HUMAN RIGHTS QUARTERLY Bremer's "Gordian Knot": Transitional Justice and the US Occupation of Iraq Eric Stover,* Hanny Megally, ** & Hania Mufti*** ABSTRACT Shortly after the US invasion and occupation of Iraq, L. Paul Bremer III, in his capacity as the chief administrator of the Coalition Provisional Author- ity (CPA), introduced several transitional justice mechanisms that set the *Eric Stover is Director of the Human Rights Center at the University of California, Berkeley, and Adjunct Professor in the School of Public Health. In 1991, Stover led a team of forensic scientists to northern Iraq to investigate war crimes committed by Iraqi troops during the Anfal campaign against the Kurds in the late 1980s. In March and April 2003, he returned to northern Iraq where he and Hania Mufti monitored the compliance with the 1949 Geneva Conventions by all sides to the conflict. He returned to Iraq in February 2004 to assist Mufti in investigating the status of documentary and physical evidence to be used in trials against Saddam Hussein and other members of the Ba'athist Party. -

FACT SHEET: THE TRANSITION TO IRAQI SELF-GOVERNMENT “The rise of a free and self-governing Iraq would deny terrorists a base of operation, discredit their narrow ideology, and give momentum to reformers across the region. This would be a decisive blow to terrorism at the heart of its power, and a victory for the security of America and the civilized world.” George W. Bush May 24, 2004 Today’s Presidential Action Ø In a speech at the U.S. Army War College in Carlisle, Pennsylvania, President Bush reported to the Nation on our strategy in Iraq and the specific steps we are taking to achieve our goal. Our coalition has a clear goal, understood by all: To see the Iraqi people in charge of Iraq for the first time in generations. America’s task in Iraq is not only to defeat an enemy, it is to give strength to a friend – a free, representative government that serves its people and fights on their behalf. And the sooner this goal is achieved, the sooner our job will be done. Ø The President announced five steps in his plan to achieve freedom and democracy in Iraq. We will: 1. hand over authority to a sovereign Iraqi government; 2. help establish the stability and security in Iraq that democracy requires; 3. continue rebuilding Iraq’s infrastructure; 4. encourage more international support; and 5. move toward free, national elections that will bring forward new leaders empowered by the Iraqi people. 1. Handing Over Authority to a Sovereign Iraqi Government Ø On June 30, full sovereignty will be transferred to a government of Iraqi citizens. -

Iraq’s Elections of September 1954 ELIZABETH BISHOP Historian Bernard Lewis observes: ”Americans tend to see democracy and monarchy in antithetical terms; in Europe, however, democracy has fared better in constitutional monarchies than in republics”1. Let us take this opportunity to consider elections held in the Hashemite Kingdom of Iraq during the Cold War, in order to assess how”democracy” fared during the years that country was a constitutional monarchy. As we do so, let’s keep Saad Eskander’s words in mind: ”You cannot have democracy in Iraq by just holding elections... You need to enable Iraq’s core of citizens to have free access to information, absolutely all, all of legislation. -

The Bush Administration asserts that establishing democracy in Iraq will catalyze the promotion of democracy throughout the Middle East. The desired outcome would also likely prevent Iraq from becoming a sanctuary for terrorists, a key recommendation of the 9/11 Commission report. The Bush Administration asserts that U.S. policy in Iraq is now showing substantial success, demonstrated by January 30, 2005 elections that chose a National Assembly, and progress in building Iraq’s various security forces. The Administration says it expects that the current transition roadmap — including votes on a permanent constitution by October 31, 2005 and for a permanent government by December 15, 2005 — are being implemented. Others believe the insurgency is widespread, as shown by its recent attacks, and that the Iraqi government could not stand on its own were U.S. and allied international forces to withdraw from Iraq. Some U.S. commanders and senior intelligence officials say that some Islamic militants have entered Iraq since Saddam Hussein fell, to fight what they see as a new “jihad” (Islamic war) against the United States. -

From the early 1930s to the early 1950s, the Political Department of the Jewish Agency (later, the Israeli Foreign Ministry) and several eminent Kurdish leaders maintained contact with a view to cooperation. The strategic calculus behind a Zionist/Israeli-Kurdish partnership was the same that directed Zionist/Israeli relations with all regional minorities: If demographic differences from the region’s Sunni Arab majority had made ii them outliers and political differences with them had made them outcasts, the Zionists/Israelis and the Kurds, together with their common circumstance as minorities, had a common enemy (Arab nationalists) against whom they could make common cause. -

A Critical Democratic Exploration of Voice and Authorship Among Resettled Iraqis in the United States Jared Keyel ABSTRACT The 2003 United States (U.S.)-led invasion and occupation of Iraq caused hundreds of thousands of deaths and led to the displacement of millions of individuals in that country. Between March 20, 2003 and late 2017, more than 172,000 Iraqis left their country as refugees and resettled in the United States. This dissertation focuses on a small cohort of that population who resettled in various locations in the U.S. after 2003. This research contributes an empirical and theoretical exploration of the possibilities for political agency for resettled Iraqis in the United States. Grounded in literature suggesting those displaced commonly experience constrained agency framed as “silence/ing” and/or “voicelessness,” I identify three requirements to democratic participation: sufficient time to exercise voice, adequate information and attenuating lingering suspicion of (authoritarian) government. Moreover, despite constraints, opportunities for engagement existed including discussion and dialogue; civil society volunteering; and activism. Drawing on 15 semi-structured qualitative interviews, this work first critically explores the American invasion of Iraq and the social and political breakdown that it triggered in that country.
