1. Dean’s Debate: Future Trends for the Provision of Legal Services in Scotland – to merge or not to merge? Austin Lafferty (Partner, Lafferty Law), Gilbert Anderson (Partner, DAC Beachcroft), Bruce Beveridge (President, ) to Chair 5 Sept. 2013 Thursday 5.45pm – 7.15pm The Royal Faculty is holding a debate focusing on mergers in Scots Law. In order to get a breadth of different views and opinions heard, we have invited three fantastic participants. Austin Lafferty was President of the Law Society of Scotland until May 2013. Gilbert Anderson is the Senior Partner of DAC Beachcroft Scotland LLP. He was formerly Senior Partner of Andersons Solicitors LLP until the firm’s merger with DAC Beachcroft in September 2012. These two speakers will discuss mergers in general, but will also touch on some of the wider issues affecting the Scottish Legal landscape at this dynamic time such as ABS and civil justice reform. Bruce Beveridge will be chairing the debate.

2. Changes to Employment Tribunal Practice Lunchtime seminar Innes Clark (Partner, Morton Fraser LLP) 17 Sept. 2013 Tuesday 1pm – 2pm New Employment Tribunal rules came into force on 29 July 2013 along with the introduction of Employment Tribunal Fees. This talk will look at the key changes in Employment Tribunal procedure brought about by the new Employment Tribunal rules including the new initial sift stage, preliminary hearings, interlocutory applications and the circumstances in which a claim or response may be rejected. Innes Clark is the head of Morton Fraser’s Employment Law Team and advises both employers and employees on a wide range of employment law issues.

3. Missives: Setting a New Standard Ian Ferguson (Partner, Mitchells Roberton) & Paul Carnan (Partner, Blaney Carnan) 19 Sept. 2013 Thursday 5.45pm – 7.15pm Combined Standard Clauses (2013 edition) – The 2013 version is due for release in Autumn 2013 and the changes will be highlighted and discussed and future developments considered. Builders’ Standard Missives - the holy grail? – Given the undoubted success of the various regional standard missives, the team behind the creation of the CSC, together with colleagues representing the housebuilding industry, believe that a similar initiative for housebuilders’ missives could become a reality. Ian Ferguson is a Partner in Mitchells Roberton specializing in commercial and domestic conveyancing, banking and security work. Paul B Carnan is a sole practitioner and has been a member of the Property Law Committee of the Law Society of Scotland since 1992.

Child Law Conference ½-day Conference Panel of 4 speakers – John Fotheringham (BTO), Amanda Masson (), Sara Matheson (MTM Family Law) Sheriff Cubie (Glasgow Sheriff) 25 Sept. 2013 Wednesday 9.30am – 1.00pm This conference will focus on several different aspects of Child Law. John will look to discuss CSA Child Support, Amanda is going to discuss relocation, Sara will discuss children’s hearings and Sheriff Cubie is going to give us more information on Child Law. 5. A Renewable Energy Transaction – How to Protect a landowner Jacqueline Mitchell & Graham Bell (Wright, Johnston & Mackenzie LLP) 26 Sept 2013 Thursday 5.45pm – 7.15pm As part of the core Renewable Energy Team, Jacqui provides advice on the wide range of legal documents required for a renewable energy Projects. Jacqui will provide an overview of the salient points in an Option and Lease Agreement from a developer’s perspective, with particular emphasis on the provisions in the drafts which a landowner’s solicitor should refrain from revising where possible. Graham is the Chief Executive in WJM. His work covers corporate finance, project management and governance aspects of renewables projects, and he also provides advice on general commercial matters. Graham will outline the corporate vehicles and structures which a landowner may wish to put in place in order to grant the option agreement and to which the landowner may wish the wind farm rent to be paid, all with a view to minimising a landowner’s tax liability, whilst having in place a structure which works for the developer.

6. PII Claims Profile and Risk Management Lunchtime seminar Russell Lang (Client Executive, Marsh Ltd) 2 Oct. 2013 Wednesday 1.00pm – 2.00pm This lunchtime seminar will be focusing on the current Master Policy claims experience. Russell Lang is a solicitor formerly in private practice for over 25 years specializing in commercial litigation, corporate and commercial and insolvency work. He joined Marsh in 2004 as part of the Scottish Solicitors team and since then has been exclusively involved in the broking and administration of the Law Society Master Policy for Professional Indemnity Insurance and in giving risk management advice and training to the Scottish Legal Profession.

7. Financial Guardianship and Power of Attorney John Kerrigan (Partner, Morisons LLP) 3 Oct. 2013 Thursday 5.45pm – 7.15pm With Scottish society living longer private client solicitors are increasingly having to deal with issues arising from assisting elderly/vulnerable clients and their families. In this seminar John is going to look to Powers of Attorney, Vulnerable Clients and Financial Guardianships and Intervention Orders. John Kerrigan is one of Scotland’s leading authorities in Will preparation. He is the author of the text ‘Drafting for Succession’ and he also recently penned a book called ‘Finance and the Older Client’.

8. Procurement Law/Legislation Roger Cotton (Partner, LLP) 9 Oct. 2013 Thursday 5.45pm – 7.15pm In this seminar Roger will explain why and how the specialist area of law can impact on the activities of public sector and utility purchasers and suppliers. It will include pointers on what to look out for, what the effect of the law is (and who it affects) and the consequences if things go wrong. Roger will also explain how a series of recent cases in the Court of Session are changing the procurement law landscape in Scotland – and the direction of change in the coming year. Roger Cotton is a partner with Brodies LLP and is accredited as a specialist in public procurement law by the Law Society of Scotland. He works with authorities and with bidders advising on procurement strategies, bid preparation, compliance issues and disputes in relations to major projects and routine purchasing.

9. Contract Law Update Professor Hector MacQueen (Professor, University of Edinburgh) 10 Oct. 2013 Thursday 5.45pm-7.15pm Professor MacQueen will review the recent decisions of the Scottish Courts in the field of contract law, whilst taking into account significant and relevant Scottish and English Law Commissions, notably on counterpart execution and consumer rights. Professor MacQueen has been a member of the Edinburgh Law School staff since 1979. Appointed to the Chair of Private Law in 1994, he was Dean of the Law School 1999-2003, and Dean of Research and Deputy Head of the College of Humanities and Social Science in the University 2004-2008.

10. Personal Injury Conference Full-day Conference 11 Oct. 2013 Friday 9.30pm – 4.30pm The Royal Faculty and the GBA are delighted to be jointly hosting a full-day Personal Injury Conference. Speakers and topics for the Conference will include the following - Dr. Alan Carson - Whiplash and other Helpful Disorders; Chris Marney - Common Law Liability; Prof. Peter Lyons - Proof Questioning Techniques; Fraser Simpson - Dynamic Scotland: leading the way for victims of negligent asbestos exposure; Richard Pugh - Quantum Damages; and Sandy Forsyth - Scottish PI Cases Update. 11. Update on Financial Provision in Family Cases Anne Dick (Family Law Matters Scotland LLP) 17 Oct. 2013 Thursday 5.45pm – 7.15pm This seminar will provide an update on financial provisions in family cases, focusing on discretion demonstrating why this matters not only to family lawyers. Anne Dick is a solicitor who has specialised in Family Law for over 35 years and is accredited by the Law Society of Scotland as a Family Law Specialist. She is a partner in a niche family law practice which has just been set up called Family Law Matters Scotland. She was a part-time Tribunal Chairman for some years from 1986, first of Social Security Appeal Tribunals and then Child Support Appeal Tribunals and was for a time on the Training Committee of the Independent Tribunal Service. Anne has been involved in developing and presenting advanced mediation training in Scotland with fellow trainers in CALM as part of the CALM training team.

12. Anti-money Laundering Lunchtime seminar Richard Farquhar (Financial Compliance Department, Law Society of Scotland) 23 Oct. 2013 Wednesday 1.00pm – 2.00pm This seminar will focus on Anti-money Laundering discussing what solicitors should aim to cover within their own office procedures including: use of Financial Action Task Force Statements, Joint Money Laundering Steering Group Guidance, identification of politically exposed person and risks, enhanced due diligence; whilst also looking at some useful case-law. Richard provides legal advice to the Financial Compliance Department of the Law Society of Scotland including guidance on compliance with the CML Handbook, Money Laundering Regulations and the Proceeds of Crime Act.

13. Taylor Report Sheriff Principal James Taylor LLD 24 Oct. 2013 Thursday 5.45pm – 7.15pm Sheriff Principal James Taylor will deliver a talk on his report (which is to be delivered to the Scottish Government in the second week of September). Sheriff Principal Taylor was among the first solicitors to attain rights of audience in the Court of Session and until being appointed a floating Sheriff to Lothian and Borders in 1998, he was his firm’s in-house advocate. During his period of office he was a member of the Board of the Scottish Civil Courts Review. Upon retirement in 2011 he was appointed the chairman of the Review into the Expenses and Funding of Civil Litigation in Scotland.

14. Litigation - Written Pleadings Lunchtime seminar Brian Cameron (Partner, Morton Fraser) 30 Oct. 2013 Wednesday 1.00pm – 2.00pm This seminar will aim to remind practitioners of the purpose of written pleadings and the duties owed by practitioners to the court in framing such pleadings. Brian is widely experienced in litigating in the Sheriff Court and Court of Session. In 2007 he acted as principal solicitor for the successful appellant in an appeal to the House of Lords. Brian is a part-time Sheriff, co-editor of Greens Civil Practice Bulletin and Lead Tutor in civil litigation on the Diploma at the University of Strathclyde.

15. The Changing Face of Dispute Resolution John MacKenzie (Partner, Shepherd & Wedderburn) 31 Oct. 2013 Thursday 5.45pm – 7.15pm This seminar will focus on dispute resolution and will consider what the future holds for the “traditional litigator”. An experienced Solicitor Advocate, John deals with a range of commercial litigation matters and has particular expertise in intellectual property and IT disputes. He is accredited as a specialist in Intellectual Property Law by the Law Society of Scotland and sits on the Lord President’s Consultive Committee on Commercial Actions in Court of Session.

Gill Review Conference ½-day Panel: Lord Gill (Lord President), Robert Sandeman (Justice Directorate), Gilbert Anderson (DAC Beachcroft), Kate Dowdalls (Advocate), Gordon Dalyell (Digby Brown) and David Taylor (HBM Sayers) 6 Nov. 2013 Wednesday 9.30pm – 1.00pm The Royal Faculty is very pleased to have brought together a very distinguished panel of speakers for this Conference on the Gill Review which will focus on civil justice. In addition to the Lord Gill, Gilbert Anderson will speak about his experience of the consultation of the Scottish Civil Courts Review, will discuss his support for key recommendations of SCCR for change and concerns around the retention of civil juries and other aspects of the draft Courts Reform (Scotland) Bill, Kate Dowdalls will present a view from the bar including discussion of opportunities and challenges for counsel and agents and Robert Sandeman will be discussing the proposals which the Scottish Government intend to take forward in the Court Reform Bill.

Incorporating your Practice April Bingham (Head of Corporate, Bellwether Green Ltd) & Mark Barry (Associate Director, Haines Watts) 7 Nov. 2013 Thursday 5.45pm – 7.15pm This seminar will look at reasons to consider incorporating, choice of incorporated entity, tax and financial implications, the necessary documentation, the Law Society of Scotland’s requirements and practical issues. April is a co-founder and Head of Corporate at Bellweather Green. She deals with acquisitions and sale, investment, insolvency and commercial contracts. Clients include public and private companies, financial institutions and social enterprises.

How to get more from, and give more to, your Family Business Clients Liam Entwhistle (Partner, Wright, Johnstone & Mackenzie LLP) 14 Nov. 2013 Thursday 5.45pm – 7.15pm The aim of this seminar is to give you the tools to better understand your family business clients, and to use that understanding to improve your standing with them, and identify their needs – which should lead to more work for you, better relationships and happier clients. Liam is head of the Conflict Resolution Group at WJM, and joint head of their Family Business/Business Families sector team. 19. Inheritance Tax and Capital Gains Tax prior to and post death Lunchtime seminar Beth Hamilton (Partner, Bartys) 20 Nov. 2013 Wednesday 1.00pm – 2.00pm When someone dies there are several tax implications. Capital gains tax and inheritance tax are key factors which need to be explored post and prior to death. In this lunchtime seminar Beth Hamilton will cover these tax implications and explain the best way to advice your clients in regards to both capital gains tax and inheritance tax. Beth is a qualified solicitor and a Partner of BMK Wilson, Solicitors in Glasgow, but works from their Branch Office, Tho & J W Barty, Solicitors in Dunblane.

Land Registration Reform: making sense of the changes Ann Stewart (Partner, ) 28 Nov 2013 Thursday 5.45pm – 7.15pm The Land Registration (Scotland) Act 2012 is expected to come into force in Autumn 2014, and while much of the day-to-day aspect of land registration will look the same, much will change. Changes both large and small will impact on the practice of conveyancing and thus practical session will provide an overview of the Act, and look at its likely effect on the daily life of the conveyance. Ann is Head of Knowledge Management at Shepherd and Wedderburn, and a senior professional support lawyer specializing in all aspects of commercial property.

Complete TCPD Programme (September 2013 to February 2014)

The Royal Faculty and the Scottish Law Agents Society, following the success of the first two programmes, will begin their third complete TCPD programme on 6th September 2013.

The programme is delivered over 6 months from September 2013 to February 2014 during which we have 9 meetings followed by a six month consultation period during which trainees have the opportunity to complete the independent study items arising from the course with access to guidance by telephone or email.

The programme is intended to ensure that trainees are as prepared as possible to meet the demands of working in the legal profession. It will again provide, through a team of experienced solicitors, an excellent training in each of the main areas of legal practice and cover all the required elements of TCPD. The total cost per participant, including all materials, will be £900 (no VAT).
