A BILL INTITILLED
An AcT to validate certain Exchanges of Land in Title. New Plymouth. TATHEREAS under the provisions of " The New Plymouth Preamble. ¥¥ Exchanges Commission Act, 1865," "T he New Plymouth Exchanges Commission Act Amendment Act, 1866," and " The New Plymouth Exchanges Commission Amendment Act Amendment Act, 5 1867," certain exchanges of land in the Town of New Plymouth have been certified to by the Commissioners appointed pursuant to the first recited Act : And whereas it is by the last reeited Aet enacted that every such certificate shall, for the purpose of completing the exchange so agreed or arranged, vest and be taken to vest in the person therein 10 certified to be the owner of the land therein certified to be the property of such person for an estate of inheritance in fee-simple, subject to a contract to exchange such land with the Superintendent of Taranaki for such other land, being part of the public reserves of the Town of New Plymouth, or land by such exchanges as aforesaid 15 arranged to be taken for the same, as shall also be described in such certificate : And whereas it is expedient to validate the exchanges made under the authority of the said Acts: BE IT THEREFORE ENACTED 'by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, 20 as follows :- 1. The Short Title of this Act shall be " The New Plymouth Short Title. Exchanges Validation Act, 1874." 2. The tenth, eleventh, and twelfth sections of the Act of 1865 Repeal. are hereby repealed. 25 3. The ex-changes of land certified to by the said Commissioners L.d, received in ex- and particularized in the First Schedule hereto, shall thereby vest the ch,knge to be ve.ted in parties described lands, being part of the public reserves in the Town of New Plymouth in Sohedule. described in the said Schedule, in the parties whose names are ' set against the' same respectively, their heirs and assigns, for an estate of inheritance in fee-simple as fully and effectually as if conveyances of the said lands were executed to the said parties : Provided that no exchange shall be valid unless a deed of grant is obtained by the said 5 parties of the allotments surrendered by them in exchange for the said public reserves. The allotments or parcels of land so surrendered and par- rest in Superinten- dent. ticularized in the Seeond Schedule hereto shall, subject to the issue of Crown grants for the same, respectively, as aforesaid, vest in the 10 Superintendent of Taranaki as fully and effectually as if conveyances of the same respectively were executed to him, and shall be held by the Superintendent as public reserves, upon the same trusts as those re-selected in respect thereof. Maps to be recorded, 5. Maps indicating the several exchanges of land certified to by 15 and Registrar to make entries. the Commissioners, together with the Schedules to this Act, shall be recorded in the Register Office in New Plymouth, and the Registrar of Deeds shall thereupon make such entries in the register books as shall accord with the said Schedules.
