Membership The Committee has eleven members including a Chairperson and Deputy Chairperson with a quorum of five. NILQ 63(4): 509–32 Modernising environmental regulation in Northern Ireland: a case study in devolved decision-making SharoN TurNer aNd CIara BreNNaN School of Law, Queen’s university Belfast * Introduction or over a decade, controversy about the quality of environmental regulation has cast a Fshadow over the effectiveness of environmental governance in Northern Ireland. Most fundamentally this debate has centred on a crisis of confidence about the quality of regulation and a consensus that effective reform depends on the externalisation of this responsibility from central government. Not surprisingly, the causes of weak regulation were rooted in the eclipsing impact of the Troubles and the fossilisation of government that occurred during the decades of Direct Rule.1 However, although the first steps towards meaningful reform were eventually taken under Direct Rule, the restoration of devolution and the stabilising power-sharing process has meant that the trajectory of regulatory reform has been largely shaped by a devolved administration. The purpose of this paper is to examine the nature and implications of that process. Pressure for regulatory reform is an issue that has confronted both configurations of Northern Ireland’s power-sharing Executive. Despite its brief and tumultuous lifespan, the first Ulster Unionist Party (UUP)/Social Democratic and Labour Party (SDLP)-led administration was immediately faced not only with the evidence of serious regulatory dysfunction but also the first stage of what became a concerted civil society campaign for independent regulation. The collapse of power-sharing did nothing to quell this pressure. Instead, when devolution was restored five years later the new Democratic Unionist/Sinn Fein-led administration was faced once again with pressure for regulatory reform. -

The Chairman welcomed Messrs Des McFarland, Noel McMullan and George Nobel to the meeting. Messrs McFarland, Mullan and Nobel presented Roads Service Report and answered questions from councillors.. The Chairman thanked the officials for their attendance. 4 REPORT OF DIRECTOR OF ENVIRONMENTAL HEALTH & BUILDING CONTROL A copy of the above report had been previously circulated. The Committee adopted the report together with the following matters contained therein. 4.1 Environmental Health 4.1.1 Cookstown Healthy Lives Programme 2014/15 The Committee RECOMMENDED to approve the extension of Joint Funding to the value of £9,000 for the ‘Cookstown Healthy Lives Project’, as currently budgeted for . 4.1.2 Lafarge Tarmac, Cement & Lime Ltd Application for Variation of Waste Material to be used as Kiln Fuel The Committee RECOMMENDED that Council agrees to the proposals as per the Director of Environmental Health & Building Control report. -

COUNTMAKE EDUCATION CONSTITUENCY PROFILES FOR FURTHER AND HIGHER EDUCATION IN NORTHERN IRELAND CONSTITUENCY PROFILES FOR FURTHER AND HIGHER EDUCATION MAKE EDUCATION COUNT IN NORTHERN IRELAND Introduction It’s 2010 – the second decade of the 21st century – and it remains a stark reality that Northern Ireland is still riddled with some of the more dire statistics in the UK, when it comes to educational attainment and employment. Northern Ireland is bottom of UK tables that measure employment rates and people with qualifications, according to UCU analysis. Just over two-thirds of people in Northern Ireland (69.7%) are employed, the worst percentage of the UK's 12 regions. The South East of England tops the table with over three-quarters of people (78.5%) employed. The average is 74%. Northern Ireland has the highest percentage of people without qualifications. One in five (21.8%) have no qualifications, which is a long way off the national average of 12.4%. Northern Ireland fares slightly better when it comes to the percentage of people with a degree though. Over a quarter of people (25.7%) have a degree, which puts Northern Ireland in the middle of the regions' table but still some way behind the average of 29%. 104 • NAMA needs to dampen expectations of what it can deliver in this area, as ultimately it could take the blame for unrealised Housing Association plans. The Committee agreed that NAMA should consider a strategic plan on possible sites for Housing Associations, and engage with the NI Housing Executive and Department of Social Development to progress the matter. The Committee separately noted that one housing body has expressed interest in a site in Belfast and NAMA is exploring the matter further. 4d. UUJ Project Update Matter for Information Committee Paper: NIA Mr. Milligan updated the Committee on the progress of phase II of the UUJ research project, advising that the process of correctingany lingering data set inaccuracies had been completed and that the two financial institutions outside the project, Barclays and Santander, had now agreed to partake. Mr. Milligan advised that while a scoping meeting had been planned for late August, it will now occur in October and a more detailed update will be provided to the Committee in December. 5. NI Property Market Update Matter forInformation Committee Paper: NorthernIreland Commercial PropertyMarket Overview The Committee received a detailed presentation on the NI commercial property market from Messrs. Lavery, Reid and Wright of CBRE Belfast. It noted: • As with Dublin, there is a demand for, and shortage of, Grade A office space in Belfast city and the shortage presents a corollary need for landlords to refurbish existing stock, particularly 2 3 years out from the end of leases; 4 105 • Uptake of BPRA 3 forrefurbishment of secondary office stock has been very limited; • While retail demand remains depressed, the sector is also struggling due to the local rates burden; • Positively, rent and yield forecasts across the commercial property sector are predominantly stabilising or strengthening; • US funds are showing interest in NI, including Kennedy Wilson and Oaktree; and • There is a shortage of prime location development land in the greater Belfastarea. -

THE name Bobby Sands is known throughout the world, symbolising the heroism of an Irish prisoner and his comrades who died on hunger strike in their unequal fight against their British jailors. Over the course of the past two years British Foreign Secretary Jack Straw has been lobbying Iran’s Foreign Minister to change the name of Bobby Sands Street, where the British Embassy is situated, in the capital Tehran. (It was formerly known as Winston Churchill Street.) Bobby Sands was an Irish patriot and martyr, who died on 5 May 1981, after 66 days on hunger strike. Whilst in prison he was elected as a Member of Parliament [MP]. One hundred thousand people attended his funeral, including the Iranian ambassador to Sweden. The British government has no right to be in Ireland, just as it has no right to be interfering in the affairs of any other nation. We appeal to the Iranian government and its people not to bow to requests from the British government to rename Bobby Sands Street.
