120 Introduction

1. The Parish/ Town Council(s) of Doncaster and the Doncaster Metropolitan Borough Council (DMBC) have agreed to publish a charter, which sets out how they aim to work together for the benefit of local people. This Charter is the result of discussions locally to establish a new way of working and to confirm existing good practice.

2. DMBC acknowledges that parish and town councils are the grass-roots level of local government. By working with them, DMBC aims to act in partnership with local communities, while balancing the needs of the wider community.

3. In their role as democratically accountable bodies, Parish and Town councils offer a means of shaping the decisions that affect their communities. They offer a means of decentralising the provision of certain services and of revitalising local communities. In turn, the parish or town council’s recognise the strategic role of DMBC and the equitable distribution of services, which it has to achieve.

4. This Charter reflects the increasing importance attached by Central Government (As prescribed in the Government White Paper) to partnership working and the development of Quality status for parish and town councils. DMBC will positively encourage and support those Parish and Town Councils that wish to strive for Quality Status, and those communities that wish to create Parish and Town Councils.

5. Parish and Town Councils signed up to the Charter are committed to supporting DMBC through the Comprehensive Performance Assessment.

6. The Charter is a flexible and an adaptable document, so as to keep pace with changing circumstances and arrangements for local government. The minimum of an annual review and regular meetings of the Charter Working Group will achieve this. Any concerns regarding the implementation of the document will be directed to the relevant Cabinet Portfolio Holder to ensure the issues are raised at the meetings of the Charter Working Group.

Sustainability

7. DMBC will work in partnership with all Parish and Town councils in its area to promote sustainable social, economic and environmental development for the benefit of local communities.

Community strategies

8. DMBC will involve Parish and Town councils in the processes of preparing and implementing the community strategy to promote or improve the economic, social and environmental well being of the area, and the role, which Parish and Town councils should take. DMBC will consult and involve Parish and Town councils accordingly about the content and direction of the community strategy as it affects the local communities they represent.

Local governance

9. DMBC will hold liaison meetings with representatives of all Parish and Town councils that wish to take part. This is currently achieved via the Parish Council Joint Consultative Committee, and any working group assigned by this Committee. The meetings of the PCJCC are to be held 4 times a year.

10. Parish and Town councils will invite representatives (members and/or officers) of DMBC to meetings where deemed appropriate. DMBC Members will be encouraged to take an active involvement in Parish and Town Council Matters.

11. DMBC will administer the holding of parish and town council elections. The respective authorities will work together to limit the costs of holding such elections.

12. Where a Parish or Town Council (or Group of Parish and Town Councils) has prepared a Parish plan, DMBC will take account of its proposals and priorities. DMBC will work to strengthen the links between these Parish and Town Councils and the local strategic partnership (Discover the Spirit) in order to improve the delivery of local priorities.

Consultation

13. DMBC will aim where appropriate, to give parish and town councils in a timely manner, the opportunity to comment before making a decision, which affects the local community. In furtherance of this, DMBC will circulate a list of its public reports to committees and subcommittees to parish clerks at the same time as they are sent to members of DMBC. Parish and Town councils can request a copy of any public report and are encouraged to comment directly to members of DMBC.

To help achieve the objectives laid down in this Charter, liaison and consultation (both formal and informal) will be further developed at Parish and Town council level through regular meetings or specific service consultative groups and, at officer level, individually or through working parties and groups.

15. Parish and Town councils will send copies of their agendas and papers to DMBC and to councillors for their area upon request.

16. DMBC supports the Parish and Town Council liaison function; an Officer will be nominated from Doncaster Council’s Neighbourhoods, Safer, Stronger and Sustainable Communities Policy Team to act as the responsible officer for this duty.

Information

17. When DMBC consults Parish and Town councils, it will provide them with sufficient information to enable them to reach an informed view on the matter, and give them adequate time to respond in accordance with the statutory requirements where applicable.

18. DMBC will communicate with parish and town councils and others in the community by publishing Doncaster News regularly and making it available to the local community. It will also keep Parish and Town councils informed by sending them copies of other relevant newsletters/local promotional material.

19. DMBC and Parish/ Town Councils are committed to Customer Care, and excellence in Customer Service, all parties will respond to enquiries prompt and professionally. In regards to responding to correspondence received, both parties will send a full substantive reply or an acknowledgement within 10 working days. If an acknowledgment is sent, the full substantive reply will be sent within 20 working days, or a time frame agreed by all parties. In the unlikely event that correspondence is not responded to, an appeal can be presented to the nominated Officer from Doncaster Council’s Neighbourhoods, Safer, Stronger and Sustainable Communities Policy Team and if still unresolved to the Corporate Director of Customer Services who will investigate this matter fully.

20. DMBC in discussion with the YLCA are committed to providing appropriate training to its Elected Members and Officers about the roles and functions of Parish and Town Councils.

Standards committee

22. Both DMBC and the Parish and Town councils have adopted codes of conduct, based on the national model code of conduct. The Parish and Town councils will work with DMBC’s Standards Committee and the Standards (Parish Council) Sub- Committee to promote and maintain high standards of conduct. The Committees will meet 4 times yearly. The Standards Committee is made up of Independent Members

123 and Elected Councillors. The Standards (Parish Council) Sub-Committee is made up of Parish Councillors and two Independent Members.

23. The Independent Members have the majority of seats on the Standards Committee, and come from a range of varying backgrounds within local communities across the Borough of Doncaster. Whenever the Standards Committee considers a matter relating to Parish Councillors the Parish Council representative must be present.

Delegating responsibility for service provision

24. If a Parish or Town council (or group of Parish and Town Councils) wishes to take on shared responsibility for Service Delivery, DMBC will consider this, where it is best value (taking account of cost, quality, local preferences and practicability). Where it is not best value or practicable DMBC will, in consultation with the Parish or Town council, explore alternative solutions to encourage more local-level input into service delivery.

Financial arrangements

25. DMBC has set out its financial arrangements for parish and town councils at Appendix 1 in accordance with the principles and good practice guidance [financial principles as set out in the accompanying document 'Guidance on Financial Arrangements with Parish and Town Councils'].

26. Where a parish or town council takes on the provision of certain services, the level of funding will be agreed by DMBC.

Local community life

27. In consultation with Parish/ Town Councils, DMBC will promote local community life through a wide range of initiatives, for example capital grants and loan schemes to village halls, community centres, and other similar organisations.

Practical support

28. DMBC will, where practical, offer parish and town councils access to their own support services, to enable them to take advantage of facilities such as printing, purchasing, IT Support, etc, at a mutually agreed price. In particular, assistance will be offered in identifying and helping to meet the training needs of parish and town councils (for example, through County Training Partnerships).

124 Appendix 1

The financial arrangements between Doncaster Metropolitan Borough Council and the Parish and Town Council will be based on the current government guidance, including - The Quality Parish and Town Council Scheme (June 2003) and Guidance from central government on avoiding double taxation.

The return of the Parish Precept information to Financial Services should be undertaken in a timely manner as issued by the Corporate Director of Financial Services.

Whole Service Transfers

Proposals for service transfer may be based on all of a service within the Borough, or all of the service within a Parish area. Where it is proposed that a whole service is to be transferred to the Parish and Town Council community in Doncaster, all of the direct costs will be raised by DMBC. Any contractual implications arising from the transfer will need to be considered fully and resolved prior to the service being transferred. This could result in a reduction of the Parish Precept to avoid any double taxation.

Transfers to a Parish

Where there is a proposal for a transfer of a service to a Parish, provided the transfer meets the requirements as set out in the Charter, it will be supported financially by the relevant direct costs for that service being transferred as a grant, providing it will not have a detrimental financial impact on service provision across the Borough. The Councils party to this Charter will consider the transfer of additional associated costs. Any contractual implications arising from the transfer will need to be fully considered and resolved before the service is transferred.

Principles

The principle of the service transfer and the associated financial impact will be subject to Member approval at the appropriate level.

Double Taxation

The Council’s party to this Charter will make every effort to avoid double taxation, through negotiation and consultation and having regard to the government’s guidance. As a general rule all the components of a service in that particular parish area will be transferred simultaneously.
