ANNEXA .... ......... .. ........ ... ....... ...... ......... ... ......... ......... .. ... .... .... .. ... ... ................6 2 380383 1 THIS 26 H SUPPLEMENTAL AGREEMENT is dated 2018 and made BETWEEN: (1) NETWORK RAIL INFRASTRUCTURE LIMITED, a company registered in England under number 2904587 having its registered office at 1 Eversholt Street, London, NW1 2DN ("Network Rail"); and (2) GOVIA THAMESLINK RAILWAY LIMITED, a company registered in England under number 07934306, having its registered office at 3rd Floor, 41-51 Grey Street, Newcastle upon Tyne, NE1 6EE (the "Train Operator"). WHEREAS: (A) The parties entered into a Track Access Contract (Passen!~er Services) dated 02 March 2016 in a form approved by the Office of Rail and Road ("ORR") pursuant to Section 18(7) of the Act, as amended by various supplemental agreements each in a form approved by ORR pursuant to Section 22 of the Act (which track access contract as subsequently amended is hereafter referred to as the "Contract"). (B) The parties wish to amend the Contract in the terms described below. IT IS HEREBY AGREED as follows: 1. INTERPRETATION In this Supplemental Agreement: 1.1 Words and expressions defined in and rules of interpretation set out in the Contract shall have the same meaning and effect when used in this Supplemental Agreement except where the context requires otherwise; and 1.2 "Effective Date" means the later of: (1) 0200 hours on the Principal Change Date 2018; and (2) the date upon which the Office of Rail and Road issues its approval, pursuant to Section 22 of the Act, of the terms of this Supplemental Agreement. 1.3 "Annex" shall mean the annexes and their relevant parts and attached hereto. 2. EFFECTIVE DATE AND TERM 2.1. The amendments to the Contract pursuant to this Supplemental Agreement shall have effect from the Effective Date and shall cease to have effect on the Expiry Date or earlier termination of the Contract. 3 380383 3. AMENDMENTS.TO THE CONTRACT Table 2.1 Passenger Train Slots of Schedule 5 of the Contract, the entries relating to Service Groups ET02 and ET07 shall be deleted and re~placed by those as set out in Annex A to this Supplemental Agreement. Table 4.1 Calling Patterns of Schedule 5 of the Contract, the entries relating to Service Groups ET02 and ET08 shall be deleted and replaced by those as set out in Annex B to this Supplemental Agreement. 4. GENERAL The Contract, as amended by this Supplemental Agreement, shall remain in full force and effect in accordance with its terms, and during the period in which the amendments made by this Supplemental Agreement are to have effect, all references in the Contract to "the contract", "herein", "hereof", "hereunder'' and other similar expressions shall, unless the context requires otherwise, be read and construed as a1 reference to the Contract as amended by this Supplemental Agreement. 5. THIRD PARTY RIGHTS No person who is not a party to this Supplemental Agreement shall have any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Supplemental Agreement. 6. LAW This Supplemental Agreement shall be governed by, construed and given effect to in all respects in accordance with English Law. 7. COUNTERPARTS This Supplemental Agreement may be executed in any number of counterparts, each of which when executed and delivered shall constitute an original, but all the counterparts shall together constitute but one and the same document. 4 380383 IN WITNESS whereof the duly authorised representatives of Network Rail and the Train Operator have executed this Supplemental Agreement on the date first above written.     Joint Performance Improvement Update Period 1 (2018-19) This report gives progress on the joint improvement plan for Govia Thameslink Railway (GTR) and Network Rail with punctuality data by route, as well as the main operational issues in the period (there are 13, 4-week reporting periods per year), and planned customer improvements. PPM* statistics and delay responsibility by route – Period 1 (to 28 April 2018) Gatwick Express Great Northern Southern Thameslink *The public performance measure (PPM) data above shows the percentage of trains which arrive at their terminating station within five minutes of the planned arrival time. It combines figures for punctuality and reliability into a single performance measure. A summary of key issues affecting performance in this period In period 1, GTR’s PPM was 85.2% with the main incidents affecting performance being the emergency services dealing with incidents near South Croydon on 7 and 19 April, these services dealing with an incident near Cricklewood on 3 April, a track circuit failure near Hornsey on 19 April and a vehicle striking a bridge near East Croydon on 11 April. The PPM for each of the brands for this period was: Gatwick Express 79.01%, Great Northern 87.33%, Southern 83.49% and Thameslink 89.33%. Delivering improvements for passengers Thameslink Class 700s There are 71 class 700 trains in regular service between Brighton and London Bridge or Bedford; between Wimbledon, Sutton, St Albans and Luton; on the Sevenoaks route and between Horsham / Littlehampton and London. Performance Strategy Huge investment is being put into the railway which will ultimately deliver more capacity through new and longer trains at the end of the Thameslink programme in 2018, as well as a transformed station at London Bridge.

Purpose 1.1. The purpose of this report is to seek approval to adopt the final version of the Adur & Worthing Local Cycling and Walking Infrastructure Plan (LCWIP): a high level, strategic network plan for safe and accessible future cycling and walking infrastructure provision. 1.2. This report outlines recently published government guidance for walking and cycling provision relating to the COVID-19 pandemic; and seeks member approval for urgent work with West Sussex County Council on local improvements in line with the Adur & Worthing LCWIP. The published guidance documents are: Traffic Management Act 2004: network ​ management in response to COVID-19; and Coronavirus (COVID-19): safer ​ ​ public places - urban centres and green spaces. ​ 1.3. A Draft version of the LCWIP was presented to the Joint Strategic Committee on 7th November 2019, where Members approved the draft version being taken through Public Consultation between November 2019 and January 2020. 1.4. The report presents the outcomes of the public consultation, in particular, the overwhelming support for improved cycling and walking infrastructure provision (see section 4). It seeks approval for amendments made to the Plan as a result of consultation responses. 1.5. The Plan was produced with the consistent support and input from the Adur & Worthing Cycling & Walking Group; and oversight and support from West Sussex County Council. 2.
