THE INSTITUTION OF PRESIDENTIAL IMPEACHMENT IN SEMI-PRESIDENTIAL SYSTEMS -CASE STUDY OF ROMANIA- By Valentina-Andreea Dimulescu Submitted to Central European University Department of Political Science In partial fulfilment of the requirements for the degree of Master of Political Science Supervisor: Professor Nenad Dimitrijevic CEU eTD Collection Budapest, Hungary 2009 i ABSTRACT The present paper examines the institution of presidential impeachment in countries displaying a semi-presidential institutional design. More specifically, it addresses the question whether the functioning of impeachment can be attributed to the particular institutional arrangement mirrored in the specific interactions between the state actors involved – the president, parliament and PM – or by non-institutional factors such as the president’s actions throughout his/her tenure which can be considered as having violated the constitutional text. The methodology used is the case study of the 2007 Romanian presidential impeachment against Traian Băsescu. The principal finding is that it is difficult to point to a clear, mono- causal relationship between the tensions caused by semi-presidentialism and the practice of impeachment since the impeachment of the head of state is not a common practice in countries that display semi-presidential features. The Romanian case represents a situation where the ambiguity of the constitutional text permitted the parliamentary majority to sanction the President, whose self-proclaimed active role in the political system was supported by the Romanian Constitutional Court and by the citizens who participated in the referendum on his dismissal. HARVEY, et al., ) ) Respondents. ) ) RESPONDENTS’ OPPOSITION TO PETITIONERS’ MOTION FOR A TEMPORARY RESTRAINING ORDER Respondents hereby oppose petitioners’ remarkable request that this Court issue a temporary restraining order preventing an international military force from fulfilling its duty under United Nations mandates to transfer petitioner Mohammad Munaf (“Munaf”), a defendant in the midst of prosecution under Iraq’s criminal justice system, to the sovereign government of Iraq in the event he is convicted and sentenced at trial in an Iraqi court. The Court should deny petitioners’ motion because it fails to satisfy the requirements for temporary injunctive relief. In particular, petitioners cannot demonstrate a likelihood of success on the merits of their underlying habeas petition. As an initial matter, petitioners’ motion rests on the faulty premise that this Court has habeas jurisdiction over Munaf’s custodians. See Memorandum of Law in Support of Petitioners’ Motion for a Temporary Restraining Order at 1-2 (dkt. no. 7) (Sept. 8, 2006) (“Petrs.’ Mem.”). Post's submission in "Patterns format," updating last year's "Patterns of Global Terrorism" report (reftel) follows: Romania is a staunch ally of the United States in the global war against terrorism, providing full public and diplomatic support for US goals to counter terrorism. In 2004, about 1,200 Romanian troops served at any one time in Iraq and Afghanistan, and Romania has promised to maintain its commitment of troops through mid-2005. Romania has made its airspace, ground infrastructure, and naval facilities available to US and NATO forces engaged in the global war against terrorism and senior government leaders have promised to continue to do so in the future. The Romanian Government has established internal mechanisms to combat terrorism, including adoption of a "National Anti- Terrorism Strategy" and guidelines to prevent the use of the Romanian financial and banking system for the purpose of financing terrorist acts. As part of its national strategy, Romania adopted legislation in 2004 that delineates the responsibilities of Romanian government institutions in battling terrorism, providing a clearer framework for interagency coordination and cooperation. Bucharest is the site of the Southeast European Cooperation Initiative, a regional center that provides law enforcement training and intelligence sharing on transborder criminal activities, including terrorism, for 12 member countries in Southeastern and Central Europe. -
