BBC Radio Solent Christmas Story Competition 2018

Terms and Conditions

1. The competition is open to persons who will be aged between 5 and 16 years (inclusive) on the 29th November 2018 who are full time residents of , or the . The children of BBC or BBC Group company employees, or those of anyone connected with the competition cannot enter the competition. Proof of age, identity and eligibility may be required.

2. The competition will open on 29 October 2018 at 07:00. All entries will need to have been submitted by 19:00 on 18 November 2018. Entries outside of the period will not count so please do not wait until the last minute to upload your entry.

3. Entrants must write a fictional short story (no more than 350 words in length). Entry is via an online entry form available at https://www.bbc.co.uk/radiosolent. No other method of entry will be accepted. Entrants will be asked to provide their name, email address, a contact number and their age. They must enter the story in the text box provided for submission. All stories should be submitted in English. We can only accept stories which are 350 words or under according to the word counter on the online submission form; the BBC cannot accept word counts from any other software. Please make sure you check the word count on our form if you are pasting from another piece of software.

4. Entrants can only enter individually. Only one entry per person is permitted and the story must be wholly written by the entrant only; stories cannot be written by more than one person. If more than one entry is submitted, only the entrant's first submission will be considered.

5. As the stories will be broadcast it is important that entrants do not include any personal details about themselves. The entrant must not include their name in the title or body of the story; entries which do contain this information may be removed from the competition.

6. Entries cannot be returned so please remember to retain a copy. Unsuccessful entrants will be contacted in respect of their entry but no feedback on any entry will be provided.

7. An adult will be required to approve the entry and agree to these Terms and Conditions (including the BBC’s use of the story submitted and the fictional nature of the story) on behalf of the entrant, by way of a check-box in the online form. The adult may be the child’s parent or guardian. The adult must provide their own contact and personal details (not the child’s).

8. Entries will be judged on the following criteria:

- Originality - Creativity - The spirit of Christmas - Local interest - Enjoyment

9. Entrants will be judged by BBC Radio Solent’s managing editor, weekday mid- morning and Sunday breakfast presenters.

10. The Top 4 winning entrants will be read out as part of BBC Radio Solent’s Carol Concert recording on the 9th of December in Chandlers Fords. The 4 winning entrants will receive 4 tickets to the recording. The BBC cannot pay for the travel and accommodation of winners to the recording. For the avoidance of doubt the prize as described here does not contain any other fees, expenses or costs.

11. The prize is stated as above. There is no cash alternative and the prize cannot be sold or transferred in any circumstances.

12. The BBC's decision as to entrants taking part and winner is final. No correspondence relating to the competition will be entered into.

13. All entries must be the original work of the entrant and must not infringe the rights of any other party. The BBC accepts no responsibility if entrants ignore these Terms and Conditions and entrants agree to indemnify the BBC against any claim by any third party from any breach of these Terms and Conditions.

14. Entries must not contain defamatory, obscene, offensive, or any other unsuitable material. Entries must be suitable to be broadcast, published or used online by the BBC for audiences of all ages. Please see the BBC Editorial Guidelines for further information. If the story has troubling content the BBC may if required take advice from the NSPCC, and may refer the troubling content to the relevant authorities in accordance with the BBC Child Protection and Safeguarding Policy.

15. Entrants retain the copyright in their original submissions but grant to the BBC a perpetual non-exclusive royalty-free licence to broadcast their entry across all media, use it on any online platform as part of any BBC programme or service and in exploitation of such programme or service. This licence will be deemed to include all the necessary rights and permissions to enable such use by the BBC, to fulfil the prize and to complete the administration of this competition. For the avoidance of doubt, no fees or expenses will be paid for the creation of any part of the entry.

16. Entrants permit the BBC to edit or change entries in any way it may, in its sole discretion, consider necessary for the purposes of use in the competition.

17. This competition is conducted in line with the BBC's Code of Conduct for Competitions and Votes, which can be found on https://www.bbc.co.uk/editorialguidelines/guidelines/appendix2.

18. The BBC reserves the right to: (i) amend these terms and conditions and vary the competition rules including but not limited to the opening and closing times; (ii) disqualify any entrant who breaches the rules, displays rude, insulting or inappropriate behaviour at any point (including prize fulfilment) or has acted fraudulently in any way or; (iii) cancel the competition, at any stage, if in its opinion it is deemed necessary or if circumstances arise outside its control.

19. The BBC, its sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure, loss of data via use of a third party email platform or malfunction or any other problem which may result in any loss of data before it is received by the BBC, its sub-contractors, subsidiaries and/or agencies, or any entry being lost or not properly registered before it is received by the BBC, its sub-contractors, subsidiaries and/or agencies.

20. Entrants will be deemed to have accepted these rules and to agree to be bound by them when registering.

21. The competition is run by the BBC. The applicable law is that of England and Wales.

Privacy Notice

The BBC is committed to keeping your personal data and that of your family secure. The BBC is the data controller of your data.

The BBC will process the personal information that you provide to us about yourself and your children by submitting your application including entrant’s name, contact number, email address and county of residence and the parent or guardian’s contact number and email address. We will only use your data for the purposes of the competition.

We rely on your consent to process your / your child’s personal information. You may withdraw your consent at any time (unless your application is successful) by contacting us using the email address below. If your child is shortlisted, we will follow up with you to ensure that you would still like your child’s application to proceed.

Our online application system is hosted by a third party supplier, Monterosa.

If you are unsuccessful, the BBC will delete your data once the competition is closed. We will store the personal information of shortlisted candidates for a period of 2 months. Winners’ personal information will be stored for a period of 2 years for regulatory purposes. The names of the winning and shortlisted entrants will be made public.
