* From Indifference to 19-12-2003 17:26 Pagina 1 NORBERT BOTH NORBERT NORBERT BOTH Fr om Indifference to Entrapment to om Indifference The Yugoslav crisis represents a formidable foreign policy challenge to many Western and Islamic government bureaucracies. From Indifference to Entrapment deals with the question of how the Netherlands faced up to this challenge during the years 1990-1995. It was during this period that the crisis erupted into armed conflict and the single worst war crime in Europe since the end of World War II took place in the ‘safe area’ of Srebrenica. The role of the Netherlands is particularly interesting, as the country held the EC/EU Presidency during the recognition debate in 1991 and supplied the peacekeeping presence in Srebrenica. The questions addressed in this book include: Did early warning work? What role did the Dutch Presidency (July-December 1991) play in the recognition debate? What motiv- ated the Dutch opposition to the Vance-Owen Peace Plan? Why did the Netherlands become From Indifference entrapped, as symbolised through its isolated peacekeeping commitment to Srebrenica? Finally, what can this story tell us about the ability of small and medium powers to in- fluence international affairs? This study is based on interviews with key players, including former Cabinet Minis- ters, and on documents from the Netherlands Ministry to Entrapment of Foreign Affairs, made available under the Dutch ‘freedom of information act’. Customary International Law and Torture: The Case of India A. Mark Weisburd* I. INTRODUCTION This paper examines the contradiction between statements from well-respected sources regarding customary international law as it bears on torture and the actual behavior of states as to torture. It does so by focusing on one state, India. The purpose of the paper is both to make clear the conflict between state behavior and rules that are supposed to be law and to reflect on some of the implications of and conundrums raised by this situation. This paper will discuss the claim that prohibitions against torture and violations of human rights are a part of customary international law, suggesting that they are not, nor should they be. II. Chairmanship 2003 Permanent Representation of the Netherlands to the OSCE The Hague, 9 July 2003 SEMINAR ON HUMAN RIGHTS AND TERRORISM Dear Colleagues, The seminar Human Rights and Terrorism is organised in the context of the Netherlands Chairmanship of the Organization for Security and Cooperation (OSCE) during 2003 and is a joint initiative of the Netherlands Helsinki Committee (NHC) and the Netherlands Ministry of Foreign Affairs. The Chairman of the seminar is Professor P. Kooijmans, Judge at the International Court of Justice and former Netherlands Minister of Foreign Affairs. The seminar will be held on 18 September in The Hall of Knights in The Hague and will start at 9.00 and finish at 17.30. After the opening speech from the Netherlands Minister of Foreign Affairs, Jaap de Hoop Scheffer, the agenda provides for three sessions. Please find enclosed a provisional agenda and other organisational modalities. The evening prior to the seminar, all participants are cordially invited to the reception hosted by the Municipality of The Hague, the Netherlands Ministry of Foreign Affairs (OSCE Task Force) and the NHC.
