5. On transcript p.17, song no. 8, it is alleged that the

word 'Mandela' can be heard at times. This was not heard.

The words 'soldiers' and 'Oliver Tambo' is also alleged to

be heard at times. These words similarly cannot be heard. 6. On page 25, the song entitled 'come with the guns' is not

translated nor was it heard. Also during this time the

video screening shows elections taking place and a person

I wearing a T shirt with the image of the late Griffiths

Mxenge.

7. At the bottom of the transcript on p.25 it is alleged that

^ 'audience sings in Zulu something about Thambo'. This did

not emerge from a viewing of the video.

8. Song no.10 on p.26 of the transcript did not emerge at a

i/ viewing of the video.

9. On p.26 of the transcript, last line it is alleged that

^ , the meeting closed with the singing of Nkosi Sikelele

Afrika, but this did not appear on the video.

ADDITIONAL COMMENTS CONCERNING THE SPEECH BY CHIKANE WHICH ARE

NOT SPECIFICALLY REFERRED TO IN THE INDICTMENT.

1. On page 10 of the transcript the last line of the first

paragraph of Chikane's speech should read 'has become a

historic t e j. 1 ina point in the history of struggle in South

Africa'. In the second paragraph of Chikane's speech on page 10 of

the transcript, the first word of the fourth line should

read 'history' and not 'mistery'.

In the second paragraph of Chikane's speech on page 10 of

the transcript in the second last line, for the portion

which is inaudible, insert 'and thereafter our people will

completely dis-arm'.

IOn p.12 of the transcript on the last line the words I 'different share ships' should read 'differentiation'.

,1 f On p.13, second line, where it says inaudible, substitute

the word 'all'.

I In the fourth line on p.13 of the transcript the first

word, 'avoid' should read 'appoint'.

On p.13 in line 6 where it says inaudible for the first

time, substitute the words 'during our' and when it says

On page 13 of the transcript in the last paragraph, in the second last line where it states '(inaudible) (audience laughter)' insert 'wrong in the economic system' and after the word 'audience laugher' the sentence should read, ' I have no doubt that even the bible recognises the importance of sharing together...'

On p. 14 of the transcript in the second line where it says inaudible, insert the words 'of course'.

On page 14 of the transcript in the fourth line the words

is happening in South Africa. He was also

saying why the people in the Vaal and elsewhere

are expressing their frustration by saying

"Let us make it impossible for them to administer

us". It is consequently denied that the

accused urged, encouraged and incited the

masses to become ungovernable. It is also

denied that he urged them to make it impossible

in most respects. There are a few minor

1. As far as the accused Frank Chikane

can remember he was invited by the

conveners of this meeting to deliver

an account of what was happening then

in the Vaal Triangle. The first quotation

appears on page 366 of the Indictment

and appears on page 3 of the Transcript.

It is an accurate transcription of the

tape recording. However, this statement

must be viewed in the context of the

information which the accused was recounting

during the course of his speech. Against

the background of the widespread police

and defence force involvement in the

Townships the accused was merely stating

what the residents of the Townships felt

about the SAP and the SADF.

2. The next quotation appears on page 36 7

of the Indictment and is transcribed on

page 10 of the Transcript. The quotation

on page 367 of the Indictment which reads

"making / ...2. Page 2.

"making it impossible for them to

administer us ..." differs from what

is contained in the Transcript on page

10 namely "let us make it impossible

for them to administer us." The

quotation as it appears in the Transcript

is the correct one and was heard on the

tape recording. It is to be noted here

that what is being implied by the State

is that the accused joined in the call j> »‘V\k B'f tnu-r, Eu.Fvnie' E where a call was made "to make the

Country ungovernable". It should also

be noted that the accused was merely

stating what the people were saying when

they said "let us make it impossible

for them to administer us".

3. It has been noted that the speech of

the accused is the first-one in the

Transcript and it begins after the accused

had already started his speech.

1. Accused number 4 appears to have spoken

This is a very unreliable recording^

it is completely full of interruptions

some lengthy others not so lengthy but

in any event it is unable to make any

kind of sense whatsoever. Accused

number 4 has a record of his speech

on that date. The recording that he

has, had been taped and it has as yet

not been transcribed and is in the

process of being transcribed. If it

is relevant for the defence of the

accused in this matter, a copy of it

will be presented to Counsel.

2. In order to understand how unreliable

this particular tape is^ on page 9 of

the Transcript Firoz Cachalia delivered

a speech lasting for 15 minutes and 20

seconds. This was timed by us. All

that / ...2. Page 2.

that could be transcribed of that lengthy

speech'was approximately not more than

10 lines as appears on page 9 of the

Transcript. Similarly, at the bottom of

the page the performance by the Lenasia

Youth League of a skit on the new

constitution, took approximately 5 minutes,

but was incapable of being transcribed.

On page 10 an interruption of some 5 minutes

is not even recorded on the Transcript.

3. On page 14 of the Transcript when a speaker

by the name of Prema Naidoo is speaking

from the 2nd line onwards to the 14th line

on that page nothing of what is transcribed

could be heard on the video recording.

Excepting for the last 2 words which says

"accept this constitution". Thereafter

the balance of what appears on page 14 cannot

be heard right up to the 8th line on page

15. On page 15 after line 9 we have under­

lined portions that we could hear which

indicates again portions tha.t are inaudible

on the video transcript.

4. The State is not relying on this tape

in the Indictment against accused number

4 but Mew Ramgobin accused number 1

is extensively quoted and this will be

dealt with by the persons in Durban

1. We began to view this video recording and

as noted under general on the cover of

the transcript this video recording is

extremely poor and inaudible. We agree

with that. Because of the very poor

transcription it became impossible to

carry on and it was decided not to continue

with this. In any event the only quotation

in respect of this transcript appears from

the speech made by accused number 1. They

would be viewing this video and thelrst

comments would then be considered.

2. It is said in the Indictment that this is

a joint NIC, TIC meeting in Lenasia.This

is not correct it was a TIC meeting.

note form from the accused. He has a copy
