    1 ACCESS TO JUSTICE Introduction Chinese citizens continue to face substantial obstacles in seeking remedies to government actions that violate their legal rights and constitutionally protected freedoms. International human rights standards require effective remedies for official violations of citi- zens’ rights. Article 8 of the Universal Declaration of Human Rights provides that ‘‘Everyone has the right to an effective remedy by the competent national tribunals for acts violating the funda- mental rights granted him by the constitution or by law.’’ 1 Article 2 of the International Covenant on Civil and Political Rights (ICCPR), which China has signed but not yet ratified, requires that all parties to the ICCPR ensure that persons whose rights or free- doms are violated ‘‘have an effective remedy, notwithstanding that the violation has been committed by persons acting in an official capacity.’’ 2 The Third Plenum and Judicial Reform The November 2013 Chinese Communist Party Central Com- mittee Third Plenum Decision on Certain Major Issues Regarding Comprehensively Deepening Reforms (Third Plenum Decision) con- tained several items relating to judicial system reform.3 In June 2014, the office of the Party’s Central Leading Small Group for Comprehensively Deepening Reform announced that six provinces and municipalities—Shanghai, Guangdong, Jilin, Hubei, Hainan, and Qinghai—would serve as pilot sites for certain judicial reforms, including divesting local governments of their control over local court funding and appointments and centralizing

This was at base, a function of perceived huaqiao economic utility, especially for what their remittances offered to China’s foreign reserves, and hence the party-state’s qiaowu approach was a political practice to secure that economic utility.

    TRAMES, 2012, 16(66/61), 3, 237–285 OFFICIAL COLOURS OF CHINESE REGIMES: A PANCHRONIC PHILOLOGICAL STUDY WITH HISTORICAL ACCOUNTS OF CHINA Jingyi Gao Institute of the Estonian Language, University of Tartu, and Tallinn University Abstract. The paper reports a panchronic philological study on the official colours of Chinese regimes. The historical accounts of the Chinese regimes are introduced. The official colours are summarised with philological references of archaic texts. Remarkably, it has been suggested that the official colours of the most ancient regimes should be the three primitive colours: (1) white-yellow, (2) black-grue yellow, and (3) red-yellow, instead of the simple colours. There were inconsistent historical records on the official colours of the most ancient regimes because the composite colour categories had been split. It has solved the historical problem with the linguistic theory of composite colour categories. Besides, it is concluded how the official colours were determined: At first, the official colour might be naturally determined according to the substance of the ruling population. There might be three groups of people in the Far East. (1) The developed hunter gatherers with livestock preferred the white-yellow colour of milk. (2) The farmers preferred the red-yellow colour of sun and fire. (3) The herders preferred the black-grue-yellow colour of water bodies. Later, after the Han-Chinese consolidation, the official colour could be politically determined according to the main property of the five elements in Sino-metaphysics. The red colour has been predominate in China for many reasons. Ce dernier a également resserré son emprise non seulement sur Beijing – par le biais de son proche collaborateur Wang Xiaohong [王 小洪]3-, mais bien aussi sur le pays en entier. Tandis que le temps d’« abattre les tigres » [打虎] et que les déraillements de la jiwei sont encore perceptibles, en particulier dans la province du Hebei4, fort est de constater que l’impact n’est pas celui escompté, sauf dans les cas de Su Shulin [苏树林]5 et Jiang Jiemin [蒋洁敏]6, et qu’il ne sera pas vraiment possible d’évaluer les dégâts de cette campagne avant la formation du Comité central de 2022.
