BBC Radio WM Make a Difference Heroes Awards Terms and Conditions

1. In order to nominate someone, you must be a UK resident (including Channel Islands and the Isle of Man) aged 13 or over, and not be a BBC or BBC Group company employee, employee of any of its affiliates, close relative of any such employees or connected to the awards competition directly or through a close relative. You cannot nominate yourself.

2. Any person who is a resident or travels on a typically daily basis (e.g. for work and does not need to include weekends or bank holidays) in the , except BBC or BBC Group company employees, employees of any of its affiliates, close relatives of any such employees or connected to the award directly or through a close relative. Proof of age, identity and eligibility may be requested.

3. Nominations can be made online at bbc.co.uk/wm Please provide as much information as possible to ensure the nomination can be judged for one of the categories below. Written nominations must not be any more than 150 words and audio/video nominations must not be longer than one minute. Please note that all nominations must be received no later than 6pm on Friday 15th January 2021. Any nominations received after this will not be accepted.

4. You agree to the broadcasting of your audio/video nomination and you will assign to us all rights in your contribution and for us to use it worldwide in perpetuity in all media known now or in the future. We may edit, copy, adapt or translate your video /audio nomination at our discretion and you will irrevocably waive any “moral rights” that may exist in your video /audio nomination.

5. The BBC team will contact the nominator, the nominee (his/her parent or guardian, where applicable) to verify facts and/or events and whether the relevant consents/permissions have been obtained.

6. The categories and criteria to qualify for nomination and on which winners will be selected are:

CALL OF DUTY AWARD: presented to a member of the emergency services, military, or NHS for their commitment to their profession.

TRIUMPH OVER ADVERSITY AWARD: Awarded to an individual who has overcome significant difficulties in order to be successful.

INSPIRING YOUNG PERSON AWARD: Awarded to someone 17 or under who has demonstrated courage, talent or commitment in any field.

GOOD NEIGHBOUR AWARD: Awarded to an individual or group that helps make the neighbourhood or local community a better place to live or work, either on a regular basis or through a single act of kindness.

VOLUNTEER OF THE YEAR AWARD: Awarded to a person who makes a real difference to the community by giving up their time voluntarily to help out a charity or good cause.

COMMUNITY SPIRIT AWARD: Awarded to an individual or group whose efforts have embodied the spirit of and the Black Country whose achievements have consistently made you proud to be from the West Midlands.

7. A ‘volunteer’ can be someone who is paid for some of their time but also chooses to give up some time without pay.

8. A BBC production team headed by the managing editor of BBC Radio WM will select a shortlist of three finalists per category and then a panel of judges including non-BBC guest judges and BBC managers will select one winner per category from those finalists. A second place will also be selected so this can be used should the original winner not be able to take up the award. The head judge will be the managing editor of the radio station who will have the final veto in the case of a tie.

9. The BBC's decision as to the winners is final. Whilst we do not have the resources to engage in correspondence with every individual and feedback as to the merits of a particular entry will not be made available normally, we aim to be as inclusive as possible. 10. All finalists will be invited to a virtual ceremony in March 2021 where the winners of each category will be announced. The ceremony will be pre-recorded and the audio and video will be edited and used for broadcast and social media.

11. The prize will consist of a trophy. There is no cash alternative and the prize cannot be sold or transferred in any circumstances. No commercial gain can be made from using or referencing the BBC brand, the award itself or any other element of this awards process.

12. Nominees must agree to take part in any post-award publicity if required.

13. The BBC reserves the right to: (i) vary these Rules, including but not limited to, opening and close times of the awards nominations; (ii) disqualify any nomination that breaches the rules, is fraudulent in any way or brings the BBC into disrepute; (iii) move nominees into another category should they see fit and (iv) cancel the awards, at any stage, if in its opinion it is deemed necessary or if circumstances arise outside its control.

14. Nominees who have been shortlisted will be notified by February 2021. The BBC will then contact them to arrange a broadcast interview and/or to film them for social media videos.

15. The BBC, their sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure, loss of data via use of a third party email platform or malfunction or any other problem which may result in any nomination not being properly registered.

16. The promoter of the awards is the British Broadcasting Corporation and these Rules are subject to the laws of England and Wales.

18. To the extent permitted by law, the BBC will not be liable for any loss or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise) including financial, reputational loss or disappointment.
