KAMLOOPS NORTH OFFICIAL COMMUNITY PLAN

INTRODUCTION

The Kamloops North Official Community Plan has been prepared pursuant to Part 29 of the Municipal Act and consists of:

i) a statement of the Board of Directors' objectives, policies and implementation program contained in this Schedule;

ii) a map of the existing and future land use included in this Schedule as the Kamloops North Official Community Plan Map.

The Kamloops North Official Community Plan provides a policy framework and serves as a basis for decisions and actions related to the use and development of all lands within the Kamloops North Official Community Plan Area. It is based on the criteria and mandatory considerations set out in the Municipal Act. The plan is further based on information obtained during the course of meetings and on the information contained in the Background Report, which accompanies this bylaw but is provided for information only and does not form part of the Kamloops North Official Community Plan.

OTHER LEGISLATION

All or parts of the Kamloops North Official Community Plan Area are subject to other legislation, including but not limited to the Forest Act, the Health Act, the Land Act and the Agricultural Land Commission Act. In particular, a number of objectives, policies and land use designations of this plan apply to land located in the Agricultural Land Reserve (ALR). Where the provisions of this plan provide for the development of land located in the ALR which is not consistent with the Agricultural Land Commission Act or regulation made thereunder, the approval of the B.C. Agricultural Land Commission is required. Also the Ministry of Energy, Mines and Petroleum Resources is responsible for administering energy and mineral resources in the area. Furthermore, a large portion of the Plan Area is Provincial Forest land which can only be managed and used for specific timber, grazing, recreation and resource purposes specified in the Forest Act.

INTERPRETATION

In this bylaw:

"Agriculture” means the growing, rearing, producing or harvesting of agricultural crops, poultry, fish and livestock and includes:

a) the storage, sale and processing of primary agricultural products that have been harvested, reared or produced by the farming operation; and b) the storage and repair of farm machinery, implements and supplies.

"Development" means effecting a change in the use of land or in the nature of the use of land, including but not limited to the subdivision of land, the installation of works and services to serve areas of new subdivision, and the building or placement of structure on land.

"Dwelling Unit" means one or more rooms with self-contained cooking, eating, living, sleeping and sanitary facilities used or intended to be used as a residence for one or more persons.

"Highway Commercial" means retail and service outlets, or both, which cater to the commercial needs of the travelling public and local area residents.

"Institutional" means a facility owned and operated by a society incorporated under the Society Act, the Farmers and Womens Institute Act and any independent act of .

"Intensive Agriculture" means one or a combination of the following: a) a beef cattle feeding enterprise which involves 200 or more cattle that are contained within the feeding area for a period of greater than 150 consecutive days in any one calendar year; b) any swine enterprise exceeding 20 head, including piglets; c) any poultry enterprise exceeding 500 birds; d) any fur-bearing animal enterprise exceeding 50 animals.

"Local Commercial" means a retail or service outlet which caters to the needs of local area residents.

"Plan Area" means the Kamloops North Official Community Plan Area as described on the Official Community Plan Map.

"Public use" means land, buildings or facilities owned or otherwise held by a government or government agency, used or intended to be used for public non-commercial uses such as a park and recreation purposes, education, health, welfare, public administration, safety, communications or public works.

"Resort Commercial Use" means a small scale commercial facility which provides accommodation, recreation and other services to tourists including, but not limited to, fishing camps and guest ranches.

OBJECTIVES & POLICIES

The broad objectives and policies of the Board of Directors with respect to the form and character of existing and proposed land use and servicing requirements within the Kamloops South Official Community Plan Area are set out in this section. The objectives are to be achieved through the implementation of policies contained in this section.

1. FORM AND CHARACTER OF EXISTING AND FUTURE LAND USE

Objective: 1.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO DESIGNATE AND DIRECT THE FUTURE PATTERN OF LAND USE FOR THE KAMLOOPS NORTH COMMUNITY PLAN AREA, TO MAINTAIN THE EXISTING RURAL AND AGRICULTURAL CHARACTER AND TO PRESERVE AND PROVIDE OPPORTUNITIES FOR RURAL RESIDENTIAL LIFESTYLES WITHIN THE PLAN AREA.

Policies: 1.1 It is a policy of the Board of Directors that the future pattern of land use in the Kamloops North Official community Plan Area be consistent with the Official Community Plan Map based on the following general guidelines: a) Existing rural residential areas are recognized and opportunities for future development of rural residential uses are provided for in existing communities of Vinsulla, McLure and Black Pines; b) Recreational residential uses are recognized in existing areas located around Heffley Lake and Sullivan (Knouff) Lake; c) Agricultural development is recognized and encouraged in the valley, as well as in the upland valleys generally associated wit Heffley Creek, Edwards Creek, Knouff Creek and Robbins Creek; d) Rural resource uses such as grazing and forestry activities are recognized and encouraged in the rural areas which have lower capability for agriculture; e) Limited general commercial uses are directed to the existing commercial nodes in McLure; f) Existing resort commercial developments are recognized on Sullivan (Knouff) Lake and Heffley Lake. Further resort commercial development on these lakes is not encouraged; however, provisions are made for limited future resort commercial development in areas which are capable of supporting additional development;

g) Existing tourist commercial activities are recognized along the Yellowhead Highway and future tourist commercial development is directed to suitable areas along the Yellowhead Highway; h) Existing public use is recognized at the intersection of McLure Ferry Road and the Yellowhead Highway, and provisions made for the development of other public facilities.

2. RURAL RESOURCE

Objective: 2.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO RECOGNIZE AND SUPPORT RURAL RESOURCE ACTIVITIES WITHIN THE KAMLOOPS NORTH OFFICIAL COMMUNITY PLAN AREA.

Policies: 2.1 The location and extent of lands designated for Rural Resource use within the Kamloops North Community Plan Area are as delineated on the Plan Map. These areas encompass the upland slopes and plateaus including most areas above the North Thompson River Valley.

2.2 Areas designated as Rural Resource may be used for a full range of agricultural, resource management and extraction activities. Uses permitted within the Rural Resource designation include grazing, forestry, silviculture, resource extraction and processing, agriculture, primary processing of agricultural products, intensive agriculture and public uses. Rural Resource areas within Provincial Forests are to be managed for timber, range and forest oriented recreation as well as for wildlife and watershed purposes.

2.3 For lands designated as Rural Resource it is the policy of the Board of Directors to require a minimum parcel size of 8 hectares provided that within the rural Resource designation, applications for the subdivision of parcels to less than 8 hectares, or for uses other than those specified in Policy 2.2 of this section, will be considered based on the following criteria: a) the resource capability of the land; b) existing use of the parcel; c) the area of the parcel and its ability to support resource uses, or its potential to be an integral part of a larger viable resource use; d) the nature of surrounding land uses; e) the ability to obtain potable water and to dispose of effluent on the parcel without adversely affecting lands or water bodies on the parcel or outside of the parcel; f) the ability to develop suitable road access to the parcel.

2.4 It is a policy of the Board of Directors to allow a reduction of parcel size where, at the date of adoption of this Official Community Plan, a parcel is divided by an existing public highway or other major physical barrier provided that the resulting parcel has a minimum area of 0.8 hectare.

2.5 It is a policy of the Board of Directors to continue to support the control of noxious weeds, particularly knapweed, within the Plan Area.

Intergovernmental Policy: 2.6 It is a policy of the Board of Directors to encourage the Ministry of Forests and Lands to undertake the disposition of Crown Lands on a planned basis, in accordance with the provisions of this Official Community Plan.

3. AGRICULTURAL

Objective: 3.0 DUE TO THE IMPORTANCE OF AGRICULTURE WITHIN THE PLAN AREA, IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO MAINTAIN AND IMPROVE THE

VIABILITY OF AGRICULTURAL OPERATIONS WITHIN THE PLAN AREA, PRESERVE LAND WITH AGRICULTURAL CAPABILITY AND TO SUPPORT THE AGRICULTURAL LAND RESERVE.

Policies: 3.1 The location and extent of lands designated as Agricultural within the Plan Area are as delineated on the Plan Map. These areas include lands within the Agricultural Land Reserve as well as some land along the North Thompson River and in the upland valleys having agricultural capability, as well as grazing areas on the hillsides above Heffley Creek, Robbins Creek and the upland areas traversed by the road between Vinsulla and Sullivan (Knouff) Lake.

3.2 Areas designated as agricultural may be used for agriculture, intensive agriculture, silviculture, aquaculture, horticulture and associated commercial uses. Areas within Provincial Forests are also to be managed for timber, range and forest oriented recreation as well as for wildlife and watershed purposes.

3.3 In order to prevent the subdivision of agricultural land in parcels which may not be sufficiently large to support agriculture and to prevent residential encroachment on agricultural land, it is the policy of the Board of Directors to require a minimum parcel size of 8 hectares.

3.4 It is a policy of the Board of Directors to prevent residential encroachment on land used for ranching or agricultural purposes. Notwithstanding this policy, the subdivision of parcels having an area of less than 8 hectares or the development of non-agricultural uses may be allowed based on an assessment taking into account the following criteria: a) the agricultural capability of the land; b) existing use of the parcel; c) the area of the parcel and its ability to support a farming operation, or its potential to be an integral part of a larger viable farm unit; d) the nature of surrounding land uses;

e) the ability to obtain a supply of potable water and to dispose of effluent on the parcel without adversely affecting lands or water bodies on or outside of the parcel; f) approval of the Agricultural Land Commission if the parcel is within the Agricultural Land Reserve; g) the ability to provide suitable road access to the site.

3.5 It is a policy of the Board of Directors to allow a reduction of parcel size where, at the date of adoption of this Official Community Plan, a parcel is divided by an existing public highway or other major physical barrier provided that the resulting parcel has a minimum area of 0.8 hectare.

3.6 It is a policy of the Board of Directors to support the intensification and expansion of the agricultural industry within the Plan Area provided that suitable siting, physical development and agricultural management practices are implemented.

Intergovernmental Policies: 3.7 The Regional District supports the goals and objectives of the Agricultural Land Commission Act and the establishment of the Agricultural Land Reserve. Any application for the exclusion, subdivision or non-farm development of land within the Agricultural Land Reserve will be considered in terms of all Regional District bylaws which may affect the land, including zoning, subdivision and official community plan bylaws, recognizing that final decisions on such applications lie with the Provincial Agricultural Land Commission.

3.8 It is a policy of the Board of Directors to request that the Provincial Agricultural Land Commission review the Agricultural Land Reserve boundaries within the Plan Area in order to refine the boundaries of the Reserve.

3.9 To ensure that conflicts are reduced between intensive agricultural uses and other uses, it is a policy of the Board of Directors to allow intensive agricultural uses subject to a review based on the following criteria:

a) Intensive agriculture should be developed in accordance with the environmental guidelines established by the Ministry of Agriculture and fisheries which specify conditions for confinement of beef, dairy, poultry and swine, including the siting of facilities, and handling, storage and application of manure; b) Intensive agriculture developments should be referred to the Ministry of Agriculture and Fisheries for comments.

3.10 It is a policy of the Board of Directors to request fencing to a minimum legal standard to be constructed around the perimeter of any new non-farm development abutting agricultural land and to be maintained at the cost of the developer or subsequent property owner.

4. RURAL RESIDENTIAL

Objective: 4.0 IN ORDER TO REDUCE CONFLICTS BETWEEN RURAL RESIDENTIAL USES AND OTHER USES, IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO PROVIDE FOR FUTURE RESIDENTIAL DEVELOPMENT IN AREAS WHERE IT WILL BE COMPATIBLE WITH EXISTING USE AND WHERE IT WILL NOT ENCROACH UPON AGRICULTURAL OR OTHER RESOURCE-ORIENTED USES.

Policies: 4.1 The location and extent of land designated for Rural Residential use within the Plan Area are as delineated on the Official Community Plan Map. Future Rural Residential development is to be directed to designated areas within the communities of Vinsulla, McLure, and Black Pines, subject to the following criteria: a) approval must be granted by the Agricultural Land Commission if the parcel is within the Agricultural Land Reserve; b) the ability to obtain a supply of potable water and to dispose of effluent on the parcel without adversely affecting lands or water bodies on or outside the parcel; c) the parcel should have road access.

4.2 In addition to those lands designated on the Official Community Plan Map for rural residential use, it is the policy of the Board of Directors to consider the development of rural residential uses in areas adjacent to areas designated for rural residential use in Vinsulla, McLure and Black Pines subject to the following criteria: a) the proposed rural residential area should have a minimal impact on the existing or potential agricultural or rural resource use of the parcels involved; b) the proposed rural residential use should be compatible with surrounding uses; c) the proposed rural residential use should be subject to the criteria stated in policy 4.1.

4.3 It is a policy of the Board of Directors to discourage rural residential development in the following areas: a) areas susceptible to flooding, erosion or rockfall; b) areas within 0.5 kilometre of Heffley, Little Heffley, or Sullivan (Knouff) Lakes, except where the Development Permit Area requirements of Section 11.4 have been met; c) the areas adjacent to existing rural residential development just north of the community of Heffley Creek; d) within the Fringe Area of the City of Kamloops as defined in the Fringe Areas Policy Paper.

4.4 Areas designated as Rural Residential may be used for residential use and associated uses including home occupations and agricultural use except intensive agriculture. Rural Residential areas are not to be used for mobile home parks or other intensive residential uses.

4.5 For lands designated as Rural Residential, the minimum parcel size is to range between 0.8 hectare and 2.0 hectares in order to provide for a variety of parcel sizes. In the determination of the minimum parcel size, it is a policy of the Board of Directors to consider the following criteria: a) the existing use of the parcel; b) the nature of surrounding land uses;

c) the ability to obtain a supply of potable water and to dispose of effluent on the parcel without adversely affecting lands or water bodies on or outside of the parcel.

4.6 It is a policy of the Board of Directors to consider the designation of areas for Rural Residential use, other than those within or adjacent to areas designated for such use on the Plan Map subject to a review based on the following criteria: a) Rural Residential development should be developed in concentrated nodes and not in strip residential development along roadways; b) In order to reduce residential encroachment on agricultural land, Rural Residential use should be located to have a minimal impact on the existing or potential agricultural or rural resource use of the parcels invovled and adjacent lands; c) Approval must be granted by the Agricultural Land Commission if the parcel is within the Agricultural Land Reserve; d) The existing use of the parcel and the nature of surrounding land uses should be considered; e) Parcels to be created to Rural Residential use should have a proven supply of potable water and be suitable for on-site disposal of sewage; f) Adequate forest fire protection measures should be taken such as fire breaks and access roads; g) Adequate road access should be provided to each parcel; h) Rural Residential development should not be located within critical wildlife ranges or adjacent to critical spawning systems; i) Rural Residential development should not be located adjacent to intensive agricultural activities; j) Rural Residential development should not be located in those areas described in Policy 4.3.

4.7 It is a policy of the Board of Directors to ensure that home occupations are family operated, small scale and unobstrusive to neighbouring parcels.

5. RECREATION RESIDENTIAL

Objective: 5.0 DUE TO THE INCREASING PRESSURE PLACED ON LAKES WITHIN THE PLAN AREA, IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO LIMIT ANY FUTURE LAKESHORE RECREATIONAL RESIDENTIAL DEVELOPMENT.

Policies: 5.1 The location and extent of lands designated for Recreation Residential use within the Plan Area are as delineated on the Official Community Plan Map. The specific areas are located around Heffley Lake and on the southern end of Sullivan (Knouff) Lake.

5.2 Areas designated as Recreation Residential may be used for residential use including seasonal cabin use.

5.3 It is a policy of the Board of Directors to require a minimum parcel size for Recreation Residential uses of 0.4 hectare.

5.4 It is the policy of the Board of Directors to recognize existing Recreation Residential development, but to discourage further subdivision for Recreation Residential development within the Plan Area. Development of existing parcels located within 0.5 kilometre of Heffley, Little Heffley, Badger and Sullivan (Knouff) Lakes is subject to a Development Permit as outlined in Policy 11.4.

6. COMMERCIAL

Objective: 6.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO ENSURE THAT FUTURE COMMERCIAL OR TEMPORARY COMMERCIAL DEVELOPMENT IS OF A SCALE AND CHARACTER CONSISTENT WITH THE RURAL NATURE OF THE PLAN AREA.

Policies: General Commercial: 6.1 The location and extent of lands designated for General Commercial use within the Plan Area are as delineated on the Official Community Plan Map. This includes areas presently developed to commercial use in the vicinity of the firehall on McLure Ferry Road and in the vicinity of the cafe and welding shop in the Fishtrap Canyon area along the Yellowhead Highway.

6.2 Areas designated as General Commercial may be used for a variety of commercial uses including highway commercial and local commercial.

6.3 For areas designated as General Commercial, the parcel should be of sufficient area to accommodate the use and required servicing, but in no case shall it be less than 0.4 hectare.

6.4 To ensure that General Commercial uses are developed in suitable areas and at the appropriate scale, it is the policy of the Board of Directors to encourage the development of future General Commercial uses within or adjacent to existing commercial nodes established at the intersection of McLure Ferry Road and the Yellowhead Highway in the Fishtrap Canyon area where a precedent for General Commercial use has been established. Development within or adjacent to established nodes is subject to the following criteria: a) the parcel must provide the capability to obtain a supply of potable water and to dispose of effluent on the parcel without adversely affecting lands or water bodies on or outside the parcel; b) the parcel must contain suitable area for required off-street parking.

6.5 It is a policy of the Board of Directors to consider the designation of new General Commercial nodes in the Plan Area subject to an amendment to this Official Community Plan and subject to the following criteria: a) the development should not contribute to strip development along the Yellowhead Highway or the Heffley-Louis Creek Road; b) the commercial area or use should be compatible with surrounding land uses;

c) the commercial uses developed should serve the needs of local residential communities or the travelling public; d) parcels located within the new commercial nodes should: - provide the capability to obtain a supply of potable water; - provide the capability to dispose of effluent on the parcel without adversely affecting lands or water bodies on or outside of the parcel; - contain suitable and sufficient areas for the development of required off- street parking.

6.6 Transportation Policies 9.2 and 9.4 of this bylaw apply to General Commercial development in proximity to the Yellowhead Highway.

Tourist Commercial: 6.7 The location and extent of lands designated for Tourist Commercial sites identified include a campsite and a riding stable/guest ranch along the Yellowhead Highway.

6.8 Areas designated as Tourist Commercial may be used for campsites, motels, and other tourist-oriented commercial activities.

6.9 For lands designated as Tourist Commercial, the parcel should be of sufficient area to accommodate the use and required services, but in no case should it be less than 0.4 hectare.

6.10 It is a policy of the Board of Directors to consider the designation of other lands within the Plan Area for Tourist Commercial use subject to an amendment to this Official Community Plan and subject to a review of the following criteria: a) the development should not contribute to strip development along the Yellowhead Highway or the Heffley-Louis Creek Road; b) the use should be consistent with the rural character of the area; c) the use should be compatible with resource, agricultural and residential activity on surrounding land;

d) the capability of obtaining a supply of potable water and disposing of effluent without adversely affecting lands or water bodies on or outside of the parcel should be demonstrated.

Resort Commercial: 6.11 The location and extent of lands designated for Resort Commercial use within the Plan Area are as delineated on the Official Community Plan Map. The Resort Commercial designations apply to the fishing resorts on Sullivan (Knouff) Lake and Heffley Lake.

6.12 For lands designated as Resort Commercial the parcel containing the commercial use should be of sufficient area to accommodate the use and required services, but in no case should it be less than 0.4 hectare.

6.13 Areas designated as Resort Commercial may be used for resort commercial use provided that the expansion or redevelopment of resort commercial uses within Development Permit Area boundaries will be required to meet the criteria set out in Policy 11.4

6.14 While major lakes within the Plan Area are extensively developed, the Board of Directors may consider the designation of new resort commercial areas subject to an amendment to this Official Community Plan and subject to a review including, but not limited to, the following criteria: a) the development of new resort commercial uses are not encouraged in areas within 0.5 kilometre of the natural boundary of lakes; b) the environmental and recreational carrying capacity of any lake that the resort commercial development may affect should be examined to ensure that the resort development will not result in significant negative impacts on a lake; c) Ministry of Environment and Parks concerns respecting the management of the fisheries resources, water quality and other concerns should be addressed; d) any resort commercial development within the designated Development Permit Areas surrounding Badger, Heffley, Little Heffley or Sullivan (Knouff) lakes is subject to Development Permit conditions set out in Policy 11.4;

e) the development should be consistent with the rural character of the area; f) the development should be compatible with resource, agricultural and residential activity on surrounding lands; g) the capability of obtaining a supply of potable water and disposing of effluent without adversely affecting water tables or lands on the parcel or outside the parcel should be demonstrated.

Temporary Commercial Uses: 6.15 The Board of Directors hereby designates the entire Kamloops North Official Community Plan Area as an area for the issuance of Temporary Commercial Use Permits.

6.16 Where suitable land cannot be found within the City of Kamloops, temporary service commercial development, highway commercial development or tourist commercial development may be permitted within the Plan Area provided that the development: a) has access to an internal, frontage or collector road rather than having direct access to a trunk highway; b) is adequately serviced with a supply of potable water and means of sewage disposal; c) is designed to maximize the efficient use of land; d) has been approved by the Provincial Agricultural Land Commission if within the Agricultural Land Reserve; e) has been approved by the Ministry of Transportation and Highways if it is within 800 metres of a Controlled Access Highway.

7. INDUSTRIAL USE AND GRAVEL DEPOSITS

Objective: 7.0 IN ORDER TO MAINTAIN THE AGRICULTURAL LAND RESOURCE EMPHASIS IN THE PLAN AREA, IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO ENSURE THAT INDUSTRIAL OR TEMPORARY INDUSTRIAL DEVELOPMENT IS OF A SCALE AND CHARACTER CONSISTENT WITH THE RURAL NATURE OF THE AREA.

Policies: 7.1 No industrial designations currently exist within the Plan Area. However, it is the policy of the Board of Directors to consider the designation of land for industrial uses subject to an amendment to this Official Community Plan and subject to a review of the following criteria: a) the parcel should have direct access to major roads to ensure that surrounding agricultural or residential activities will not be impacted; b) the industrial use should be compatible with surrounding uses; c) the special suitability of the site for the industrial use proposed; d) the capability of obtaining a supply of potable water and disposing of effluent and waste material without adversely affecting lands or water bodies on or outside of the parcel should be demonstrated.

7.2 Areas designated as Industrial may be used for a range of industrial uses including the processing of agricultural products, processing of forest products and primary processing of resources in general.

7.3 For lands designated as industrial, it is a policy of the Board of Directors to require a minimum parcel size of 0.4 hectare.

Objective: 7.4 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO IDENTIFY AND PRESERVE GRAVEL DEPOSITS FOR THE PURPOSE OF DEVELOPING SAND AND GRAVEL QUARRIES IN THE FUTURE.

Policies: 7.5 The location and extent of areas designated as Gravel Deposits within the Plan Area are as delineated on the Official Community Pan Map. Major gravel deposits are those along Heffley-Louis Creek Road and the deposit north of McLure along the east side of the Yellowhead Highway.

Temporary Industrial Uses: 7.6 The Board of Directors hereby designates the entire Kamloops North Official Community Plan Area as an area for the issuance of Temporary Industrial Use Permits.

7.7 Where suitable land cannot be found within the City of Kamloops, industrial development may be permitted within the Plan Area provided that the development: a) has access to an internal, frontage or collector road rather than having direct access to a trunk highway; b) is adequately serviced with a supply of potable water and means of sewage disposal; c) is designed to maximize the efficient use of land; d) has been approved by the Provincial Agricultural Land Commission if within the Agricultural Land Reserve; e) has been approved by the Ministry of Transportation and Highways if it is within 800 metres of a Controlled Access Highway.

Intergovernmental Polices: 7.8 Gravel extraction is recognized as a permitted use in the Agricultural and Rural Resource areas. It is recognized that the Regional District does not have direct jurisdiction over gravel extraction activities.

7.9 It is a policy of the Board of Directors to encourage gravel extraction from existing pits rather than opening new gravel pits.

7.10 In order to enhance the visual landscape of the Plan Area, it is a policy of the Board of Directors to encourage any owner or operator of a gravel pit to reclaim exhausted portions of gravel pits still being used.

8. INSTITUTIONAL/PUBLIC USE

Objective: 8.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO ENSURE THAT INSTITUTIONAL/PUBLIC USE IS LOCATED TO BEST SERVE THE NEEDS OF THE AREA RESIDENTS.

Policies: 8.1 The location and extent of lands designated for Institutional/Public Use within the Plan are as delineated on the Plan Map and include the McLure Fire Hall, Hart Park and the rifle range just north of the refuse disposal site for Heffley Creek and area.

8.2 Areas designated as Institutional/Public Use may be used for buildings and facilities for Institutional and/or Public use.

9. TRANSPORTATION

Objective: 9.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO ENHANCE THE SAFETY AND CONVENIENCE OF ROADWAYS FOR RESIDENTS AND NON- RESIDENTS ALIKE.

Policies: 9.1 A major road network as outlined on the Official Community Plan Map shall be implemented within the Plan Area. Major roadways in the area include the Yellowhead Highway and the Heffley-Louis Creek Road and Westsyde Road. Other important roadways include the Knouff Lake Road, the Vinsulla-Knouff Lake Road, the McLure Ferry Road and the Jamieson Creek Forest Service Road.

9.2 In order to maintain the functional integrity of the Yellowhead Highway as a Controlled Access Highway, the use and development of local and collector streets, and frontage roads is encouraged. Sufficient highway right-of-way is also to be protected for possible future widening.

9.3 The provision of off-street parking is required to discourage parking in highway rights-of- way.

9.4 In order to reduce the potential for conflicts between the Yellowhead Highway and surrounding uses, it is the policy of the Board of Directors to ensure that land uses along the highway and rail line are compatible with the noise and speed that are typical of traffic using such facilities.

Intergovernmental Polices: 9.5 Any roadways developed within the Plan Area are to adhere to Ministry of Transportation and Highways regulations and standards except for roads constructed or authorized by the Ministry of Forests and Lands.

9.6 The potential for double tracking of the CN Rail line through the Plan Area is recognized.

9.7 In order to ensure adequate public access to Crown land it is a policy of the Board of Directors to ensure that all new development of parcels is referred to the Ministry of Forests and Lands.

10. HAZARD AREAS

Objective: 10.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO ENSURE THAT DEVELOPMENTS IN HAZARD AREAS ARE AVOIDED AND THAT ADEQUATE PRECAUTIONS ARE TAKEN IF DEVELOPMENT IS UNAVOIDABLE.

Policies: 10.1 The hazard areas identified within the Plan Area are as follows: a) the floodplain of the North Thompson River and/or other watercourses and lakes as defined by the Ministry of Environment and Parks;

b) the fans at the mouths of larger tributaries to the North Thompson River, which are subject to channel shifting and bank overflow. These streams are Jamieson Creek, Knouff Creek, Whitewood Creek, Fishtrap Creek and Badger Cree; c) the banks on the outside bends of the North Thompson River, which are subject to erosion; d) areas near the base of colluvial slopes or bedrock outcrops, which are susceptible to rolling or falling rock.

Floodplains: 10.2 It is a policy of the Board of Directors to limit development on floodplain areas to parks, open space, recreation or non-intensive agricultural uses. If more intensive development is unavoidable, the Board of Directors will rely on the Ministry of Environment and Parks to specify the necessary precautions to be taken.

10.3 For any development within a floodplain area, setbacks and elevations for buildings and structures should be established in consultation with the Ministry of Environment and Parks.

Erosion: 10.4 In order to ensure the safety of life and property, it is a policy of the Board of Directors to require the developer of any parcel within a hazard area subject to erosion, channel shifting or bank overflow to provide a professional engineer's report which addresses the relevant hazards. Any development is to comply with the recommendations of the report and the requirements of Provincial and Federal agencies having authority.

10.5 In order to prevent stream bank erosion, a leavestrip of streamside vegetation is to be maintained by the property owner in its natural state adjacent to all watercourses. The width of the leavestrip is to be determined in consultation with the Ministry of Environment and Parks.

Rockfall: 10.6 In order to ensure the safety of life and property, it is a policy of the Board of Directors to require the developer of any parcel within a hazard area near the base of colluvial

slopes or bedrock outcrops which may be susceptible to rolling or falling rock to provide a professional engineer's report which addresses the relevant hazards. Any development is to comply with the recommendations of the report and requirements of the Provincial and Federal agencies having authority.

Wildfire Hazard Management Wildfire is a risk for rural communities and settlements in the Official Community Plan Area. The objective of the Wildfire Hazard Management policies is to regulate development activities to reduce the risk to citizens and property in areas where there is a hazard of wildfire. Two factors have increased the hazard of wildfire within the Official Community Plan Area. The first event is the forest health epidemic, which is causing a widespread mortality of trees, thereby adding fuel loads to forests and grasslands, and to any wildfire that should arise. Secondly, it is anticipated that one of the impacts of climate change will be increased drought during late spring, summer, and early autumn; drought can increase the duration of the wildfire season, and have a negative impact on the availability of water to combat wildfires in our communities.

The Official Community Plan Area has High Wildfire Hazard Areas, as identified by the Ministry of Forests and Range and shown on the attached Wildfire Hazard map. Also shown on the Wildfire Hazard map are Buffer Zones, which represent land located within 2 kilometers of the High Wildfire Hazard Areas that are at risk of fire through spotting of airborne embers; and Moderate to Low Wildfire Hazard Areas.

10.7 Within a High Wildfire Hazard Area, prior to undertaking any subdivision or land use application that will create four or more parcels or dwelling units, the landowner shall provide the Regional District with a Wildfire Hazard Assessment Report for the proposed development, prepared by a Registered Professional Forester licensed in BC or equivalent qualified professional.

The Wildfire Hazard Assessment Report shall: i. Assess the current wildfire hazard; ii. Assess conditions on and off-site including neighbouring lands; iii. Evaluate the proposed development for wildfire susceptibility; and

iv. Provide Fire Smart wildfire hazard mitigation recommendations to reduce the hazard of wildfire for the land and buildings to moderate or lower.

The recommendations of the Wildfire Hazard Assessment Report shall be implemented during development and be written into a restrictive covenant to be registered on the property title advising the property owner of the ongoing responsibility to manage their land and buildings in accordance with the recommendations of the Wildfire Hazard Assessment Report.

10.8 Within High Wildfire Hazard Areas, during any subdivision or land use application that will create three or less parcels or dwelling units the property owner shall not be required to submit a Wildfire Hazard Assessment Report, but shall register a standard restrictive covenant on the titles of the properties encouraging landowners to use Fire Smart wildfire hazard mitigation practices for building construction and land management to reduce the wildfire hazard in their development.

10.9 Within the Buffer Zones and Moderate to Low Wildfire Hazard Areas, during any subdivision or land use application the property owner shall register a standard restrictive covenant on the titles of the properties encouraging landowners to use Fire Smart wildfire hazard mitigation practices for building construction and land management to reduce the wildfire hazard in their development.

10.10 Where Wildfire Hazard Management requirements and Riparian Areas requirements overlap, the Riparian Areas requirements shall prevail.

11. ENVIRONMENTALLY SENSITIVE AREAS

Objective: 11.0 DUE TO THE VALUE OF LAKES AND WATERCOURSES, IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO RECOGNIZE AND PROVIDE SPECIAL PROTECTION FOR CREEKS, RIVERS AND LAKES WITHIN THE PLAN AREA.

Policies: Watercourses: 11.1 It is a policy of the Board of Directors to direct development away from critical spawning streams in the Plan Area. The critical streams are Jamieson Creek, Heffley Creek, Knouff Creek as well as streams flowing into and out of Badger, Little Badger and Spooney Lakes.

Lakes: 11.2 It is a policy of the Board of Directors to not allow further development within 0.5 kilometre of the natural boundary of Little Badger and Spooney Lakes except where the Development Permit Area requirements of Section 11.4 have been met.

11.3 It is a policy of the Board of Directors to not allow further subdivision of parcels for Rural Residential, Recreation Residential or Resort Commercial uses within 0.5 kilometre of the natural boundary of Heffley Lake, Little Heffley Lake or Sullivan (Knouff) Lake except where the Development Permit Area requirements of Section 11.4 have been met.

11.4 It is a policy of the Board of Directors to designate the area around Heffley, Little Heffley, Badger and Sullivan (Knouff) lakes (as shown on Official Community Plan Map 12 and Detailed Maps C, D and E) as Development Permit Areas pursuant to Section 945(4) (a) (protection of the natural environment) of the Municipal Act. The justification and guidelines are as follows: a) Justification: The Ministry of Environment and Parks has requested that Heffley, Little Heffley, Badger and Sullivan (Knouff) Lakes be safeguarded against potential increased nutrient enrichment from sewage disposal on parcels located within the watershed of the lakes. Also, the Lakes Study indicates that Sullivan (Knouff) and Heffley lakes have been developed in excess of their capacity and that any redevelopment should not increase the intensity of use in the area. The Lakes Study also notes Badger Lake as being a ‘Natural Environment Lake’ and that development should be limited around this lake.

Setbacks and requirements for sewage disposal are also provided in the Lakes Study. The objective of the Development Permit Area designation is to ensure that the current quality of the lakes is maintained. b) Guidelines: i) certified soil data and a report by an appropriately qualified engineer or geoscientist must be submitted providing assurance that there will be no detrimental impact on the water quality of adjacent waterbodies resulting from the development and sewage disposal fields.

11.5 Development, filling or dumping in lake foreshore areas are discouraged.

Intergovernmental Policies: Fisheries: 11.6 In order to maintain the quality of recreational fishing within the Plan Area, it is a policy of the Board of Directors to encourage the continuation of Provincial fish stocking and enhancement programs in the Plan Area.

11.7 It is a policy of the Board of Directors to encourage the developer to refer development proposals that may potentially affect fisheries resources or fish stocking and enhancement programs to the appropriate Federal and Provincial management authorities for their comments.

11.8 It is a policy of the Board of Directors to refer development proposals that may potentially affect lakes to the appropriate Federal and Provincial management authorities for their comments.

Groundwater: 11.9 Because most surface water sources within the Plan Area have been essentially committed to existing water licencing, it is a policy of the Board of Directors to promote groundwater as the prime source of water supply for all new parcels created for residential purposes. Surface water for new developments can only be used when derived from the North Thompson River or from sources which can be backed up by storage.

Riparian Areas 11.10 The Riparian Areas Regulation applies to land and watercourses within the Official Community Plan, and is implemented in accordance with Zoning Bylaw No. 2239 and amendments thereto.

11.11 The Regional District will work with First Nations, Federal, and Provincial governments, and civil society organizations toward improving the stewardship, protection, and enhancement of riparian values.

11.12 Where Riparian Areas Regulation requirements and wildfire hazard management requirements overlap, the Riparian Areas Regulation requirements shall prevail.

11.13 Encourage the Provincial government to enhance and share improved riparian areas mapping with the TNRD to reduce the financial burden and responsibility on private landowners who may be required to retain the services of a Qualified Environmental Professional (QEP) to define and evaluate the impact of a development on a riparian area.

12. PUBLIC FACILITIES

Objective: 12.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO MAINTAIN THE CURRENT LEVEL OF PUBLIC SERVICES AND FACILITIES AND TO CONSIDER FURTHER SERVICING AS DEMAND WARRANTS AND FINANCIAL CAPABILITY ALLOWS.

Policies: Water: 12.1 The Board of Directors recognizes irrigation districts and improvement districts within the Plan Area.

Refuse Disposal: 12.2 The Board of Directors administers the refuse disposal function in consideration of appropriate studies and criteria including the provision of new sites or methods of disposal based on an assessment of future growth and potential subdivision locations. The current sites are in Black Pines, north of McLure, and just north of the Heffley-Louis Creek Road along the road to Lyons Lake. Future refuse disposal sites handling refuse primarily generated outside the Thompson-Nicola Regional District will require amendment to this Official Community Plan.

General: 12.3 It is the policy of the Board of Directors to consider the provision of additional services on a Specified Area basis, taking into account the financial capabilities of the local community and Regional District.

13. HERITAGE RESOURCES

Objective: 13.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO RECOGNIZE, PRESERVE AND ENHANCE BUILDINGS AND SITES OF SIGNIFICANT HISTORICAL AND ARCHAEOLOGICAL VALUE.

Intergovernmental Policies: 13.1 Development should not disrupt, alter or damage significant archaeological sites existing within the Plan Area or those sites which may be discovered or identified in the future.

13.2 The Thompson-Nicola Regional District may consider taking on the heritage conservation function at such time as the Heritage Conservation Act is amended to allow Regional Districts to assume this function.

14. RECREATION

Objective: 14.0 TO PROVIDE OUTDOOR RECREATION AND CONSERVATION OPPORTUNITIES WHILE MINIMIZING RECREATIONAL-RESOURCE USE CONFLICTS AND PRESERVING THE RURAL CHARACTER AND ENVIRONMENTAL QUALITY OF THE PLAN AREA.

Policies: 14.1 Encourage the retention of unimpeded public access to water based recreational areas.

14.2 Prepare a Community Parks Master Plan within the term of this Official Community Plan.

14.3 Prepare a Trails Network Plan as part of a Community Parks Master Plan or as an independent project, possibly in collaboration with communities of interest including provincial resource agencies, ALC, first nations and local service groups.

14.4 Work with service clubs and other organizations to provide public facilities within parks.

14.5 Encourage the sharing of fields, playgrounds and recreational facilities with School Districts.

14.6 Provide park facilities based upon the recommended standard of 4 hectares per 1000 population as follows:

• neighbourhood parks = 1 hectare/1000 • community parks = 3 hectares/1000

Park Land and Open Space Acquisition: 14.7 Recreational lands and existing park sites are designated and shown on the Existing Land Use Map (Map 3). They will continue to provide recreation opportunities within the Plan Area.

14.8 With the development of new subdivisions, the direction of the Plan respecting park land acquisition is as follows: (a) to acquire additional park land within the area of Detail Maps “A”, “B”, “C”, “D”, “E”, “F” and “G”, as shown on the Official Community Plan. (b) under Section 941 of the Local Government Act, the Regional District may, at its option, require a subdivision applicant to dedicate park land or pay money in lieu of park land, in accordance with the following: (i) generally require payment of money when subdivisions are not within the area shown on the Land Use Map where the Plan calls for acquisition of additional park land (ii) generally require payment of money when subdivisions are within the designated area for park land acquisition, but would not be able to meet the criteria for park land dedication – i.e. size, function, topography (iii) the money paid to the Regional District in lieu of park land dedication will be used for park land acquisition within the Plan Area (c) the criteria for selection of land to be dedicated by a subdivision applicant for park purposes include the following provisions: (i) dedication of up to 5% of the entire subject property (as permitted in the Local Government Act) (ii) wherever feasible, the minimum area of the land to be dedicated should meet the guideline of being not less than 2,000 m2 (iii) consideration of potential for additional dedication through future subdivision of contiguous parcels when choosing location (iv) the land to be dedicated should have an average slope of less than 20%, and contain no obvious hazards such as, but not necessarily limited to, landslip or flooding (v) natural areas or areas suitable for amenity or stewardship purposes may be sought where appropriate (vi) areas suitable for the protection of cultural resources may be sought where appropriate (vii) the land to be dedicated should have good road accessibility (viii) the land to be dedicated shall be free of liens or encumbrances.

14.9 The Plan encourages provision of new park land that will complement existing private and public recreation facilities, rather than compete with or duplicate existing resources.

14.10 The Plan encourages local community groups to operate and maintain community and neighbourhood parks where possible.

Intergovernmental Policies: 14.11 Cooperate with the appropriate Provincial agencies having authority, to promote appropriate expansion of recreational opportunities on Crown lands within and adjacent to the Plan Area, where conflict with agricultural uses, wildlife habitats, conservation areas and residential development may be minimized.

14.12 Cooperate with the appropriate Provincial agencies having authority, and interest groups, in a coordinated effort aimed at increasing public awareness of subjects such as ATV use, watershed management, stock grazing practices, noxious weed control and factors causing soil erosion in rural areas of the Plan in order to reduce the impact of recreational activities in rural areas.

14.13 Cooperate with the appropriate Provincial agencies having authority, as well as the Canadian National Railway, to establish increased opportunities for public access to the North Thompson River where access can be provided while ensuring public safety and protection of this important surface water source.

14.14 In cooperation with the appropriate Provincial agencies having authority, the Regional District may establish community parks as demand warrants.

14.15 The Thompson-Nicola Regional District shall work towards the formulation of a Regional Parks Plan, in cooperation with the Provincial agencies having authority.

14.16 Support the proposed Provincial government all-terrain vehicle licensing program, under the All Terrain Vehicles Act.

15. GREENHOUSE GAS (GHG) EMISSION REDUCTION

In 2007, the Provincial Government passed Bill 44 – the Greenhouse Gas Reduction Targets Act – thereby committing the Province to reduce GHG emissions by 33% below 2007 levels by the year 2020 and 80% below 2007 levels by the year 2050. In order to help achieve this commitment, the Province enacted the Local Government (Green Communities) Statutes Amendment Act (“Bill 27”). Under this legislation and Section 877(3) of the Local Government Act, Official Community Plans are now required to include targets for the reduction of GHG emissions as well as policies and actions to support the reduction targets.

As signatory to the B.C. Climate Action Charter, the TNRD has voluntarily agreed to develop strategies and take actions to achieve the following goals: i. being carbon neutral in respect of corporate operations by 2012, ii. measuring and reporting on the community’s GHG emissions profile; and iii. creating complete, compact, more energy efficient rural and urban communities.

Targets The Province has provided each local government with a Community Energy & Emissions Inventory (CEEI) report to track and report annual community-wide energy consumption and GHG emissions. For the baseline year 2007, the Regional District’s CEEI report includes GHG emission estimates in three sectors - on-road transportation, buildings, and solid waste. There is no specific data on the quantity of GHG emissions generated within the Plan Area. However, the CEEI data shows that transportation accounts for the majority of GHG emissions in the region followed by buildings and solid waste. Reducing transportation emissions is a challenge in rural communities therefore additional Provincial and Federal Government policies, actions and initiatives will be needed to support the community-wide GHG reduction targets set by the Regional District.

Recognizing the challenges of reducing GHG emissions in rural communities, the Regional District sets the following community-wide GHG reduction targets:

 10% by 2020 from 2007 levels

 33% by 2050 from 2007 levels

The Regional District will utilize the provincially supplied 2007 CEEI data as the baseline for measuring GHG emission reductions.

Achievement of the community-wide reduction targets will be supported by the following policies and actions:

Policies: 15.1 Consider climate change and the impacts of land use decision making on climate change when reviewing new development applications and undertaking long-range planning initiatives.

15.2 Encourage compact community design, infill development and planning strategies that reinforce smart growth principles and best practices in sustainable development.

15.3 Encourage and support non-vehicular walkways, trails and alternative modes of transportation to help reduce automobile dependence.

15.4 Encourage home-based businesses that do not create a nuisance or detract from the residential character of a neighbourhood.

15.5 Encourage and support energy efficient new construction and the retrofit of existing buildings.

15.6 Encourage water conservation, including the installation of low-flow plumbing fixtures in new construction.

15.7 Encourage low-impact renewable energy generation including solar and geothermal technology.

15.8 Encourage and support initiatives to upgrade wood-burning appliances through wood stove exchange programs.

15.9 Support the preservation of agricultural lands and local food production.

15.10 Encourage local community gardens and farmers’ markets within the Plan Area.

15.11 Encourage tree planting where appropriate and the retention of existing healthy trees and natural vegetation during new development.

15.12 Support recycling initiatives and the diversion of waste from area landfills.

Actions: 15.13 As signatory to the Climate Action Charter, the Regional District will take steps to address and support the goals of the Charter.

15.14 Raise awareness about BC Climate Action and energy conservation by making relevant informational material available to residents of the Regional District.

15.15 Investigate potential incentives to builders, developers and homeowners who incorporate alternative energy sources.

15.16 Investigate the feasibility of a tree planting incentive program for residents of the Regional District.

15.17 Request the Province’s continued support in providing the Regional District with the tools and resources necessary to monitor and measure GHG reduction levels.

15.18 Continue to raise awareness about recycling and landfill diversion through educational initiatives such as newsletters, information guides, and newspaper inserts.

15.19 Continue to explore opportunities to reduce energy use at Regional District recycling and refuse transfer stations including through the use of alternative energy generation.

15.20 Support waste reduction policies and actions outlined in the Regional Solid Waste Management Plan, including a region-wide goal of 30% reduction in waste disposal by 2013 (from 2004 levels).

15.21 The Regional District shall work toward a comprehensive regional greenhouse gas reduction strategy, including action plans for: a. Encouraging and improving public transit b. Encouraging public transit/car-pooling for all Regional District personnel c. Improving the energy efficiency of existing Regional District buildings d. Using a minimum “LEED Gold” equivalent standard for all new Regional District buildings where practical, affordable and applicable e. Purchasing fuel efficient “green” vehicles whenever possible f. Reducing Regional District personnel travel through video conferencing and other available methods g. Enhancing urban and rural forests in the Regional District and participating communities where possible h. Seeking partnerships with participating Regional District municipalities on joint “green” initiatives and undertakings i. Encouraging development of energy efficient (green) refueling/re-charge options/networks within the Regional District and member municipalities.

16. IMPLEMENTATION

Objective: 16.0 IT IS THE OBJECTIVE OF THE BOARD OF DIRECTORS TO ACHIEVE THE OBJECTIVES OF THIS PLAN WHILE FOSTERING COOPERATION BETWEEN ALL AGENCIES RESPONSIBLE FOR PLANNING AND LAND USE WITHIN THE PLAN AREA.

16.1 Future changes to Zoning Bylaw No. 940 of the Thompson-Nicola Regional District must comply with the objectives and policies in this plan.

16.2 Those areas not developed for the uses for which they are designated at the time of adoption of this plan may be placed within another zone until such time that they are proposed for development in accordance with the policies of this Plan.

Approval Process for Development Proposals Contrary to the Plan:

16.3 With respect to development proposals which are contrary to the objectives, policies or land use map designations of this plan, an amendment to the plan shall be required before the development proposal can be accommodated. Providing that the Board of Directors wishes to proceed with the consideration of such a proposal, an amendment to the Official Community Plan shall involve a change to the relevant policy or land use map designation.

Upon amendment to the plan, the procedures prescribed in the Municipal Act for rezoning and subdivision approval shall apply.

Intergovernmental Policy: Provincial Agricultural Land Commission:

16.4 With respect to minimum parcel sizes, land use designations and policies established in this plan, the Board of Directors recognizes that for lands within the Agricultural Land Reserve, the Agricultural Land Commission is obliged under the mandate of the Agricultural Land Commission Act to consider individual applications for subdivision or non-agricultural use on their own merit, and is not obliged to approve applications that comply, or alternatively refuse applications that do not comply with the minimum parcel sizes, land use designations or policies of this plan.
