Abstract Hampton Lawrence Carson was born on February 21, 1852, in Philadelphia to Joseph Carson (1808-1876) and Mary Hollingsworth (1813-1868). He married Anna Lea Baker (1854-1933) in 1880 and with her had five children. Hampton graduated from the University of Pennsylvania Law School in 1874 and taught there from 1895 to 1903. He was also a partner in several private laws firm and dealt primarily in estate law. In 1903 Governor Samuel W. Pennypacker appointed him attorney general of Pennsylvania, a post which was held until 1907. From 1919 to 1921 Carson was both president of the American Bar Association and chairman of a sub-committee of the Pennsylvania Commission on Constitutional Amendment and Revision. He was a member of several other law organizations throughout his lifetime, as well as several historical associations including the American Historical Association Endowment Fund and the Historical Society of Pennsylvania (HSP). He was HSP president from 1921 until his death in 1929. His interest in history is also reflected in his major published works, History of the Supreme Court of the and History of the Historical Society of Pennsylvania. Carson was also an avid collector of manuscripts, autographs, political cartoons, and portraits.

A diverse amount of materials related to the legal profession and to Carson’s many personal interests are contained in this collection. Legal practice correspondence and dockets extend from 1871 until 1941; beginning around 1920, however, the materials in this series increasingly pertain to the legal work of his son, Joseph Carson. Documents exist from Hampton Carson’s tenures as attorney general of Pennsylvania, as president of the American Bar Association, and as president of the Historical Society of Pennsylvania. His work with the 1887 Constitutional Centennial Commission and with the Pennsylvania Commission on Constitutional Amendment and Revision are also represented, as are his affiliations with many law and historical organizations. The nearly one thousand political cartoons in this collection, which were clipped from newspapers and span the years 1863-1904, primarily depict Governor Samuel W. Pennypacker, Senator Matthew S. Quay, and Senator Boies Penrose. Carson’s portrait collection of lawyers, judges, and statesmen contains images of well over one hundred notable men, and his letters and ephemera collection contains handwriting samples, newspaper clippings, and other materials related to many of the same men.

Background note Hampton Lawrence Carson was born February 21, 1852, in Philadelphia to Joseph Carson (1808-1876) and Mary Hollingsworth (1813-1868). Hampton had two siblings, Ann Catherine Carson (1853-1923) and Susan Carson (1855-1935). Their father was a graduate of the University of Pennsylvania Medical School, physician at Pennsylvania Hospital, and professor of materia medica (a predecessor of modern-day pharmacology) at the Philadelphia College of Pharmacy and also at the University of Pennsylvania. Exhibiting an interest in history and city intellectual life that would be shared by his son, Joseph Carson composed a history of the University of Pennsylvania’s medical department that was published in 1869 and was a member of the Philadelphia Medical Society, the Academy of Natural Sciences, and the American Philosophical Society.

Hampton graduated from the University of Pennsylvania in 1871 and from its Law School in 1874. He was a professor of law at his alma mater from 1895 to 1903 and later in life maintained ties with the institution by serving on its Board of Trustees. Carson was a partner in several private legal practices and primarily was involved in estate cases. His partners included Joseph F. Lamorelle, J. Levering Jones, John Kent Kane, Dimner Beeber, and later his son, Joseph Carson. Under the governorship of Samuel W. Pennypacker, Hampton was appointed attorney general of Pennsylvania from 1903 to 1907. From 1910 to 1913 Hampton was chancellor of the Law Association of Philadelphia; from 1913 to 1914 was president of the Pennsylvania Bar Association; and from 1919 to 1921 served as the president of the American Bar Association, the first two-term election in the organization’s history. He was also secretary of the 1887 Constitutional Centennial Commission and chairman of a sub-committee of the Pennsylvania Commission on Constitutional Amendment & Revision from 1919 to 1921. At the time of his death, Carson held the posts of president of the Historical Society of Pennsylvania, vice-president of the Board of Trustees of the Free Library of Philadelphia, and councillor of the American Philosophical Society.

During his lifetime, Hampton was a prolific orator and writer on historical and legal subjects. In 1891 his large work, History of the Supreme Court of the United States was published, and his two-volume History of the Historical Society of Pennsylvania was published posthumously in 1940. Hampton also was interested in the careers of Pennsylvania Governor Samuel W. Pennypacker (1843-1916) and prominent Philadelphia lawyer and art collector John Graver Johnson (1841-1917). After conducting his own research, Hampton delivered memorial addresses for these men, and initiated a committee to erect a memorial statue of Johnson. Additionally, Hampton was a great collector of manuscripts, portraits, letters, and political cartoons, much of which was donated to the Historical Society of Pennsylvania.

Hampton married Anna Lea Baker (1854-1933), daughter of John Remigius Baker and Anna Robeson Lea, on April 14, 1880, and with her had five children: Joseph (1883- 1953), Hope (1885-1980), John Baker (b. 1887), Lawrence (b. 1889), and Anna Hampton (1891-1976). Hampton Carson died in Philadelphia in 1929.

Scope & content A wide array of materials related to Hampton Carson’s occupations and interests are represented in this collection. Apart from legal practice correspondence and dockets, 1871-1941, documents exist from his tenures as attorney general of Pennsylvania, 1903- 1907, as president of the American Bar Association, 1919-1921, and as president of the Historical Society of Pennsylvania (HSP). While attorney general, Carson was criticized for his handling of the Capitol Investigation Commission in 1906, which probed into questionable spending during the construction of the capitol building. Materials related to this issue can be found in series 3. During his presidency of HSP Carson composed a comprehensive two-volume history of the organization, a draft of which can be found in Series 5d.

Carson’s work with the 1887 Constitutional Centennial Commission and with the Pennsylvania Commission on Constitutional Amendment and Revision, 1919-1921, are represented in Series 4. The materials from the latter commission provide valuable insight into the complexities of an undertaking as intricate as constitutional revision. Hampton also participated in many organizations, primarily those with a legal and/or historical focus; just a few of those represented in Series 6 and also interspersed in his personal correspondence in Series 7 include the Pennsylvania Legal Advisory Board, 1917-1918, the Pennsylvania War History Commission, 1914-1921, the Valley Forge Commission, 1919-1927, the American Philosophical Society, 1863-1927, and less abundantly, various Republican organizations. Hampton delivered memorial addresses for two of his distinguished colleagues, Governor Samuel W. Pennypacker and John G. Johnson, and his preparatory work, including correspondence with the colleagues of the men being memorialized, can be found respectively in Series 8 and 9.

Carson’s papers also contain a large amount of collected materials. These include letters, autographs, and ephemera (Series 11a) related to various notable men in legal, political, and military professions from the 18th through 20th centuries. Thomas McKean, signer of the Declaration of Independence and former governor of Pennsylvania, is best represented here. The portrait collection in Series 11b contains images of many of the same men represented in Series 11a. Incoming letters regarding Carson’s collections are contained in his personal correspondence in Series 7. The nearly one thousand political cartoons in Series 11c primarily depict Governor Samuel W. Pennypacker and to a lesser extent, former Pennsylvania senators Boies Penrose and Matthew S. Quay. The political cartoons, dating to Carson’s tenure as attorney general, provide a vast array of commentary on the careers of these figures and on the issues and controversies in which they were involved.

The legal work of Joseph Carson, Hampton’s son, is represented in the legal practice correspondence (Series 1) beginning in roughly 1920. Joseph joined his father’s firm around this time and his correspondence becomes the bulk of this series in its later years. Series 2b also contains materials from a 1924 American Bar Association trip to London in which Joseph participated. Carson’s other partners in his legal practice, namely Joseph F. Lamorelle, J. Levering Jones, John Kent Kane, and Dimner Beeber, are also represented to some extent in the legal practice correspondence in Series 1.

Series description

Series 1. Legal practice, 1871-1941, n.d. (Boxes 1-7, vols. 1-3) The documents in this series primarily consist of incoming letters to Carson from clients and other Philadelphia lawyers regarding various estate cases in which he served as council; a small number of divorce and liability cases are also represented. Most of the letters do one or more of the following: acknowledge receipt of communication from Carson, discuss details of a case, request a meeting time or certain documents relevant to a case, indicate that settlement was agreed upon or not agreed upon, or thank Carson for his assistance and signify payment. Correspondence in this subseries does not create a complete picture of the legal proceedings for most of the cases represented, although in many of the cases it is 4 The Historical Society of Pennsylvania

possible to discern a fair amount of the details and the outcome. A smaller portion of the incoming correspondence consists of requests for recommendations by Carson and introductions by lawyers for other lawyers.

Some incoming letters are addressed to other members of his firm and others are addressed to lawyers from different firms. Beginning around 1920, the amount of incoming correspondence decreases with an increasing number of those letters addressed to Joseph Carson, Hampton’s son, who joined the firm around that time and who continued to work there after his father’s death. The last piece of private practice correspondence in this series is dated from 1941, over a decade after Hampton’s death.

A significantly smaller amount of outgoing letters exists in this subseries, which are mostly from Hampton, though a few are from Joseph Carson and Joseph Lamorelle, a partner in the firm.

In this series there are also two dockets that document cases during the periods of 1874 to 1883 and 1879 to 1890, as well as a cashbook from 1890 to 1893 that is arranged by person with charges for legal services rendered to them on one page and credits listed on the opposite page.

Series 2. American Bar Association, 1915-1936, n.d. (Boxes 7-12) a. Correspondence, 1915-1931. The incoming and outgoing correspondence in this subseries details a range of Carson’s American Bar Association (ABA) activities, primarily from his terms first as treasurer of the organization and then as ABA president from 1919 to 1921. He was the first individual to hold the post of ABA president for two consecutive terms. The bulk of the series is comprised of letters of congratulations for his election to the presidency as well as for speeches he delivered to the ABA, RSVPs for ABA events, suggestions for future events, and correspondence regarding membership. Resolutions of the executive committee and minutes of a few ABA meetings are included with some correspondence. Present in smaller quantity are requests calling on Carson’s knowledge of constitutional history and for his professional advice on matters of legal ethics, as in an August 1920 letter from Kentucky which explains the case of Governor Edwin P. Morrow, who was criticized for appearing as counsel while still governor for a case in which he had become involved before the governorship.

b. Trip to London, 1924, n.d.. This subseries includes some correspondence and a larger quantity of printed materials from a 1924 visit to London made by Joseph Carson and other members of the ABA. The invited ABA members were guests of the British Bar, London Law Society, and Canadian Bar Association. A decorative blue souvenir pamphlet of the Cunard liner on which they sailed contains a list of those ABA members and their spouses who participated in the voyage. Included with the rest of the printed materials are programs of events, guides for several tourist sites like the Royal 5 The Historical Society of Pennsylvania

Botanic Gardens, two postcard series including one of Sulgrave Manor, a map of London and of the Underground, pamphlets related to the ship on which they sailed, and printed invitations and calling cards. There is also a small cache of London newspapers collected by Carson during the trip.

c. Miscellaneous, 1880-1936, n.d. Printed materials comprise the bulk of this subseries and they consist mainly of committee reports and programs for ABA conferences. There are also some brief un-authored articles on topics addressed by the ABA, like the systematic restatement of the law and the re-adoption of the nation’s constitution. There is also a copy of the December 1923 American Bar Association Journal.

The folder titled “miscellaneous” contains a blank membership card, printed materials from receptions, several reports including “Suggestions as to action which should be taken at the American Bar Association, at Cleveland,” and several law- related news clippings from the years 1919 to 1924. “Report on a League of Nations” is a pamphlet produced by a special committee of the ABA in an unknown year that is addressed to the president and members of the executive committee of the ABA. It pledges the United States’ commitment to join the League of Nations and outlines provisions for this organization.

One folder contains a published catalog and copies of an earlier draft of English-law related collections donated by Hampton to the Historical Society of Pennsylvania, printed for an ABA meeting held in Philadelphia in 1924.

There are also two folders that contain small Philadelphia Trust Company account books with entries ranging from 1880 to 1921, though the majority of these entries fall within the years 1915 to 1916. These account books document small charges for items like postage and invitations and are most likely from Caron’s time as ABA treasurer.

Series 3. Attorney General of Pennsylvania, 1902-1921, n.d. (Boxes 13-18, vols. 4- 12) The bulk of this series consists either of grateful letters addressed to Hampton Carson for sending copies of his published official opinions as attorney general or of incoming and outgoing correspondence regarding the backlash of Carson’s 1906 Capitol Investigation Commission. Hampton initiated a probe into the construction costs of the state capitol building in Harrisburg and was attacked for the manner in which he did this in an article by Owen Wister in a publication entitled Everybody’s Magazine. In a seventeen-page letter to Mr. Wister, Hampton thoroughly presented his case as to why the article was incorrect. As summarized on the first page of the letter to Mr. Wister, “you have misconceived the nature of my duties; you have omitted material facts; you have misdescribed my manner of performance; you have perverted testimony; you have mutilated quotations so as to give them a false meaning; and you have assumed that I had things called to my attention of which I had not the slightest knowledge.” There are also two folders of news clippings related to the capitol investigation. delivered during his term and a small amount of incoming correspondence concerns legal issues in which Carson was engaged as attorney general, including a judge’s salary bill, a Susquehanna Iron Company controversy, and a case involving allegations against the Company regarding unpaid capital stock taxes.

Several scrapbooks contain newspaper clippings pertinent to his term as attorney general and one contains congratulatory letters received upon his appointment.

Series 4. Pennsylvania Commission on Constitutional Amendment and Revision, 1919-1921, n.d. (Boxes 19-20) Carson served as chairman of a sub-committee of the Constitutional Amendment Commission, which was established to revise the Pennsylvania constitution. The four folders of incoming correspondence in this series contain communications regarding the committee’s meeting times and comments by various Pennsylvania lawyers on proposals to constitutional articles, including squabbles over word usage and style. Letters were also received from people not directly affiliated with the committee, as evidenced by a seven-page May 1920 letter from environmentalist who explained why the topic of renewable energy should be addressed in the state’s constitution.

The second grouping of materials in this series—four folders of notes, drafts, and memoranda—consists of typed reports of the committee, Carson’s own notes, various drafts of the constitution, incoming letters to William Draper Lewis, the committee’s secretary, Carson’s expense reports for his trips to Harrisburg, and small slips of paper with typed amendment suggestions.

The printed materials consist mainly of reports of the proceedings, a preliminary draft of the constitution printed in February 1920, and four small pamphlets printed by the Citizens’ Business Bureau of Municipal Research that contain constitutional comments on topics such as “A budget system for PA,” “Metropolitan Areas,” “State Aid,” and “Grandfather’s Old Clothes,” a brief treatise on the difficulty of committing to writing a constitution for an ever-changing nation.

Series 5. Historical Society of Pennsylvania, 1898-1931, n.d. (Boxes 20-26) a. Correspondence, 1898-1929, n.d. Within the Historical Society of Pennsylvania (HSP), Carson held the posts of recording secretary from 1893 to 1903, vice president from 1903 to 1921, and then president from 1921 until his death in 1929. A large portion of this subseries consists of incoming and outgoing correspondence regarding Society membership. Letters from Carson extend the invitation and letters to him either acknowledge acceptance or decline. There are also lists of people (with addresses) to be approached for membership and some statements of the amount of money collected through membership dues. Other correspondence concerns trust funds and legacies of which HSP was the beneficiary, collection materials, and addresses either made by Hampton or solicited by HSP.

Internal correspondence consists of Hampton’s communications with HSP head librarians and some with an HSP treasurer. There is a fair amount of correspondence (internal and external) in 1921 regarding the choice of a successor to late HSP head librarian, John W. Jordan. Thomas L. Montgomery was selected.

b. Financial, 1892-1928. This subseries consists of financial reports, including a 1919 audit report and the 1925 HSP budget, annual expense reports, Girard Trust Company statements, and documents concerning HSP endowments, in particular endowments from the Simon Gratz, Anna J. Magee, Craig T. Ritchie, and William Brooke Rawle estates. HSP trust fund information is also contained in the correspondence in subseries a.

c. Draft of history, n.d. A complete type written draft with corrections of Hampton’s two-volume history of the Historical Society of Pennsylvania is contained in the folders in this subseries. This manuscript was published posthumously in 1940.

d. Miscellaneous, 1903-1931, n.d. The printed materials in this subseries are the organization’s 1903 Charters & By- Laws, invitations to HSP events, and newspaper clippings on HSP-related topics, such as the appointment of new librarian Thomas L. Montgomery.

The rest of the materials include information on a collection of silhouettes donated by Hampton to HSP in 1929, an undated report on paper-based documents held at Cliveden, a speech made during the HSP centenary, miscellaneous hand-written notes, and copies of documents from legal proceedings that involved HSP.

A catalog of English law-related materials donated to HSP by Hampton, as well as copies of a draft of this catalog, exist in Series 2c.

Series 6. Organizations & affiliations, 1863-1930, n.d. (Boxes 26-27, vols. 13-14) The organizations and affiliations represented in this series each contain five folders of material or less, and are mostly either legal or historically related. The materials are a mixture of correspondence, printed materials, and memoranda. The legal- related organizations and affiliations include the Pennsylvania Legal Advisory Board (1917-1918), Law Association of Philadelphia (1930), the Report Committee on Legal Biography (1899), and the Relief Committee of the Philadelphia Bar (1892). There is also one folder of incoming correspondence pertaining to the Constitutional Centennial Commission in 1887. As Carson was the secretary of this commission, the materials in this folder consist exclusively of letters that express that the person has accepted or will decline the invitation to attend the events in Philadelphia in that year.

The historical organizations represented in this series include the Pennsylvania War History Commission (1914-1921), the American Historical Association Endowment Fund (1926-1927), and the Valley Forge Commission (1919-1927). Some 8 The Historical Society of Pennsylvania

correspondence, a land ordinance, and printed materials also exist (1863-1927) for the American Philosophical Society. A miscellaneous array of other organizations, including the Wistar Party, the Gimbel Brothers Foundation, and the Johnstown Relief Fund are also represented in this series, with materials spanning the years 1889 to 1928.

Personal correspondence in series 7 also contains materials pertinent to organizations and Carson’s affiliations.

Series 7. Personal correspondence, 1874-1929, n.d. (Boxes 28-30) The two boxes of incoming letters contained in the personal correspondence series are mainly from other lawyers. The letters primarily thank Carson for addresses he delivered, request that he consider delivering an address, communicate details about meetings for various legal and political organizations, or contain information about autographs and images Carson requested.

Series 8. Samuel W. Pennypacker, 1877-1921, n.d. (Boxes 30-31) Incoming letters in this series consist of requests to Hampton for addresses or articles on former Pennsylvania governor Samuel Whitaker Pennypackers, thank- yous for Carson’s addresses or articles, or letters from Pennypacker’s colleagues that state various details of the former governor’s life. There is also some correspondence regarding the sale of materials from the Pennypacker estate.

Drafts and final versions of addresses presented before the Philobiblon Club in 1916 and the Historical Society of Pennsylvania in 1917, as well as typed & hand-written notes on Pennypacker’s life also exist in this series.

The printed materials in this series include an 1877 pamphlet from an event called “The Pennypacker Reunion,” a 1903 inaugural address by Pennypacker, articles about Pennypacker, newspaper clippings from during his lifetime and after his death, an auction catalog from the Pennypacker estate sale, and an invitation to Hampton’s 1916 Pennypacker memorial address before the Philobiblon Club.

The miscellaneous folder contains memoranda, typed copies of letters to and from Pennypacker, a copy of an 1891 speech by Pennypacker before the New England Society of Pennsylvania, and an undated list of the public libraries in Pennsylvania that contained over 10,000 volumes.

A small number of letters from Samuel Pennypacker to Carson are included in the personal correspondence in series 7.

Series 9. John G. Johnson, 1917-1928, n.d. (Box 31) John G. Johnson was a prominent Philadelphia lawyer and art collector. Correspondence in this series consists of two main types: letters from John G. Johnson’s associates that include details on his life and practice that were requested in preparation for a memorial speech Carson delivered before the Pennsylvania Bar

Association and correspondence with Philadelphia lawyers regarding the feasibility and details of erecting a statue in Johnson’s honor.

In the miscellaneous folder there is a copy of the minutes from a June 1927 committee meeting which assembled to discuss the memorial statue, notes for what may have been Carson’s speech on Johnson, an April 1917 copy of the minutes from a meeting of the Pennsylvania Railroad Company that held special council upon Johnson’s death, and miscellaneous printed items and news clippings.

A small number of letters from John G. Johnson to Carson are included in the personal correspondence in series 7.

Series 10. Miscellaneous, 1767-1933, n.d. (Boxes 32-39, vols. 15-19) a. Legal, 1863-1933, n.d. The materials in this subseries primarily concern various legal issues and cases involving Carson that had nothing to do with his private practice, including the Henkels case, in which an auctioneer was sued by state of New Hampshire for ownership of materials he attempted to sell. Also included are papers concerning the controversy surrounding Judge Landis, who was reprimanded by Hampton for accepting a position as baseball commissioner while still a judge, memorials for various lawyers, and visits by various legal-related groups or persons. There are several folders of correspondence related to the Mellon plan for taxation reduction, recommended in 1923 by Secretary of the Treasury Andrew W. Mellon for the purposes of reducing internal revenue taxation, which Carson favored and lobbied several Pennsylvania senators to do the same. Several folder relate to the appointment of Joseph Lamorelle, a former partner of Carson’s, to the judgeship in the Orphans’ Court. One folder of miscellaneous materials primarily contains official court documents and two boxes contain small printed legal directories from 1909 to 1928.

b. Printed materials, 1873-1927, n.d. The bulk of this subseries consists of ornate invitations to various legal-related events and pamphlets collected on various legal and historical topics. There is also one small folder of materials related to the re-election of George Wharton Pepper to the U.S. Senate.

c. Miscellaneous, 1767-1922, n.d. A hand-written text by an unidentified author with notes entitled “Suggestions towards a critical appreciation of the Washington portraits,” a folder of miscellaneous writings and speeches, and a play by Edgar S. Materials in this subseries consist of letters, signatures, newspaper clippings, and printed invitations pertaining to many lawyers, military figures, and statesmen. 10 The Historical Society of Pennsylvania

Materials for each individual are contained in separate folders that are listed alphabetically. Thomas McKean, former governor of Pennsylvania, has more materials than any other individual in this subseries.

b. Portraits, n.d. The images in this subseries are for many of the same notable men featured in subseries 11a. Images consist primarily of reproduced etchings, drawings, portraits, and photographs. Almost every folder contains images for several individuals, arranged alphabetically. Caspar Wistar and are best represented in this subseries.

c. Political cartoons, n.d. [ca. 1902-1907]. The nearly one thousand political cartoons in this subseries were taken from unknown newspapers. Many political topics and individuals are featured throughout. Most of the cartoons present a criticism or mockery of the figure(s) represented. Samuel Pennypacker, Pennsylvania’s governor from 1903 to 1907, is represented most often in this subseries, and is often shown holding a muzzle intended for the press. When depicted alongside “cousin Matt” Quay, who is also well represented in this subseries, Pennypacker is often dwarfed by the senator or drawn holding the senator’s hand. One cartoon depicts Pennypacker as a shield being brought into the executive mansion by Quay. Behind the shield is a mob of looters who exclaim “This may protect us until we get in [to state offices]!” Senator Quay is routinely depicted engaging in illicit activities and the cartoons link him to campaign fraud, bribery of legislators, treasury looting, and the protection criminals.

Series 12. Artifacts, 1924, n.d. (Box 62) This series consists of two pins and a medallion commemorating the 1924 American Bar Association trip to London, in which Joseph Carson participated, as well as a luggage tag for the Cunard Line vessel which brought the group from New York to England. There are also two nametags with ribbons for the Law Association of Philadelphia Committee; “Joseph Carson, Esq.” is printed on one nametag and the other is blank. One small additional pin advertises Wilkie for president.
