In addition to the following cursory overview, Appendix A to these reasons contains a more detailed chronology of related events. [2] Mr. Mohamed Zeki Mahjoub (the applicant) is an Egyptian national who came to Canada in 1995 and was found to be a Convention refugee in October 1996. [3] Mr. Mahjoub has been in detention since the Spring of 2000, when the Solicitor General of Canada and the Minister of Citizenship and Immigration (the Ministers ) issued a security certificate qualifying Mr. Mahjoub as inadmissible under section 19 of the Immigration Act , R.S.C. 1985, c. I-2 (former Act) in effect at that time. Appendix B to these reasons sets out the relevant parts of the former Act. This opinion was based on a security intelligence report expressing the belief of the Canadian Security Intelligence Service (CSIS) that Mr. Mahjoub was a member of an inadmissible class referred to in the former Act, by virtue of CSIS’ opinion that he: • will, while in Canada, engage in, or instigate, the subversion by force of the government of Egypt • is a member of the Vanguards of Conquest (VOC), a faction of Al Jihad (AJ). The VOC is an organization that there are reasonable grounds to believe will engage in, or instigate, the subversion by force of the government of Egypt, and will engage in terrorism; • is, and was, a member of the VOC, which is an organization that there are reasonable grounds to believe is, or was, engaged in terrorism; and • has engaged in terrorism.

MONTREAL "PROMPT RESOLUTION OF EVERY CASE, ON REQUEST" The role ofthe Federal Court ofAppeal in the prompt resolution ofcases Hello and thank you for inviting me to talk to you today on an important subject: the prompt resolution of cases in the Federal Courts, and specifically in the Federal Court of Appeal. I will repeat to you what my friend, the Honourable Michel Robert, Chief Justice ofthe Court of Appeal of Quebec, recently confided to me by telephone about his own court's success in case management and mediation. He explained to me that the Court of Appeal of Quebec does very little mediation because ofthe success achieved by the lower courts in this area. At the Federal Court of Appeal, we are also the beneficiaries ofthe effective work done by the Federal Court's judges and prothonotaries. In other words, we are the victims of our own success. In fact, we do not receive requests for mediation at the Federal Court of Appeal. It must be remembered that the Federal Court of Appeal is different from the Federal Court in many respects: for example, we have no witnesses, no evidence, few or no interlocutory motions, etc. Nor do we have prothonotaries, experts in case management and mediation, to help us. As you know, three Federal Court of Appeal judges sit together, and we often travel across the country to hear cases according to the needsArchive ofthe parties. That said, I remain open to the idea and I encourage you to submit your requests or motions for mediation to the Court of Appeal ifyou believe that this could be useful for your clients.

Drapeau' Ottawa The Canadian Charter ofRights and Freedoms recognizes the existence of the militaryjustice system and its own tribunals operating in parallel to the Canadian criminal law system. Yet, there continues to be an absolutepaucity of any reference works on military law and members of the Canadian military bar are seldom heard or read. This article aims atfilling the void, at least in part. In writing this article, the author, who servedfor 34 years in general staff and command positions in the Canadian Forces, had two general purposes in mind: a) to present the general reader with a general overview ofthe history, customs, organization, and structure ofthe military personnel system, and b) to provide a reference work presenting a detailed view ofthe Code ofMilitary Discipline, both in its contents and its workings. Finally, in light ofthe extensive changes in 1999 to the National Defence Act and the accompanying regulations, the author concludes by reviewing the nature and impact of each of the punishments that may be imposed by a military tribunal or the Court Martial Appeal Court ofCanada to those who are subject to the Code ofService Discipline. Over the last decade, the aftershocks of these terrorist attacks on the US have certainly been felt the world over, including in one of its closest, proximal, neighbours, Canada. While initial responses claimed that 9/11 “changed everything,” this spe- cial issue explores and evaluates whether and/or how this was the case for Canada.
