At paragraph 85 and 86 of Annexure ‘FA1’ to the application, an internal memorandum from Colonel Roelofse, it said the following: 85 The investigating team have also been informed on 10 October 2011 by the member that on the same evening that he was taken to Major General Lazarus’s house he heard them discussing the placement of a newspaper article relating to Lieutenant General Dramat and Major General Sibiya. He stated that the Major General Lazarus wanted to use sources within the media (journalists paid by CI) to write a story in order to take the focus away from them. This according to the member is a strategy employed to cast suspicion on those they perceived to be a threat. 86 This newspaper article was published in the Sunday Times on 23 October 2011. Lieutenant General Mdluli has made representations to the National Prosecuting Authority earlier that month and uses the above mentioned [sic] article to cast suspicion on Lieutenant General Dramat and the investigating team. A copy of the above memorandum is annexed hereto with its original file name being retained, which is ‘FUL v NDPP (Gen Mdluli) - Annexure FA1.docx’.

The Guptas, the Public Protector’s Report and Capital Accumulation in South Africa Ashwin Desai Goolam Vahed Abstract The relationship between South African President Jacob Zuma and his family, and the Guptas, possibly the richest family of Indian origin at present in South Africa, has made persistent national and increasingly international headlines in the media over the past few years. The Gupta family, who arrived in South Africa from India just prior to the country’s first non-racial democratic elec- tions in 1994, are accused of colluding with Zuma in the removal and appoint- ment of government ministers, as well as the directors of State-Owned Enter- prises (SOEs) in order to secure lucrative state contracts. This article examines the allegedly corrupt relationship between the Zumas and the Guptas to probe key issues in post-apartheid South African society: corruption, state capture, inequality, class formation, Black Economic Empowerment, and White Mono- poly Capital. It argues that corruption has negative consequences such as creat- ing despondency amongst the populace leading to capital flight and creating the possibilities for state capture as well as further deepening inequality. Keywords: Apartheid, Gupta, Zuma, Black Economic Empowerment, White Monopoly Capital, Social Cohesion The lexicon of South African English has been constantly transformed by the inclusion of words from the Afrikaans language, and phrases from the Indian sub- continent, as well as by some words and phrases from local African languages. • Economic Ascendance Is/As Moral Rightness: the New Religious Political Right in Post-Apartheid South Africa Part
Economic Ascendance is/as Moral Rightness: The New Religious Political Right in Post-apartheid South Africa Part One: The Political Introduction If one were to go by the paucity of academic scholarship on the broad New Right in the post-apartheid South African context, one would not be remiss for thinking that the country is immune from this global phenomenon. I say broad because there is some academic scholarship that deals only with the existence of right wing organisations at the end of the apartheid era (du Toit 1991, Grobbelaar et al. 1989, Schönteich 2004, Schönteich and Boshoff 2003, van Rooyen 1994, Visser 2007, Welsh 1988, 1989,1995, Zille 1988). In this older context, this work focuses on a number of white Right organisations, including their ideas of nationalism, the role of Christianity in their ideologies, as well as their opposition to reform in South Africa, especially the significance of the idea of partition in these organisations. Helen Zille’s list, for example, includes the Herstigte Nasionale Party, Conservative Party, Afrikaner People’s Guard, South African Bureau of Racial Affairs (SABRA), Society of Orange Workers, Forum for the Future, Stallard Foundation, Afrikaner Resistance Movement (AWB), and the White Liberation Movement (BBB). There is also literature that deals with New Right ideology and its impact on South African education in the transition era by drawing on the broader literature on how the New Right was using education as a primary battleground globally (Fataar 1997, Kallaway 1989). Moreover, another narrow and newer literature exists that continues the focus on primarily extreme right organisations in South Africa that have found resonance in the global context of the rise of the so-called Alternative Right that rejects mainstream conservatism.

  • South Africa's Anti-Corruption Bodies
Protecting the public or politically compromised? South Africa’s anti-corruption bodies Judith February The National Prosecuting Authority and the Public Protector were intended to operate in the interests of the law and good governance but have they, in fact, fulfilled this role? This report examines how the two institutions have operated in the country’s politically charged environment. With South Africa’s president given the authority to appoint key personnel, and with a political drive to do so, the two bodies have at times become embroiled in political intrigues and have been beholden to political interests. • Bosasa Executives Privy to Sensitive Details of NPA Case Against Them
24 January 2019 Zondo Commission: Bosasa executives privy to sensitive details of NPA case against them Bosasa CEO Gavin Watson allegedly boasted about playing puppeteer with former president Jacob Zuma to his colleague Angelo Agrizzi and former commissioner of the Department of Correctional Services (DCS) Linda Mti. He also told the pair that he knows of a particular approach he has to use with the president to get him to listen, and act. The commission of inquiry into state capture heard on Thursday an audio recording, which Agrizzi said he made during a 2015 meeting between himself and the two men. In the audio, a distinction between three different voices - all male - can be made. For the most part it features the person identified by Agrizzi as Watson, talking about the details of the politics within the National Prosecuting Authority (NPA) at the time, particularly with regard to the DCS tender corruption case against Bosasa. He also seems to express his frustrations with the status of the case, which seemed to have gone away at some point in the past. Bosasa directors, including Watson and Agrizzi, as well as Mti and former DCS chief financial officer Patrick Gillingham featured in the potential prosecution. The man further singles out then senior prosecutor for the NPA Glynnis Breytenbach as being the reason why the case would not go away, because she was obsessed with discrediting Bosasa in the media. He talks of plans to bring Zuma up to speed with all this information, to show him who cannot be trusted within the NPA.

Editor’s Summary The transition to a new constitutional dispensation necessitated that mechanisms be put in place to overcome reluctance to change and to deal with conduct regarded as inappropriate in the new society. The Constitution recognised this need. Legislation was enacted to provide the framework necessary to alleviate and overcome the friction resulting from change. It seeks to provide the standards society is to adhere to and to assist society to determine what standards of conduct are acceptable. The Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (“the Equality Act”) forms part of this legislation. An ubuntubased jurisprudence has been developed. Ubuntu is a concept which is contrasted with vengeance. It dictates that a high value be placed on the life of a human being. It places a high premium on dignity, compassion, humaneness and respect for the humanity of others. It enjoins good attitudes and shared concern, and a shift from confrontation to mediation and conciliation. It favours the reestablishment of harmony in the relationship between parties, and for such harmony to restore the dignity of a plaintiff without ruining the defendant.
