A. Confirmation of minutes of previous meeting: Minutes of the previous MHCC meeting held on 27.02.2018 (39th) were confirmed and the office was instructed to get the final copy of minutes signed by the Chairman.

B. The following pending proposals which were discussed previously were then considered:

1. Case No. :680 / 2018 Sr. No : 150 Grade- III (Prop II-B) ‘St. Xavier’s high school’

Page 1 of 17 Proposal: - Proposed façade maintenance and roof repair works at St. Xavier’s high school situated at Lokmanya Tilak Marg, Dhobitalao,Fort div. Mumbai. Applicant: - Fr. Ainsley Dmello, Secretary. Consultant/ Contractor: - SPS Coatings Pvt Ltd. Ref: - i) Applications received on 05.02.2018 and 13.03.2018; ii) MHCC Meeting dated 27.02.2018.

The high school campus under reference abuts Lokmanya Tilak Marg and has been listed at Sr.No.150 of the existing heritage list under grade III category and has been proposed to be upgraded to Grade IIB.

The earlier proposal envisaged replacing old asbestos cement sheets with new UPVC Tile sheet. It was stated that the entire school is in process of renovation.

The site was visited by the office and it was observed that asbestos/cement sheets placed on the roof have become very old and corroded causing a lot of leakages in the building. Due to this the entire building is getting damaged and worn out. The matter was discussed by the MHCC in its meeting held on 27.02.2018. It was also observed that tenantable repair works were in progress at the site u/r such as pointing of the external stone façade, painting works, scaffolding erected along the walls etc. The Committee had no objection from heritage point of view for replacing the A.C.sheet roofing, however, it was advised to put up a comprehensive restoration proposal along with methodology and material specifications for consideration of the Committee.

Revised scope of work: - It was informed that SPS Coatings Pvt. Ltd have been appointed as consultants / contractors by St Xaviers School for the following restoration works : • Repairs to joints / pointing of external facade; • Treating Moss/mould growth on stone surfaces; • Pressure cleaning of entire façade with water. It was informed that painting was carried out only to previously painted surfaces.

Decision of the Committee in today’s meeting: - The methodology of envisaged works was explained by the consultant / contractor who was present along with representatives from school. The overall scope of work was found to be approvable from heritage point of view. Although the floor for which the roofing sheets are proposed to be replaced does not appear to be part of original fabric it does look quite old. Though not in the purview of the Committee it was advised to check authenticity of the floor. As regards the new roofing material of UPVC it was suggested to check fire retarding certification from safety point of view. For façade restoration / maintenance works, it was advised to submit methodology

It was also suggested that pointing repairs should be done in same material and pattern as existing and stone should be cleaned manually with use of nylon brush. If at all the water pressure cleaning is required to be done, it should be ensured that appropriate pressure (not more than 25 psi) is used. Subject to aforesaid and obtaining all other applicable permissions from competent authorities, the Committee decided to grant its NOC for the said proposal.

2. Case No. :668 / 2017 Sr. No.: 67/84 & 68/85 Grade - III

‘The Gabion & The Cresset' Proposal: - Proposed redevelopment of existing buildings known as ‘The Gabion’ and ‘The Cresset’ on plot bearing CTS No. C/546A & C546/B of Village - C at St. Alexious Road at Bandra (W), Mumbai in H/W Ward. Architect: - Yomesh Rao for M/s YMS Consultants Ltd. Ref: - i) CHE/28658/DP-DyMA dated 10.01.2018; ii) MHCC Meeting dated 06.02.2018.

The site u/r situated St. Alexious Road at Bandra (W) comprises of two existing bungalows known as ‘The Gabion’ and ‘The Cresset’ which are included at Sr. No. 67/84 & 68/85 in proposed new heritage list of 2012 under Grade-III category.

Scope of Work: - The proposal contemplates redevelopment of the said two existing bungalows with construction of a new basement (2 levels) + stilt + 14 + 15 (part) storied building with total height of 57.95 m up to terrace floor level. The building comprises parking at lower basement, upper basement, stilt and first floor podium levels and residential units from 2nd to 15th floors. The proposal was considered by the Committee in meeting held on 06.02.2018. After discussion, the Committee had decided to visit the site for better understanding of present condition of the bungalows and impact of the envisaged proposal on the neighbourhood.

Decision of the Committee in today’s meeting: - The site was visited by office and the observations of visit were noted by the Committee. It was noted that street / neighbourhood u/r is now synonymous with high rise development as several new high rise buildings have come up at adjacent plots. The two bungalows u/r although in fairly maintained state, do not display any special architectural character other than a bungalow typology and the location does not have any group value. Being in proposed Grade-III redevelopment is allowed as per the provisions of heritage regulations. Considering all, the Committee decided to grant its NOC for the said redevelopment proposal subject to authenticity and approvability of the

Page 3 of 17 redevelopment proposal / plans being subsequently got approved from the concerned B.P. dept. as per DCR's in force.

3. Case No. :669 / 2017 Sr. No.: 49/41 Grade II-A

‘Commissariat Building’ Proposal: - Proposed comprehensive repairs and restoration of the external façade, roof repairs and internal structural repair works at building known as ‘Commissariat building’, No. 231 bearing C.S. no. 762 of Fort Division, D. N. Road in ‘A’ Ward, Mumbai. Architect: - M/s F. S. Lokhandwala. Ref: - i) MHCC NOC dated 12.03.2018 ; ii) Instant application received on 15.02.2018

The building u/r is included at Sr. No. 49/41 as a Grade II-A structure in the proposed heritage list of 2012 and also falls within Bazzargate Sub-precinct of Fort Precinct.

The application seeking NOC from heritage point of view for proposed comprehensive repairs and restoration of the external façade, roof repairs and internal structural repair works at building u/r, was considered by the MHCC in its meetings dated 17.01.2018 and 06.02.2018 and NOC for the said works was granted.

Instant application u/r: - It was separately mentioned by the applicant that the Traffic Dept. of MCGM, in its remarks dated 01.01.2018, has shown R.L. to Dr. D. N. Road which cuts through the front arcade area of the building u/r. It was further informed that the said road setback in front would be insisted by MCGM authorities to be handed over or twin columns would be insisted to be erected within the bldg along R.L. while granting permission for repairs. As the building is proposed to be only restored, it was requested by the applicant to exempt and waive the twin column arrangement or the R.L.

Decision of the Committee in today’s meeting: - The Govt. Directive dtd.25th April 1995, suggesting that heritage sites & provisions need to be taken into consideration while proposing R.L. was noted by the Committee. The Committee was also of the view that the buildings along Dr. D.N. Road are one of the significant heritage stocks in Mumbai and the facades & arcade adds to the heritage character. The Committee was of the opinion that these building facades and street edge with arcades need to be maintained from heritage point of view. It was, therefore, decided by the MHCC to recommend that the R.L. and/or twin column arrangement for ‘Commissariat building’ u/r should not be insisted.

Page 4 of 17 In addition to forwarding the aforesaid remarks in respect of Commissariat Building u/r it was also suggested by the Committee to get the details of R.L for entire Dr. D.N. Road so as to take a comprehensive view. It was advised that the Traffic dept. officials may be requested to attend the MHCC meeting with said details for discussion in the matter.

C. Following new proposals / cases were then considered:

1. Case No. :680 / 2018 Sr. No : 160 Grade- II-B (Prop II-A) ‘St. Xavier’s College’ Proposal: - Proposed restoration / maintenance works of building facade at St Xavier’s College, 5 Mahapalika Marg, Fort, Mumbai. Applicant: - Dr. B.A. Menezes, Principal. Consultant/ Contractor: - SPS Coatings Pvt Ltd. Ref: - Application received on 09.03.2018.

The St Xavier’s College campus under reference has been listed at Sr.No.160 of the existing heritage list under grade II-B category and has been proposed to be graded as Grade II-A.

The proposal envisages restoration / maintenance of building façade with following scope of work: - • Repairs to joints / pointing of external facade; • Treating Moss/mould growth on stone surfaces; • Pressure cleaning entire façade with water.

Decision of the Committee in today’s meeting: - The proposal was explained by the consultant / contractor. The overall scope of work was found to be approvable from heritage point of view. It was suggested by the Committee that pointing should be done in similar material & manner as existing and stone surfaces should be cleaned manually with use of nylon brush. If at all the water pressure cleaning is required to be done, it should be ensured that appropriate pressure (not more than 25 psi) is used. Subject to aforesaid and obtaining all other applicable permissions from competent authorities, the Committee decided to grant its NOC for the said proposal.

4. Case No. :690 / 2018 Sr. No: nil Grade- I

‘Restoration of Milestones in Mumbai’

Page 5 of 17 Subject: - Proposed restoration of Milestones at various locations in Mumbai City. Applicant: - Sr. H.C. Engineer. Reference: - CHE / 35494 / DPC dtd. 16.03.2018.

An application was received on 16.03.2018 from Sr. H.C. Engineer requesting MHCC NOC for the proposed restoration of Milestones at various locations in Mumbai City. It is informed that design plans are prepared by architect M/s Vaastu Vidhaan Projects for said works and have been submitted for consideration of the Committee.

Scope of Work: - The proposal contemplated restoration / new installations of 13 number of mile stones across Mumbai City as per the following list:

The scope of work as envisaged broadly contemplated the following: • The mile stones to be brought to present ground level so that engravings are cleanly visible; • A clear distinction in the paving to be made by using cobblestones and black granite with ‘Mumbai Milestones etched into it to enhance its importance, QR Code with link to relevant information of Milestones will be etched on SS plate embaded into the paving; • The information plaque in brushed steel to be placed in front of Milestone in least intrusive way. • Depending upon the location and site condition, variations in the paving may be made along with maintaining uniformity in design; • A new ‘0 Milestone’ plaque containing comprehensive information about Mumbai Milestones with location map is proposed to be installed near St. Thomas Cathedral , a location which was originally considered as starting point or zero mile.

Discussion & decision of the Committee in today’s meeting: - Earlier, the proposal for restoration of Milestone (Vth and VIth) situated in ‘F/S’ Ward was approved by the MHCC with request to put up a comprehensive restoration proposal for all Milestones. The instant comprehensive proposal was presented by the Consulting Architect Shri Rahul Chemburkar. The Committee found the overall scope of work, for comprehensive restoration of 13 milestones across Mumbai city with uniform design and character, approvable from heritage point of view. The following suggestions were, however, given by the Committee. i) Different geometrical shapes should be used for paving so as to bring some variation in design to easily distinguish between original milestone and recreated milestone; ii) Mirror polished black granite should be used instead of flamed granite for the periphery / border of the demarcation around mile stone; iii) Information plate with QR code should be kept flushed with the paving; iv) The original / period names of associated locations should be etched on the granite border in addition to ‘Mumbai Milestone’ as proposed by the consultant; v) It was also brought to notice by one of the Committee members that it as per a newspaper article, the Baptism stone in the St Thomas Cathedral marks the zero mile of the city. It was advised by the Committee to verify the authenticity of information and

Page 7 of 17 then decide about installation of zero milestone plaque. After verification, a mock up of Zero Mile stone plaque as envisaged could be placed at the selected site before final installation to take feedback from public. Subject to taking cognizance of aforesaid suggestions and submitting the revised drawings, the Committee decided to grant its NOC for the said proposal purely from heritage point of view.

D. Following applications seeking Completion Certificate were then considered:

1. Case No. :684 / 2017 Sr. No.: nil Grade - Nil ‘Ghamat Lodge Building’ Subject: - Application seeking Completion Certificate of the MHCC in respect of regularization work carried out as per amended plans for proposed change of activity from Shop to Bank at ground floor (part) and internal additions / alterations in existing bank premises at ground floor (part) of existing building on plot no. 804A of Dadar Estate bearing C.S. No. 513/A of Matunga Div., Mumbai. Architect: - Nandkishor Udas. Ref: - i) MHCC NOC dated 12.07.2005; ii) Instant application received on 14.02.2018.

The MHCC had granted its NOC on 12.07.2005 for the proposed change of user and additions / alteration at Flat No. 01, Ground floor of existing ‘Ghamat Lodge Building’ on plot bearing CTS No. 513 A/10 of Matunga Div. plot no. 804, Dadar Matunga Estate in ‘F/N’ Ward, Mumbai. It has been informed by applicant now that the work has been carried out at site and proposal was put up online in AutoDCR for regularization of work. The scrutiny report of B.P. dept u/no. EB/1182/FN/A has been attached wherein following has been mentioned: As per IOD and approved plans dated 11.05.2005, ground floor of the building was partly approved for bank and partly for shop. Now as per the amended plans the part of ground floor portion which was approved as bank is reduced in size and the earlier shop portion along with additional area from bank is now proposed for use of another bank. Also the change in internal layout of both these banks consisting of removal and erecting some non- load bearing masonry partition walls and aluminum/wooden/glass partition /cabins. It is further mentioned that the aforesaid amendments are already carried out on site. Hence the proposal for regularization of said work as per amended plans by recovering necessary regularization penalty has been put up for approval.

Page 8 of 17 Decision of the Committee: - It was noted by the Committee that the Government has sanctioned final heritage list for F/N, F/S, G/N and G/S Wards vide notification no. TPB 4315 / 471 / CR-71 / 2016 / UD-11 dated 27.10.2016 and the site u/r has been excluded from Parsi Colony Precinct. However, in view of the earlier NOC granted in this regard, the Completion Certificate has been sought. The site was visited by the office and it was noted that the works carried out at site have not been reflected properly in the drawings. The architect was requested to submit revised drawings as per actual site condition. Considering the present heritage status of the building it was decided by the Committee to grant its requisite completion certificate for the said proposal for further processing of the regularisation proposal by the concerned B.P. dept as per prevailing norms.

2. Case No. :687 / 2017 Sr. No.: nil Grade - Nil ‘Sri Shankar Mattham Temple’ Subject: - Application seeking Completion Certificate of the MHCC in respect of addition of external lifts at existing building known as Sri Shankar Mattham on land bearing plot no. 385 in Dadar Matunga Estate Scheme no.. 5(s), C.S. no. 24/10 of Matunga Div in F/N Ward at Telang Road, Matung (E), Mumbai. Architect: - K. R. Rege & ASsociates. Ref: - i) MHCC NOC dated 23.05.2013; ii) Instant application received on 28.02.2018.

The MHCC had granted its NOC on 23.05.2013 for addition of external lifts at existing building known as Sri Shankar Mattham at C.S. no. 24/10 of Matunga Div in F/N Ward at Telang Road, Matung (E), Mumbai.

It has now been informed by applicant that the said works of addition of lift have been completed on site and Completion Certificate of the MHCC has been sought.

Decision of the Committee: - It was noted that the Government has sanctioned final heritage list for F/N, F/S, G/N and G/S Wards vide notification no. TPB 4315 / 471 / CR-71 / 2016 / UD-11 dated 27.10.2016 and the site u/r has been excluded from Five Garden Precinct. However, in view of the earlier NOC granted in this regard, the Completion Certificate has been sought.

The site was visited by the office and it was observed that lift shafts have been constructed as per approved plans except the plaster bands as suggested earlier. However, considering the current heritage status it was decided by the Committee to grant requisite

Page 9 of 17 completion certificate for the said proposal for further scrutiny by the concerned B.P. dept as per the prevailing DCRs.

3. Case No. :688 / 2017 Sr. No.: nil Grade – 100m from Grade I ‘Rosary Villa’ Subject: - Application seeking Completion Certificate of the MHCC in respect of new building on plot bearing CTS No. B/1065/18 of Village Bandra, Bandra (W), Mumbai. Architect: - Pushkar Consultants. Ref: - i) MHCC NOC dated 10.04.2014; ii) Instant application received on 08.03.2018.

The MHCC had granted its NOC on 10.04.2014 for redevelopment of property known as ‘Rosary Villa’ on site u/r by constructing a new G+ 4 storied building with total height of 19.45 mts up to staircase / LMR.

It has now been informed that the said works have been completed on site and as per the condition laid down in the MHCC NOC, the Completion Certificate of the MHCC has been sought.

Decision of the Committee: - The site was visited by the office and observations of site visit were noted by the Committee. The work carried out at site was found to be as per the earlier granted NOC and it was decided to grant the Completion Certificate of the MHCC for the said proposal for further scrutiny by the concerned B.P. dept.

D. Following matter was also discussed:

1. Case No. :679 / 2018 Sr. No.: 60/066 Grade: II-A

‘Deul Wadi,

Subject: - Proposed repairs / restoration of Hanuman Temple at ‘Deulwadi’ on plot bearing CTS No. 917, 917/1-20, Village Chembur, R C Marg, Chembur, Mumbai. Applicant: - Shri Bhulingeshwar Devalaya Trust, Chembur. Architect: - Vaastu Vidhan Consultants.

Ref: - i) Applications received on 31.01.2018, 26.02.2018 and 28.02.2018; ii) Complaint letters from Nilang Pathare received on 12.02.2018, 26.02.2018; iii) MHCC meetings dated 06.02.2018 and 27.02.2018; iv) Remarks / compliance letter of the MHCC to complainant dated 28.02.2018;

Page 10 of 17 v) Letter received on 09.03.2018 from Khandepkar & Asociates – Advocates representing complainant.

The proposal for repairs / restoration of Hanuman Temple at ‘Deulwadi’ on plot bearing CTS No. 917, 917/1-20, Village Chembur, R C Marg, Chembur, Mumbai was received from Shri Bhulingeshwar Devalaya Trust, Chembur on 31.01.2018. It was informed that the complex has four temples namely Bhulingeshwar, Ram, Sitala Devi and Vitthal Rakhumai Mandir other subsidiary shrines of Hanuman, Someshwar and Ghatoba are located in these main shrines. The main temple is a single storied load bearing structure with a hipped roof with timber trusses, purlins and rafters. The Hanuman Mandir is a vaulted composite masonry structure centrally located between two major shrines and sharing a Sabha Mandap with them. It was proposed to repair and restore the said Hanuman Temple structure including the vault roof and facades. Existing polycarbonate sheet roofing was proposed to be replaced with mangalore tiled roof. A new façade with wooden framed glass panelled windows and wooden panelled central door was also proposed at west side in place of the existing wall thereon.

The proposal was presented by the consulting architect Shri Rahul Chemburkar and Trustee of Shri. Bhulingeshwar Dewalaya Trust in MHCC meeting held on 06.02.2018. It was noted by the Committee that repairs / restorations is proposed on the existing footprint and within the existing mass of the Hanuman Mandir structure. The Committee discussed various roof patterns and concluded that the roof as proposed would be aesthetically appropriate in this case. The Committee suggested exploring alternatives of stone for cladding the shrine externally which would be easy for maintenance. The Committee also suggested using plain / tinted glass instead of stained glass at rear façade. It was instructed to submit revised drawings incorporating the suggestions of the Committee before issuing the NOC for the proposal. The revised sets of drawings incorporating suggestions of the Committee were received on 26.02.2018.

Meanwhile, complaint letters objecting to the works undertaken by Bhulingeshwar Devalaya Trust at Hanuman Temple, Deulwadi Chembur were received from Shri. Nilang Pathare on 12.02.2018 and 26.02.2018, requesting MHCC not to grant permission for the said proposal. The following points were mentioned by applicant:

• On 15.01.2017 the trustees and the Committee members of Bhulingeshwar Devalaya trust have illegally encroached the property and have broken wall of one of the temple along with removal of certain vital structures of Hanuman Temple. • There is a case pending in High Court against the Bhulingeshwar Devalaya Trust and it is alleged that the said construction is a criminal offence;

Page 11 of 17 • There is a police complaint registered at Chembur Police Station, Basant Park regarding the said dispute. • It is stated that the said premises is the ancestral property of applicant and their family is looking after the entire property and the temple is in possession of the applicant and management. • It is further alleged that Bhulingeshwar Devalaya Trust has fraudulently registered a public trust for which there a case pending in the High Court as well as Charity Commission and in guise of restoring temple, they are trying to take possession illegally of the property by breaking the wall and constructing a door from back side of the temple. • A copy of police complaint dated 08.02.2018 along with photographs of site u/r is attached with the representation. Considering this, the Committee had requested both parties i.e. the Trustees of Bhulingeshwar Temple Trust and the complainant to attend the MHCC meeting dated 27.02.2018 to represent their case.

A letter was then received by hand from the complainant on the same day of meeting conveying their inability to attend the meeting. The Trustees of Bhulingeshwar Temple Trust however attended the meeting later in the day.

It was claimed by the Trustees of Bhulingeshwar Temple Trust that the said temple premises is in legal possession of Bhulingeshwar Temple Trust. The decision / order of Hon. City Civil Court disposing off the suit filed by the complainant earlier in this regard was presented by them and it was informed that there is no matter pending in this regard in Hon’ble High Court. The Committee suggested them to submit the documents for perusal and record of the Committee. The documents regarding the decision of Hon. City Civil Court were submitted by the Shri Bhulingeshwar Devalaya Trust on 28.02.2018.

It was also decided by the Committee to request the complainant to produce by 9th March 2018, documents / details regarding any pending case in the Mumbai High Court, as mentioned in their complaint letter, informing that in case the details are not submitted ex Party decision would be taken by the MHCC. Accordingly, a letter was issued to the complainant on 28.02.2018.

Subsequently, a letter from Khandeparkar & Associates, Advocate High Court, has been received on 09.03.2018 on behalf of the complainant Shri Nilang Pathare.

It was stated that Ld. City Civil Court by judgment and Decree dated 06th Jan 2015 dismissed S.C. Suit 7585 of 1975 and Complainant had then filed First Appeal No. 1071 of

Page 12 of 17 2015 against the said judgment. It was informed that the first appeal is circulated on 9th April 2018 before Hon’ble Smt Anuja Prabhudessai (High Court Judge) for urgent admission and hearing on stay application. No document to this effect was however submitted. A copy of the original appeal filed on 20.03.2015 was submitted along with the letter. In the accompaniment the advocate had also attached letter from Shri Nilang Pathare wherein additional documents such as property tax extract etc were attached. It was also alleged that Bhulingeshwar Trust has misinterpreted the facts and it was requested to give direction for restoration of the wall to its original form.

Meanwhile, it was requested by Shri Bhulingeshwar Devalaya Trust to grant the NOC for the repairs / restoration of the said temple at the earliest as they are eager to complete the work the Hanuman Jayanti on 31st March 2018.

Decision of the Committee in today’s meeting: -. The complainant Shri Pathare had informed that hearing on their appeal has been scheduled on 9th April 2018 in the Hon’ble High Court. It was the general opinion of the Committee that scope of MHCC is to examine the proposal only from heritage conservation point of view and the ownership details need to be examined by the concerned dept of the MCGM. In its earlier consideration, the MHCC had found the scope of restoration & addition / alteration works, as of proposed by Shri Bhulingeshwar Devalaya Trust, approvable purely from heritage conservation point of view. However, in view of the dispute about ownership and counter claims by both parties, the Committee, in the interest of conservation and public convenience, decided that if no communication about proceeding of Court hearing dated 09.04.2018, as informed by the complainant Shri Nilang Pathare, is received by 10.4.2018, NOC of the MHCC purely from heritage point of view should be issued for the complete scheme / proposal. The decision of the Hon’ble High Court, if any, would however be binding on both parties.

1. Case No. :691 / 2018 Sr. No.: 79 Grade: II-A

‘Rajbahadur Mansion’

Subject: - Proposed internal additions / alterations and interior works at Shop No. 24, Ground floor of existing building known as ‘raja Bahadur Mansion’, Mumbai Samachar Marg, Fort, Mumbai. Architect: - M/s Virtuoso Architects & Consultants. Ref: - Application received on 19.03.2018.

Page 13 of 17 The building u/r known as ‘RajBahadur Mansion’, situated at Mumbai Samachar Marg, Fort in ‘A’ Ward is listed at Sr. No. 79 as a Grade II-A structure in the heritage list.

It was informed that the ground and mezzanine floor of premises u/r which was earlier used for bank has been proposed to be converted in to a restaurant. The proposal envisages internal additions / alterations, interior works and installation of signage on external façade with following scope of work: i. Demolition of existing partition walls and construction of new ones as per layout; ii. Installation of full height partitions; iii. Replacement of existing flooring on both floors; iv. Pre-laminated plywood covering to existing Steel beams at ceiling; v. Refurbishment of toilets, kitchen and installation of other furniture; vi. Installation of two signages of size 0.90 x 0.45 m and 0.45 m dia. at external façade.

Decision of the Committee in today’s meeting: - The proposal was explained by the architect. The Committee found the scope of work approvable from heritage point of view. However, it was suggested by the Committee that authenticity of the floors should be examined by the concerned MCGM dept. Subject to this and ensuring structural stability of the building u/r, the Committee decided to grant its NOC purely from heritage point of view for the said proposal.

2. Case No. :565 / 2018 Sr. No.: 79 Grade: II-A

‘Old Precinct’ Proposal: - Proposed redevelopment of existing building known as ‘Mohammad Building’ on plot bearing C.S. No. 102 of Division, situated at junction of Rambhau Salgaonkar Marg and Nathalal Parekh Marg, Colaba, Mumbai. – Amended proposal. Applicant: - 1 Architectural Consultants. Ref: - i) MHCC NOC dated 16.03.2017; ii) Amended proposal received on 19.03.2018.

The building u/r is located at junction of Rambhau Salgaonkar Marg and Nathalal Parekh Marg, Colaba, Mumbai. The site u/r is situated in ‘Old Cuffe Parade Precinct’.

The MHCC had its granted it’s NOC vide letter dated 16.03.2017 for the redevelopment of existing building known as ‘Mohammad Building’ on plot bearing C.S. No. 102 of Colaba Division situated at junction of Rambhau Salgaonkar Marg and Nathalal Parekh Marg,

The proposal contemplated demolition of the existing building on the plot u/r and construction of new building comprising 2 level basement + stilt + 4 parking floors + 5th to 17th and 18th part residential floors with total height of 69.95 mts up to terrace floor level.

It was informed by applicant by letter dated 19.03.2018 that it is now proposed revise the plan slightly by increasing the size of the living room in each tenement with corresponding changes in elevation and the revised NOC of the MHCC was sought.

Decision of the Committee in today’s meeting: - It was noted by the MHCC that there are minor modifications in the plan and the theme of the elevation has been maintained as approved earlier. Also there is no change in the total height of proposed building as approved earlier. Considering this the Committee had no objection to the amended proposal and decided to grant its NOC purely from heritage point of view subject to the authenticity / approvability of the proposal including the permissible F.S.I., open spaces, ownership, utilization of TDR etc. being subsequently examined and got approved from concerned B.P. dept. as per the provisions of general prevailing DCRs.

3. Case No. :537 / 2016 Sr. No.: 537 100mts from Grade - I ‘100 mts from ’ Proposal: - Proposed redevelopment on plot bearing C.S. No 1849, 1850, 1/1840 and 1/1850, Division, Shivaji Park, Mumbai. Applicant: - 1 Architectural Consultants. Ref: - i) MHCC NOC dated 23.12.2016. The site u/r, comprising four numbers of plots with independent existing buildings, is situated at north-east side of ‘Shivaji Park’ abutting Pandurang Naik Marg at north and Dr. Madhukar B Raut Road to the South. Two of the plots viz. 1/1850 and 1/1849 were partly affected by the line of 100 mts radius from ‘Shivaji Park Maidan’ which is a Grade-I site listed at Sr. No. 537 of notified heritage list of G/N Ward.

The MHCC had granted its NOC purely from heritage point of view for the redevelopment on plot bearing C.S. No 1849, 1850, 1/1840 and 1/1850, Mahim Division, Shivaji Park, Mumbai on 23.12.2016. The proposal contemplated redevelopment of existing structures by construction of a basement + ground + 33 storied single building comprising parking floors (basement to 6th) and residential units (8th to 33rd floor) with an amenity floor at 7th level. The total height of the proposed building would be 124.90 mts upto terrace level.

It was informed by applicant by letter dated 19.03.2018 that due to change of method in calculation of staircase, lift, lift lobby areas there is an amendment in plan. Also ramps are

Page 15 of 17 proposed instead of car lifts resulting change in plan. It was informed that the shape and size of typical floor has generally been kept similar to earlier approved plans.

Decision of the Committee in today’s meeting: - It was noted by the MHCC that there are minor modifications in the plan and the theme of the elevation has been maintained as approved earlier. Also there is no change in the total height of proposed building as approved earlier. Considering this the Committee had no objection to the amended proposal and decided to grant its NOC purely from heritage point of view subject to the authenticity / approvability of the proposal including the permissible F.S.I., open spaces, ownership, utilization of TDR etc. being subsequently examined and got approved from concerned B.P. dept. as per the provisions of general prevailing DCRs.

4. Case No. :689 / 2016 Sr. No.: 91 & 92 Grade – II-A ‘Royal Bombay Yacht Club’ Subject: - Proposed restoration and additions / alterations at Royal Bombay Yacht Club, Apollo Bunder, Mumbai.

Ref: - i) Your letter received on 14.03.2018; ii) MHCC meeting dated 20.03.2018; iii) MHCC NOC dated 21.11.2015.

This is with reference to the letter received from Secretary, Royal Bombay Yacht Club, updating the MHCC about ongoing restoration, additions / alterations works and balance works to be carried out at Royal Bombay Yacht Club, Apollo Bunder, Mumbai as per the MHCC NOC granted earlier on 21.11.2015. The work status as informed was as follows:

List of completed works: i) Restoration of rooms; ii) Revamping of the toilets attached with rooms & common toilet; iii) The chimney in the kitchen; iv) Stone pointing on external façade; v) Repairing / replacing furniture; vi) AC system to VRV system in rooms on 3rd & 4th floor; vii) Renovation and rearrangement of toilet blocks; viii) New mangalore tile roofing on parking garage; ix) Tiling patch work and new patch work repair in its place; x) Shifting the split ac units in the verandah and condensers on terrace connecting room to VRV system;

List of works to be carried out in immediate future: i) Replacing minton tiles on 3rd floor; ii) Replacing damaged pipes in verandah; iii) Replacing minton tiles in patchwork; iv) Replacing split AC units on 1st and 2nd floors to VRV system in restaurant and ball room; v) Polishing furniture / wooden floor in Dolphin and Ballroom. It was further informed that Completion Certificate of the MHCC will be sought after completion of all works at site.

The matter was discussed by the MHCC in its meeting held on 20.03.2018 when applicant also present. It was informed by applicant that restoration and addition / alteration works are being carried out at site as per the NOC & suggestions given by the MHCC earlier and there are no deviations or additional works being done. The MHCC noted the same and advised that Club authorities may go ahead and complete the balance works as per approved plans and then apply for Completion Certificate of the MHCC. The Committee also instructed that minton tiles, wherever needs to be replaced, should be replaced with similar tiles and pattern.

The meeting then concluded with a vote of thanks to the chair.
