Each lot is subject to any reserve price imposed by the Vendor. Such reserve prices may or may not be shown in the catalogue at the discretion of the Auctioneer. A buyer's premium of 15% of sale price will be added to the hammer price of each lot. 2. Subject to term #1, the highest bidder for each lot shall be the purchaser thereof at one increment over the second highest bid. 3. The Auctioneer reserves the right to refuse any bid or bids without explanation. 4. In the event of any dispute as to the highest bidder, the Auctioneer shall have absolute discretion to determine the dispute. 5. The bidding and advances shall be regulated by and at the absolute discretion of the Auctioneer. 6. The Auctioneer reserves the right before or during a sale to group together lots belonging to the same vendor, to split up and to withdraw any lot or lots at the Auctioneer's discretion and without giving any reason in any case (without liability to any potential purchaser). 7. The auctioneer acts as agent between vendor and purchaser only and shall not be liable for any default of the purchaser (providing he has not handed over the goods) or vendor. 8. All phone bids must be confirmed in writing. We will act on behalf of the mail bidder and will enter all bids via mail or telephone with due diligence. However, we accept no responsibility for errors in either understanding or executing bids. Phone bids made within 7 days of auction by bidders unknown to us must be secured by Visa, MasterCard or American Express numbers and expiration date. You should confirm phone bids by sending your SIGNED bid sheet to our Fax 407-645- 4434. 9. Successful bidders are expected to make payment in full before lots are delivered, immediately upon notification. All payments must be made in US funds drawable upon a U.S. bank. All bidders who have not previously established credit must furnish satisfactory references well in advance of the sale date, or send a deposit of 25% of their bids which is applicable to purchases. Any portion of such deposit not used will be promptly refunded after the sale. Lots will not be sent until paid in full. Bidders who have established credit are expected to remit on receipt. No claims or returns accepted for any reason (except authenticity) after 14 days of receipt. Proof by the Auctioneer of receipt of sending at the address submitted with the bid sheet shall constitute delivery. Lots paid for by American Express, MasterCard or Visa are shipped at once, subject to credit verification. WE PREFER CHARGE CARD PAYMENT. See page 8 for Bank Wire Payment Instructions. 10. Until paid in full, all lots remain the property of MICHAEL ROGERS INC. on behalf of the seller. If payment is not received on time, we have the option to offer any lot to the underbidder. Auctioneer reserves the right to dispose of all lots without notice to the defaulting buyer if payment is not made under the terms specified herein, and the defaulting buyer agrees to pay the reasonable costs of such subsequent sales; should a lower price be obtained, the defaulting buyer further agrees to pay any such difference to the auctioneer. LATE REMITTANCE MAY BE CONSIDERED JUST CAUSE TO REVOKE ALL RE- TURN PRIVILEGES. 11. If purchase price has not been paid within the time limits agreed, a late charge of 1½% per month shall be imposed on overdue payments. If legal action is required, all expenses are to be paid by the bidder, and all matters arising on account of this auction shall be construed under laws of the State of Florida. Jurisdiction shall be in Orange County, State of Florida. 12. All cost of mailing lots will be paid by buyer. Handling and insurance minimum $3.00 on invoices with hammer prices of $250.00 or more. We normally mail lots via priority insured mail with delivery confirmation ( minimum $10 ); foreign buyers, ( minimum $30) express mail. 13. US & Foreign Delivery successful winners under $20 sent by regular airmail, not Registered or Insured, at customer's risk. 14. All returned lots are at expense of buyer. AUTHENTICITY: 15. All lots are sold as genuine and correctly described; if in the buyer’s opinion a description is incorrect, the lot must be returned intact within 14 days of receipt. If an extension of time is required for submission of a lot to a mutually acceptable authority for expertizing, the buyer must notify us within 14 days of receipt that an opinion is being sought, together with the name of the authority and expected date of the opinion. The sale shall remain open until an opinion is rendered; however, no returns will be accepted under any circumstances more than two months from the date of sale. A finding of “no opinion” is not grounds for the return of a lot. All expenses for expertizing will be borne by the buyer except in the case that a lot is proven not to be as described, in which case the seller will refund the actual costs, not to exceed $50 per lot. 16. All lots for which an opinion is sought must be paid for at the time of notification. 17. The following lots are not returnable under any circumstances: lots containing 10 or more items, lots described with defects, faults or repairs of any kind, or illustrated lots on account of factors visible in the illustration, or lots described “AS IS”. 2 Michael Rogers Inc.
