I. LAWS & REGULATIONS UPDATE AGRICULTURE f Prakas Nº 445 (MEF) of October 9, 2008 on The Service Fees for Inspection of Animal Sanitation and Products Derived from Animals (Ogs, Year 08, N0 77, October 19, 2008): Natural person or legal entity asking for the inspection of animal sanitation and products derived from animals for their goods shall pay service fees on it. The service fees on the inspection of animal sanitation and products derived from animals shall be divided as follows: - Service fee for circulation in the country; - Service fee for import and import circulations; and - Service fee for circulation across the country. The service fees for the inspection of animal sanitation and products derived from animals shall be regulated in the list of annex attached to this Prakas. The list of annex shall be modified if necessary. The service fees for the inspection of animal sanitation and products derived from animals shall be paid to the national budget. Goods items and service fee levels of inspection of animal sanitation and products derived from animals may be added or modified if necessary.

CIVIL LAW & PROCEDURES f Sub-Decree Nº 157 (RGC) of October 13, 2008 on Khmer Nationality Identity Cards (Ogs, Year 08, N0 76, October 15, 2008): Article 1 of Sub-Decree No. 60 dated June 12, 2007 on the Khmer Nationality Identity Cards as referenced to in the attached annex shall be modified under this present Sub-Decree. The Khmer nationality identity cards provided by the contents of Sub-Decree No. 60 dated June 12, 2007 shall be still in force.

CUSTOMS & IMPORT-EXPORT f Prakas Nº 928 (MEF) of October 2, 2008 on The Temporary Export under the Temporary Admission Regime (Ogs, Year 08, N0 75, October 12, 2008): Imported goods may be authorized by the Customs Administration to be temporarily imported under the admission regime if the importer can show that the goods shall be exported. The temporary import shall be under the control of customs until other conditions under the customs regime are completed in accordance with Article 15 of the Law on Customs.

The temporary admissions of imported goods are Customs procedures for authorizing the goods to be imported into Customs territory under the

conditions of tax-free payment or partial tax payment. The goods shall be imported for the purpose of clearance, and shall be exported within a specific time and shall not be recycled or changed, except for simple reduction by means of use. Other detailed procedures related to the temporary import of goods under the temporary admission regime are found in this Prakas.

INVESTMENT f Sub-Decree Nº 149 (RGC) of October 3, 2008 on The Organization and Functioning of the Council for the Development of (Ogs, Year 08, N0 73, October 8, 2008): The Council for the Development of Cambodia [CDC] is comprised of 23 members led by Samdech Akka Moha Sena Padei Techo Hun Sen, Prime Minister of the Kingdom of Cambodia.

The CDC shall be the executive agency of the Royal Government and shall have the following responsibilities:

- To be the supporting staffs and one-stop-service of the Royal Government responsible for the rehabilitation, development, public investment, private investment, and establishment and management of special economic zones; - To guide the preparation and the conception of development strategies for Cambodia in cooperation with the relevant institutions; - To establish relations with countries, bilateral/multilateral international organizations and NGOs in order to make them aware of economic strategic conceptions and other priorities of the national development strategy for coordinating the responsibilities and effective use of cooperative financing in accordance with the needs and priorities of the nation by adhering to the roles of owner for achieving results for the country; - To coordinate works between ministries/institutions, donor countries, international organizations, and investors; - To provide guidance for distribution and utilization of public and private resources for the development process of Cambodia; - To enable and facilitate projects of development partners and investors, and - To review and decide all matters pertaining to rehabilitation and development, public investment, private investment, and establishment and management of special economic zones. The structure and other duties of the CDC are found in this Sub-Decree.

LAND & PROPERTY f Sub-Decree Nº 145 (RGC) of September 23, 2008 on The Transfer of State Public Property to State Private Property (Ogs, Year 08, N0 73, October 4, 2008): Under this Sub-Decree, locations of 500.05-square-meter police Inspectorat of Kampong Cham district, 36,006-square-meter land of Kampong Cham former guest house, 3,214-square-meter land of Stung Sen district hall, , 104,890-square-meter land of Police Intervention Unit of the Ministry of Interior, a part of 6,048-square-meter land for parking lots in Svay Rieng Veal Yun market, a part of 67,000-square-meter land of intervention Unit of the Heavy Machinery Center of the Ministry of Public Work and Transport, 5,484- square-meter land of Kheang Tboung Forestry Administrative Inspectorat of Tonle Sab lake, 991,470.79-square-meter Tuol Kraseang crop seed laboratory station of the Ministry of Agriculture, Forestry and Fisheries, and 2,367-square- meter land of Secretariat of Public Service have been transferred as State private property. The exchange of new property record into the State property inventory shall be reorganized by the Ministry of Economy and Finance, Ministry of Interior, Ministry of Agriculture, Forestry and Fisheries, Secretariat of Public Service Kampong Cham Provincial Hall, Kampong Thom Provincial Hall and relevant specialized Departments in accordance with the Royal Government’s policy. 646.020-square-meter land (six hundred forty six thousand and twenty square meter) shall be granted to development partners. The land of 430.680 (four hundred thirty thousand six hundred eighty) square meter is a part of State land recorded into State property inventory of Kampong Cham Provincial Hall. The fulfillment of [private] possessive formalities on State station shall be conducted under law and principles in force.

MILITARY/POLICE/WEAPONS f Sub-Decree Nº 158 (RGC) of October 14, 2008 on The Procedures and Conditions for Management and Use of Weapons, Explosives and Ammunition of Royal Cambodian Armed Force, National Police Force, Public Institutions, and Officials (Ogs, Year 08, N0 76, October 15, 2008): The purpose of this Sub-Decree is to regulate procedures and conditions for management and use of weapons, explosives and ammunition of the Royal Cambodian Armed Force, National Police Force, Public Institutions, and Officials as mentioned in the Law on the Management of Weapons, Explosives and Ammunition. This Sub-Decree also aims at the protection of security, social safety, and public order. The Sub-Decree shall have its scope cover the management and use of weapons, explosives and ammunition of the Royal Cambodian Armed Forces, national police force, public institutions and officials in the Kingdom of Cambodia.

The procedures and conditions for management and authorization to use weapons, explosives and ammunition; import, export and transport of weapons, explosives and ammunition; clubs, training places, workshops and testing locations of weapons, explosives and ammunition; and final provisions are stated in details in this Sub-Decree.

PUBLIC ADMINISTRATION f Prakas Nº 826 (RGC) of September 9, 2008 on The Organization and Functioning of the IT Department (Ogs, Year 08, N0 73, October 4, 2008): Under this Prakas, the IT Department shall be a supporting staff of the Ministry of Economy and Finance on: − complying with the Royal Government’s instructions, orders or decisions on information technology [IT] and communication developments;

− preparing, making and strengthening IT strategy and policy to support the effective and transparent reform of public financial system management;

− compiling and reviewing laws that may be reflected and suffered from the implementation of project on IT systematic management on public financial sector, and project on IT and telecommunication sectors;

− reinforcing the enforcement of Law on Intellectual Property and other laws related to the use of IT, telecommunication and internet systems;

− implementing and managing project on “management of IT system on public financial sector” at all levels in order to reach the goal of public financial reform program of the Ministries and the Royal Government;

− undertaking the procurement work on connection network of computer machine, IT instruments, and computer program for financing projects provided by development partners, especially projects on the management of IT system for the public financial sector;

− taking part in the procurement works on IT and telecommunication technical materials used by national budget and relevant Departments of the Ministry of Economy and Finance;

− cooperating in national, regional and international frameworks for the works related to IT and telecommunication developments for the Ministry of Economy and Finance such as the process of forming the Government electronics, electronic procurement works, and electronic commerce, etc;

− installing documentary safe and retaining systems for computer users in the Ministry of Economy and Finance;

− reinforcing the implementation and dissemination of the changed management of the public financial IT systematic management project to all levels of officials of the Ministry of Economy and Finance, and all Ministries/Institutions of the Royal Governments;

− training officials from Ministries/Institutions of the Royal Government in the use of IT systematic management on public financial sector by working

together with the Economics and Finance Institute [EFI] and other training institutes;

− supporting the organization and implementation of national budget through the project on public financial IT systems management;

− providing telecommunication and IT electronic technical services, such as internet services, email, homepage, documentary distribution, and conference organization through IT technical systems and other services for all Departments of the Ministry of Economy and Finance;

− being responsible for management, reparation and maintenance of network connections for computer machines, IT instruments, and other computer programs for all Departments of the Ministry of Economy and Finance; and

− performing other duties on IT and telecommunication as assigned by the leadership of the Ministry of Economy and Finance. The IT Department shall be led by one Chief and assisted by some deputy chiefs. The structure of the IT Department shall be found in this Prakas. f Sub-Decree Nº 152 (GRC) of October 6, 2008 on the Establishment of the Excise Department, Customs Regime Department, and Free-Tax-Area Management Department Under the Management of the General Department of Customs and Excise of Cambodia of the Ministry of Economy and Finance (Ogs, Year 08, N0 75, October 12, 2008): The Excise Department, Customs Regime Department, and Free-Tax-Area Management Department under the Management of the General Department of Customs and Excise of Cambodia of the Ministry of Economy and Finance have been formed under this present Sub-Decree. The Excise Department shall have the following duties:

− To raise policies on taxation, production management, export/import, distribution circulation of stock of Tell Seila products, and other special taxable products as defined by the Ministry of Economy and Finance;

− To make master and action plans for tax development and trade facilitation through each customs regime of the Customs and Excise Units;

− To control and inspect export/import formalities, tax collection, distribution, transportation, circulation, and stock of Tell Seila products throughout the country at warehouse centres or other business places;

− To manage the operation of business places producing special taxable goods, free duty shops, and postal package formalities as defined by the Ministry of Economy and Finance as well as working together with relevant authorities to research and suppress customs offences related to these business operations; and

− To perform other duties assigned by the Ministry of Economy and Finance. The Excise Department shall be led by one Chief and assisted by some Deputy Chiefs. The Customs Regime Department shall have the following duties:

− To take part in the preparation of the management of investment and import/export activities, goods of NGOs, embassies, state institutions, and other individuals under the favoured customs regime;

− To control and manage the issuance of import/export goods permits through the favoured customs regimes in accordance with the determination of the General Department of Customs and Excise of Cambodia as well as following up and controlling the use of all kinds of favoured materials and goods in accordance with determined directions;

− To organize the next control for customs declaration and attached documents, to consolidate the results and to raise reasonable recommendations for necessary cases;

− To perform other duties as assigned by the Ministry of Economy and Finance. The Customs Regime Department shall be led by one Chief and assisted by some deputy Chiefs.

The Tax-Free-Area Management Department shall have the following duties:

− To take part in the preparation of policy on the processing management of tax-free areas of the Kingdom of Cambodia, especially all special economic zones under relevant law and provisions in force, international best implementation and Tokyo Convention on Making Customs Procedures Simple and Coherent in order to ensure the smooth and immediate completion of formalities of export and import of goods in these areas;

− To cooperate with the Cambodian Committee of Special Economic Zones to control the proposal for importing instruments, materials and goods for construction of special economic zone infrastructure of developers;

− To coordinate the effective participation from competent customs and excise officials in their task as permanent guards in the administration of special economic zones and for making inspections and approvals to encourage the import of production materials and instruments, construction materials, and other production substances of investors in the region;

− To manage, control, and verify the conformities of duties and obligations of regional developers and investors in special economic zones during infrastructural construction and production basis and during doing business;

− To directly manage and lead the order in accordance with hierarchy from competent customs and excise unit in tax-free areas or special economic zones;

− To perform other duties assigned by the Ministry of Economy and Finance. The TaxFree-Area Management Department shall be led by one Chief and assisted by some deputy Chiefs. More details of the three above Departments shall be found in this Sub-Decre. f Prakas Nº 1019 (MEF) of October 16, 2008 on The Organization and Functioning of the Department of Local Treasury Management and Statistic Consolidation of the General

Department of National Treasury of the Ministry of Economy and Finance (Ogs, Year 08, N0 78, October 23, 2008): The Department of Local Treasury Management and Statistic Consolidation of the General Department of National Treasury shall have the following duties:

− To follow up the process of local treasuries;

− To inspect fund transfer from central level to local level and from local level to central level;

− To inspect cash balance and follow up income/expense of local treasuries;

− To coordinate all relevant works between local treasuries and central specialized Departments of the General Department of National Treasury;

− To collect information about accounts and statistics from central-level Departments and local treasuries; and

− To prepare daily, monthly, quarterly and annual reports. The Department of Local Treasury Management and Statistic Consolidation of the General Department of National Treasury shall be led by one Chief and assisted by some deputy Chiefs. It still has three specialized Offices in the provinces and municipalities. f Sub-Decree Nº 159 (CoM) of October 14, 2008 on The Establishment of the General Department of Political and Foreign Affairs (Ogs, Year 08, N0 77, October 19, 2008): The Royal Government of Cambodia, pursuant to the proposal of the Minister of National Defense, has decided to establish the General Department of Political and Foreign Affairs under the Ministry of National Defense to be added to the structure of Sub-Decree No. 65 dated September 14, 2000 on the Organization and functioning of the Ministry of National Defense. The General Department of Political and Foreign Affairs shall have the following duties:

− To research and make strategic political plans for the national defense field in accordance with the Royal Government’s policy;

− To implement reinforcement and expansion of military cooperation with countries;

− To coordinate diplomatic tasks and cross-border documents for Royal Cambodian Armed Force[RCAF];

− To raise recommendations on the works of national and security defense and foreign affairs for the leadership of the Ministry of National Defense;

− To cooperate international security sector in bilateral and multilateral frameworks and security mechanism in regional and foreign countries;

− To prepare and manage military attachés to countries;

− To coordinate works of overseas mission persons and trainees;

− To perform duties related to ASEAN affairs for the national defense field;

− To coordinate affairs with relevant Ministries/Institutions, especially coordinating mechanism of the Royal Government for missions and peace operation of the RCAF in the UN framework;

− To establish relations and cooperation with Ministries, Institutions, Units, and authorities related to strategies for national defense and to build effective and transparent security policy and national defense;

− To develop, document and construct national defense policies including national defense white book and related documents;

− To respond to or explain incorrect information about the national defense field in the name of the Ministry of National Defense;

− To seek aid and cooperation from foreign countries and coordinate affairs for supporting the RCAF reform and for building up of the ability for peace operation;

− To manage and develop IT ability; and

− To perform other duties assigned by the Minister of National Defense. The General Department of Political and Foreign Affairs has its three Departments: (1) Department of Planning Politics, (2) Department of International Relation, and (3) Department of Peace Operation. The General Department of Political and Foreign Affairs shall be led by one Chief and assisted by some deputy Chiefs, and its structure is annexed in this Sub-Decree. f Sub-Decree Nº 167 (RGC) of October 17, 2008 on The Formalities for Evacuating the Public from Dangerous Places (Ogs, Year 08, N0 79, October 27, 2008): This Sub-Decree aims at regulating conditions and rules for the temporary evacuation of the public in case of having danger as mentioned in Article 13 of the Law on Management of Weapons, Explosives and Ammunition. This Sub- Decree also wishes to ensure public safety and to prevent vital disasters of damages to life and property. The Sub-Decree shall have its scope cover all evacuations of the public from public and private locations throughout the country. Conditions and measures for evacuation and final provisions are stipulated in detail in this Sub-Decree.

TREATIES f Prakas Nº 1004 (MEF) of October 10, 2008 on The Use of Tariff Reduction Schedule of Products Transferred from General Exception List of Cambodia under Agreement on the CEPT [Common Effective Preferential Tariff] Scheme for the AFTA [ASEAN Free Trade Area] (Ogs, Year 08, N0 77, October 19, 2008): After seeing Cambodia’s obligations in CEPT scheme for AFTA, the Ministry of Economy and Finance has declared to use the tariff reduction schedule that is the obligation of Cambodia under CEPT scheme for AFTA as attached to this Prakas. This Prakas shall come into effect from January 1, 2009.
