WARNING: All forms of alpine activities, such as driving vehicles on or off resort work roads, trails, and the ski resort premises are dangerous and contain hazards and risk that can result in injury, property damage and death. Risks include, but are not limited to, collisions or mishaps related to changing weather, visibility and surface conditions, variations in terrain, surface or subsurface water, potholes, rocks, trees, stumps and other forms of forest growth or debris, lift components (all of the foregoing whether above or below the surface of the ground), pole lines, fence posts and ropes, and plainly marked or visible equipment.

I am fully aware that all forms of alpine activities, including driving, riding and transporting passengers in my personal vehicle, are hazardous and filled with high risks such as those listed in the WARNING paragraph above. I acknowledge that only I know whether my minor child/children or I can safely participate in these activities. I EXPRESSLY ACCEPT FOR MYSELF the full responsibility for this decision and for any property damage or personal injury of any kind that may result from my participation in this activity. I attest that I carry appropriate automobile insurance for this activity.

As a condition of being permitted to participate in driving and transporting passengers in my personal vehicle in the 2014 Jeep Jamboree and to use the ski area premises in or outside of my vehicle I, for myself personally and as a representative of an off-road association, hereby RELEASE AND PROMISE NOT TO SUE Killington/Pico Ski Resort Partners, LLC, Powdr Corp., its owners, affiliates, employees, agents, sponsors, volunteers and insurers (hereinafter ) as I FREELY AND VOLUNTARILY ACCEPT ALL RISKS arising out of the driving and transportation of passengers such as, but not limited to, those stated above, and the condition of any terrain on KPSRP premises used for such driving.

I further agree to DEFEND, INDEMNIFY AND HOLD HARMLESS KPSRP from any and all claims and suits arising out of liability for personal injury, including death, and property damage resulting from use of vehicles on the mountain, from the operation of the ski area, condition of the premises, and from my participation in activities at the ski resort.

I further agree that any claim I may at any time bring for any reason against KPSRP shall be submitted to the jurisdiction of the State or Federal Court in the State of Vermont and no other jurisdiction and shall be governed by Vermont law. I also agree to pay and reimburse KPSRP any and all attorney fees, costs and expense incurred by KPSRP in responding to or defending any claim or litigation brought by me or on my behalf related to my participation in the Event, or incurred by KPSRP to enforce any terms of this Agreement including my indemnification obligations.

I acknowledge the right of KPSRP to make use of any pictures and video of me produced in connection with this activity and further consent to use of said pictures and video for commercial purposes, and I waive any right to use thereof by KPSRP.

I agree that if any portion of this Agreement is determined to be unenforceable by a court of law, all other parts of the Agreement shall remain in full force and effect and the conditions and covenants herein shall be binding on me, my heirs and assigns.
