There are also y video interruptions, one of which is even described as 'long video interruption1. Although some of the gaps can be filled, it is probably wise to admit the entire speech in its incomprehensible form. 1. Indictment p.335 alleges that this accused attended and actively participated in the meeting. On page 10 of the transcript, line 12, it is stated that Chikane can be seen saying 'Thambo'. Immediately before \ this the audience is said to be chanting 'Oliver Thambo' Chikane's lips can be seen moving but his voice has not been recorded. 2. Indictment p.336, sentence begining 'we must be y careful...' is accurately reflected in transcript p.14 line 25-27. Indictment p.336-339, sentence begining '...is important // to go house to house...' is reflected in transcript p.15, line 10 - p.16,line 16 save for the following corrections: (a) Transcript p.14, line 25, 'enter political' should / \ 1 read 'end up fighting another'. (b) Transcript p.14, line 26, 'capita' should read \/ 'c a p i t a l '. Transcript p.16, line 11, 'that is the \ (c) \ (inaudible)'should read 'that is the method of'. L^> lUv- • t L ^ - ' Indictment p.340 alleges that 'a photograph of Yusuf Dadoo (and ANC and SACP leader) was displayed'. This is reflected in the transcript on p.4, line 3. However, the description of Dadoo as an ANC and SACP leader is the interpretation of the State. There is nothing to suggest that the actual placard stated that Dadoo was a leader of the ANC or SACP. OTHER SPEAKERS UNKNOWN PERSON Indictment p.340 - 343 is reflected in transcript p. 6, lines 1-23 with minor discrepencies. N o t e : In this short passage five portions of the speech are described as inaudible, one passage is described as indistinct and one passage is described as distorted. MEETING — BURGER CENTRE, CLARE MONT, CAPE TOWN — 1984-11-26 SPEAKERS REV. FRANK CHIKANE (Acc. No. 10) ANDREW BORIANE MARIE PHILLIPS DR. ALLAN BOESAK IMPORTANT ORGANISATIONS, PEOPLE AND OCCASIONS MENTIONED ENEMY ARMY (3) FRIENDLY ARMY (4) 1955, CONGRESS OF THE PEOPLE (9) SWAPO (16) 26th November 1984: UDF meeting - Burger Centre, Claremont, Cape M52(T): 1- The transcript and the indictment only refer to accused No. 10. 2. The meeting was called by a white group which was an affiliate of the UDF. B. Reference to accused No. 10, 1366/7: 1. The accused was a guest-speaker at the meeting. | The tape is apparently edited. For example, the accused is not introduced before his speech begins and his speech does not start at the beginning 3. The accused did attend and give a speech at this meeting. (1366, 1 1 - 2 ) C. 1336, first quotation 1 2-5: This quotation is accurate and correct (M52, p. 3, 1 11-17) D. 1366, last two lines to 1337 1 1-3 are denied The quotation contained on 1367 appears on p. 10 of the transcript. There is a slight / ...... 2 slight distortion in the indictment: Whereas the words "making it impossible" are used, the transcript, which is the correct version of what was said, read as follows: "Let us make it impossible". It appears that the accused is stating what is happening in South Africa. He was also saying why the people in the Vaal and elsewhere are expressing their frustration by saying "Let us make it impossible for them to administer us". It is consequently denied that the accused urged, encouraged and incited the masses to become ungovernable. It is also denied that he urged them to make it impossible for them to administer us. (^-6 ■ v cwVy; r.KLv , E. The accused's speech is an accurate transcription of what was heard on the tape recording in most respects. There are a few minor errors. NOTES ON U.D.F. MEETING - BURGER CENTRE, CLAREMONT, CAPE TOWN 26th November 19 84 OUR REFERENCE NO. M52 1. As far as the accused Frank Chikane can remember he was invited by the conveners of this meeting to deliver an account of what was happening then in the Vaal Triangle. The first quotation appears on page 366 of the Indictment and appears on page 3 of the Transcript. It is an accurate transcription of the tape recording. However, this statement must be viewed in the context of the information which the accused was recounting during the course of his speech. Against the background of the widespread police and defence force involvement in the Townships the accused was merely stating what the residents of the Townships felt about the SAP and the SADF. 2. The next quotation appears on page 36 7 of the Indictment and is transcribed on page 10 of the Transcript. The quotation on page 367 of the Indictment which reads "making / ...2. Page 2. "making it impossible for them to administer us ..." differs from what is contained in the Transcript on page 10 namely "let us make it impossible for them to administer us." The quotation as it appears in the Transcript is the correct one and was heard on the tape recording. It is to be noted here that what is being implied by the State is that the accused joined in the call j> »‘V\k B'f tnu-r, Eu.Fvnie' E where a call was made "to make the Country ungovernable". It should also be noted that the accused was merely stating what the people were saying when they said "let us make it impossible for them to administer us". 3. It has been noted that the speech of the accused is the first-one in the Transcript and it begins after the accused had already started his speech. 14. The speech of the accused is an accurate transcription / ...3. M38 (VIDEO) TIC - LENS CIVIC CENTRE DATE - 8-2-84 DR JASSAT : Tape starts with lots of interruption. NOTE : Long periods of interrupt ion. Totally incoherent for about 5-10 minutes. Jassat’s speech several interruptions. (i) Jassat at p.5 of M38 - says "MAYIBUYE" - not "AMANDLA" as in transcript. NB : (ii) In the indictment - relating to JASSAT, no mention is made of this meeting in the schedule (ie. Schedule "D") LEKOTA : p. 5 (1) We want a constitution drafted for the people of S.A. by themselves, (p.5 and 6). Long interruptions on video. Context debatable. (2) / (2) "TIC arose out of the struggles of Mahatma Gandhi" : (p.7). At the end of page 7 a whole sentence is omitted. (3) "There is 90% difference between the constituents of the UDF" (page 8). NOTES ON TIC MEETING LENASIA CIVIC CENTRE 8th FEBRUARY 19 84 VIDEO TRANSCRIPT OUR REFERENCE M38 1. Accused number 4 appears to have spoken from page 2 to page 5 of the Transcript. This is a very unreliable recording^ it is completely full of interruptions some lengthy others not so lengthy but in any event it is unable to make any kind of sense whatsoever. Accused number 4 has a record of his speech on that date. The recording that he has, had been taped and it has as yet not been transcribed and is in the process of being transcribed. If it is relevant for the defence of the accused in this matter, a copy of it will be presented to Counsel. 2. In order to understand how unreliable this particular tape is^ on page 9 of the Transcript Firoz Cachalia delivered a speech lasting for 15 minutes and 20 seconds. This was timed by us. All that / ...2. Page 2. that could be transcribed of that lengthy speech'was approximately not more than 10 lines as appears on page 9 of the Transcript. Similarly, at the bottom of the page the performance by the Lenasia Youth League of a skit on the new constitution, took approximately 5 minutes, but was incapable of being transcribed. On page 10 an interruption of some 5 minutes is not even recorded on the Transcript. 3. On page 14 of the Transcript when a speaker by the name of Prema Naidoo is speaking from the 2nd line onwards to the 14th line on that page nothing of what is transcribed could be heard on the video recording. Excepting for the last 2 words which says "accept this constitution". Thereafter the balance of what appears on page 14 cannot be heard right up to the 8th line on page 15. On page 15 after line 9 we have under lined portions that we could hear which indicates again portions tha.t are inaudible on the video transcript. 4 . / . . . 3 . Page 3. 4. The State is not relying on this tape in the Indictment against accused number 4 but Mew Ramgobin accused number 1 is extensively quoted and this will be dealt with by the persons in Durban who have viewed the same video. NOTES ON TIC MEETING LENASIA CIVIC CENTRE 8-2 -19 84 VIDEO TRANSCRIPT NUMBER M38 1. We began to view this video recording and as noted under general on the cover of the transcript this video recording is extremely poor and inaudible. We agree with that. Because of the very poor transcription it became impossible to carry on and it was decided not to continue with this. In any event the only quotation in respect of this transcript appears from the speech made by accused number 1. They would be viewing this video and thelrst comments would then be considered. 2. It is said in the Indictment that this is a joint NIC, TIC meeting in Lenasia. This is not correct it was a TIC meeting. 3. The speech made by accused number 4 at this particular meeting is available in note form from the accused. He has a copy of it if it is necessary. - - M. 38 TIC MEETING : LENASIA CIVIC CENTER-8 FEBRUARY 1984.
