SR. PRESIDENTE: Muy buenas tardes. Siendo el día 17 de noviembre, a la una y once de la tarde (1:11 p.m.), el Senado de Puerto Rico se apresta a comenzar esta Sesión Extraordinaria, según citada por el Gobernador. Les pedimos a todos los Senadores que se alleguen al Hemiciclo del Senado. Es la una y once de la tarde (1:11 p.m.). Para comenzar la Sesión, agradeceré que todos los Senadores se acerquen al Hemiciclo para hacer el Pase de Lista Inicial. Para el Pase de Lista Inicial es requisito que todos los Senadores se encuentren en el Hemiciclo. Señora Secretaria. Señora Secretaria, en virtud de la Constitución de Puerto Rico, el Gobernador nos ha convocado a una Sesión Extraordinaria. Por favor, pase lista en este momento para establecer el quórum para comenzar la Sesión Extraordinaria, siendo hoy 17 de noviembre, jueves, a la una y treinta y tres de la tarde (1:33 p.m.). PRESIDENTE: A los Senadores, vamos a proceder a leer la Convocatoria, como exige el Reglamento y la Constitución. La Convocatoria del Gobernador tiene cerca de treinta (30) páginas, por lo tanto se va a proceder a leer en este momento, para que todos estén al tanto de que vamos a tomarnos unos minutos en lo que se leen estas treinta (30) páginas, como así exige nuestro ordenamiento jurídico. LECTURA DE LA CONVOCATORIA DE LA CUARTA SESIÓN EXTRAORDINARIA DEL GOBERNADOR “ORDEN EJECUTIVA DEL GOBERNADOR DEL ESTADO LIBRE ASOCIADO DE PUERTO RICO, HON. ALEJANDRO J. GARCÍA PADILLA, PARA CONVOCAR LA CUARTA SESIÓN EXTRAORDINARIA DE LA DÉCIMO SÉPTIMA ASAMBLEA LEGISLATIVA “ESTADO LIBRE ASOCIADO DE PUERTO RICO LA FORTALEZA SAN JUAN, PUERTO RICO Boletín Administrativo Núm. OE-2016-44 ORDEN EJECUTIVA DEL GOBERNADOR DEL ESTADO LIBRE ASOCIADO DE PUERTO RICO, HON. ALEJANDRO J. GARCÍA PADILLA, PARA CONVOCAR LA CUARTA SESIÓN EXTRAORDINARIA DE LA DÉCIMO SÉPTIMA ASAMBLEA LEGISLATIVA POR CUANTO: La Constitución del Estado Libre Asociado de Puerto Rico, en su Artículo IV, Sección 4, reconoce entre los deberes, las funciones y las atribuciones del Gobernador, la facultad para convocar a la Asamblea Legislativa a Sesión Extraordinaria cuando, a su juicio, los intereses públicos así lo requieran. POR CUANTO: La Constitución del Estado Libre Asociado de Puerto Rico, en su Artículo III, Sección 10, dispone que cuando el Gobernador ejerce su facultad de convocar a la Asamblea Legislativa a Sesión Extraordinaria, solo podrán considerarse en esta los asuntos especificados en la convocatoria o en mensaje especial que este le envíe en el curso de la Sesión. Dicha Sesión Extraordinaria no podrá extenderse por más de veinte (20) días naturales. POR CUANTO: A pesar del intenso y arduo trabajo realizado por la Decimoséptima Asamblea Legislativa de Puerto Rico durante su Séptima Sesión Ordinaria, han quedado pendientes de consideración ciertas piezas legislativas dirigidas a atender asuntos de alto interés público. POR TANTO: Yo, ALEJANDRO J. GARCÍA PADILLA, Gobernador del Estado Libre Asociado de Puerto Rico, en virtud de los poderes inherentes a mi cargo y de la autoridad que me ha 44102 Jueves, 17 de noviembre de 2016 Núm. 1 sido conferida por la Constitución y las Leyes del Estado Libre Asociado de Puerto Rico, por la presente dispongo lo siguiente: PRIMERO: Se convoca a los miembros de la Decimoséptima Asamblea Legislativa de Puerto Rico, para una Cuarta Sesión Extraordinaria que habrá de comenzar el jueves, 17 de noviembre de 2016 a la 1:00 de la tarde. SEGUNDO: En la Cuarta Sesión Extraordinaria se considerarán las siguientes medidas: 1. F-195 (P. del S. 1354/P. de la C. 2413): “Para enmendar el Artículo 2.030; enmendar el Artículo 2.050; añadir un nuevo Artículo 2.060; añadir un nuevo Artículo 2.070; añadir un nuevo Artículo 2.080; añadir un nuevo Artículo 2.090; añadir un nuevo Artículo 2.100; añadir un nuevo Artículo 2.110; renumerar los Artículos 2.060, 2.070, 2.080 y 2.090 como los Artículos 2.120, 2.130, 2.140 y 2.150; enmendar el Artículo 8.030; enmendar el Artículo 8.050; enmendar el Artículo 8.070; enmendar el Artículo 8.120; enmendar el Artículo 10.020; enmendar Artículo 10.030; enmendar el Artículo 10.040; enmendar el Artículo 10.050; derogar el Artículo 10.070; derogar el Artículo 10.080; enmendar el Artículo 10.090; enmendar el Artículo 10.100; enmendar el Artículo 10.110; derogar el Artículo 10.120; derogar el Artículo 10.130; derogar el Artículo 10.140; derogar el Artículo 10.150 y, en su lugar, crear un nuevo Artículo 10.150 de la Ley 194-2011, según enmendada, conocida como el “Código de Seguros de Salud de Puerto Rico.” 2. F-239 (P. del S. 1461/P. de la C. 2593): “Para enmendar los Artículos 1B, 1B-3, 1B-4, 2, 3, 6, 9, 13, 22 y 29; añadir los Artículos 13A, 13B y 13C; y derogar el Artículo 1C de la Ley Núm. 45 de 18 de abril de 1935, según enmendada, conocida como la “Ley del Sistema de Compensaciones por Accidentes del Trabajo”; para establecer que la Corporación del Fondo del Seguro del Estado estará exenta del pago de contribuciones, patentes, arbitrios, aranceles, comprobantes y sellos de rentas internas; para eliminar el Consejo Médico Industrial; para que, en los casos en que se niegue la cubierta del seguro obrero, la Corporación pueda recobrar del seguro médico del reclamante los gastos incurridos en su tratamiento médico; para requerir la utilización mandatoria de las Guías Oficiales de Impedimentos (Official Disability Guidelines) para la determinación del tiempo promedio estimado en que el trabajador permanecerá recibiendo tratamiento en descanso y de las Guías para la Evaluación de Incapacidad adoptadas por la Asociación Médica Americana en los procesos de fijación de incapacidades parcial y total permanentes; para que los aditamentos especiales prescritos por el médico de la Corporación en los casos de incapacidad parcial o total permanente puedan ser reparados o remplazados por causa justificada; para reconocer al lesionado el beneficio de una compensación por incapacidad total y permanente por factores socioeconómicos; para fijar un término para reclamar la reposición de la compensación otorgada por la Corporación en los casos en que esta se hubiere extraviado o hubiere sido hurtada o cobrada fraudulentamente; para eliminar la Junta Consultiva; para simplificar el proceso de apelación ante la Comisión Industrial; para imponer un término al patrono para negar responsabilidad de un accidente laboral; para establecer los términos de vigencia de la anotación del embargo y de prescripción para la acción en cobro; para autorizar al Administrador a eliminar deudas incobrables de sus libros de contabilidad; para fijar un término para solicitar revisión de notificaciones de aumento de primas; para cambiar el término establecido para que el Administrador pueda ejercer la acción subrogatoria y pautar el trámite de notificación al Administrador; y para otros fines relacionados.” 44103 Jueves, 17 de noviembre de 2016 Núm. 1 3. F-240 (P. del S. 1467/P. de la C. 2599): “Para añadir el apartado (W) al sub inciso (6) del inciso (k) de la Sección 2 de la Ley Núm. 74 de 21 de junio de 1956, según enmendada, conocida como la “Ley de Seguridad de Empleo de Puerto Rico” para excluir de la aplicación de dicho cuerpo legal a los participantes del programa National and Community Service Act.” 4. F-176 (P. del S. 1246/P. de la C. 2201): “Para añadir un nuevo inciso (i) y (jj) a la Sección 1 del Artículo III; reenumerar los incisos subsiguientes; enmendar los incisos (b) (c), (f) y (g) de la Sección 5 del Artículo VI de la Ley 72-1993, según enmendada, y mejor conocida como la “Ley de la Administración de Seguros de Salud de Puerto Rico”, para incluir como beneficiarios en todo plan de salud familiar del gobierno a los cohabitantes de los miembros de la Policía de Puerto Rico, de los empleados del gobierno central y municipal y de los veteranos; y para otros fines.” 5.

I also draw your attention to the 2,800 individuals—and still growing—who have signed a petition with this same request.1 At this critical historical juncture, Puerto Rico needs accurate, objective, and timely statistics. Government statistics empower the economy, serve the health and welfare of citizens, improve governance, and inform decisions and policies in the public and private sectors, among many other vital functions. Government statistics are also fundamental to evidence-based policymaking, the engagement of which is on a rapid rise in local, state, and federal governments. To address the challenges posed by its decade-long economic recession and the devastation of back-to-back hurricanes, Puerto Rico must chart its path toward sustainable recovery using reputable and reliable data and statistical methods. Because of their broad and profound importance, it is imperative that government statistics be produced through rigorous scientific processes and analyses performed by experts that can function without improper outside influence. Government statistics must be independent, objective, accurate, and timely and be perceived as such. It is just as important to have adequate statistics on a variety of topics. PRIS has demonstrated repeatedly it has the expertise to function independently to produce rigorous, objective, and accurate statistics for the benefit of Puerto Rico and its people.

Thank you for the invitation to participate in today’s hearing to discuss potential amendments to the Puerto Rico Oversight, Management and Economic Stability Act of 2016 (“PROMESA”).1 My name is Eduardo Bhatia Gautier. I am a former president of the Senate of Puerto Rico (2013-2016), and currently serve as the minority leader for the Popular Democratic Party. On behalf of the people of Puerto Rico, we welcome the opportunity to have a constructive dialogue with you and your colleagues on PROMESA. From the outset, it is important to underscore that I have always been opposed to the imposition by Congress of an undemocratic fiscal control board for the Government of Puerto Rico.2 As the former president of the Senate of Puerto Rico, I advocated for a comprehensive framework that would give Puerto Rico the tools it needed to reach a resolution with creditors and adjust its debts to a sustainable level. Recognizing that debt restructuring alone would be an insufficient path to Puerto Rico’s recovery from its long-standing fiscal and economic crisis, together with multiple experts, I also encouraged Congress to address Puerto Rico’s inequitable health care financing structure and adopt legislative measures promoting sustained economic growth. Regrettably, Congress did not heed such advice. It opted for a colonial and paternalistic approach that focused exclusively on fiscal adjustment, and by doing so, effectively stripped the people of Puerto Rico from the limited autonomy recognized pursuant to Public Act 600 of 1950 and Public Act 447 of 1952.3 My testimony today will first provide you with a general overview of the principal mistakes of PROMESA and then proceed to demonstrate why they are at the root of your concerns in proposing these amendments.

    Plenary Session Speaker Biographies Christopher L. Eisgruber ’83 Christopher L. Eisgruber has served as Princeton University’s 20th president since July 2013. He is the Laurance S. Rockefeller Professor of Public Affairs in the Woodrow Wilson School and the University Center for Human Values. Before becoming president, he served as Princeton’s provost from 2004-2013 and as director of Princeton’s Program in Law and Public Affairs from 2001-2004. A renowned constitutional scholar, he is the author of The Next Justice: Repairing the Supreme Court Appointments Process (Princeton 2007), Religious Freedom and the Constitution (co-authored with Lawrence G. Sager, Harvard 2007), and Constitutional Self- Government (Harvard 2001), as well as numerous articles in books and academic journals. In 2014, he was elected to membership in the American Academy of Arts and Sciences. Eisgruber served on the faculty of the New York University School of Law for eleven years before joining the Princeton faculty in 2001. Prior to his time at NYU, he clerked for Judge Patrick Higginbotham of the United States Court of Appeals for the Fifth Circuit and for Justice John Paul Stevens of the United States Supreme Court. Eisgruber received an A.B. magna cum laude in Physics from Princeton, an M. Litt. in Politics from Oxford University, and a J.D. from the University of Chicago Law School. His wife, Lori Martin, is a distinguished securities litigator with the law firm WilmerHale, and his son, Danny, attends the University of Chicago.     Eduardo Bhatia '86 ([email protected]) (Cell: 787.362.6100) • Eduardo Bhatia was born on May 16, 1964. Bhatia’s father, Dr. Mohinder Bhatia, was working as an economist at the US Embassy in El Salvador as part of President Kennedy's Alliance for Progress, a program to eradicate poverty. Bhatia's father moved to Puerto Rico from India in 1957. • Bhatia's mother, Dr. Carmen Gautier, was a political science professor at the University of Puerto Rico, one of the first Puerto Rican women to attend Wellesley College and the London School of Economics. • Eduardo Bhatia is the youngest of three siblings. His brother, Andrés Bhatia, is a practicing oncologist in Gainesville, Florida, and his sister, Lisa Bhatia, is an assistant U.S. attorney at the San Juan District office of the U.S. Attorney. • Bhatia attended Princeton University, obtaining his Bachelor's degree in Government and Public Policy from the Woodrow Wilson School of Public and International Affairs in 1986. During Bhatia's university years, he was a member of the Princeton University Democrats and the Princeton University Council. He was an activist in the student movement for divesting the University's endowment from companies doing business in the Apartheid regime in South Africa where Nelson Mandela was jailed. • In May 1986, Bhatia was awarded a Fulbright scholarship to study law, economics and politics in Santiago, Chile for one year. The focus of his research was the need for Chile to transition to a democratic regime where human rights were protected. At that time and during Pinochet's dictatorship, he secretly helped collect and transport pamphlets, flyers and underground documents from human rights groups to Princeton's Library, to help with the efforts to document the struggles in Latin America.
