Allen(Chairman), presiding; also, Messrs. Patk. Colfer, Jonn Connors, R. Corish, C. Culleton, W. Cullimore, John Day, Col. C.M. Gibbon, W. P. Keegan, John P. Kelly, W. Kinsella, Jas. Lawler, Sean O'Byrne, Miss

N. O'Ryan, Ml. Redmond, T. Redmond, P. Ronan and Myles ~ The County Secretary, County Surveyor and the five Assistant Surveyors were also in attendance. Mr. Elgee, County Solicitor, wrote he was laid up witn influenza and Col. QUin wrote apologising for his absence from the meeting as he was ill with the flu. The Minutes of last meeting were confirmed.

PAYMENTS Treasurer's Advice Notes for £336. 3. 4d Salaries and £8226. 14. 4d ordinary payments (including payments \ to Road Contractors) were examined and signed.

THE LATE MR. SAMUEL BOLGER On the motion of Mr. Kelly seconded by Mr. Corish it was resplved tnat the following reply from Mr. Moses Bolger, Coolnaleen, Camolin, in acknowledgment of vote of condolence from the County Council in the death of his brother, Samuel, be inserted on the minutes of the day:- "Please convey to the members of your Council my sincere thanks for their resolution of sympathy tendered me on the death of my brother, and also accept my gratitude for your personal message of sympatny. Such sympathy as yours leaves a per·son to know that at tne time of afflic­ tion tney are not forgotten by old friends and colleagues."

EMPLOYMENT SCHEMES VOTE: The following extract from Minutes of Meeting of Wexford Board of Health under date 18th January 1937, was read!- "Mr. J. Whitty, Rent Collector reported: "The roads in the Gorey Garden City are in a bad state of repair. . Large pools of water lie on it after rain and the portion passing the playground is dangerous as there is a hole out in the road, the gravel picked away by the children. In fact, I believe there are people drawing gravel out of it and undermining the road. II The Secretary stated that this road was provided when the Garden City Scheme was being completed by the Board of Hea.lth. On the motion of Mr. Denis Allen, seconded by Mr. Patrick Ronan the Board directed that the County Council be asked to take over the Garden City roads and have it put in a passablecondi tion. " As regards the proposal to repair roads at Ferns and Boolavogue, the County Surveyor read letter from Mr. Ennis, ASSistant Surveyor for the district, in which he stated he had examined these roads. The best way to divide the money would be for Ferns (part of road No. 290) £570. This was the road up by the Catholic cnurch out to Tinnashrule and to spend on Boolavogue (Road No. 310) £190. The Ferns road would take a good deal of work for its length and the levels and drainage would be awkward. At Boolavogue road the trouble was also drainage. Mr. Ennis believed there were some sub-soil drains crossing this road from the Churchyard and that the stoppage of these drs.ins caused the road to be damp . With reference to the proposed improvements at Marshal~ town he had already pointed out it would be impossible to get any material tnere for the next six months. What was required was fairly extensive rolling and regrading. The County Surveyor said no money for this work was available now. In the course of the discussion on the recommendations of the County Surveyor in respect of Gorey and approved by the Finance Committee, Mr. Keegan pointed out that in his opinion it would be more advisable to take over Gorey Garden ~ City~ than to repair the back streets of Gorey at the memento

There were about 60 houses in the Garden City and the road had to be used by families residing there and by their chil- dren going to school. About £600 had been spent on this road by the Board of Health and it had been repaired several times. Mr. O'Byrne said it was in very bad repair at the moment. The Chairman pOinted out that if the Council took over the road they could repair it under Grant, while if it remained with the Board of Health, the money would be found by taxation. Mr. Keegan pOinted out the County Council had the staff and machinery at hand torepair the road. The County Surveyor stated that the pOint he wished to raise about taking over this particular road was that it must be regarded as an exception to the usual procedure seeing that it was constructed by a local Body which was financed by the Council. The Council would not take over any private road unless it had been put into proper repair. The following resolution was adopted on the motion of Mr. Keegan seconded by Mr. Corish:- © WEXFORD COUNTY COUNCIL ARCHIVES "That the County Council take over the road to Gorey Garden City as requested by the County Board of Health and that tne usual procedure as to publication of advertisements to this effect be issued by the County Surveyor." Mr. Smyth asked what was the position regarding Ballygarrett village. The County Surveyor stated it might be necessary to secure material from Carriganeagh Quarry costing the full amount allocated for this particular work. The actual road work might have to wait until more money would be available, and in that case a thoroughly good job could be carried out.

CLEARANCE OF ROADS IN STORMS: In connection with this, tne County Surveyor submitted letter from John Kennedy,Road Ganger, Ballycarney, under date 26th January 1937 that when he was informed at 10 o'clock on the 22nd January that a tree had fallen on the Camolin road between Ferns and Broadford, he went at one o'cloch and worked at the tree until dark. They put up lamps and finished removing the tree the following day. Mr. Ennis, Assistant Surveyor for the district, said the trouble seemed to be that they were letting the owners of the trees evade their liability. The Chairman said that the owners were responsible to

a certain extent, but they could not have main thoroughf~ blocked for twenty-four hours. Mr. Ennis said he wanted the Council to put them in the position that they could go to an owner and say he must remove a tree. He was primarily endeavouring to make the

owner do the work. It was the owner's tree, and he thcu~ they should get the Guards to notify the owner. Miss O'Ryan - Suppose the owner happened to be a man who had not much help, or who was not in a position to do the work? © WEXFORD COUNTY COUNCIL ARCHIVES

------______0_ Mr. Ennis - We always help him. The Chairman said that last year he saw that road and other roads in the County closed. Public roads were now as important as the railway, and if a hundred men would be mobilised to clear a railway it should be the responslbiliW of the County Council to keep the thoroughfares clear. They had two Guards out at the place on a very bad night diverting traffic, and it was not their responsibility either. Mr. Connors - Who is responsible for the clearing of the road - the County Councilor the man who owns the timber? The Chairman said they understood that under some antlquated law the man who owned the tree was responsible for taking it off the road, but there was a question that a lot of traffic might have to go five or ten miles of a round on a boggy road. They could pass a further resolu­ tion to the effect that the owner of every obstruction be notified that if he did not remove it within, say, an hour,

Mr. T. Redmond - Why not notify the owner of any ~ thatts a danger to the highway to bave it removed before it falls at all? After further discussion the Chairman proposed and Col. Gibbon seconded the following resolution:- "That the owner of any tree or other obstruction blocking any public road be interviewed by ASSistant Sur­ veyor or Road Ganger, and informed that if he did not immediately remove such obstruction the County Council

with in future legislation. Mr. Connors said the local people would clear the road with the ganger in very quick time, for the timber, but they would not be allowed to interfere. He proposed that if the owner would not remove a tree the sanger should get local people and his own men to remove it and let the people take it away. Mr. Ronan pOinted out that the Council could not legally do this and they should keep within the law. They believed there were severa,l available quarries in the dis- trtot and it would be for the County Surveyor to determine the suitability of any of them. They heard that materi 1 as to be ootained from the Ballagh quarry, but the draft be would be costly and it ouldj much more economical to secure a local quarry and hic would ~ermanently relieve the misery of unemployment. Dempsey and Sheill complained t ~t though they had been permanent workers with the Council for years, they were not no getting their share of ark. Demp ey said he

got only t 0 days ' work in 1936 and Sheill, !.hat he was not employed by the Council for the whole year. It as decided that tneir complaint be investigated by the County Surveyor who w s asked to present report in the matter to the next Finance Committee meeting.

TACUMSHANE lAKE: Col. Gibbon asked how the £100 grant was f to be expended. Was it by the County Surveyor directly or should the local farmers be made responsible? The Chairman said what was suggested by the Office of Public Works was that the fa·rmers should give voluntary help to supplement the £100. Col. Gibbon pOinted out that time was a most important factor in carrying out the work, and if any delay occurred now the lake might drop about 18 inches or 2 feet and a large head of water would be lost. Mr. Birthistle said the £100 would go nowhere if spent in the same manner as previous amounts. It would cost £25 to deal with the plant, leaving only £75 for actual w'ork. If an effort was to be made to cut the gap it snould be done quickly. He was afraid they could not count on much assistance from the local people. It was decided that the representatives appointed by the Finance Committee should meet at Mr. Gibbon's, Linziestown, Tomhaggard, on Friday, 12th February 1937 at

ST. HELENt S HARBOUR: The following resolution was adopted on the motion of Mr. Corish seconded by the Chairman:­ "That application be made to the Fisheries Branch of the Department of Agriculture for a grant for the improve­ ment of st. Helen's Harbour."

CLONJORDAN FLOODING: Mr. Ennis reported tnat on one of the worst days in JfUluary he examined this road and found about eight' inches of water on it. This is the first time / he had seen any water on it. The place would be greatly improved if the owner of the land would do some cleaning of the river on the down-stream side. The outlet of the double gullet seemed to "drown" in a heavy flood. If it had a free delivery it would take considerably more water. The cleaning of the river would not be a very big job. If this were done, Mr. Ennis said he would open up the gullet next summer and see if it could be improved.

DAVIDSTOWN LANE: Mr. Joseph Shea, Boolabawn, Davidstown, Enniscorthy, wrote under date 5th February, making applica- tion for repair of above lane. One portion had been repaired last year under Minor Relief Schemes Vote. Unless a bridge was erected at the place referred to in Fr. Powers letter some one would be drowned there. The place was a death trap- He was prepared to give stones free of cost from his own quarry towards the work of repair. Orpen sa.id the Committee were anxious for sugge s­ tions from Mr . Leask as to what stens they could take to preserve the monuments hich were now in existence. he Commi ttee had no funds and it appeared the County Council could not move unless monuments were vested in them. They had some unique monuments jn the County 8nd something shoul be done for their preservation. An instance of this was the fortified Church in Clonm nes "hich was in fair order, but ash trees ere growing through the roof and the water coming in. Mr . Leask said that the principal Act of 1930, good as it was, did not cover the whole field. He had noted that at a nrevious meeting the Committee had discussed the ques­ tion of the preservation of monuments in graveyards. In the apnendix to th~ report of the Commission under the Church Temnoralities Act of 1869, there a,ppeared lists of graveyards vested in the Church Re resentative Body and also those ve~ted in Sanitary Autnorities. The Board of Healt as the successors of the Sanitary Authorities were now chDrged with contro and maintenance of the last n gravey .ra~ . APPLICATIO ASSISTANT SURVEYORS At the meeting of County Council on 12th October 1936 a Sub-Committee was appointed consisting of the Chairman,

Vice-Cnairman, Miss 0 1 Ryan, Messrs. McCarthy, O'Byrne and Kelly to consider an application from Messrs. R. J. Ennis, J.' F. Birthistle, T. Cullen and P. OINeill, Assistant Surveyors, to have their salaries placed on incremental basis of £15 up to a maximum of £400, and also to formulate a scheme under which the services of County Council Survey Staff could be utilised for work in connection with all the County Council's Subsidiary Bodies. A meeting of the Sub-Committee was held on 30th October 1936. It was then recognised that there were many obstacles to the proposal of the co-ordination of Engineering services and the securing of data as to how this nad been effected in other Counties etc. was found to be necessary. The following are the Minutes of second meeting of the Sub-Committee:-

The Chairman of the County Council (Mr. Allen) presided and there were also present:- Miss O'Ryan, Messrs. Corish, , Kelly and O'Byrne. The Secretary of the County Council was also in attendance. Return as to sa laries paid to Assistant Surveyors in other Counties received from the Department of Local Government and PubliC Health was submitted. During the discussion which followed it was stated that tne County Board of Health were obliged to call in outside engineers for Sewerage, Water, Housing and other Schemes, and it was pOinted out that if the services of the Survey Staff of the Council could be utilised it would mean a more satisfactory and economical arrangement. The Sub-Committee agreed to a further adjournment with a view to a further investigation as to how far all engineering work in the County could be re-organised and co-ordinated. It was also decided that, in the meantime, a consultation relative to this matter should be arranged (after sanction by the Minister) with Mr. Courtney, Chief Road Engineer of tne Department of Local Government and Public Health.

OYLEGATE WATER SUPPLY AND SEWERAGE SYSTEM The following motion of which ne nad given previous notice and which was circulated to the members of the Coun- cil on 17th December 1936, was moved by Mr. Ronan:- "That the Council consent to the borrowing by County Wexford Board of Health and Public Assistance of £3,400.

(Three tnousand eHd four hundred pounds) to provide a water supply and sewerage system at , this amount to be in substit·.ltion of loan of £1,624 agreed to for this pur­ pose by County Council at their meeting on 13th January 1936. The increase is caused by amended estimate of the Consulting Engineer to the Board of Health and Public Assistance." In moving his motion Mr. Ronan pointed out that the loan for the present sum was being substitued for that' already agreed to and which only covered the water schame. It waS recognised by the Board of Health tnat a sewerage scheme was the natural complement of a water supply, and

© WEXFORD COUNTY COUNCIL ARCHIVES WARBLE FLY (TREATMENT OF CATTLE) ORDER 1936 In connection with the proposal of the Finance Commit­ tee .asking the Department of Agriculture to provide some colouring matter in Cattle Washes for Warble Fly treatment the following is extract from letter of the Department under date 29th January 1937 (L.279/37):- IIRepresentations to tne same effect were made to this Department last season and were considered when the Order was recently under revision. It was decided that the adoption of tne suggestion would really serve no useful purpose as tne proper application of the cattle wash is usually evident a few days afterwards in the death and shrinkage of the warble larvae. There was also the objection to colouring the wash in that it could be substituted by a non-approved coloured preparation. 1I Under date 19th January, 1937, the Department of Agriculture wrote (L.164/37) that the names of the temporary Inspectors appointed by Wexford County Council under Warble Fly Order had been noted. The Minister approved of the re-appointment of the local Veterinary Inspectors for super­ visory work under the Order at the same rate of remuneratim and on the same conditions as were sanctioned last season. Letters accepting the supervisory position under the Order were read from Messrs. F. S. Ringwood (Enniscorthy) ; T. A. Mernagh (Gorey) and F. W. Taylor (New Ross) Veterin&y Inspectors. The three first mentioned stated that as the period this year was three weeks longer, perhaps the County Council would increase tne remuneration proportionately, if at the end of the period they were satisfied the work had been carried out in a satisfactory manner. Mr. Smyth said last year in some instances the wash was only sprinkled on cattle and he noped the work would be better done this year. in which the wash was not properly applied the County Council would deal with then and see that the Order was properly carried out.

FLOODING AT CAMPILE ETC. The County Surveyor submitted the following letter from Irish Land Commission under date 23rd January 1937 (Ref. P.A.2436/37) Estates E. H. Ryland E.c.8483 and E.M. Galwey s.855 Wexford:- IIWith reference to your letter of the 12th instant asking for an interview for a member of the County Council, two of the local persons affected, and yourself, for the purpose of discussing the question of flooding occurring at Great Island and Fisherst,own on the above Estates, I am desired by tne Land Commission to inform you that after careful consideration of this matter they sanctioned an expenditure of £250, of which £150 only, would be repayable, for tne purpose of affecting the repairs necessary to the embankment in these townlands. This offer was not accepted, the Land Commission being informed by Mr. Thomas J. Kelly, New Ross, SoliCitor, acting on benalf of the tenants that his clients considered the sum sanctioned inadequate and that an Engineer employed by the tenants had estimated that the cost of repairs would be considerably in excess of this sum.

The Land Comm~ssion although satisfied that the sum of £250 is adequate to effect the repairs have asked Mr. Kelly to furnish tnem with a copy of the specification prepared by the Engineer acting on behalf of the tenants. Tnis request nas not yet been complied with and in the absence of the particulars asked for it does not occur to the Land Commission that the suggested interview would serVE any useful purpose. II

On the motion of Mr. Colfer seconded by ]~. T. Redmond' it was decided that copy of letter from the Land Commission be furnished Mr. Kelly, SoliCitor, New Ross, for his infor- mation. In reply to Mr. T. Redmond the County Surveyor said he nad never examined the place, but he knew that the damage to the road caused by the flooding cost £70 in repair. Mr. Thomas Redmond said tne County Council was con- cerned in the matter because there was danger that the road and the two big retaining walls would be carried away the s~e as last year. £250 would be thrown away on the work, as a proper job would cost at least' twice as much. County Surveyor - We are interested, because we have the drainage below that place, and the protection of the County Road also. The following resolution was adopted on the motion of Mr. Thomas Redmond seconded by Mr. Michael Redmond:- "That the County Surveyor inspect and report to the County Council as to application of tenants at Great Island and Fisherstown re drainage of their lands. That after consideration of this report the Land Commission be reques­ ted to arrange to receive the deputation appointed by the

COUNTY ANALYST'S QUARTERLY REPORT Report of County Analyst for quarter ended 31st December, 1936, was submitted. The total number of samplffi analysed was 311, including Foods 230; Drugs 63; Waters J8. Of these two samples of butter, two of new milk, and one drug were adulterated, while 14 samples of water were con­ demned. Of the samples of water, eight submitted by the Health Board for the following districts were condemned:-

Rathnure, Baldwinstown, Kilbride, Aughanmoe, Duncannon~ Klltealy, Blackwater and Tubberlamina. For the Wexford Corporation waters were condemned from:- Reservoir (2); St. John's Road (2); and Anne Street Main (2).

NEW ROSS URBAN ROADS Under date 3rd February 1937 the following letter was read from County Surveyor:- "I have now heard from the Town Clerk, New Ross, that the Urban Council is prepared to put up £200 for MaintenancE of the Urban Roads in the coming year. amount fairly reasonable in view of the fact that a good deal of improvement work has been recently carried out

under Loan and Grant, and, moreover, two Employment Scheme I Grants have also been allocated for the Urban Roads. It will be necessary to add to this £200, £25, amount author­ ised as Surveyors' fees, so that the total to be raised will be £225 for the Urban Area. Will you please arrange for this when dealing with Road Estimate." The following resolution was adopted on the motion of Mr. Colfer seconded by Mr. Kelly:- "That Wexford County Council hereby agree to raise on behalf of New Ross Urban Council a sum of £225 for the , maintenance of Non Main Roads in New Ross Urban District." Mr. Thomas Redmond said that when the next scheme was carried out a sum of £1660 would have been expended in New Ross for the maintenance of roads and in view of the fact that another grant was expected the cost of maintenance would be considerably reduced. In the circumstances, he

was of opinion that the £225 asked for by the County Surw~ would be quite adequate for the next financial year.

KILMANNOCK DRAINAGE AREA The County Surveyor submitted the following letter from Mr. N. J. Murphy, Hon. Secretary of Kilmannock Drainage Local Commi'ttee, under date 23rd January 19-37:- "Re Kilmannock Drainage. The marsh owners held a meeting here lately, and we decided that as there was so very little in the drain at present it would not be worth while doing anytning till next Summer. When the Causeway wall broke last year, the tide gave it a good scouring out, and the Spring Tides are flooding it out still, so tnat 1I0ut of evil some good cometh". Mr. O'Neill was out inspecting it, he will be in a position to inform you on all particulars, and we shall abide by your

©decision WEXFORD on the COUNTY matter.1I COUNCIL ARCHIVES The County Surveyor said he was submitting this letter in order to explain to the Council that very little money would be necessary to expend in the coming financial year on the drains of this system for which the County Council were responsible.

EEMSTOWN GAP Col. Gibbon said that at the gap at Neemstown some of the concrete used in the last repair job had been washed away. The gap was very steep and unless something was done to remove the concrete and stones, and improve the gradient, the whole parish of Kilmore which was dependant on sea weed as manure for carrying out 75 per cent of their tillage, would suffer badly. Most of the sea weed gathereo by the Kilmore people came through Neemstown Gap. Mr. Birthistle, Assistant Surveyor for the district, said in his opinion it would be almost impossible to have any permanent structure erected at this gap. He was get­ ting the gradient gradually improved and would take out the concrete and stones referred to by Col. Gibbon. There never had been any hold up to the people using the gap.

ROADS IN CASTLESOW Under date 6th February 1937, Mr. D. Connolly, Hon. Secretary Fianna Fail Cumann, forwarded the following resolution which had been adopted by that body:­ "That we call the attention of the Wexford County Council to the deplorable state of the by-roads under the Direct Labour System. We calIon them to at least have proper drainage carried out. In their present condition they are a disgrace to any public body.lI It was decided to ask Mr. Connolly to furnish the Council with the location of the roads complained of by them, when the matter would be investigated.

© WEXFORD COUNTY COUNCIL ARCHIVES DEFAULTING ROAD CONTRACTOR The County Surveyor submitted the following report from Mr. Ennis, Assistant Surveyor, under date 2nd February, 1937, in respect of roads Nos. 233, 234 and 236:- "The Contractor for these roads, Thomas Kane, has done very little work. I think we should get authority to prosecute him if necessary. His contract expires on 31st March 1937, hence the matter is urgent. I am writing to him to improve, and will see the roads again in three weeks or SO." The Chairman proposed and Miss OtRyan seconded the following resolution which was adopted:- "That the County Surveyor be empowered to prosecute Thomas Kane, contractor for Roads Nos. 233, 234 ann 236, and his sureties, for his negligence in not keeping these roads in repair or otherwise that he take these roads into his own charge or adopt such other steps as will enable him to put the three roads in question into proper repair."

WAGES ON RELIEF SCHEMES In reply to Mr. Corish, the County Surveyor said that County Council wages were not paid on Minor Relief Schemes as wages on this scheme had been fixed by Government at 24/- per week. The rotational system of employment had

been first p~t into operation in reference to Minor Relief Schemes, but recently a notification had been issued by the Department of Local Government and Public Health that this scheme was to apply to all relief jobs. Mr. Corish proposed and Mr. Kelly seconded the following resolution . which was adopted:- "That representations be made to the Government with ' a view to securing that men employed on all Relief Works obtain a week and not three days employment, as with the rotational system they cannot draw money from the Labour Exchange." © WEXFORD COUNTY COUNCIL ARCHIVES Mr. Redmond pointed out that the danger of this reso­ , lution mignt be to upset the system of Relief Schemes.

POACHING TRAWLERS Under date 21st January 1936 (P.A.12/36) the Department of Agriculture, Fisheries Branch, wrote that in reply to the resolution of the County Council the Minister had been

Gibbon said it was not possible with only one boat to provide proper protection for the fisheries. These were worth several millions, but the entire Fishery Vote of the Government was only £60,000, of which £45,000 was spent on protection. More serious steps would have to be taken 9r the fishing would be absolutely ruined. Continuing Col. Gibbon said:- liThe real trouble is that our fishermen live by inshore fishing entirely and

tney do not go in for deep sea fishing. Unless the insh~ fishing is properly protected tnere will be nothing left, and the sooner the Government awakens to the fact and pro­ vide some facilities for the Minister the better it will be for tne country . Further representations should be • made to the Government. The Chairman thoroughly agreed that one boat is not sufficient, and he thought the time was long pa. t .. · when additional protection should be provided. Mr. Smyth said that on a couple of oooasions the fishermen called his attention to the foreign trawlers off the coast. All the fishermen could do was to stand and look on. Col. Gibbon proposed:- IIThat this County Council point out to the Minister for Agriculture it is within the knowledge of numbers of Councillors that there is consider­ able illegal fishing around Wexford coasts and the Council understand around other portions of tne Irish coast by foreign trawlers. It is manifest to the Council that one protection boat is absolutely unable to deal with these trawlers and that very much increased protection is neces- sary. Several of our members have watched the manner in ·, wnich tnese trawlers constantly came within the three mile

It is certain tnat if tne present condition of affairs be allowed to continue the insnore fisnermen of will be depriv­ ed of tneir livelihood, a result to be deplored, and one which we feel certain tne Gover;nment will endeavour to avert. We look upon this matter as of the most serious importance and worthy of the immediate consideration of the Government Departments concerned." Mr. Smyth seconded tne resolution which was unanimously adopted.

POSITION OF NATIONAL TEACHERS AND DECREASE OF POPULATION. Tne following resolution from Clare County Council was adopted on the motion of Mr. Colfer seconded by Mr. Kelly:­ "We, the Clare County Council, realize that owing to the alarming decrease in the population of the Rural areas of our Country, Teachers are being dismissed and are under threat of dismissal. The system in operation which demands that a certain average must be maintained as a condition of an Assistant retaining his or ner position is, in our opinion, under present circumstances, unreasonable, and snould be removed. We, therefore, request the Minister for Education to alter the system under which Teachers may be appointed and retained in the service, so that, what we hope is only a temporary decline in the population, will not adversely affect the prospects of any Teacher. II
