrespect,theinitiativefavoursthefreemovementof personswithintheEuropeanUnion;

• asregardsthevictim,thebenefitisthatitallowssentencedpersonstobesubjecttoobligations withaviewtovictimprotectionalsoattheirplaceofhabitualresidenceandsubsequent decisionstobetakenincaseofbreachofsuchobligations.Inthisrespect,theinitiativealso helpstomaintainpublicorderandprotectsociety;

• asregardsjusticeingeneral,thebenefitoftheinitiativeisthatitallowsthejudiciarytoapplythe mostadequatesolutioninaparticularcaseandcontributestotheapplicationofnoncustodial measuresto'nonresident'offenders.Inotherwords,itallowsjudicialauthoritiestofindand applyasolutionthatistailoredtothesituationoftheindividualpersoninquestionirrespective ofwhetherthepersonlivesintheStateofconvictionorwantstoreturntohis/herplaceof habitualresidence.

InrespectoftheEUMemberStatesthatarepartytotheCouncilofEuropeConventionof 30November1964ontheSupervisionofConditionallySentencedorConditionallyReleased OffendersintherelationshipbetweenEUMemberStates,thedraftFrameworkDecisionisto replacethatConventionandfurtherexpandonit.

Scope of application

ThescopeofthedraftFrameworkDecisionrelatestothesupervisionbyaMemberStateof "suspensorymeasures",whichareimposedonthebasisof,orcontainedin,a"suspendedsentence", "conditionalsentence"oradecisionon"conditionalrelease".1

Thebasisfortheimpositionof"suspensorymeasures"willalwaysbeajudgmentbyacourt,which establishesthatthepersonhascommittedacriminaloffence.Asubstantialnumberofdelegations wouldadvocatethat,onthebasisofsuchadecision,theconcrete"suspensorymeasures"couldalso beimposedbyanauthorityotherthanacourt,inaccordancewiththerelevantrulesofnationallaw. However,thisissueisstillopenandneedstobefurtherexamined.

Subjecttofurtherdiscussionofthepoliticalaspects,andinlinewiththewishesofaverylarge majorityofdelegations,“alternativesanctions”thataredecidedbyacourtshouldingeneralterms alsobeincludedinthescopeoftheFrameworkDecision.Itshouldhoweverbeexaminedwhether certainlimitationswouldberequiredforsuchinclusion.Inthiscontext,itneedstobefurther discussedwhetherthescopeoftheFrameworkDecisionshouldbeextendedto"alternative sanctions"thataredecidedbyapublicprosecutorratherthanbyacourt.

Types of suspensory measures and alternative sanctions

Thefollowingprincipleswillapplyasregardssupervisionofsuspensorymeasuresandalternative sanctionsasdeterminedbyauthoritiesoftheissuingState:

Therewillbealistoftypesofsuspensorymeasuresandalternativesanctions,whichtheMember State,inwhichthesentencedpersonislawfullyandordinarilyresident,isobligedtosuperviseifso requestedbytheissuingStateandinconformitywithallotherprovisionsoftheFramework Decisionandwithoutprejudicetothegroundsforrefusal.

MemberStateswilleachberequiredtoensurethatasanexecutingMemberStatetheirauthorities cansupervisesuchsuspensorymeasuresoralternativesanctionsirrespectiveofwhetherornotthe sametypeofmeasureorsanctioniscurrentlyprovidedforintheirownlegislationsinthecaseof theirowncriminalproceedings.

Giventhepossibilitythatthespecificsuspensorymeasureoralternativesanctionimposedbythe court[orothercompetentauthorityinanissuingState],evenifitfallsunderthecategoriesof measures/sanctionstobesetoutintheFrameworkDecision,maynotexistinidenticaltermsinthe executingState,theFrameworkDecisionwillprovideforthepossibilityfortheexecutingauthority toadaptthespecificmeasureorsanctionasithasbeendeterminedbytheissuingauthorityand bringitinlinewiththetypeofmeasure/sanction,whichexistsintheexecutingStateforsimilar offences.

EachMemberStatehasthepossibilityofdecidingthatinadditionitispreparedtosupervise suspensorymeasuresandalternativesanctionsotherthanthosesetoutonthelistmentionedabove. Insuchacase,theMemberStateconcernedwillnotifytheGeneralSecretariatoftheCouncilwhich willmaketheinformationreceivedavailabletoallMemberStatesandtotheCommission.Thiswill allowthecourtorotherauthorityintheissuingStatetodeterminewhichothertypesofmeasuresor sanctionscanbesupervisedinaspecificotherMemberStatewithoutpriorconsultation.

Division of competences between issuing State and executing State

OneofthekeyelementsoftheproposedFrameworkDecisionistheattempttoensureawell functioningdivisionofcompetencesbetweentheissuingStateandtheexecutingState.Whilethe executingStatewillprimarilyhavetheroleofensuringthatthepersoncomplieswiththe suspensorymeasuresoralternativesanctions,theFrameworkDecisionwillalsoneedtoaddressthe possibilitythatthepersondoesnotcomplywiththemeasures/sanctions.Inthisrespect,the followingprincipleswillapplyasregardsthedivisionofcompetencesbetweentheissuingStateand theexecutingState:

Thecompetent[judicial]authorityintheexecutingStatewillingeneralhavejurisdictiontotakeall subsequentdecisionsrelatingtothejudgment,i.e.inparticularanydecisionwhichisrequiredin viewofnoncompliancebythesentencedpersonwithsuspensorymeasuresoralternativesanctions imposed.

However,itmaybenecessarytomakeprovisionforcertainexceptionstothisruleinthecaseof "conditionalsentences"and"alternativesanctions".Inbothcases,ifthepersonhasnotcomplied withthemeasures/sanctions,thedecisiontofinallyimposeacustodialsentenceorothermeasure involvingthedeprivationoflibertymayneedtobetakenbythejudicialauthoritiesoftheissuing Statewhichhadjurisdictionofthecasewhentheconditionalsentenceoralternativesanctionwas firstimposed.

ItmayalsobenecessarytoallowtheexecutingState,incertaincasesandnotwithstandingits obligationtosupervisethemeasures/sanctionsimposed,torefusetoassumeresponsibilityfor takingsuchsubsequentdecisionsandthusleavethatresponsibilitywiththeauthoritiesofthe issuingState.

DependingonwhichStatewillhavejurisdictionoversuchsubsequentdecisions,theFramework Decisionwillneedtosetoutcertaininformationrequirementstoensurepropercooperationbetween theauthoritiesinbothStates.

VIOLENT VIDEO GAMES - Council conclusions

TheCounciladoptedthefollowingconclusions:

"THECOUNCILOFTHEEUROPEANUNION

Takes noteofthefactthat,althoughthemajorityofMemberStatesdoesnothaveaspecificconcept concerningmediathatglamoriseviolenceintheirCriminalCodes,severalprovisionsofthose CriminalCodesareapplicable.Thoseprovisionsprovideforsanctionsintheformofimprisonment orfines.

Notes withsatisfactionthatallMemberStatesprovideeffectiveprovisionsaimingattheprotection ofminorsfromobtainingaccesstomediathatglamoriseviolence.MemberStateshavevariouslaws toservethispurpose.However,inallMemberStates,legislationontheProtectionoftheChildren andtheTVandRadioActsaswellastheMediaandAdvertisingActscontainsufficientprovisions forcomplianceandsanctions.

Underlines theimportanceofcontinuedattentiontothedevelopmentofviolentvideogames,and thereforeencouragesMemberStatestoimproveandcontinuetheexchangeofinformationonthis importanttopicandtopromote,wherenecessary,intensifiedcooperationamongthoseMember Statesmostaffectedbythisphenomenon.Inthiscontext,itmightbeusefulforMemberStatesto exchangeinformationwithrespecttothoseviolentvideogamesthathavebeenorshouldbemade inaccessibletominors.

Encourages MemberStatestofullyexplorealreadyexistingEUinstrumentsandexpectsthe competentauthoritiesoftheMemberStatestocooperatecloselywithEUROJUSTandEUROPOL, therebyenablingtheseauthoritiestobenefitfromtheexperiencegainedinthisfield."

ItshouldbenotedthattheInformalJusticeandHomeAffairsministerialmeetingon14to16 January2007supportedtheintentionofthePresidencytolaunchadebateontheproductionand distributionofviolentvideosandcomputergamestoexploresolutionswithproducersand distributors.

On7March2007theGermanPresidencylaunchedaquestionnaireinordertoobtainanoverview oflegalprovisionsforpossiblecriminalsanctionsaswellaslegalprovisionsforprotectingminors fromobtainingaccesstoviolentvideogames.

Theanswerstothisquestionnairerepresentthebasisoftheaboveconclusions.Accordingtothe resultsofthequestionnaire,MemberStateshavevariouslegislationsinplacetoprotectminors againstthenegativeeffectsofviolentvideogames.

Therefore,theconclusionsdonotprovideforEUlegislativeactionforthetimebeingbutfocuson increasedcooperationinpracticeandaskforfurtherexchangeofinformationbetweentheMember Statesconcerned.

PROCEDURAL RIGHTS IN CRIMINAL PROCEEDINGS THROUGHOUT THE EUROPEAN UNION

TheCouncilheldapublicdebateonaproposalforaCouncilFrameworkDecisiononcertain proceduralrightsincriminalproceedingsthroughouttheEuropeanUnion.

Inthelightofthedebate,thePresidencyconcludedthattheCouncilwasnotabletoreacha consensusonthisfile.

ThedraftFrameworkDecisionestablishesrulesdefiningcertainrightsofpersonsarrestedin connectionwithorchargedwithacriminaloffenceinordertosafeguardthefairnessofcriminal proceedingsthroughouttheEuropeanUnion.

Atitsmeetingon1and2June2006,theJusticeandHomeAffairsCouncilagreedontheprinciples forfurtherworkonthisproposal.ItwasconcludedthatthescopeoftheproposedFramework Decisionwouldbelimitedtotherighttoinformation,therighttolegalassistance,therighttolegal assistancefreeofcharge,therighttointerpretationandtherighttotranslationofdocumentsofthe procedure.TheCouncilalsoinstructeditspreparatorybodiestoexaminepracticalmeasures.

Atitsmeetingon15and16June2006,theEuropeanCouncilurgedthefinalisationofnegotiations ontheproceduralrightsincriminalproceedings.

Atitsmeetingon19April2007,theCouncilconcludedthatworkshouldbepursuedinorderto reachaconsensusonthescopeoftheinstrumentattheCouncilmeetinginJune.Thedividingline wasthequestionwhethertheUnionwascompetenttolegislateonpurelydomesticproceedings(at least21MemberStatessharethisview)orwhetherthelegislationshouldbedevotedsolelyto crossbordercases.

HORIZONTAL APPROACH IN RELATION TO CERTAIN CATEGORIES OF OFFENCE

TheCounciltooknoteofthestateofplayofworkdoneregardingthisissue,asfollows:

Background

Atitsmeetingon1and2June2006,theJusticeandHomeAffairsCouncilagreedonageneral approachtotheproposalforaFrameworkDecisionontheEuropeanevidencewarrantand instructeditspreparatorybodiestogivefurtherconsiderationtothebroaderissueofthecategories ofoffence,withaviewtotheadoptionbytheCouncilofahorizontalapproachbytheendof2007 inrelationtoterrorism,computerrelatedcrime,racismandxenophobia,sabotage,racketeeringand extortion,andswindling.

ThehorizontalapproachstemsfromthewishofaMemberStatewhicharguedthatthosecategories ofoffencemightdiffergreatlyinsubstanceandincoveragefromonelegalsystemtoanother.Inits view,acommonunderstandingbyMemberStatesofthesubstanceofthesixcategoriesinquestion couldeliminatethatscopefordifferinginterpretations.Theobjectoftheexerciseshouldbeto makestateactionmoreforeseeableandmoretransparent.AnEUwidecoreofestablishedcriteria tobefulfilledif,say,aEuropeanarrestwarrantistobeissuedforan"undefined"listedoffence shouldbringgreatertrustonthepartofexecutingMemberStatesandmakestateactionmore predictableandmorecalculableforthepublic.

Inpreparingfortheadoptionofahorizontalapproach,dueaccountshouldalsobetakenofthe informationavailableinaccordancewiththereviewclauseinArticle25aofthedraftFramework DecisionontheEuropeanevidencewarrantandofanyotherrelevantinformation,suchas developmentsinthecaselawoftheEuropeanCourtofJustice.

Action taken so far

InresponsetotheCouncil'sinstructions,MemberStatesweresentaquestionnaireenquiring, amongotherthings,aboutanyproposalsforthehorizontalinstrumentandanypracticalproblems regardingthesixcategoriesofoffenceinquestion.

MemberStatesheldafirstdetaileddiscussionofthehorizontalapproachtocertaincategoriesof offenceon22and23March2007.

Inthatdiscussion,MemberStatesbasicallytookapositiveviewofworkonahorizontalapproach confinedtothesixlistedoffencesinquestion.

However,somedelegationswonderedwhethertotakethecourseofdefiningthelistedoffences morepreciselydidnotsignifyastepbackwardsinmutualrecognition,whichinvolvedwaiving considerationofdoublecriminality.

Asregardswhetheranyhorizontalinstrumentshouldtaketheformofbindingrulesormerelybe couchedinnonbindingguidelines,mostMemberStatescameoutinfavourofnonbinding provisions.

Withregardtohowthecategoriesofoffencesmightbedefinedmoreprecisely,somedelegations wereinfavourofreferringtointernationalconventionsorotherEUinstruments.Othershad misgivingsaboutreferencetointernationalconventions,asmanycountrieshadmadenumerous declarations,exceptionsandreservationsinrespectofindividualprovisionsinconventions.

Considerationwasalsogiventowhether,perhapsatalaterstage,delegationscouldentertainthe ideaofplacingdiscussionofahorizontalapproachonabroaderfooting.Ahorizontalapproach couldconceivablylaydownuniformrulesonmatterssuchasgroundsforrefusal(e.g.territoriality, immunityandtimebarring).Suchan"extended"horizontalapproachmightsimplifyfuture discussionsonavarietyofframeworkdecisions.Thesameproblemsandissuesarisingwouldnot needtobediscussedanewforeachpieceoflegislation.Onthispointthereweredifferentschools ofthoughtamongdelegationsastotheprosandcons.

Options

Moreprecisedefinition

Thecategoriesofoffencecouldbedefinedmorepreciselybyreferencetointernationalinstruments, whereavailable.Forthosecategoriesofoffenceforwhichtherearenointernationalconventionsor otherinstruments,aseparatedefinitioncouldbedrafted.Anotherpossibilitywouldbetodrawup separatedefinitionsaltogether,withoutreferencetoanyinternationalconventionsorEU instruments.

Possiblemechanism

Itwouldbesufficienttodefinemorepreciselythecoreconditionstobemetbyoffencesinorderfor theexecutingcountry'sauthoritiestoberequiredtogiveeffecttotheothercountry'sdecision, withoutconsideringdoublecriminality.Itwouldbepossible,forinstance,fortheformsforuse undereachframeworkdecisiontoincludeaboxforindicatingwhetherornotanoffencemetthe definitionestablishedbyMemberStates.If,intheissuingauthority'sview,acasemetthemore precisedefinitionoftheoffence,considerationofdoublecriminalitywouldnotbeallowed.If,in theissuingauthority'sview,whileconstitutingalistedoffence,acasedidnotmeettheagreed precisedefinitionofit(the"coreoffence"),doublecriminalitycouldstillbeconsidered.

Conclusion

Legalinstrumentsbasedontheprincipleofmutualrecognition,suchastheEuropeanarrestwarrant, havenotyetbeeninapplicationforlongenoughtoidentifyanyproblemsinputtingtheminto practice.Inordertodiscoveranysuchproblems,theEuropeanevidencewarrantwouldalsoneed tobeassessed.Thiswillhavetowaituntiltheevidencewarranthasbeenimplementedinall MemberStates.Onlythenwillitbepossibletoascertainwhetherand,ifso,onwhatbasisany specificstepscanbetakentowardsahorizontalinstrument.

PROTECTION OF THE ENVIRONMENT THROUGH CRIMINAL LAW

TheCounciltooknoteofaPresidencyreportonthestateofplayoftheproposalforaDirectiveon theprotectionoftheenvironmentthroughcriminallaw,asfollows:

Presidency report

On9February2007theCommissionsubmittedaproposalforaDirectiveonenvironmental protectionthroughcriminallawwhichisofparticularimportancefortheMemberStatesofthe EuropeanUnion.

AuniformlevelofprotectioninthefieldofenvironmentalcriminallawthroughoutEuropeisboth necessaryandappropriate.TheMemberStateshadalreadymadethisclearbyagreeingonthe FrameworkDecisionontheprotectionoftheenvironmentthroughcriminallaw,whichwas annulledongroundsoflackofcompetencebytheEuropeanCourtofJusticeinitsjudgmentof13 September2005.TheproposalforaDirectiveisintendedtoreplacetheannulledFramework Decisionandthusfillagapintheareaofenvironmentalprotectionthroughcriminallaw.The Directivewillprobablybeoneofthefirstsetsoflegalinstrumentsbymeansofwhichcriminallaw arrangementscanbemadeinthecontextofthefirstpillar,andassuchwilltosomeextentserveas anexample.

Discussionsontherulesonsanctions(Articles5and7)should,intheunanimousviewofthe MemberStates,bepostponeduntiltheEuropeanCourtofJusticehasruledontheCommission's actionforannulmentoftheFrameworkDecisiontostrengthenthecriminallawframeworkforthe enforcementofthelawagainstshipsourcepollution.ThatFrameworkDecisioncontainsdetailed rulesonsanctionsthatarecomparabletothoseintheproposalforaDirective.TheCourtofJustice isexpectedtogiveitsrulingtowardstheendof2007.

E-JUSTICE - Council conclusions

TheCounciltooknoteofareportonEJustice (10393/07) andrequestedthecontinuationofwork onthissubject.

TheCouncilalsoadoptedthefollowingconclusions:

"1. TheCounciltakesnoteofthereportoftheWorkingPartyonLegalDataProcessing(E Justice) 1ontheresultsoftheexaminationoftherequirementsforandthepossibilityof developingworkintheareaofEJusticeattheleveloftheEUandoftheresultsofthe ConferenceonEJusticethattookplaceinBremenfromthe2931May2007.

2. TheCouncilagreesthatworkshouldbecarriedonintheareaofEJusticewithaviewto creatingatEuropeanlevelatechnicalplatformgivingaccess,inthesphereofjustice,to existingorfutureelectronicsystemsatnational,Communityand,whereappropriate, internationallevelintheareascoveredbypoint6.

Thesystemwillbedecentralised.Itwillhoweverbenecessarytoconsiderwhetherandto whatextentacoordinationwillberequiredinordertoensureconsistencyinthe functioningofanEJusticesystematEuropeanlevel.

ThefullimplementationatEuropeanlevelofanEJusticesystemisanambitiousproject andwillrequiretheappropriateresources,atEuropeanlevelaswellasatMemberState level.Thus,animportantpreparatoryworkisnecessaryandtheCouncilinvitesthe Commissiontocarryoutstudiesinthisarea.Howeverthispreparatoryworkshouldnot preventMemberStatesfromsettinguppilotprojectsinthefieldofEJustice.

3. AnEJusticesystemshouldgiveaccesstocitizens,economicoperators,practitionersof law,judicialauthoritiesandcourts,whichwillbenefitfromavailablemoderntechnologies.

AnEJusticesystemshouldensureauserfriendlyaccess.Citizensshouldbeabletousea languageoftheinstitutionsoftheEuropeanUnion,totheextentpossible,havinghowever inmindthat,intheframeworkofjudicialproceedings,thelanguagetobeusedisthatof theplacewheretheproceedingsaretakingplace.Withregardtothecooperationbetween authoritiesofMemberStates,itshouldbeexaminedtowhatextentitwillbepossibleto adoptaflexiblelinguisticregime.Aidtotranslationandinterpretationisanimportant elementtobetakenintoaccountintheframeworkofEJustice.

4. Theworktobeundertakenwillbeofanonlegislativenatureandshouldbecarriedoutin fullcooperationwithCouncilbodieswhichhavecompetencefortheexaminationof legislativeproposals.ThedevelopmentofEJusticeatEuropeanlevelisanevolving process.TheprojectsareopentoallMemberStates.However,noteachMemberStateis requiredtofullyparticipateinallaspectsofEJusticefromtheoutset.

5. WithaviewtofullimplementationinallEUMemberStates,whichshouldbethelong termobjective,theCouncilinvitestheCommissiontoexaminewhetherandhowthe effectiveimplementationofEJusticeprojectsinMemberStatescouldbesupportedbythe Communityatorganisational,logisticalandfinanciallevelsintheframeworkofexisting programmes.

6. ActionbytheCommunity/UnionwithrespecttoanEJusticesystemshouldbelimitedto crossborderissuesincivilandcommercialmattersandincriminalmattersandshould cover:

a) thesetupofaEuropeaninterface(EJusticeportal);

b) thepossibleuseofITforthecommunicationsbetweenthejudicialauthoritiesand interestedparties(applicant,defendantandotherparticipantsinvolvedinthe proceedings);

c) thepossibleuseofITinthecontextofspecificprocedures;

d) accesstojudicialregistersinelectronicform,inthefullrespectofthelegalorders oftheMemberStates.

7. Theprioritiesforfutureworkshouldbethefollowing:

a) setupaEuropeaninterface(EJusticeportal);

b) createtheconditionsfornetworkingofthefollowingregisters 1:

c) ensurethattheEJusticesystemwillbefullysecured.

9. WithoutprejudicetoArticle202oftheECTreaty,theCouncilinstructsCoreperto organiseworkinthefieldofEJusticeandpreparethemandatetoacompetentworking partyinorderto:

a) preparetheimplementationofworkasdefinedinpoint7andincompliancewith point8;

b) allowthatthenecessarytechnicalassistanceisgiventoCouncilworkingparties, whererequired,withaviewtoensure,totheextentpossible,aconsistentapproach toITinthesphereofjusticeand

c) submitareportforitsmeetinginDecember2007onprogressmadeintheareaof EJustice.Inparticular,thisreportshouldlisttheexistingprojectsinthisarea."

ROME II (REGULATION ON THE LAW APPLICABLE TO NON-CONTRACTUAL OBLIGATIONS)

TheCouncilheardanoralreportbythePresidencyontheagreementreachedwiththeEuropean ParliamentonRomeII.

ThepurposeofthisdraftRegulationistolaydownauniformsetofrulesoflawapplicabletonon contractualobligations,irrespectiveofthecountryofthecourtinwhichanactionisbrought.This shouldincreasecertaintyastotheapplicablelawandimprovethepredictabilityoflegaldisputes andthefreemovementofjudgments.

Asageneralrule,thedraftRegulationsetsoutthatthelawapplicabletoatort/delictisthelawof thecountrywheredamageoccurred.Onlyincertainlimited,dulyjustifiedcircumstances,willthe generalrulebederogatedfromandspecialrulesapplied.ThedraftRegulationcontainsspecialrules inmattersofproductliability,unfaircompetition,environmentaldamage,infringementsof intellectualpropertyandindustrialaction.

TheCounciladoptedajointactionextendingforayeartheEUmissiontoprovideadviceand assistanceforsecuritysectorreformintheDemocraticRepublicofCongo(DRC,EUSEC RDCongo) (9815/07) .

ThejointactionaimsatcontinuingtheEU’scontributiontocompletingtheintegrationofthe variousarmedfactionsintheDRC,aswellassupportingCongoleseeffortstorestructureand rebuildtheCongolesearmy.ItextendstheEUSECRDCongomissionlaunchedinMay2005 beyonditscurrentexpirydateof30June.

AreferenceamountofEUR9.7millionisearmarkedfortheperiodfrom1July2007until30June 2008.

– EUPOL RD Congo Mission

TheCounciladoptedajointactionestablishingapolicemissioninordertocontinuetheEU’s contributiontoCongoleseeffortstoreformandrestructuretheNationalCongolesePoliceandits interactionwiththejudicialsystemintheRDC.

ThenewEUPOLRDCongomissionwill,onaninvitationfromtheCongoleseauthorities,buildon theactivitiescarriedoutbytheEUPOLKinshasamission,whichhasbeenoperatinginthecapital oftheDRCsinceApril2005andwhichexpireson30June.

AreferenceamountofEUR5.5millionisearmarkedfortheperiodfrom1July2007until30June 2008.

EUMemberStatesandinvitedthirdStateswillcontributetothemissionbysecondingupto37 policeofficers,magistratesandotherexperts.

Underthesetwojointactions,theEUwillprovideadviceandassistancetotheCongolese authorities,includingwithaviewtopromotingpoliciescompatiblewithhumanrightsand internationalhumanitarianlaw,democraticstandardsandtheprinciplesofgoodgovernance, transparencyandrespectfortheruleoflaw.Bothmissionsaretobecarriedoutinclosecooperation withtheUnitedNationsandotheractorsoftheinternationalcommunity.

The2006electionsintheDRCmarkedtheendofthetransitionprocessandenabledtheformation ofagovernmentin2007.Itsprogrammeprovides, inter alia ,forareformofthesecuritysector,the drawingupofanationalplan,andpriorityreformsinthepolice,armedforcesandjudicialsectors.

TheEUhasshownitssupportforthetransitionprocessintheDRCandforthereformofthe securitysector,includingbytheorganisationofthreeoperations:EUSECRDCongo,EUPOL KinshasaandOperationEUFORRDCongo,whichcontributedtothecreationofasecure environmentduringtheelectionprocess.

FollowinganagreementwiththeEuropeanParliament,theCounciladoptedinfirstreadinga Directiveontheexerciseofvotingrightsbyshareholdersofcompanieshavingtheirregistered officeinaMemberStateandwhosesharesareadmittedtotradingonaregulatedmarket.Thenew DirectiveamendsDirective2004/109/EC 1(PE-CONS 3608/07) .

TheDirectiveaimsatremovingthekeyobstaclestothecrossbordervotingprocessinlisted companieshavingtheirregisteredofficeinaMemberStatebyintroducingspecificrequirements withrespecttoselectedrightsofshareholdersinrelationtogeneralmeetings.
