(Eddy Kennedy/CBC) Ron Penney says Canadians from across the country should be deeply worried about Muskrat Falls, because he's certain they will shoulder the burden of the billions being spent to construct the controversial hydroelectric project in Labrador. "One hundred per cent," Penney says when asked if Ottawa will have to bail out the province for taking a gamble that has "gone very, very wrong." CIMFP Exhibit P-00418 Page 2 Lonely critics Penney is a lawyer and former senior public servant with the province and the City of St. John's. (Eddy Kennedy/CBC) Penney and David Vardy, another former senior public servant, were early and vocal critics of Muskrat Falls at a time when public opinion was solidly behind it and former premier Danny Williams, a hard-charging politician who wielded a lot of influence, was its biggest booster. Opposing the project in those days invited ridicule and dismissal, making it difficult for people to speak out, said Penney, in a province where "dissent is frowned upon" and so many people are connected to government in some way. -

THOMAS MARSHALL, Q.C., PAUL DAVIS, SHAWN SKINNER, JEROME KENNEDY, Q.C. AND DERRICK DALLEY FOR THE MUSKRAT FALLS INQUIRY DECISION APRIL 6, 2018 LEBLANC, J.: INTRODUCTION [1] Danny Williams, Q.C., Thomas Marshall, Q.C., Paul Davis, Shawn Skinner, Jerome Kennedy, Q.C. and Derrick Dalley have applied as a group, referred to as Former Government Officials 2003 - 2015. All are members of past Progressive Conservative administrations in place from 2003 up to December 2015. It was during this period of time that the Muskrat Falls Project was initiated, sanctioned and construction commenced. Mr. Williams, Mr. Marshall and Mr. Davis were the Premier of the Province at various times throughout this period while Mr. Skinner, Mr. Kennedy and Mr. Dalley, along with Mr. Marshall, were the Minister of Natural Resources at various times. In those capacities all were significantly involved with this Project. The applicants now apply as a group for full standing at the Inquiry hearings on the basis that they have a common or similar interest in the Inquiry's investigative mandate. Page2 [2] The applicants also seek a funding recommendation for one counsel to act on behalf of the group in order to represent their interests at the Inquiry hearings. [3] There is also a request by the applicants that they individually be entitled to retain their own separate legal counsel, without any funding request, to represent the interests of each individual as they may arise during the course of the Inquiry. -

Nalcor hydrology studies indicate the Churchill River exerts a strong influence on the estuarine regime in Goose Bay and concerns have been expressed by a number of participants regarding the downstream effects of the Project. Explain the specific criteria used in Nalcor's response to Information Request (IR) JRP.43 to predict no measurable effect on downstream total phosphorus and total suspended solids, transport distances, fish productivity, salinity, velocity and thermal profiles from Goose Bay to Lake Melville, ice dynamics, ringed and harbour seal use of Lake Melville, bank stability, fish habitat utilization and fish migration. Identify whether and how these predictions apply to the period of reservoir impoundment, and the post‐impoundment transitional period before water quality stabilizes. Response: The influence of the lower Churchill River freshwater hydrology on Goose Bay and Lake Melville is recognized by Nalcor Energy (Nalcor) and has been central to limiting downstream effects to the extent possible. The minimal change in flow regime below Muskrat Falls as a result of the Project as described in IR# JRP.43, IR# JRP.149 and IR# JRP.153 mitigates most potential effects in terms of changes in salinity, circulation/current influenced by freshwater flows of the Churchill River, shoreline erosion (due to changes in water levels), tributary access, fish movements, habitat utilization and transportation distances. -

The request set out the scope as follows: We are interested in having GRL/LLP prepare a paper describing its involvement with the Muskrat Falls Project pre-sanction. Specifically, we would like the paper to: • Describe GRL/LLP involvement with the Project prior to its sanction on December 17, 2012. This would include, without limitation, their involvement in the Joint Review Panel process and any involvement they had with Government or Nalcor officials. • Describe the key issues that GRL/LLP raised in relation to the Project prior to sanction. • Describe Nalcor’s and/or the Government’s response to GRL/LLP’s efforts We have endeavoured to include as much information as possible in relation to key issues raised regarding the project prior to December 17, 2012. -

Box 12800 St. John's, NL Al B 0C9 Dear Mr. Paddick: RE: Allegations against Nalcor Energy and its Employees In correspondence to the Honourable Dwight Ball, Premier of Newfoundland and Labrador, as attached and as well as in direct meetings with this Department, concerned citizens have made serious allegations concerning Nalcor Energy ("Nalcor) including its operations, activities, and the conduct of company officials and contractors. In view of these complaints and on the advice we have received from the Department of Justice and Public Safety, I am writing to request that the Internal Auditors at Nalcor, on behalf of the Board, conduct an investigation into the allegations and provide this office with those findings. The alleged incidents include harassment, safety concerns, misappropriation of funds, theft, overcharging and personal trips paid by Nalcor. Nalcor management personnel are also alleged to have been involved in some of these activities. I request that a report be provided to me within 60 days. This report should detail the investigation, findings, and actions Nalcor has taken to address its findings, including whether the actions are employment-related or mandate referral to the Royal Newfoundland Constabulary or the Royal Canadian Mounted Police, as appropriate. I also recommend that Nalcor disclose all relevant information relating to costs of the Muskrat Falls Project to the Commission of Inquiry Respecting the Muskrat Falls Project Order as led by Commissioner Justice Richard D. -

Purpose The purpose of this technical note is to explain the changes that have been made by Nalcor Energy (Nalcor) to the development plans for the Lower Churchill Project from 1998 to 2011. This note addresses the following: • Muskrat Falls Hydroelectric Development • HVac Interconnecting Transmission Lines • Labrador‐Island Transmission Link 2. Muskrat Falls In 1998, Newfoundland and Labrador Hydro (NL Hydro) conducted a Final Feasibility Study for the hydroelectric generation facility at Muskrat Falls. The Study concluded with a short list of three development scenarios known as Variant 7, Variant 10 and Variant 11. Following an analysis of comparative costs, schedule and risk; Variant 7 was selected as the layout of choice for further development. The conceptual development for Variant 7 was described in the Final Feasibility Report by SNC‐AGRA in January 1999. Variant 7 is an 824 MW hydroelectric development. It includes two tunnels through the rock knoll on the north side eof th Churchill River for diversion of the river during construction, a four unit powerhouse with Kaplan/propeller turbines, a gated spillway constructed in the river channel, a north overflow dam with a partial fixed crest and an inflatable rubber dam, and a south closure dam. Permanent access to the powerhouse is from the north side of the river, around the rock knoll of the North Spur and across the top of the dams, spillway and intake structures. -

CIMFP Exhibit P-00269 Page 1 1 A Summary of Position of the Nunatsiavut Government to the Commission of Inquiry Concerning the Muskrat Falls Proiect June 2018 The Nunatsiavut Government (NG) has been involved with the Lower Churchill project since the project was sent to a five-member panel of a Joint Review Panel under the Canadian Environmental Assessment Act. The NG intervened in this process, challenged the violation of Labrador Inuit rights in Provincial courts in Nunatsiavut vs Newfoundland and Labrador (2013), and worked with the three Indigenous groups, other affected municipalities, the Province of Newfoundland and Labrador, Canada and Nalcor to establish the Independent Expert Advisory Committee to the Muskrat Falls hydroelectric development. In addition to these direct interventions, the NG held dozens of meetings, workshops and consultations with government officials, community members and groups, and other organizations. Despite a concerted effort by the NG, no meaningful change has taken place to address the fundamental concerns of Labrador Inuit. As a result of the lack of response from Nalcor, the Province of Newfoundland and Labrador and the Federal Government to these interventions and initiatives, including not responding to the recommendations of the Joint Review Panel Report recommendations, the NG was forced to partner with academic researchers and institutions to show through additional peer-reviewed science that Labrador lnuit’s concerns were valid. Again, the results of the peer-review literature were dismissed along with the concerns of Labrador Inuit. Additionally, the NG started the Make Muskrat Right campaign, which identified the four asks of the Nunatsiavut Government: 1. -

On cold winter nights people came to share their experiences and opinions in the belief that it would create change.
