By Her Excellency’s Command, BOB CARR, M.P., Premier s05-030-35.p01 Page 1 232 SPECIAL SUPPLEMENT 21 January 2005 Clause 1 Public Sector Employment and Management (Ministers) Order 2005 Public Sector Employment and Management (Ministers) Order 2005 under the Public Sector Employment and Management Act 2002 1 Name of Order This Order is the Public Sector Employment and Management (Ministers) Order 2005. 2 Definition In this Order: document means any Act or statutory instrument, or any other instrument, or any contract or agreement. 3 Construction of references to Minister for Fair Trading In any document, a reference to the Minister for Fair Trading is to be construed as a reference to the Minister for Commerce. 4 Construction of references to Minister for Transport Services (1) In any document, a reference to the Minister for Transport Services is to be construed as a reference to the Minister for Transport, except as provided by subclause (2). (2) In any document, a reference to the Minister for Transport Services is to be construed as a reference to the Minister for Ports if the reference is used in or in relation to legislation administered by the Minister for Ports. 5 Application of previous Order construing references to Minister for Ports Clause 7 of the Public Sector Management (General) Order 1999 (which requires a reference in any document to the Minister for Ports to be construed as a reference to the Minister for Transport) does not apply in relation to a reference to the Minister for Ports in any of the following provisions: (a) the definitions of area of operations and impounding authority in the Dictionary to the Impounding Act 1993, (b) section 5C (2) (f) of the Pipelines Act 1967, Page 2 NEW SOUTH WALES GOVERNMENT GAZETTE No. 15 21 January 2005 SPECIAL SUPPLEMENT 233 Public Sector Employment and Management (Ministers) Order 2005 Clause 6 (c) paragraph (a) of the definition of Constructing Authority in section 22A of the Rivers and Foreshores Improvement Act 1948, (d) section 23 of the Rivers and Foreshores Improvement Act 1948. 6 Ministerial responsibility for NSWbusinesslink (1) NSWbusinesslink is, as a Department of the Public Service, responsible to the Minister for Community Services. (2) The reference to Ministers in the matter relating to NSW businesslink Pty Limited in Part 1 of Schedule 2 (Responsible Ministers) to the Freedom of Information Regulation 2000 is to be construed as a reference only to the Minister for Community Services. Also in the public gallery are many distinguished friends who have come to lend their support. Thank you, one and all. It is a great honour and a privilege to stand here in this historic place representing the Australian Labor Party—a Labor Party that represents a history of commitment to giving all Australians a fair go regardless of race, colour or religion. I am deeply conscious of this responsibility, and I am aware of the community and media interest that I have attained as the first Australian of Arabic-Lebanese-Muslim heritage to enter Australia's oldest Parliament.

In addition, I am referred to and identified in the following statement: Following that complaint a summons was issued in the Supreme Court by a person whose name I often see in relation to such matters but I can never remember, no matter how many times I see it and even though it is in front of me at the moment. I believe that the statements made by Mr Hatzistergos damage my reputation as the editor of the newspaper because they inaccurately represent the circumstances surrounding the Supreme Court action and the content of the newspaper.

JOHN HATZISTERGOS (Attorney General, and Minister for Industrial Relations) [3.48 p.m.]: I move: That this bill be now read a second time. The Government is pleased to introduce the Law Enforcement (Powers and Responsibilities) Amendment (Search Powers) Bill 2009. The bill introduces a scheme for a new class of search warrant—the covert search warrant—to assist police and other law enforcement agencies in the investigation of serious criminal offences, and creates new search warrant powers in relation to the examination of computers. The bill is part of the New South Wales Government's ongoing commitment to providing law enforcement agencies with the necessary armoury to respond effectively to major crime and keep the community safe. The essential feature of the new covert search warrant scheme is the power to enter and search premises without the occupier's knowledge and delay the subsequent notification to the occupier. The use of covert search warrants is not intended to be an everyday event. In addition to the legislative restrictions of the scheme, which I will expand upon shortly, covert search warrants will not be necessary in many cases. Furthermore, the execution of a covert search warrant is considerably resource intensive and logistically difficult. Surveillance teams are required to ensure that the occupier is elsewhere, a covert entry to the house must be made, the area needs to be monitored to ensure that the occupier does not return, and so on.
