Miller * New York University School of Law Executive Summary Professor Miller begins by placing the efforts to liberalize non-trial adjudication in the context of the numerous “reforms” made in response to perceptions of a “litigation explosion.” These include changes to substantive tort law, enhanced sanctions against attorneys, and procedural changes that facilitate disposition of cases short of trial on the merits.
