The Enforcement Bureau (Bureau) of the Federal Communications Commission (Commission) and CenturyLink, Inc. have entered into a Consent Decree to resolve the Bureau’s investigation into whether CenturyLink violated section 20 1(b) of the Communications Act of 1934, as amended (Communications Act), by placing unauthorized third-party charges on customers’ wireline telephone bills. As part of its investigation, the Bureau received customer complaints about CenturyLink’s third-party billing practices. The complaints alleged that customers had been assessed unauthorized charges on their CenturyLink bills for long distance services from various third-party resellers. Customers also claimed that they had difficulty getting timely refunds for these charges. To resolve this investigation, CenturyLink has agreed to pay a $550,000 settlement amount to the United States Treasury. Additionally, CenturyLink has agreed to discontinue these types of third-party billing arrangements, with limited exceptions, and to implement a process for providing refunds or credits to customers with valid complaints about unauthorized charges. 2. After reviewing the terms of the Consent Decree and evaluating the facts before us, we find that the public interest would be served by adopting the Consent Decree and terminating the referenced investigation regarding CenturyLink’ s compliance with section 201(b) of the Communications Act. 3. In the absence of material new evidence relating to this matter, we conclude that our investigation raises no substantial or material questions of fact as to whether CenturyLink possesses the basic qualifications, including those related to character, to hold or obtain any Commission licenses or authorization. -

Telecommunications Provider Locator This report lists the contact information and the types of services sold by 5,364 telecommunications providers. The last report was released November 27, 2001.1 All information in this report is drawn from providers’ April 1, 2002, filing of the Telecommunications Reporting Worksheet (FCC Form 499-A).2 This report can be used by customers to identify and locate telecommunications providers, by telecommunications providers to identify and locate others in the industry, and by equipment vendors to identify potential customers. Virtually all providers of telecommunications must file FCC Form 499-A each year.3 These forms are not filed with the FCC but rather with the Universal Service Administrative Company (USAC), which serves as the data collection agent. Information from filings received after November 22, 2002, and from filings that were incomplete has been excluded from the tables. Although many telecommunications providers offer an extensive menu of services, each filer is asked on Line 105 of FCC Form 499-A to select the single category that best describes its telecommunications business. -

Even though the price was supposedly locked, CenturyLink twice increased the amount of the “Internet Cost Recovery Fee.” Also, CenturyLink relied on a complex promotional pricing scheme that led to frequent misquotes. Finally, CenturyLink failed to provide promised refunds to consumers who returned their equipment at the completion of service. PARTIES 3. Philip J.
