COURT OF APPEALS

The Minnesota Court of Appeals reviews cases appealed from district courts and administrative agencies. Nineteen judges serve on the Court of Appeals, which is divided into six rotating panels of three judges each, hearing oral arguments throughout the year. The court is located in the Minnesota Judicial Center in St. Paul, Minnesota.

Approximately 12-16 clerkships will be offered in October 2014 for the term August 2015 through August 2016.

COURT OF APPEALS DUTIES: 1. The primary duties of a law clerk are to analyze and research cases on appeal. 2. A law clerk’s typical responsibilities include cite checking, close review of the record and transcripts from the district court, evaluating conflicting briefs, supplementing the legal research submitted in the briefs, and assisting the judge in accurately synthesizing the facts and the law through preparation of bench memoranda and providing further assistance in opinion preparation.

QUALIFICATIONS: 1. The minimum academic requirement for application for both courts is enrollment as a second-year law student 2. Graduation from an accredited law school is required to begin employment 3. Professional skills and scholastic proficiency are both considered 4. Strong writing and research skills are essential 5. Writing for the law review, for a law journal, or for moot court is relevant.

Selection of law clerks is made after applications have been reviewed and interviews have been conducted by the court.

POSITION DESCRIPTION Start your legal career in a court system recognized as one of the best in the nation and enhance your future career prospects. Professional law clerk positions are available in the New Jersey Judiciary for individuals with strong communication and analytical skills. Supreme Court law clerks work with justices on complex cases involving difficult issues of law. Appellate Division law clerks conduct research, analyze legal data, prepare legal memoranda, process emergent motion applications, and proofread published opinions. Law clerks for assignment judges learn all aspects of court administration and assist with processing emergent motions. Trial court law clerks gain practical experience while gaining valuable insight into the judicial process. Under the direction of one or more judges over the course of the year, trial court law clerks observe judicial proceedings, attend conferences with attorneys and judges, receive training in mediation and mediate small claims cases and summarize information for judges. Tax Court law clerks perform duties similar to those assigned to law clerks in the Appellate Division and trial courts, but do not mediate cases.

REQUIREMENTS

EDUCATION: Law clerks must have graduated from a law school approved by the by the time of their law clerk appointment. The Judiciary’s law clerkship program is intended for recent law school graduates who have not yet engaged in the practice of law. Selected candidates will be required to provide an official, final law school transcript, not a photocopy, which includes the date of graduation from their law school at the time of hire. Excellent writing and analytical skills are essential.

MEDIATION TRAINING: It is helpful to have completed a course in mediation prior to the start of the clerkship. Under

Court Rule, all trial court law clerks who will serve as mediators must first complete the Judiciary sponsored 12-hour mediation training or its equivalent. Applicants selected for clerkships can request a waiver from attending the Judiciary’s training program at the start of the court term by providing documentation that confirms that they successfully completed an approved alternative dispute resolution course.

DRIVER’S LICENSE: Appointee will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.

SPECIAL NOTE: Individuals selected for clerkships must agree to a thorough background check, which will include fingerprinting. All data received will be kept in the strictest confidence except to inform the individual of the findings and what action will be taken as a result of this information.

AUTHORIZATION TO WORK: US citizenship is not required. Selected candidate must be authorized to work in the US according to Department of Homeland Security, US Citizenship and Immigration Services regulations.

RESIDENCY LAW: Pursuant to N.J.S.A. 52:14-7 (L. 2011, Chapter 70), also known as the “New Jersey First Act,” which became effective September 1, 2011, all persons newly hired by the Judiciary on or after that date shall have one year from the date of employment to establish, and then maintain, principal residence in the State of New Jersey. Law clerks are not subject to the residency law during their 53 week term. Additionally, law clerks who serve a second clerkship in a higher court are exempt from the residency requirement. New Jersey state employees hired prior to September 1, 2011 who transfer from within the Judiciary or from another State of New Jersey appointing authority without a break in service greater than seven days but who reside outside the State of New Jersey are not required to change their principal residence to New Jersey in order to comply with the Act. Clerks who anticipate moving into another state position immediately following their clerkship(s) must be mindful that, upon conclusion of their clerkship term, they will need to be New Jersey residents.

INFORMATION FOR APPLICANTS Approximately 480 clerkships are available. Of those, a limited number of clerkships exist for the Supreme Court, Superior Court Appellate Division, Superior Court Assignment Judges, Superior Court Chancery Division in general equity court, and in the Tax Court. SUPREME COURT

The Supreme Court of Minnesota is the highest court of the state and consists of seven justices. It reviews cases appealed from the Court of Appeals by Petition for Review and has direct appellate jurisdiction in Tax Court and Workers’ Compensation cases and convictions of first-degree murder. The Supreme Court also has original jurisdiction over attorney discipline matters and certain election cases. The court sits at the Capitol and at the Minnesota Judicial Center in St. Paul, Minnesota. Oral arguments are regularly scheduled from September through June.

The court will hire law clerks for one court year that generally extends from August 1 to July 31 of the following year. It is estimated that 10 clerkship vacancies exist for the period from August 2015 through July 2016.

SUPREME COURT DUTIES: 1. Law clerks accept a position with a particular justice or justices but are law clerks to the court as well. 2. Primarily, law clerks analyze and research cases on appeal, perform cite checking, and work closely with a justice in the preparation of opinions 3. Bench memos prepared by law clerks are for the whole court 4. Law clerks also listen to oral arguments in their assigned cases and, often, in other cases of interest or importance

QUALIFICATIONS: 1. The minimum academic requirement for application is enrollment as a second-year law student 2. Graduation from an accredited law school is required to begin employment 3. Professional skills and scholastic proficiency are both considered 4. Strong writing and research skills are essential 5. Writing for the law review, for a law journal, or for moot court is relevant.

Law Clerk Court of Claims of Ohio (Columbus, OH)

The Court of Claims is given original jurisdiction to hear and determine all civil actions filed against the State of Ohio and its agencies. The court also hears appeals from decisions made by the Attorney General on claims allowed under the Victims of Crime Act.

The Court of Claims decides civil claims that typically involve contract disputes, property damage, personal injury, immunity of state officers and employees, discrimination, and wrongful imprisonment. The Chief Justice assigns judges to hear such cases. In almost every instance, a single judge will hear a case, but the Chief Justice may assign a panel of three judges to a civil action that presents novel or complex issues of law and fact.

Civil complaints filed for $10,000 or less are decided on the contents of the case file or "administratively" by the clerk of the court or a deputy clerk. Appeals from those decisions ("administrative determinations") may be taken to a judge of the court upon motion for court review. The court’s judgment cannot be the subject of further appeal.

Crime victims' appeals are heard and determined by a panel of three commissioners who are appointed by the Supreme Court for a six-year term. A further and final appeal from the panel’s decisions may be taken to a judge of the court. As in the case of administrative determinations, the judge's decision is final.

The OCC is seeking two 2D/3E for a part-time clerkship opportunity. This unique experience will provide an opportunity to review two parties cases including investigations and to draft opinions.

Justice Program (NY based)

The Justice Program seeks to secure our nation's promise of "equal justice for all" by ensuring that our justice system is rational, effective, and fair. Its primary project is to reduce mass incarceration by reducing the size and severity of the criminal justice system to both improve public safety and protect individual rights. The Program works to publish empirical reports and engage in federal and state legislative advocacy, media and communications outreach, and strategic litigation. It uses these multiple tools to: document the true toll of mass incarceration on communities and the country; devise and enact new, innovative legal changes to eliminate over-criminalization, over-punishment, racially biased enforcement, and the perverse financial incentives that fuel mass incarceration; and change the public "tough on crime" mindset.

The Program's secondary project is to increase the effectiveness of the civil justice system to better serve the needs of all people. By working to close this "justice gap," the Program aims to ensure that everyone has equal access to an effective and fair civil court system to protect their basic rights.

Liberty and National Security Program (NY and DC based)

The Brennan Center's Liberty and National Security (LNS) Program fights to preserve constitutional values in the post-9/11 world. Our work centers on innovative policy recommendations, litigation, and public advocacy to ensure that our nation's commitment to national security comports with the rule of law and our fundamental freedoms.

We are currently focusing on the government's intelligence collection practices (e.g., how intelligence agents are controlled, what dangers they pose to privacy and the 1st amendment, profiling concerns) and on combating excessive government secrecy (e.g., over classification of documents). REQUIREMENTS

EDUCATION: Law clerks must have graduated from a law school approved by the American Bar Association by the time of their law clerk appointment. Selected candidates will be required to provide an official, final law school transcript, not a photocopy, which includes the date of graduation from their law school at the time of hire. Excellent writing and analytical skills are essential.

MEDIATION TRAINING: It is helpful to have completed a course in mediation prior to the start of the clerkship. Under

Court Rule, all trial court law clerks who will serve as mediators must first complete the Judiciary sponsored 12-hour mediation training or its equivalent.

Applicants selected for clerkships can request a waiver from attending the Judiciary’s training program at the start of the court term by providing documentation that confirms that they successfully completed an approved alternative dispute resolution course.

DRIVER’S LICENSE: Appointee will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.

Clerks who anticipate moving into another state position immediately following their clerkship(s) must be mindful that, upon conclusion of their clerkship term, they will need to be New Jersey residents.
