Introduction The Politics of Violence against Women In the early summer of 2012, another case of sexual abuse reached Afghan tele- vision screens and the international press. Lal Bibi, an eighteen-year-old nomad woman from the province of Kunduz, came forward in Afghan media recounting how, on May 17, 2012, she was seized by men linked to a local armed group. She was held captive for five days and sexually assaulted as revenge for her cousin’s elopement with a woman from the family of one of the kidnappers. Lal Bibi’s fam- ily declared to journalists that unless justice was done, they would have no option but to kill her. However, Afghanistan’s women’s right activists quickly mobilized in support, and pressure mounted on the government to arrest the perpetrators. But back in Kunduz, the man accused of the rape protested that no such thing had taken place. He argued that there had been an agreement of baad—a practice in which a woman or girl is given in marriage as a form of compensation for a crime or an affront. A mullah had married Lal Bibi to him just before intercourse, and “once the marriage contract is done, any sexual intercourse is not considered rape” (A. J. Rubin 2012). In present-day Afghanistan, this version of events did not necessarily exonerate him from having committed a crime. Women’s rights activists pointed out that forced marriage was also an offense, according to Afghan law and particularly the new Elimination of Violence against Women law (EVAW law), which had become a cornerstone of gender activism in the country. More- over, his attempt to justify his actions with reference to a framework of baad impli- cated others.

Rape in the Courts and Beyond INTRODUCTION Given the strong legal and social regulation of women’s sexuality in Afghanistan, as well as how this issue has been tied up with social status and “honor,” it is un- surprising that there has historically been a great reluctance to report cases of rape.1 Women themselves would risk being ostracized by both family and society, and they could also be charged with zina or other moral crimes. To families, going to the authorities with a complaint of rape could signal weakness—an admission that the family was incapable of settling its own affairs. The successful regulation of female sexuality has been considered a key locus of family and kinship power, to be jealously guarded against outside involvement. Extramarital sexual relations have been highly shameful for a woman and her family, often irrespective of the consent of the woman. Not only would her status as a wife or prospective wife be ruined or significantly diminished, but the public knowledge of such a crime would also severely taint a family’s reputation—it would be seen as unable to pro- tect (or police) its women. Yet over period of a few years, Afghanistan witnessed a number of high-profile rape cases in which public mobilization for government intervention led to asser- tive state action. Around 2008, a number of families went on national television with demands that the government punish their daughters’ rapists. Harrowing television clips showed the young girls and their families wailing and weeping, crosscut with footage of male family members calling for justice.

Sweden experienced a migrant flow from various countries because of wars and conflicts in the world (Swedish migration agency, 2016). Many unaccompanied minors, mainly from Afghanistan, needed to be taken care of in different family homes or HVB homes. To provide nursing and basic needs for the unaccompanied refugee children, the personnel must be able to handle and understand cultural differences and situations that may arise from this. Cultural competence can be crucial to provide good care for these minors. Purpose; The purpose of this study is chosen in order to understand if adequate training is available for the staff at HVB homes, if the staff feels informed about cultural diversities and if the education given helps in order to detect problems and thus be aware of them. With the help of this research, the author hopes that problems such as untrained personnel and lack of knowledge regarding cultural sensitivity can be highlighted in order to develop fitful education to give optimal care for the unaccompanied refugee minors. Knowledge is one of the pillars for the development of a well-functioning society. Method: The study was performed as a qualitative interview study in which three interviews were made with personnel working at different HVB homes.

This criminalization creates important barriers to women’s access to protection against rape, as documented widely over the last two decades (Khan 2003; Lau 2007; Mir Hosseini and Hamzić 2010; Tønnessen 2014; 2017). These barriers may include an impossibly high evidentiary threshold for establishing rape in court and that victims who claim they have been raped risk being incriminated for adultery instead. However, the exact dynamics vary, depending on how the country categorizes the crime of adultery (zina) and to what extent the crime of zina is distinguished from that of rape. The answers to such questions are shaped by the specific approach to Islamic jurisprudence in the country at question and the status of such jurisprudence vis-à-vis codified law. This working paper undertakes an initial survey of the dynamics through which the criminalization of female sexuality structures women’s access to protection against rape in Afghanistan, examining both legislation and legal practice.

Visible under the Veil: Dissimulation, performance and agency in an Islamic public space Julie Billaud1 Abstract This paper seeks to characterize new meanings attached to women’s veiling in an Islamic public space, drawing from observations, interviews and field notes collected among various women’s groups in Afghanistan. It is argued that while the chadari - or burqa, as the Western press miscalled it, using the Urdu denomination- has become the ultimate symbol of women’s oppression for Western audiences, it is necessary to take a closer look at its multiple and often contradictory uses and to contextualise the reasons for its maintenance, despite the downfall of the Taliban regime.

    [ PEACEW RKS [ WOMEN’S ACCESS TO JUSTICE IN AFGHANISTAN INDIVIDUAL VERSUS COMMUNITY BARRIERS TO JUSTICE Tim Luccaro and Erica Gaston ABOUT THE REPORT This report maps how Afghan women seek justice when their rights are violated and the barriers women face in pursuing justice or receiving a fair outcome, whether in the formal system, in community-based mechanisms, or at home. Part of ongoing research and programming by the United States Institute of Peace (USIP) on how community- based approaches can improve women’s access to justice, this report is based on a time-limited ethnographic study of women’s disputes in five provinces of Afghanistan between March 2011 and January 2012. This study was conducted in cooperation with the Women Activities and Social Services Association, the Organization for Human Welfare, and the Afghanistan Human Rights and Democracy Orga- nization. It was funded by the U.S. Agency for International Development’s Office for Democracy and Governance and the U.S. Department of State’s Bureau for International Narcotics and Law Enforcement. ABOUT THE AUTHORS Tim Luccaro, USIP’s senior program officer in Afghanistan for three years, has worked on issues related to tradi- tional dispute resolution, women’s access to justice, and nonviolent conflict resolution in Afghanistan since 2010. Previously, on behalf of USIP, he focused on traditional dispute resolution for USIP in Liberia and South Sudan. Erica Gaston is a human rights lawyer with seven years of experience in programming and research in Afghanistan on human rights and justice promotion. Her recent academic and policy publications include three books on the legal, ethical, and practical dilemmas emerging in modern conflict and crisis zones; studies mapping justice systems and outcomes in Afghanistan and Yemen; and thematic research and opinion pieces on rule of law issues in transitioning countries.
