3 Executive summary

The intent of the Norway sandeel, pout and North Sea sprat fishery to become MSC certified was announced on 14th December 2016 and the fishery certified on 6th February 2018. The scope of certification was up to the point of landing and chain of custody commences from point of sale/landing. The default assessment tree set out in the MSC Fisheries Certification Requirements, version 2.0, was used for the assessment. The fishery attained a score of 80 or more against each of the MSC Principles and did not score less than 60 against any of the individual MSC Criteria. In the second re-assessment (2018) the fishery achieved a score of below 80 against 3 scoring indicators and hence three conditions and 2 recommendations were set for continuing certification of the fishery. Table 1 provides general information on CAB and Client. The UoC is defined in Table 5. Table 2 shows the principle scores from the certification of 2018. There are no changes to report in stock status, in fisheries impact on the ecosystem and in the management, The Client presented preliminary results of an analysis of the overlap between the bottom trawling and recognised VMEs for 2018-2020. The analysis suggests that the fishery is well separated from recognised VMEs except for the sprat bottom trawl fishery for which limited incursions into vulnerable habitats are identified in each year. However, those incursions appear to be very small in VME areas. The study will be concluded for final evaluation at the next surveillance audit.

The third surveillance audit was indicated as an on-site audit in the PCR of 6th February 2018 and subsequent surveillance audit reports, but carried out as an off-site, remote audit due to travel restrictions associated with the COVID 19 situation and as permitted by the MSC Covid 19 derogations of 27.03.2020 and September 2020. The off-

site audit meetings were conducted from 16th February 2021 to 18th February 2021. The client, Ministry of Trade, Industry and Fisheries, the Directorate of Fisheries (DOF) and the Institute of Marine Research (IMR) were interviewed.

The main findings at the surveillance audit were: - Stock status is unchanged for sandeel in 1r and 3r, for Norway pout in the North Sea and for North Sea sprat - Harvest strategy and harvest control rule remained unchanged - The stock assessment approach remained unchanged - Catch composition remains comparable to previous years - There are no records of catches of ETP species except for spurdog where there are minute catches. - The fishery covered the same grounds as in previous years - The management setup is unchanged - There are 3 conditions that were found to be “On target” - There are 2 recommendations concerning documentation of interactions between ETP species and the fisheries. The client is launching a campaign to increase awareness of the need to also report catch and interactions with non-commercial species. The upgrading of the ERS regulation (J-10-2021) will not affect the fisheries that are audited here. - There was no rescoring of PI’s - Traceability issues are unchanged

3.1 The assessment process

The MSC Fisheries Certification Process v2.2 § 7.5.3 and the MSC- MSCI Vocabulary defines the Unit of Certification (UoC) (i.e., the unit entitled to receive an MSC certificate) as follows:

“The target stock(s) combined with the fishing gear type(s), vessel type(s) if relevant, and the fishing fleets or groups of vessels, or individual fishing operators pursuing that stock including entities initially intended to be covered by the certificate.”

The fisheries covered by this certification are defined as described in Table 5.

3.2 History of the assessment

3.2.2 First annual surveillance- 2019 The first surveillance audit was done as an integrated audit on-site with the following fisheries:

1. Norway sandeel, pout and North Sea sprat fishery 2. NFA Norwegian Ling & Tusk and NFA Norwegian Lumpfish

The first surveillance audit for the fisheries was done on-site in accordance with the surveillance program. The audit was announced on the MSC website and by stakeholder notification of 7th January 2019. The on-site visit took place on February 18th to 19th, 2019 in . The assessment team of Stefan Midteide and Hans Lassen) met with the Client, relevant Norwegian authorities and scientist from IMR.

The sandeel stock in sand eel area 1r was deemed to have been depleted and at reduced reproductive capacity and therefore PI 1.1.1 was rescored for this stock, see sections 8.1.1 and 8.1.2 of the first surveillance report of 9th May 2019. There was no active Norwegian fishery on this stock in 2019. The assessment team concluded that the MSC Certificate for UoC 1 in this fishery was to be suspended.

3.2.3 Expedited audit – 2019 Following information identified at an on-site audit in June 2019, the PCR for the Initial assessment of the Norway sand eel, pout and North Sea sprat fishery for the client Norges Fiskarlag was reviewed with regard to the possible existence of IPI catches. The assessment team of Sandhya Chaudhury, Hans Lassen and Lucia Revenga (Hans and Lucia were both part of the original assessment team) conducted this review of catch composition in this reduction fishery in September and October 2019 and identified IPI catches. The expedited audit was announced on 4th September 2019 and the report and IPI details published on 4th November 2019.

3.2.4 Second annual surveillance – 2019-2020 The 2nd surveillance audit was announced on 30th October 2019. The audit was integrated with the following assessment activities: 1. NEA cod & haddock fishery including coastal cod – 2nd reassessment 2. NEA cod & haddock fishery- 4th surveillance 3. Norway Sandeel, pout and North Sea sprat fishery: 2nd surveillance 4. NFA Norway tusk and ling and NFA Norway lumpfish fisheries: 2nd surveillance 5. Norway NEA saithe fishery – 1st surveillance 6. North Sea demersal fisheries – 1st Surveillance

Co-ordination of surveillance activities was done in order to achieve: • Coordinated stakeholder consultancies • Reduction in travel and subsistence costs for the client • Reduction in administration and coordination activities and costs • Reduction of the time stakeholders would have to invest in participating in multiple assessment activities • Harmonised outcomes of assessments and achievement of consistent conclusions • Sharing of fishery information

The on-site activities were held in Bergen, Norway on 2nd December 2019, in Oslo, Norway on 3rd October 2019 and by Skype on 9th December 2019. The fisheries continued to be within the scope of the MSC fisheries standard (MSC FCP v2.1 § 7.4). The fisheries, in 2018-2019, were conducted with the same strategy, same gears and covering the same grounds as in previous years The stocks remained healthy with the exception of sandeel in area 1r which remained depleted. Management regulations were unchanged, and Control and Enforcement activities and strategies were unchanged and no significant non-compliance had been reported. Research continued to improve understanding of the biology of fisheries. MCS activities remained as in previous years and the fisheries were documented at the same level as in previous years. Traceability issues were unchanged There had been no material changes to the status of the target stocks, ecosystem impact nor the management system since re-assessment. These fisheries had three conditions and one recommendation. All conditions were on target. There were no changes to scoring of performance indicators at the second surveillance audit. Overall, with the exemption of sandeel area 1r, the fishery continued to be fully compliant with the standards set for MSC certification SG 80. The assessment team concluded that the MSC Certificate for these fisheries, with the exemption of sand eel area 1r, should continue to remain active, subject to annual surveillance review.

3.2.5 Expedited audit – 2020 MRAG certified DFPO and DPPO North Sea, Skagerrak and Kattegat sandeel, sprat and Norway pout fishery announced their 3rd surveillance audit on 6th February 2020. The ICES stock assessment for sandeel of 27th February 2020 suggested that status of the sandeel stock in area 1r at the beginning of 2020 remained poor while the expected SSB for 2021 (169 kt) is well above Blim (110 kt). Harmonisation was initiated by MRAG and the 2 teams concluded to lift the suspension. Therefore, the expedited audit was initiated for the Norway sandeel, pout and North Sea sprat fishery. The audit addressed only the re- scoring of PI 1.1.1 and PI 1.1.2 for sand eel in North Sea area 1r. Based on the assessment presented in ICES (2020b) and the conclusions drawn by the Advisory Committee, ICES (2020a) the audit found that the suspension can be lifted. Rescoring of the PI 1.1.1 suggested that PI 1.1.1a is scored at SG60 and therefore a condition was set. The scoring for principle 1 was 70 for PI 1.1.1 and 90 for PI 1.1.2 changing the overall score for Principle 1 from 89.2 (original score in PCR of 06.02.2018) to 85.8. The rescoring is harmonised with the other certified sandeel fishery DFPO and DPPO North Sea, Skagerrak and Kattegat sandeel, sprat and Norway pout.

Following the ICES Advice of 27th February 2020 and consequent harmonisation with the third surveillance audit of the DFPO and DPPO North Sea, Skagerrak and Kattegat sandeel, sprat and Norway pout fishery; PI 1.1.1 for UoC 1 (sandeel area 1r) of the Norway sandeel, pout and North Sea sprat fishery was rescored at this expedited audit and the corresponding suspension lifted.

3.2.6 Third annual surveillance – 2021 The third surveillance audit was announced on the MSC website on 12th January 2021 followed with a supporting notice to stakeholders issued by the MSC on 13.01.2021. Direct email notification was sent on 13th January 2021 to the stakeholders that had previously been identified for the fishery, inviting interested parties to contact the audit team.

The timeline of this surveillance audit has been subject to a 6-month extension due to the Covid 19 derogation of 27 March 2020. In addition to this FCP v2.2 § 7.28.2.1 has also been invoked to deal with the integration of the following audits for the same client:

1. Norway North Sea herring fishery - 1st surveillance audit 2. Norway North Sea demersal fishery - 2nd surveillance audit 3. Norway North East Arctic saithe fisheries – 2nd surveillance audit 4. Norway sandeel, pout & North Sea sprat fishery – 3rd surveillance audit 5. NFA Norway ling & tusk and NFA Norway lumpfish fisheries – 3rd surveillance audit

The off-site interviews were held from 16th to 18th February 2021.

The audit was conducted according to MSC Fisheries Certification Process, version 2.2. The default assessment tree set out in the FCR v2.0 was used.

3.3 Summary of surveillance audit findings No new conditions were set at this audit.

Status of conditions and recommendation for this fishery are detailed in chapter 5.1.1 of this report.

3.4 Conclusion

The fishery continues to be within the scope of the MSC fisheries standard (MSC FCP v2.2 § 7.4.2 & 7.12) according to the following determinations:

The second surveillance audit was indicated as an on-site audit in the PCR of 11th June 2018 but carried out as an off-site, remote audit due to travel restrictions associated to the COVID 19 situation and as permitted by the MSC Covid 19 derogations of 27.03.2020 and September 2020.

This report contains the findings of the third annual MSC Fisheries surveillance audit conducted for the Norway sandeel, pout and North Sea sprat fisheries during on 16th to 18th February 2021. The purpose of this annual Surveillance Report is: 1. To establish and report on any material changes to the circumstances and practices affecting the last complying assessment of the fisheries 2. To monitor the progress made to comply with any Conditions raised and described in the Public Certification Report of 11th June 2018, and in the corresponding Action Plan drawn up by the client 3. To re-score any Performance Indicators (PI) where practice or circumstances have materially changed during the intervening year, focusing on those PIs that form the basis of Conditions raised.

4.2 Background The fisheries for sandeel, Norway pout and sprat have continued without any changes in operational strategy nor gear, also the geographical distribution of the fishery remained as in previous years, Figure 7

4.2.1 Stock Status There are special ‘Sandeel’ areas defined for the North Sea. These are shown in Figure 1

The catch advice for 2021 has decreased compared to 2020 because the 2020 year class is below average and a large reduction in fishing mortality is required to bring the SSB above MSY Bescapement at the start of 2022, Figure 2. ICES assesses that the spawning-stock size is below MSY Bescapement and Bpa but above Blim. No reference points for fishing pressure have been defined for this stock except for the Fcap applicable in the management plan.

Sandeel (Ammodytes spp.) in divisions 4.a–b and Subdivision 20, Sandeel Area 3r (northern and central North Sea, Skagerrak) UoA-2

ICES assesses that the spawning-stock size is above MSY Bescapement, Bpa, and Blim. No reference points for fishing pressure have been defined for this stock, Figure 3. Most of sandeel area 3r is within the Norwegian Exclusive Economic Zone (EEZ), where fisheries are managed by areas that are alternately open and closed based on an acoustic measurement of the stock each May and the setting of minimum biomass limits. ICES has not evaluated this management measure.

Sandeel (Ammodytes spp.) in divisions 4.a–b, Sandeel Area 4 (northern and central North Sea) UoA-3

ICES assesses that the spawning-stock size is above MSY Bescapement and Bpa. No reference points for fishing pressure have been defined for this stock. The uncertainty of the estimated SSB and F is large in the assessment. This uncertainty results from a period of low commercial fishing effort (2004–2016), no data on catch age composition (2006–2011), and no survey indices (2004–2007). The 2019 recruitment was upscaled considerably (more than doubled) with the inclusion of the 2020 dredge survey. Stock status is unchanged.

Norway pout (Trisopterus esmarkii) in Subarea 4 and Division 3.a (North Sea, Skagerrak, and Kattegat) UoA-4- 6

The stock size is highly variable from year to year, due to recruitment variability and a short life span. Spawning-stock biomass (SSB) is estimated to have been fluctuating above Bpa for most of the time-series. Fishing mortality (F) declined between 1985 and 1995 and has been fluctuating at a lower level since 1995. Recruitment in 2018 and 2019 was above the long-term average. Starting with the advice for 2016, ICES advice has been provided for the period 1 November of the previous year to 31 October of the current year. Stock status is unchanged.

Sprat (Sprattus sprattus) in Division 3.a and Subarea 4 (Skagerrak, Kattegat, and North Sea) UoA-5 The spawning-stock biomass (SSB) at 1 July has been above MSY Bescapement since 2013. Fishing mortality (F) has been higher than average for the last four years. Recruitment (R) at 1 July in recent years is estimated to have been below the longterm average, but at or above the average of the last ten years. Stock status is unchanged.

4.2.2 Harvest Strategy and Harvest Control Rule

The harvest strategy for the ‘Norwegian’ sand eel stock (3r) has been reviewed and is briefly described below.

Management model for Sandeel in 3r After a trial phase in 2010, Norway introduced an area-based management of sandeel in 2011. The main goal of the plan is to increase the spawning biomass of sandeel and ensure a long-term sustainable sandeel fishery. The model is based on a system of closed and open areas combined with a quota.

The management model was evaluated by the Directorate of Fisheries, IMR and the fisheries industry in 2014, in 2016 and again in 2020. All evaluations found that the model functions as intended and has resulted in a constant increase of the population. Therefore, it has been possible to expand the size of the open areas. In 2019, a framework was set up for determining the average annual harvest rate (defined as the landing in weight divided by estimated biomass from the acoustic survey). The result was a value of approximately 0.4 for the period 2010 to 2018. Such a harvest rate seems to provide a long-term balance between the survival of sandeel and a stable good fishery. The rule is formulated as quota = hr * B40est,1+ here hr is the rate of harvesting (0.4) and B40est.1+ is the 40-percentile of survey biomass estimates of one year and older sandeel in the Norwegian management areas 1-4. Using the 40-percentile instead of the average value or median accounts for the uncertainty of the biomass estimate (lower uncertainty results in higher quota and vice versa).

The strategies for the Norwegian fishery for Norway pout and sprat are unchanged.

The future harvest strategy for sandeel in area 1r and area 4 being within the UK sector is uncertain under the Brexit arrangements. The approach taken in the surveillance period 2019-2020 is unchanged to previous years.

4.2.3 Stock assessment and Data The are no changes in the availability of data and other monitoring data compared to previous years. The stock assessment approach is unchanged.

4.2.4 Impact on the ecosystem The are no changes to the impact on the ecosystem compared to previous years.

4.2.5 Impact on habitats The Client has engaged consultants to assist in preparing an analysis over the interactions between the fisheries for sand eel, Norway pout and sprat and VMEs as identified by OSPAR. Analysis and work are currently underway: the consultants are working with IMR, Directorate of Fisheries and others to collect the most relevant information. At the visit February 2021 preliminary results of the study was presented and is reported as Figure 7. Protected areas identified by Norwegian/EU/UK are identified to Norwegian fishers and avoided accordingly. On this basis, the UoA would not cause serious or irreversible harm to structure and function of VME habitats.

4.2.6 Changes to the management system

The are no changes in the approach and specific regulations for the Norwegian fishery for sandeel, Norway pout or sprat. The MCS activities have been conducted at the same level as in previous years and the compliance is good, Table 6.

4.2.7 Changes to relevant regulations The ERS-regulation has been extended to include the entire fleet as per 01.01.2021 (with gradual implementation for different vessel groups). This is of limited relevance to this fishery as most/all vessels are above 15 meters and have been subject to the regulation for years.

4.2.8 Changes to personnel involved in science, management or industry. Key personnel remained as in previous years.

4.2.9 Changes that impact Traceability There are no changes that effect Chain of Custody considerations since the PCR of 06th February 2018. There are no changes in landing points from earlier years and the catch that is landed by foreign vessels cannot be mixed with certified catch based on the traceability system described in the public certification report. An updated list of landing sites is given in appendix 6.8.

The systems of tracking and tracing in the fishery are still considered sufficient to make sure all fish and fish products identified and sold as certified by the fishery originate from the certified fishery.

Product landed by Norwegian vessels from the sand eel, Norway pout and North Sea sprat fisheries are recorded accurately and identified through the Directorate of Fisheries and sales organisation (or by the Danish counterpart) as described in the PCR of February 2018. Product from the certified fishery is therefore eligible to enter further Chain of Custody. Products may be sold through auction arranged by the sales organisation or directly. To be eligible to carry the MSC logo, fish must enter into separate MSC Chain of custody certification commencing sale.

The list of vessels is updated at every assessment and is an appendix to this annual report – see appendix 6.7. The scope of the MSC Fishery certification remains unchanged and is up to the point of landing and Chain of Custody commences from the point of landing and sale.

The client Norges Fiskarlag (The Norwegian Fishermen's Association) was founded in 1926 and is based on memberships in local and regional fishermen's associations. The association has a total of 110 local chapters and two semi-independent group organizations with approximately 4300 members from across the country. It has 7 regional associations and 2 group organizations all of which are part of the client group. The sales organizations are owned by fishermen and boat-owners (although details of the mechanisms that form the electoral basis may vary). The sales organizations are, therefore, all a part of the “MSC client group project” and are together with NFA (and the Norwegian Seafood Council) bound by contract to perform the certifications and provide financing for direct and indirect costs. The sales organization for this fishery, Norges Sildesalgslag, performs all sales through auctions and does not take ownership of the product or handle the products. They act solely as an intermediary between the vessel owners and the buyers.

The stock assessment structure was changed for sprat in 2018 and now subarea 4 and Progress on Condition division 3.a are assessed together. The management parties have agreed to work on the (Year 2- 2020) future management in 2020, see Anon. 2019 Skagerrak and Kattegat. On target. NFA has recently been in dialogue with IMR, regarding their progress on establishing HCRs. IMR reports that there has successfully been achieved the development of a HCR for Sandeel in the Norwegian sector (https://www.hi.no/resources/Rad-for-tobisfiskeriet-i- norsk-sone-for-2020-1.pdf) IMR has for sandeel in 3r implemented this HCR and the associated management plan in its advice for sustainable exploitation. Progress on Condition (Year 3- August 2022) The Sand eel in 1r area is in British waters and the development of management plans and HCR is British responsibility. There was, at the time of the site visit, no news on how the UK – Norway negotiations were progressing; they were ongoing at the time of the visit. All Norwegian vessels have a VMS on board regardless the vessel’s size. This serves the Directorate of Fisheries to verify that vessels do not enter Marine Protected Areas. The Norway pout fishery takes place in the muddy and sandy grounds of the Fladen Ground, while the sprat fishery mainly takes place in the muddy grounds of the Dogger bank, the Oyster ground and the German bight. According to OSPAR maps, there are seapens (VME) in these fishing grounds which may be affected by the bottom trawl fleet targeting Norway pout or sprat. 2.4.2 a: The Norwegian MAREANO program, which maps depth, topography, sediment composition, contaminants, biotopes and habitats in Norwegian waters, serves as a valuable tool to manage habitat types in Norwegian waters, and has helped to establish no fishing zones in Norwegian waters, which were designed mainly to protect cold corals which are mostly located near the shore line, with the exception of two protected areas in more open waters. The mandatory VMS in place serves to verify that these regulations are followed.

As regards fishing grounds which do not fall under the Norwegian jurisdictions, these are studied by the European’s Union Natura Directive (http://natura2000.eea.europa.eu/#), the OSPAR Commission (www.ospar.org) and the Mapping European Seabed Habitats portal (www.searchmesh.net). These areas are protected by the Habitats and Nature 2000 Directives in waters which fall under the EU jurisdiction (see Figure 21). Both the Norwegian and the European Union management tools have designated protected areas for the protection of sensitive habitats in their respective waters. Norwegian and EU enforcement systems, along with the mandatory use of VMS in the fishing fleet, serve to assure the accomplishment of these regulations.

The research undertaken in the status of benthic habitats along with the establishment of Justification protected areas could serve to support that there is a partial strategy in place (that is expected to achieve the Habitat Outcome 80 level of performance or above) if management and enforcement measures were already implemented. But as mentioned, some of the MPAs in the area (such as the central area of the Fladen Ground and the Dogger Bank) are not yet fully well managed, as there are no site-specific fisheries management measures to protect seapens and burrowing megafauna both in the fishing grounds.

SI d: There is some quantitative evidence that the UoA complies with both its management requirements and with protection measures afforded to VMEs by other MSC UoAs/non- MSC fisheries, where relevant. There is evidence of the establishment of protected areas to protect vulnerable benthic species both in Norwegian and European waters. There is also evidence on the enforcement systems taking place in both these jurisdictions, through each European nation enforcement system, and on the Norwegian fleet accomplishing management measures in the area. The Norwegian Directorate of Fisheries has been consulted in order to know the range of infractions by the Norwegian fleet entering MPAs, and these resulted in an infraction ratio below 5% for 2016. There are however some concerns about some other vulnerable habitats, such as sea pens, which are not fully protected in certain areas.

The Scottish Fisheries Sustainable Accreditation Group (SFSAG) has voluntary closed an area in the Fladen Ground to bottom trawl fishing for its vessels. This measure is taken to protect seapens (Funiculla spp). This closure will apply until approved at European level. The closure was announced to all vessels in the UoA in May 2017 and will be monitored by Marine Scotland using VMS data. The area could potentially be fished by Norsk Fiskerlag Vessels fishing sand eel, Norway pout and sprat, and Norsk Fiskerlag has not provided the required assurance and SG80 is not met by the Norwegian bottom trawl fleet considered in this assessment. Besides, the team has no information on management requirements that other non-MS fisheries may have implemented in the area. The mentioned voluntary closed area corresponds to one (the southern) of three areas within the Central Fladen Ground MPA which would be closed to demersal towed gear under Marine Scotland’s proposal. The coordinates of SFSAG’s closed area are as follows (this corresponds exactly to the coordinates given by Marine Scotland for their closed area 3 in the Central Fladen Ground MPA. Marine Scotland, 2017a; Section B in Annex, Table B6): · 58° 59.248' N 000° 08.373' W · 58° 58.226' N 000° 04.475' E · 58° 55.440' N 000° 05.816' E · 58° 51.311' N 000° 06.539' E · 58° 49.143' N 000° 00.170' W · 58° 49.819' N 000° 09.843' W The team considers that there isn’t sufficient quantitative evidence that the UoA complies with both its management requirements, and with protection measures afforded to VMEs by other MSC UoAs/non-MSC fisheries, therefore SG80 is not met by the bottom trawl UoCs. The quantitative evidence given by the lack of infringements in relation to MPA by the bottom trawl fleet serves to justify that the UoC complies with mandatory management requirements to protect VME, therefore SG60 is met for the bottom trawl UoCs. The lack of evidence regarding the impact that the bottom trawl fishery may have on this voluntary closed area prevents these UoCs from achieving SG80. SG80 is not met by the bottom trawl fleet. The SG80 requirements for PI2.4.2 SIa and SId must be met. There shall be evidence of implemented management measures directed to the different Condition VME which are expected to achieve the Habitat Outcome SG80 level of performance. The client shall present some quantitative evidence of the compliance with protection measures afforded to VMEs by other MSC UoAs/non MSC fisheries, where relevant.

23 August 2022. 5th year of certification- the deadline for this condition has been Condition deadline extended to 23rd August 2023 according to Derogation 6: Covid-19 Fishery Conditions Extension of 28th March 2021. Year 1 (Feb 2019): There shall be evidence of the Client’s plan to evaluate the establishment of potential management measures directed to the protection of identified VME by the relevant authorities (such as seapens, deep-sea sponge aggregations or corals) appropriate to this UoC. There shall be evidence of engagement with research institutions with the goal of evaluating potential measures to avoid such damage by the bottom trawl fleet. If research institutions are unable to provide such support, the fishery shall prepare the potential measures on the basis of other means (e.g. independent consultants or scientists or other means as appropriate). Milestones There shall be evidence of activities undertaken in order to comply with voluntary protection measures afforded to VMEs by other MSC UoAs/non MSC fisheries, where relevant. Score 70. Year 2 (Feb 2020): By the end of Year 2 there shall be evidence of ongoing work towards the election and implementation of the most appropriate management measures to protect identified VME by the relevant authorities in the UoC (i.e. developing options for conservation and management measures to all identified (by the relevant authorities) VME habitats affected by the UoC, such that the fishery does not cause serious or irreversible harm to habitat structure, on a regional or bioregional basis, and function).

These management measures may be developed with the support of research institutions, or may be developed within the client group, as appropriate. The measures shall be sufficient to ensure that serious and irreversible harm to seapens, sponges, and coral gardens is highly unlikely). There shall be evidence of activities undertaken in order to comply with voluntary protection measures afforded to VMEs by other MSC UoAs/non MSC fisheries, where relevant. Score 70. Year 4 (August 2022): Evaluate the options developed in year 2. Consider suggested modifications if needed and finalize and agree on conservation and management measures for the protection of seapens or other identified VME (by the relevant authorities) overlapping with the fishery. These measures can be taken either at client group level or at a higher level. There shall be evidence of activities undertaken in order to comply with voluntary protection measures afforded to VMEs by other MSC UoAs/non MSC fisheries, where relevant. Score 70. Year 5 (August 2023): Implement the agreed measures necessary to show that the UoA is highly unlikely (<30%) to reduce structure and function of the VME habitats to a point where there would be serious or irreversible harm. A formal commitment to the agreed upon conservation and management measures shall remain in place for the duration of the certification period. There shall be some quantitative evidence of the compliance with protection measures afforded to VMEs by other MSC UoAs/non MSC fisheries, where relevant. By the 4th surveillance audit the client shall provide overlapped maps of VMS records and: - OSPAR threatened or declining habitats overlapping the UoA fishing grounds. - designated MPA overlapping the UoA fishing grounds. Besides, the client shall provide evidence of the accomplishment of voluntary measures undertaken by other MSC UoAs/non-MSC fisheries in the same fishing grounds directed to the protection of VME. Score 80. The client informed that they will be undertaking a review of relevant MSC certified fisheries (relevant as to gear and location overlap with sprat/ Norway pout/ sand eel), and to note any voluntary closures, including location and reason of these. This was to form part of the work to evaluate measures to mitigate damage to relevant VMEs (see Action 3.1 above). Also, the Client informed that he has engaged consultants to assist with the Progress on Condition evaluation of potential measures. However, no information on progress with the (Year 1- 2019) evaluation was presented. As these actions were part the client commitments for the Year 1 milestone – it has not yet been met. The Client further informed that discussions with research institutions would be fruitful only based on the evaluations and these therefore has not yet been initiated. The milestones for Year 1 shall be met at Year 2 in addition to the milestones requirements for Year 2. Behind Target. The Client has engaged consultants to assist with the evaluation of potential measures Progress on Condition but the evaluation has not been completed. The Client has initiated a survey on (Year 2- 2020) additional voluntary closures apart from the SFSAG voluntary closure in the Fladen Ground. No such closures were identified. On target. There has been, as reported under condition 2, significant progress with also this condition and the data available suggests that the VMEs are respected by the fishery. Progress on Condition This includes the SFSAG voluntary area on the Fladen Ground. As noted above the (Year 3- August 2022) analysis is preliminary and a full evaluation will be done at the next audit. However, the 27 March derogation applies and the milestone for year 3 is not fully evaluated.

The Client presented a draft for a guide to be distributed among fishers. 2 Following the requirements at MSC FCP v2.01§ PA 1.3.1, the assessment team recommends the client to recognise the need of evaluating some species under MSC Fisheries Standard v 2.01 Principle 1 for the future reassessment. The species include inter alia horse mackerel, greater silver smelt and whiting. The Client is urged to promote the establishment of harvest strategy, HCR, data collection and stock assessment of these species to facilitate that these species can be assessed under principle 1 at the reassessment, or to promote the development of techniques to effectively separate catches of currently IPI stocks. 5.4 Client Action Plan

Action 3.1: NFA will engage with IMR and the Directorate of Fisheries to evaluate measures to mitigate bottom damage in the relevant VME areas. Internal discussions will be held to decide how other UoAs voluntary protection of central Fladen or other areas could be protected by a corresponding Norwegian code of conduct if governmental protective measures remain absent. Action 3.2: NFA will follow up on the results from the consultations under 3.1 and work towards the election and implementation of the most appropriate management measures. Preferably this will be in the form of expected official protective regulation by the EU. 6.4 Harmonised fishery assessments

MSC certified overlapping fisheries have been identified as fisheries operating within FAO 27, ICES Subareas IV and IIIa. The 2 MSC fisheries with overlapping UoCs to the UoAs under assessment here are detailed in the table below and the relevant PIs which have been harmonised earlier are shown.

Please note only MSC Fisheries using the same version of the assessment tree (need to be harmonised (MSC FCP v2.2 Annex PB 1.2.1).

Principle 1 was harmonised for area 1r in the expedited audit of April 2020.

Principle 2: As the DFPO and DPPO North Sea, Skagerrak and Kattegat Sand eel, Norway Pout, and Sprat fisheries certification has scored with a different assessment tree version, PI’s related to primary and secondary species were not possible to harmonize. The scoring and rationales for PI 2.3, 2.4 and 2.5 were taken into account during the initial assessment process in 2018.

The fisheries take place mainly in the same fishing grounds (North Sea) but they fall under different management regimes which co-operate with each other. Principle 3 is therefore, not eligible for harmonisation.
