INTRODUCTION “Brazil today lives out another page of hope in its history.” 1 - Anonymous, BRAZIL : NEVER AGAIN (Archdiocese of São Paulo, 1985). Brazil today is an outlier in Latin America. Over 25 years after its transition to democracy, it has not held military dictatorship-era (1964-1985) human rights violators criminally accountable for the grave abuses they perpetrated. The Amnesty Law ( Lei de Anistía ), enacted in 1979, has thus far dissuaded the prosecution of crimes perpetrated by agents of the Brazilian dictatorship, while other questions regarding accountability—such as statutes of limitations—also loom large in legal debates on transitional justice domestically. To date, this impunity has shrouded dictatorship crimes in Brazil and constituted a violation of well- established international law. Despite this overall

THE SOCIAL FUNCTION OF PROPERTY IN BRAZILIAN LAW Alexandre dos Santos Cunha* INTRODUCTION The idea that rights serve a social function was first introduced into Brazilian legal culture about a century ago. Although the concept is historically linked to the French scholar Léon Duguit, the Brazilian version is distinct and does not share these French origins. Twentieth-century Italian jurists Pietro Cogliolo and Enrico Cimbali, who both exerted overwhelming influence over the so-called “Renovators” of Brazilian Private Law, are primarily responsible for Brazil’s version.1 Unlike Duguit, Cogliolo and Cimbali construed the concept of a social function as a justification for imposing only external limits on the exercise of rights.2 Consequently, Brazilian courts have never considered Duguit’s understanding of the social function of property as a source of internal limitations. The concept of the social function of rights first appeared in the Brazilian Constitution in 1934, and has become considerably stronger since the country adopted a new Civil Code in 2002.

Resumo: Este artigo identifica e examina alguns problemas de uma aplicação inconsistente (talvez estratégica) do texto constitucional como mecanismo de justificação de decisões entre constituciona- listas brasileiros e na prática decisória do Supremo Tribunal Federal. Após diferenciar versões caricatas de formalismo de versões efetivamente defendidas por autores que se declaram formalistas, este trabalho explora uma possível defesa estratégica do textualismo por autores do constitucionalismo brasileiro da efetividade e apresenta exemplos de aplicação oscilante do texto constitucional em casos envolvendo a delimitação de poderes do Supremo e a concretização de direitos fundamentais por seus ministros. Neste sentido, uma marca indelével dessa diferenciação é de que seus partícipes devem constituir um discreto grupo com um papel bem definido no sistema político (EISENSTADT apud MCGUIRE, 2004, p. 130). Por certo, uma forma comum de aferição desse pressuposto teórico reside na extensão de como os membros de determinada instituição judicial são recrutados diante de uma gama infinita de pessoas versadas no conhecimento do Direito a ser aplicado aos casos julgados, permitindo ao observador moldar certo perfil institucional de um organismo colegiado. Pensando em Cortes Constitucionais, o resultado não é diferente. Diante de sua natureza mista, no sentido de que seus membros exercem uma função dúplice, na perspectiva de serem guardiões dos textos legais e ao mesmo tempo constituírem o gargalo de disputas acerca de políticas nacionais, a atenção prestada pelo estudioso na forma em que se recrutam esses agentes reforça a preocupação de como organicamente se molda a Câmara mais alta da Corte de Justiça de um país.

    January 22, 2010 Dear BSH Supporters, In June, 2009, Judge Pinto ruled for the immediate return of Sean to his father, David Goldman. This ruling was then confirmed by an appellate ruling. From this, came a firestorm of legal maneuvering. Ultimately, the Chief Justice of the Federal Supreme Court of Brazil (STF), Gilmar Mendes, took it upon himself to rule on the merits of the numerous forms of legal relief sought by both parties. Beyond the first few pages, both of Justice Mendes' rulings are identical. As such, we chose to include both as part of one packet of translated documents. As we translated the documents, we took great pains to reproduce Judge Mendes' intentions through the use of bold, italics, and underlining. Throughout the rulings, we chose to retain the original Latin terminology as well as the original Portuguese when there was no direct translation into English. In each instance, we included a thorough definition on the following pages. These translations err on the side of fidelity to the original text.
